Mr. Lero read the case into the record and asked the Board to hear it in absentia and
accept evidence.
MR. GOTTBERG MOVED to hear the case in absentia; MS. SODERLAND
SECONDED.
Chairman Tucker called on the motion; the vote was unanimous and the motion carried.
Mr. Lero said this came to Staff as a Public Information Department complaint on April
17, 2008 and a short form Notice of Violation was left at the site on April 22, 2008.
There had been no communication with the homeowner and no application of permit
was on file. He asked Mr. Gary Smith to speak on the matter.
Mr. Gary Smith, Building Inspector, stated his name and title into the record. He said he
was familiar with the site and its violations.
Mr. Lero said there were no photographs to show the Board.
Discussion followed regarding the violations and Mr. Smith’s knowledge of the case.
Further discussion followed regarding how Mr. Smith determined it was new
construction and not permitted.
MR. CURRIE MOVED to find that a violation existed and allow 180 days to come into
compliance or face a $150.00 per day fine; MR. BLACK SECONDED.
