Mr. Lero read the case into the record and asked the Board to hear it in absentia and<br />
accept evidence.<br />
MR. GOTTBERG MOVED to hear the case in absentia; MS. SODERLAND<br />
SECONDED.<br />
Chairman Tucker called on the motion; the vote was unanimous and the motion carried.<br />
Mr. Lero said this came to Staff as a Public Information Department complaint on April<br />
17, 2008 and a short form Notice of Violation was left at the site on April 22, 2008.<br />
There had been no communication with the homeowner and no application of permit<br />
was on file. He asked Mr. Gary Smith to speak on the matter.<br />
Mr. Gary Smith, Building Inspector, stated his name and title into the record. He said he<br />
was familiar with the site and its violations.<br />
Mr. Lero said there were no photographs to show the Board.<br />
Discussion followed regarding the violations and Mr. Smith’s knowledge of the case.<br />
Further discussion followed regarding how Mr. Smith determined it was new<br />
<strong>construction</strong> and not permitted.<br />
MR. CURRIE MOVED to find that a violation existed and allow 180 days to come into<br />
compliance or face a $150.00 per day fine; MR. BLACK SECONDED.<br />
Chairman Tucker called on the motion; the vote was unanimous and the motion carried.<br />
