Welcome to <strong>DVLA</strong>’s second <strong>Timed</strong><br />

<strong>Auction</strong> of 2013.<br />

We are proud to offer for sale<br />

1,300 previously unissued vehicle<br />

registration numbers, many<br />

following direct requests from<br />

members of the public, with reserve<br />

prices from just £130.<br />

Bidding will open at 10am on Monday<br />

17th June. Bidding will start closing on<br />

Monday 1st July 2013.<br />

If you have not bid before in one of our <strong>Timed</strong><br />

<strong>Auction</strong>s, please visit the auctioneer’s website at<br />

www.dvlaauction.co.uk/timed and select the<br />

"How to Bid" Video from the menu on the left. You<br />

will find this very short video useful in explaining<br />

how the auction runs.<br />

I strongly recommend that you use the Internet to<br />

place your bid and that you bid early. The auction<br />

is run on the basis of "Maximum Bids" which<br />

means you could win your registration for just the<br />

Reserve Price if no one bids against you, no matter<br />

what the value of your Maximum Bid! Please note<br />

we also have "Sliding End Times". This means if<br />

someone outbids you in the final 30 minutes (or if<br />

you outbid them!), the End Time will slide back 30<br />

minutes to give everyone a fair chance of winning<br />

the lot. So, my advice is to bid once and bid early.<br />

Set your Maximum Bid limit and let the auction<br />

system bid on your behalf.<br />

To bid at a <strong>DVLA</strong> <strong>Timed</strong> <strong>Auction</strong>, please follow the 6 simple steps below:<br />

Decide which registration(s) you’d like to bid for<br />

Find the lot number and the reserve price on pages 8 to 31. The lots are published in alphabetical order.<br />

Decide how much you’d like to spend<br />

Decide on your spending limit. Don’t forget that there is also VAT and a Buyer’s Premium of 8%<br />

(minimum £40) + VAT and an £80 Assignment Fee to be added to the bid price if successful. Have a<br />

look at the ‘What Will It Cost?’ table on page 38 to see the final amount you will need to pay based<br />

on your bid. When deciding on the value of your bid, remember that bids must be for at least the<br />

reserve price and must be in increments of £10.<br />

Decide how you’d like to pay<br />

Find out when you will need to pay and what payment methods are accepted. See page 39.<br />

Read through the Terms & Conditions<br />

Ensure you understand the <strong>Auction</strong>eers’ Terms & Conditions of Sale and the <strong>DVLA</strong> Sale of<br />

<strong>Registrations</strong> Marks Regulations on pages 44 – 46.<br />

Register for the <strong>Auction</strong><br />

To submit a bid for a registration in this auction, first of all you will need to register<br />

for the auction. Most people prefer to register online. Once you have registered you can submit your<br />

bids online. For those with no Internet access please see foot of page.<br />

REGiSTERinG On THE inTERnET<br />

To register to bid online, please visit the auction website below:<br />

www.dvlaauction.co.uk/timed<br />

Here you will be able to register securely then place your<br />

confidential bids 24 hours a day, 7 days a week until the close of<br />

the sale. At the end of the auction, you will be contacted by email<br />

if you have been successful.<br />

Submit your Bid(s)<br />

Once you have registered as a bidder, you can place your bids. You will be able to see the current<br />

bid price on each Lot together with the number of bidders interested in each Lot. You will have the<br />

freedom to increase your bids up until the deadline. Once placed, bids cannot be removed. This<br />

auction operates on the basis of Maximum Bids and features Sliding End Times.<br />

Please see pages 5 & 6 for details.<br />

BiD DEADLinES<br />

Please note that bids will only be accepted from 10am on Monday 17th June until the End Time<br />

on Monday 1st July 2013 (see pages 3 & 4 for details).<br />

No bids can be accepted by any means after this time.<br />

Bidding Without the internet<br />

If you do not have access to the Internet, please complete and return the <strong>DVLA</strong> <strong>Timed</strong> <strong>Auction</strong><br />

Registration Form on page 41 and return it to us by post or by fax. Please make sure the form arrives<br />

at our office at least 24 hours before the closing day of the auction. At the end of the auction, we<br />

will contact you by post if you have been successful.<br />

Maximum Bids and<br />

Sliding End Times<br />

Maximum Bids<br />

The <strong>DVLA</strong> <strong>Timed</strong> <strong>Auction</strong> runs on the principle of “Maximum Bids”. Bidders submit<br />

“Maximum Bids” which are invisible to other bidders. Bidding starts at the Reserve Price<br />

for each registration, clearly shown online. If there is competitive bidding on a Lot, the<br />

auction system will automatically increase bids on behalf of bidders in £10 increments.<br />

Once a bidder’s “Maximum Bid” has been reached, the system will stop bidding for them.<br />

The current winning bid price for each registration is on view on the website at all times<br />

along with the number of bidders on each Lot.<br />

Maximum Bids and<br />

Sliding End Times<br />

Sliding End Time<br />

The “Sliding End Time” is a mechanism to prevent auction sniping, or the practise of rival<br />

bidders outbidding each other with just seconds to go before the deadline.<br />

Every Lot has a published “End Time” clearly visible on the website at all times. This is the<br />

deadline by which all bids must be received.<br />

For Lots on which the winning bid changes in the last 30 minutes before the End Time, the<br />

End Time will slide by 30 minutes to allow the underbidder the chance to bid again, thereby<br />

allowing bidding to reach its natural conclusion.<br />

To cause the End Time to slide, the bid must be a winning bid. This means the bid must<br />

actually exceed the current hidden Maximum Bid.<br />

Examples<br />

To help explain the Maximum Bid & Sliding End Time features, please study the examples below:<br />

Scenario A: End Time Does not Slide<br />

Opening Scenario: Lot is due to end at 5pm and lot is with Bidder A at £900<br />

Time Bidder Maximum Bid Current Winning Bid & Winner End Time<br />

4.20pm Bidder A £1,000 £900 Bidder A 5.00pm<br />

4.40pm Bidder B £910 £920 Bidder A 5.00pm<br />

In this scenario, Bidder A has a Maximum Bid greater than his current winning bid. Bidder B<br />

places a bid against Bidder A which is lower than Bidder A’s Maximum Bid. This simply<br />

increases the hammer price to £920 in Bidder A’s favour. Importantly, as Bidder B never<br />

outbid Bidder A, the End Time does not slide.<br />

If no more bids are placed, the lot will sell at 5.00pm to Bidder A for £920 (even though his<br />

Maximum Bid was £1,000).<br />

Scenario B: End Time Slides<br />

Opening Scenario: Lot is due to end at 5pm and lot is with Bidder A at £900<br />

Time Bidder Maximum Bid Current Winning Bid & Winner End Time<br />

4.20pm Bidder A £1,000 £900 Bidder A 5.00pm<br />

4.40pm Bidder B £910 £920 Bidder A 5.00pm<br />

4.50pm Bidder B £1,050 £1,010 Bidder B 5.30pm<br />

In this scenario, Bidder A has a Maximum Bid greater than his current winning bid. Bidder B<br />

places a bid against Bidder A which is lower than Bidder A’s Maximum Bid which has the<br />

effect of increasing the winning bid price but still in Bidder A’s favour. Bidder B then increases<br />

his Bid beyond Bidder A’s Maximum Bid. This places the winning bid with Bidder B at one<br />

bidding increment (£10) greater than Bidder A’s maximum. Importantly, as Bidder B outbid<br />

Bidder A, the End Time slides by 30 minutes to allow Bidder A to bid again.<br />

If no more bids are placed, the lot will sell at 5.30pm to Bidder B for £1,010 (even though his<br />

Maximum Bid was £1,050).<br />

Purchasing your Registration<br />

n <strong>Registrations</strong> are not sold for less than reserve.<br />

n <strong>Registrations</strong> cannot be purchased before the auction.<br />

n If unsold, registrations cannot be bought after the auction.<br />

Bidding Strategy<br />

n Bids are submitted on a “Maximum Bid” basis. “Maximum Bids” are not visible to<br />

any other bidder.<br />

n Bidding starts at the Reserve price. If there is competitive bidding, bids will<br />

automatically be taken in £10 increments up to your Maximum Bid.<br />

n We strongly recommend you place your Maximum Bid early as there is no<br />

advantage to leaving your bid until the last minute.<br />

n We do not recommend bidding using internet access from a mobile phone or<br />

similar device due to reduced visibility of the website.<br />

Close of the <strong>Auction</strong><br />

n Each lot in the <strong>DVLA</strong> <strong>Timed</strong> <strong>Auction</strong> has an End Time which is shown on the<br />

website. Please note that this will be extended in the event of last minute<br />

competitive bidding activity.<br />

n The <strong>DVLA</strong> <strong>Timed</strong> <strong>Auction</strong> will close on Monday 1st July 2013<br />

(see website for precise End Times).<br />

n No bids will be accepted after the Lot closes.<br />

Payment<br />

n You will be liable for all bids made using your bidder details.<br />

n If you are successful, the price you will pay will be your winning bid price,<br />

in addition to VAT on the bid price, an 8% (minimum £40) + VAT and an £80<br />

Assignment Fee.<br />

n Your credit or debit card details must be provided in order to register as a bidder.<br />

If you are successful, your nominated card will automatically be charged with a<br />

10% deposit. An invoice will then be sent to you.<br />

n The balance of the payment must be made within 5 working days.<br />

n If full payment is not received within the 5 days, your nominated card will be<br />

charged with the full outstanding balance.<br />

Representation<br />

n You cannot use a registration number to make a vehicle look younger than it is.<br />

n Warning: It is an offence to alter, re-arrange or misrepresent a registration number.<br />

There is a maximum fine of £1,000 and the registration number can be withdrawn<br />

without compensation.<br />

In Twitter, we endeavour to provide<br />

information surrounding all of our<br />

sales as well as engage in a little<br />

light-hearted banter with our<br />

followers and, where possible, provide<br />

answers to a whole raft of questions.<br />

While this can be a tad periodic<br />

leading up to a sale, our<br />

near-constant, real-time,<br />

commentary and banter throughout<br />

our three-day auctions has acquired<br />

quite a following and we urge you to<br />

Twitter is proving a hugely valuable<br />

tool for us in our need to raise the<br />

profile of individual registrations<br />

being featured in our sales.<br />

tap into a variety of celebrities – we<br />

A <strong>DVLA</strong> <strong>Timed</strong> <strong>Auction</strong> differs from a traditional <strong>DVLA</strong> <strong>Auction</strong> in that there is no live, physical auction to<br />

attend. Bidders submit "Maximum Bids" which are invisible to other bidders and bidding starts at the<br />

Reserve Price for each registration. If there is competitive bidding activity on a Lot the auction system will<br />

increase bids in £10 increments on behalf of a registered bidder up to their Maximum Bid. If someone’s<br />

Maximum Bid is outbid, the underbidder will be sent an email inviting them to increase their Maximum Bid<br />

(only if they have registered and bid online). When the End Time has passed, each Lot will be sold to the<br />

highest bidder for the amount of their winning bid. See examples on page 3.<br />

The “Sliding End Time” is a mechanism to prevent auction sniping, or the practise of rival bidders outbidding<br />

each other with just seconds to go before the deadline.<br />

Every Lot has a published “End Time” on the website which is the deadline by which all bids must be<br />

received. If a winning bid is placed in the final 30 minutes before the deadline it will cause the End Time to<br />

slip back a further 30 minutes.<br />

For the End Time to slide, the bid must be a winning bid. This means the bid must actually take out the<br />

current winning bid, not simply be a bid against the winning bid that is lower than the current hidden<br />

"Maximum Bid".<br />

Example:<br />

To make this clear, if Bidder A is winning the lot with a current bid of £900 and a Maximum Bid of £1,000,<br />

then a bid from Bidder B for £910 will raise the hammer price to £920 for Bidder A. As it is not a winning bid,<br />

the End Time will not extend.<br />

However, if Bidder B placed a bid of £1,010 then they would become the winning bidder and the End Time<br />

would slide a further 30 minutes, allowing Bidder A to respond. For further examples please see page 3.<br />

We strongly recommend you use our online bidding service as you will receive notifications if you are<br />

outbid.<br />

It’s free and easy to use and you can submit your bids securely. Once you have placed your bids, you will<br />

have the freedom to increase your bids up until the End Time. You cannot cancel bids once placed.<br />

If you do not have access to the Internet, you can submit your bids by using the Bidder Registration Form in<br />

this <strong>Timed</strong> <strong>Auction</strong> catalogue. This should be completed and returned to the auctioneers by post, email or<br />

fax to arrive at least 24 hours before the closing day of the auction. For these “offline” bidders, we regret<br />

we cannot inform you before the End Time if your Maximum Bid is exceeded.<br />

Reserve Prices are the minimum prices at which Lots will be sold. All Reserve Prices are clearly shown in the<br />

catalogue for every auction. Please note that these do not include the additional charges of VAT, Buyer’s<br />

Premium (+vat) and Assignment Fee.<br />

The lowest bid that will be accepted is the Reserve Price for each Lot. You can make any bid you like above<br />

the Reserve Price but it must be in increments of £10. No bids in pence will be taken.<br />

How can i find out what other bids people have made?<br />

The current highest bid on each Lot will be visible at all times, together with the number of bidders. You<br />

cannot view the Maximum Bids of other bidders.<br />

If you bid online, you will be informed by email soon after the Lot End Time has been reached. If you bid by<br />

post, by email or by fax, we will let you know by letter up to 3 working days after the results are published.<br />

If you are successful at the <strong>Timed</strong> <strong>Auction</strong>, full payment will be required including all the extras for Buyer’s<br />

Premium, VAT and the Assignment Fee. At the end of the sale a 10% deposit will automatically be taken from<br />

your nominated debit or credit card. If you have bid online you will be sent an invoice by email showing the<br />

Payment of the outstanding balance must be made in full within 5 working days from the close of the<br />

auction. If full payment is not received within the 5 days, your nominated credit or debit card will<br />

automatically be charged.<br />

What happens to registrations that do not reach their reserve prices?<br />

The auctioneer will not accept any bid on a registration that is below the reserve price. If a registration does<br />

not receive a bid at all, it will be declared as “Unsold”. The <strong>DVLA</strong> may, at its discretion, include such<br />

registrations in future auctions. Please contact the <strong>DVLA</strong> immediately after the auction if you are interested<br />

in any unsold registrations.<br />

Can i place a <strong>DVLA</strong> registration on a vehicle registered in northern ireland?<br />

Registration numbers can be purchased from the <strong>DVLA</strong> if you live in Northern Ireland. However, the<br />

personalised registration must firstly be assigned to a vehicle registered to a mainland Great Britain address;<br />

this can be accomplished by adding a nominee (who lives in mainland GB) to the certificate at the time of<br />

purchase.<br />

The nominee should assign the personalised registration at a mainland <strong>DVLA</strong> Local Office.<br />

Once the paperwork is completed and they have received the new V5C in the personalised number, the<br />

registration can be transferred to your vehicle in Northern Ireland. There is currently an administration fee of<br />

outstanding balance. If you have bid by post or by fax you will be notified by post. Payment of the<br />

Payments be cheque con only be made within 5 working days of the auction. Cheques should be made<br />

you will not receive documentation for up to 20 working days.<br />

Bank Giro Credit<br />

You can deposit cash directly into our account (details above), but you MUST produce a photocopy of your<br />

paying in slip with the lot number(s) and registration number(s) on the reverse, otherwise we will not be able<br />

to check receipt of your funds.<br />

Payment by Euro<br />

The auction will be conducted in pounds sterling but payment by Euros will also be acceptable providing you<br />

possess a Euro cheque book. Cheques in Euros drawn on a Euro bank account will only be accepted and a<br />

charge of 0.25% will apply.<br />

What Happens next?<br />

Within 10 working days of cleared funds being received, the <strong>DVLA</strong> will send you a Certificate of Entitlement<br />

(V750). This will enable you to assign the registration number to a vehicle registered in your name or in that<br />

of the nominee. If you buy more than one registration, Certificates of Entitlement will not be issued until<br />

payment has been received in full for all registrations.<br />

<strong>Auction</strong>eers’ Conditions of Sale<br />

inTERPRETATiOn<br />

In these conditions the following will have<br />

the following meanings:<br />

“Appropriate Vehicle”<br />

means the vehicle which complies with the<br />

conditions specified in paragraph “10” of<br />

the Regulations.<br />

“Bidder”<br />

means a prospective Purchaser who has<br />

provided the <strong>Auction</strong>eers with a properly<br />

completed <strong>DVLA</strong> Online <strong>Auction</strong><br />

Registration Form together with the<br />

appropriate verification of personal details<br />

and who has been issued with a Bidder’s<br />

Number by the <strong>Auction</strong>eers.<br />

“Bidder’s number”<br />

means the number allocated by the<br />

<strong>Auction</strong>eers to each prospective Purchaser<br />

who has made an application for such a<br />

Bidder’s Number.<br />

“Certificate”<br />

means the Certificate of Entitlement in<br />

relation to the Relevant Right to be issued<br />

by the Vendor to the Purchaser following<br />

payment in full in accordance with the<br />

conditions.<br />

“Lot”<br />

means in each case the Relevant Right to<br />

be acquired by the Purchaser from the<br />

Vendor relating to the registration mark<br />

described in such Lot by the <strong>Auction</strong>eers.<br />

“Purchaser”<br />

means the highest Bidder or the person<br />

declared by the <strong>Auction</strong>eers as being the<br />

Purchaser.<br />

“Regulations”<br />

means the Sale of Registration Marks<br />

Regulations 1995.<br />

“Relevant Right”<br />

means a right acquired by the Purchaser<br />

from the Vendor to have assigned to an<br />

Appropriate Vehicle registered in the name<br />

of the Purchaser or a person nominated by<br />

him a registration number in accordance<br />

with the Regulations.<br />

“Sale”<br />

means sale by auction.<br />

“Schedule”<br />

means a Schedule to the Sale of<br />

Registration Marks Regulations 1995.<br />

GEnERAL<br />

1. These conditions shall apply to all lots<br />

sold by SMA Vehicle Remarketing<br />

(hereinafter called “the <strong>Auction</strong>eers”) as<br />

selling agents for the Secretary of State for<br />

Transport (hereinafter called “the Vendor”)<br />

and shall be binding for every Purchaser<br />

and the Vendor.<br />

2. The Vendor reserves the right to fix a<br />

reserve or minimum bid price for any Lot.<br />

3. The Vendor reserves the right to<br />

withdraw from Sale at any time and without<br />

giving any reason for doing so any Lots<br />

advertised or catalogued to be offered for<br />

sale.<br />

4. The <strong>Auction</strong>eers reserve the right to<br />

withdraw any Lot from Sale, or refuse to<br />

take any bid, without explanation even<br />

though the Sale may be in progress and the<br />

Lot is above reserve.<br />

5. No Relevant Right may be transferred by<br />

any Purchaser or where relevant his<br />

nominee unless under the Regulations.<br />

6. The <strong>Auction</strong>eers cannot accept<br />

responsibility for the late arrival and/or<br />

non-arrival of the auction catalogue.<br />

7. The <strong>Auction</strong>eers will not be held<br />

responsible for any consequences following<br />

a “force majure” leading to the cancellation,<br />

postponement or partial completion of an<br />

auction.<br />

8. <strong>DVLA</strong> and the <strong>Auction</strong>eers reserve the<br />

right to use any details regarding the<br />

auction for promotional purposes without<br />

revealing the identity of the Purchaser.<br />

9. The <strong>Auction</strong>eer will provide to the <strong>DVLA</strong><br />

details of all the transactions including but<br />

not limited to the name and address of the<br />

Purchaser and the purchase price paid for<br />

the Relevant Right. The <strong>DVLA</strong> reserves the<br />

right to publish the purchase price details<br />

provided to it by the <strong>Auction</strong>eer in any<br />

format it deems fit and the Purchaser<br />

hereby agrees to such publication.<br />

10. Any person who makes a bid at the<br />

auction regardless of whether or not they<br />

have completed a <strong>DVLA</strong> Online <strong>Auction</strong><br />

Registration Form will be deemed to have<br />

accepted these terms and conditions.<br />

REGiSTRATiOn<br />

11. The <strong>Auction</strong>eers and <strong>DVLA</strong> at their<br />

discretion, reserve the right to refuse entry<br />

to the <strong>DVLA</strong> Online <strong>Auction</strong>.<br />

12. All Bidders must be over 18 years of age<br />

and shall apply to the <strong>Auction</strong>eers for a<br />

Bidder’s Number. Prospective Purchasers<br />

must complete the <strong>DVLA</strong> Online <strong>Auction</strong><br />

Registration Form relevant to the<br />

appropriate auction catalogue or online.<br />

The <strong>Auction</strong>eer reserves the right to refuse<br />

an application to register as a Bidder if the<br />

applicant completes a <strong>DVLA</strong> Online <strong>Auction</strong><br />

Registration Form not relevant to the<br />

appropriate auction and/or has a history of<br />

late or non-payment relating to the<br />

purchase of registrations from the <strong>DVLA</strong>.<br />

13. The <strong>Auction</strong>eer reserves the right to<br />

carry out any appropriate financial checks<br />

on an individual, business or company to<br />

determine the financial standing of the<br />

individual, business or company making the<br />

application as Purchaser.<br />

14. No bids will be accepted unless the<br />

bidder has first completed and delivered to<br />

the <strong>Auction</strong>eer a <strong>DVLA</strong> Online <strong>Auction</strong><br />

Registration Form prior to the <strong>DVLA</strong> Online<br />

<strong>Auction</strong> deadline.<br />

BiDDinG<br />

15. The <strong>Auction</strong>eer will not accept bids<br />

below the published reserve or minimum<br />

bid price.<br />

16. The <strong>Auction</strong>eers must receive bids<br />

before the published deadline (or “End<br />

Time”).<br />

17. The “End Time” may be extended by the<br />

<strong>Auction</strong>eers at any time and will be<br />

displayed on the website.<br />

18. The “End Time” will be based on the<br />

auctioneer’s server time.<br />

19. The successful bidder will be the highest<br />

bid received by the auctioneers for each lot<br />

before the deadline.<br />

20. Each lot will be sold to the successful<br />

bidder for the amount of their winning bid,<br />

and not less. No negotiations will be<br />

entered into.<br />

21. Any dispute as to any bid shall be settled<br />

by the <strong>Auction</strong>eers in their absolute<br />

discretion.<br />

22. Every Bidder shall be deemed to act as<br />

Purchaser unless he confirms that he is<br />

acting as agent and provides the name and<br />

address of his Purchaser to the <strong>Auction</strong>eers<br />

in accordance with condition 30 opposite.<br />

Registration numbers that do not attract a<br />

bid will be declared as unsold by the<br />

<strong>Auction</strong>eer. Such registrations will not<br />

subsequently be offered for sale by private<br />

treaty. The Vendor may choose to offer<br />

such registrations by some other means<br />

without prior notice.<br />

23. Bids will be accepted only from Bidders<br />

who have registered with the <strong>Auction</strong>eers.<br />

The <strong>Auction</strong>eers, nevertheless, have<br />

absolute discretion to refuse any bid<br />

without giving a reason.<br />

24. Immediately on the sale of a Lot a<br />

legally binding contract shall be deemed to<br />

have been formed between the Purchaser<br />

and the Vendor.<br />

25. The <strong>Auction</strong>eers shall not be held<br />

responsible for any loss of communication<br />

or connection between a Bidder’s Internet<br />

system and that of the <strong>Auction</strong>eers,<br />

however caused.<br />

26. The <strong>Auction</strong>eers do not accept any<br />

responsibility for the mis-use of your log in<br />

details.<br />

27. The <strong>Auction</strong>eer has the complete<br />

discretion as to the manner in which the<br />

auction is conducted and the order in which<br />

lots are offered for sale not withstanding<br />

any numbers given to lots within the<br />

catalogue.<br />

28. The <strong>Auction</strong>eer has the sole discretion<br />

and the right to refuse any bid, and/or to<br />

withdraw a lot from the auction and if a<br />

adispute arises to re-auction a lot.<br />

SALE<br />

29. On the sale of any Lot the contract shall<br />

be deemed to have been made between<br />

the Vendor and the Purchaser and neither<br />

the Vendor nor the Purchaser nor (where<br />

relevant) his nominee (nor any other party)<br />

shall have any legal right of action against<br />

the <strong>Auction</strong>eers in respect of any cause or<br />

matter arisen out of the sale.<br />

30. The Purchaser, if,<br />

(i) he is acting for a named Purchaser and<br />

wishes that person to be named as the<br />

Purchaser (for the purposes of the<br />

Regulations) on the Certificate of<br />

Entitlement, and/or<br />

(ii) he is acting for a named Purchaser who<br />

wishes some other person to be named as<br />

the nominee of that Purchaser (in<br />

accordance with the Regulations) on the<br />

Certificate of Entitlement, or<br />

(iii) he is acting as Purchaser and wishes to<br />

nominate some other person as his<br />

nominee (in accordance with the<br />

Regulations) must provide the <strong>Auction</strong>eers<br />

with the full name(s) and address(es) of the<br />

Purchaser and the name of the nominee (as<br />

the case may be) to be named on the<br />

Certificate of Entitlement as the Purchaser<br />

and/or his nominee before making payment<br />

or within 5 working days after the auction,<br />

whichever is the sooner.<br />

PAYMEnT<br />

31. Both the agent and Purchaser are<br />

equally and severally responsible for<br />

payment.<br />

32. At the end of the sale all successful<br />

bidders will have 10% of the winning bid<br />

price automatically taken from their<br />

nominated debit or credit card.<br />

Customers who have bid online will be sent<br />

an invoice by email showing the<br />

outstanding balance. If you have bid by post<br />

or fax you will be notified by post.<br />

Payment of the outstanding balance must<br />

be made in full within 5 working days from<br />

the close of the auction. If full payment is<br />

not received within the 5 days your<br />

nominated credit or debit card will<br />

automatically be charged.<br />

It is of critical importance that funds are<br />

readily available to you to pay the purchase<br />

price for the Lot in full before you make a<br />

bid.<br />

33. VAT at the current rate is payable on the<br />

Bid Price of every Lot.<br />

34. The Purchaser shall pay to the<br />

<strong>Auction</strong>eers on making payment for the<br />

Lot, a premium of 8% (minimem £40) of the<br />

final bid price, plus VAT on the hammer<br />

price and buyer’s premium together with<br />

the £80 assignment fee.<br />

35. A payment by cheque will not confer<br />

upon the Purchaser or the nominated<br />

person an entitlement to the Relevant Right<br />

until the cheque has been cleared and will<br />

not until clearance be deemed to constitute<br />

a payment within the meaning of these<br />

conditions.<br />

36. A payment by credit card will not confer<br />

upon the Purchaser or nominated person an<br />

entitlement to the Relevant Right until<br />

cleared funds have been received by the<br />

<strong>Auction</strong>eer from the credit card provider<br />

and will not until such time be deemed to<br />

constitute Payment within the meaning of<br />

these conditions.<br />

37. The <strong>Auction</strong>eer is not liable for any<br />

disruption and/or failure to the Internet<br />

based payment system. The <strong>Auction</strong>eer<br />

reserves the right to withdraw the service at<br />

any time with or without notice and the<br />

Purchaser must arrange to use an alternate<br />

method of Payment.<br />

38. If the price of any Lot and any other<br />

payment due is not paid in full the<br />

<strong>Auction</strong>eers/Vendor reserve the right to<br />

pursue the Purchaser and legal action will<br />

be taken to recover the full or outstanding<br />

balance appropriate.<br />

39. If a Purchaser buys more than one Lot<br />

he must have paid for them all in full before<br />

Certificates will be issued in respect of any<br />

of them.<br />

40. When payment in full for all the Lots<br />

purchased has been received the Purchaser<br />

or some other person nominated by him in<br />

accordance with paragraph of the Schedule<br />

shall be entitled to acquire the Relevant<br />

Right. The registered mark described in the<br />

Lot may then be assigned to an<br />

Appropriate Vehicle registered in the<br />

Purchaser’s name or that of the nominated<br />

person whose name has been provided to<br />

the <strong>Auction</strong>eers by the Purchaser on the<br />

day of the sale.<br />

41. On the sale of Lot a contract is formed<br />

with the Secretary of State for Transport<br />

and included in that a contract is deemed to<br />

have been formed between the Purchaser<br />

and the <strong>Auction</strong>eer. In the event of late<br />

payment, the <strong>Auction</strong>eer reserves the right<br />

to recover the amount owing to him and/or<br />

deal with the matter in any way they see fit.<br />

The <strong>Auction</strong>eers retain the right to add a<br />

special service charge in the event of late<br />

payment.<br />

42. <strong>DVLA</strong>’s 10 day cancellation period does<br />

not apply to any marks purchased at any<br />

43. If the full purchase price is not received<br />

for a lot then the <strong>Auction</strong>eer will without<br />

providing further notice to you and at the<br />

<strong>Auction</strong>eer’s complete discretion be<br />

entitled to exercise any of the following :-<br />

l To resell the lot by auction or any other<br />

means and reclaim any loss on the resale<br />

from any monies already paid by the<br />

Purchaser.<br />

l To charge interest on the purchase price<br />

at 5% per annum above the base lending<br />

rate of Lloyds TSB Bank plc from time to<br />

time to be calculated on a daily rate from<br />

the date which the purchase price<br />

becomes payable to the date of actual<br />

payment.<br />

l To deduct from any part payment or<br />

deposits already paid, the interest<br />

payable, buyer’s premium and any service<br />

charges due.<br />

l To sell any other property in the<br />

<strong>Auction</strong>eers possession or control for any<br />

purpose (including without limitation of<br />

the lot sold to you) and to apply any<br />

monies due to you as a result such as sale<br />

in payment or part payment of the<br />

purchase price and/or towards<br />

satisfaction of any amounts owed to the<br />

<strong>Auction</strong>eer pursuant to these conditions<br />

of sale.<br />

l Reject a bid from you at any future sale or<br />

require you to pay an amount on account<br />

by way of deposit before any bid will be<br />

accepted from you at a future sale.<br />

l Such deposit or money on account can<br />

be applied by the <strong>Auction</strong>eer as payment<br />

or part payment towards the purchase<br />

price of any future lot for which you are<br />

the successful bidder.<br />

l You will indemnify and keep the<br />

<strong>Auction</strong>eer and the seller fully<br />

indemnified against all legal and other<br />

costs of enforcement and any other<br />

expenses and losses (including the fees to<br />

which the <strong>Auction</strong>eer is entitled and are<br />

incurred by the <strong>Auction</strong>eer) and or the<br />

seller on a full indemnity basis together<br />

with any interest thereon at a rate of 5%<br />

per annum above the base lending rate of<br />

Lloyds TSB Bank plc from time to time<br />

the date upon which the and or the seller<br />

becomes liable to pay such costs or<br />

incurs such expenses or suffers such<br />

losses.<br />

Sale of Registration Marks<br />

Regulations 1995<br />

On the sale of a lot a legally binding contract is formed between the Purchaser<br />

and the Secretary of State for Transport.<br />

The Purchaser has 12 months to assign the registration number to a chosen<br />

vehicle; the entitlement period can be extended annually shortly before expiry<br />

upon application and payment of a fee.<br />

Registration numbers can be assigned to a vehicle registered in the name of the<br />

Purchaser or a vehicle registered in the name of the Nominee if Nominee details<br />

were provided on the bidder registration application. Following a purchase the<br />

Nominee details may only be changed upon application and payment of a fee.<br />

The registration number can only be assigned to a vehicle, which is registered, or<br />

about to be registered in mainland Britain and which is an appropriate age to<br />

receive the registration number. At the time of assignment the vehicle must be<br />

licensed, of a testable type and have a test certificate in force, if applicable.<br />

Once the registration has been assigned it may be transferred to another vehicle<br />

subject to the <strong>DVLA</strong>'s transfer rules.<br />

It is an offence to mis-represent the registration number in any way.<br />
