CONDITIONS OF SALE<br />

The highest bidder to be the purchaser but with the Auctioneers reserving the right to refuse the bidding<br />

of any person without giving reason and if a dispute should arise as to the identity of the highest bidder,<br />

the Lot in dispute shall be immediately put up again and resold. The Auctioneers reserve the right to<br />

arbitrate solely on any disputed matter connected with the offering of Lots at the Sale and their decision<br />

shall be binding on all parties.<br />

No person shall be allowed to retract any bidding once made.<br />

The Auctioneers reserve the right to bid on behalf of both vendors and purchasers but shall not be liable<br />

for errors or omissions in executing instructions to bid. Commissions to purchase are accepted at the<br />

purchaser's risk.<br />

All Lots offered for <strong>sale</strong> are exhibited with any faults or errors of description whether they be related to<br />

quality, quantity, weight, number, additional information or the like.<br />

The Auctioneers act as agents only and do not have personal knowledge as to the accuracy or correctness<br />

or otherwise of the description of any Lots offered for <strong>sale</strong> and give no warranty whatsoever. All<br />

warranties, either expressly or implied <strong>by</strong> sections 13-15 inclusive of the Sale of Goods Act 1979 or at<br />

common law are expressly excluded from this Sale.<br />

At the fall of the hammer each Lot shall be considered as delivered and at the purchaser's risk thereon.<br />

All purchasers are required to leave their full name and address at the Auctioneer's Office.<br />

No purchase shall be removed until paid for.<br />

The purchaser shall be responsible for and shall duly indemnify the Auctioneers and the owners of the<br />

property on which the <strong>sale</strong> is conducted, against any damage caused to buildings or property or any other<br />

Lot at the Sale. Any damage occasioned and consequential loss shall be made good <strong>by</strong> and at the expense<br />

of the purchaser. The Auctioneers shall be under no liability whatsoever for any damage to the property<br />

of the purchaser at any time.<br />

Any person entering onto the premises / <strong>sale</strong> ground at any time prior, during or after the Sale shall do so<br />

entirely at their own risk.<br />

The contract of <strong>sale</strong> is to be deemed in all cases as being made exclusively with the Auctioneers as “Agents<br />

for the Vendor” and payment shall be made to them only.<br />

Health & Safety at Work Act 1974 and all other Acts and Regulations applicable to Farm Safety and<br />

Electrical Equipment<br />

The purchaser is responsible for complying with all the legal requirements as to the safe use of any Lot<br />

purchased at the Sale and shall ensure compliance with all relevant legislation relating to the safe use of<br />

such Lots. Any Electrical items should be installed <strong>by</strong> Fully Qualified Electricians.<br />

Compliance with the Road Traffic Acts<br />

The purchaser of any vehicle or trailer is responsible for complying with all legal requirements as to the<br />

construction and use of such vehicle or trailer, and for obtaining all certificates, permits or other<br />

authorisations necessary before such vehicle or trailer can be used on the road.<br />

The Auctioneers reserve the right to vary the order of <strong>sale</strong>, to combine two or more lots and to withdraw<br />

any lots and generally to conduct the <strong>sale</strong> in the manner in which they so decide at the time of <strong>sale</strong>.<br />

VAT & Commission<br />

VAT will be payable on all lots. Commission at the rate of 5% plus VAT will be payable on all Lots.<br />

Payment<br />

All items purchased shall be paid for on the day of the <strong>sale</strong> immediately at the conclusion of the <strong>auction</strong>.<br />

Purchasers wishing to pay <strong>by</strong> cheque who are unknown to the Auctioneers must produce the relevant<br />

reference from their Bank indicating a maximum amount that will be honoured.<br />

Money Laundering Regulations<br />

We are unable to accept payments or multiple payments in cash totalling over £7,500.<br />
