National Hispanic Leadership Agenda Congressional Scorecard113th CongressHouse Floor VotesA. On passage of the Nutrition Reform and WorkOpportunity Act (H.R. 3102)The bill would have reauthorized through fiscal 2016 theSupplemental Nutrition Assistance Program (SNAP) andcut funding for it by $40 billion over 10 years. The bill wouldestablish a pilot program to allow states to impose newwork requirements on SNAP recipients, including parentsof young children exempt under current law. It would alsorequire that individuals receive at least $20 or more in aidthrough the Low Income Home Energy Assistance Programto qualify for automatic increases in SNAP benefits, and itwould authorize states to conduct drug testing on applicantsas a condition of receiving benefits. The CongressionalBudget Office estimated that this bill would end benefitsfor approximately 3.8 million low-income people in 2014,including children, seniors, veterans, active duty military,and working parents earning low wages. The bill passedthe House on September 19, 2013 by a vote of 217-210(6 not voting) (Roll Call Vote No. 476, 1st Session, 113thCongress), Democrats – 0 yes, 195 no, 5 not voting;Republicans – 217 yes, 15 no, 1 not voting. NHLA did notsupport the legislation.B. To amend the Internal Revenue Code of 1986 tomake improvements to the child tax credit, ChildTax Credit Improvement Act of 2014 (H.R. 4935)Amends the Internal Revenue Code, with respect to theChild Tax Credit, to 1) raise the income threshold for thephase out of the Child Tax Credit for married couples, 2)allow an inflation adjustment to the threshold amounts andthe $1,000 credit amount beginning after 2014, and 3)eliminate the Child Tax Credit for taxpaying parents whofile tax returns using an Individual Taxpayer IdentificationNumber (ITIN). Immigration ReformAddendumThe votes in the addendum took place in the Senate and House Judiciary committees, and they are not includedin the calculation of the Members’ overall percentage scores as only a portion of the total number of Members ineach chamber are represented on the committees. Nevertheless, these debates on immigration within these twocommittees offered insight into the breadth and complexity of immigration reform.Known as “regular order,” the congressional committee process involves marking up legislation before reporting itto the House or Senate floor. The use of regular order - especially in the Senate - represents a marked departurefrom the recent historical trend of bypassing the committee process or truncating debate and amendments withincommittee. Regular order allows members of Congress who have expertise in areas related to legislation to moreclosely review, analyze, and amend legislation. Accordingly, NHLA looked closely at amendments and legislation inthe committee process; identified those that had the greatest impact on legalization, due process, and benefits; andincluded them as an aside within the NHLA congressional scorecard.


AddendumSENATE JUDICIARY COMMITTEEFranken Amendment 7 (ARM13584) to BorderSecurity, Economic Opportunity, and ImmigrationModernization Act (S. 744)Sen. Franken (D-Minnesota) offered an amendmentto the Border Security, Economic Opportunity, andImmigration Modernization Act to improve immigrationenforcement policies to protect child wellbeing andpromote family unity by ensuring that immigrant parentsare able to make decisions regarding childcare at thetime of apprehension, while in immigration detention,and prior to and following removal. The Senate JudiciaryCommittee adopted the amendment on May 20, 2013,by a vote of 18-0, Democrats – 10 yes, 0 no; Republicans– 8 yes, 0 no. NHLA supported the amendment.Feinstein Amendment 1 (EAS13279) to BorderSecurity, Economic Opportunity, and ImmigrationModernization Act of 2013 (S. 744)Sen. Dianne Feinstein (D-California) offered an amendmentto the Border Security, Economic Opportunity, andImmigration Modernization Act that broadens thedefinition from those convicted of certain crimes tothose charged with certain crimes for purposes ofreimbursement of state and local governments under theState Criminal Alien Assistance Program (SCAAP). Thiscould incentivize greater state or local enforcement. TheSenate Judiciary Committee adopted the amendmenton May 9, 2013, by a vote of 10-8, Democrats – 3 yes,7 no; Republicans – 7 yes, 1 no. NHLA opposed theamendment.Sessions Amendment 9 (EAS13443) to BorderSecurity, Economic Opportunity, and ImmigrationModernization Act of 2013 (S. 744)Sen. Jeff Sessions (R-Alabama) offered an amendmentto the Border Security, Economic Opportunity, andImmigration Modernization Act that requires completionof the 700 miles of reinforced, double-layered fencingbefore the Administration grants registered provisionalimmigrant (RPI) status. The Senate Judiciary Committeerejected the amendment on May 9, 2013 by a vote of6-12, Democrats – 0 yes, 10 no; Republicans – 6 yes, 2no. NHLA opposed the amendment.Cruz Amendment 2 (DAV13373) to Border Security,Economic Opportunity, and Immigration ModernizationAct of 2013 (S. 744)Sen. Ted Cruz (R-Texas) offered an amendment to theBorder Security, Economic Opportunity, and ImmigrationModernization Act that denies United States citizenship toanyone who has ever previously been in the US while notin lawful status. This approach would prevent registeredprovisional immigrant (RPI) holders and blue card holdersfrom having the opportunity to eventually naturalize andmay even retroactively repeal the naturalization of certainU.S. citizens. The Senate Judiciary Committee rejectedthe amendment on May 21, 2013 by a vote of 5-13,Democrats – 0 yes, 10 no; Republicans – 5 yes, 3 no.NHLA opposed the amendment.Cruz Amendment 4 (MDM13526) to Border Security,Economic Opportunity, and Immigration ModernizationAct of 2013 (S. 744)Sen. Ted Cruz (R-Texas) offered an amendment to theBorder Security, Economic Opportunity, and ImmigrationModernization Act that rewrites Sections 2303 (repealof diversity visa lottery), 2304 (world-wide levels andvisa recapture), 2305 (reclassification of spouses andchildren of legal permanent resident (LPR) as immediaterelatives), 2306 (country caps), and 2307 (allocation ofvisas) of S.744. This approach would reduce familysponsoredimmigration and would make it harderto reunite families. The Senate Judiciary Committeerejected the ammendment on May 21, 2013 by a vote of6-12, Democrats – 0 yes, 10 no; Republicans – 6 yes, 2no. Chuck Grassley (R-Iowa) offered an amendmentto the Border Security, Economic Opportunity, andImmigration Modernization Act that limits judicial reviewof decisions on applications for adjustment to registeredprovisional immigrant (RPI), DREAM Act, Blue Card, orlegal permanent permanent resident (LPR) status fromone the aforementioned statuses. This would abolishmost judicial review of decisions and direct claims to theUnited States District Court of the District of Columbia.The only exemption would be for challenges to theconstitutionality of the law itself or the regulations. FootnoteS. 744, the Border Enforcement, Economic Opportunity, andImmigration Modernization Act of 2013, was a comprehensivebill that would have reformed our nation’s antiquatedimmigration system and provided a roadmap to citizenship forthe nation’s undocumented population.S. 744 included several provisions NHLA supported in theareas of legalization, legal immigration reform, federal andstate benefits, integration, enforcement reform, detentionreform, and due process.Enforcement reform provisions NHLA supported include:(1) improvements to use-of-force policies and training forimmigration agents; (2) the emphasis on alternatives todetention; (3) a limitation on immigration enforcement inlocations such as schools, hospitals, churches, and domesticviolence shelters; (4) the ability for the U.S. Department ofJustice to commence a civil action against notarios; and (5)the creation of criminal penalties for notario fraud.Legalization provisions NHLA supported include: (1) a roadmapto citizenship for eleven million undocumented immigrantsbeginning with a “registered provisional immigrant” (RPI)status; (2) a shortened roadmap to citizenship for DREAMAct-eligible youth; (3) a shortened roadmap to citizenshipfor agricultural workers via a new “blue card” status; (4)a ten-year backstop to issue visas in case of litigation overthe new law; (5) the suspension of removals for prospectiveRPI applicants; (6) the optional extension of the applicationperiod for RPI status for an additional eighteen months; (7) theallowance of “brief, casual, and innocent” breaks in presencefor applicants; (8) a duty for immigration authorities to engagein a multilingual information campaign to reach prospectiveapplicants; (9) the establishment of legal assistance grants;(10) the allowance of a single family application for RPI status;and (11) the allowance of RPI self-petitioning in the case ofdeath, divorce, or domestic violence.Legal immigration reform provisions NHLA supported include:(1) the reduction of the waiver standard for the three- andten-year bars from “extreme hardship” to “hardship;” and (2)classifying dependents of Lawful Permanent Residents (LPRs)as immediate relatives.Federal and state benefit provisions NHLA supported include:(1) an ability for all employment-authorized individuals toobtain commercial, professional, and business licenses andsit for corresponding professional and licensing exams; (2) theopening of federal loans, work study, and services to collegeboundimmigrants; and (3) the partial lifting of the ban on LegalService Corporation access for many farmworkers.Integration provisions NHLA supported include: (1) thecreation of a Task Force on New Americans to coordinate interagencywork impacting new Americans; (2) funding for theOffice of Citizenship and New Americans (OCNA) to facilitatedirect assistance in filing RPI and Blue Card applications,naturalization exam preparation, and adult civics/ESLeducation; and (3) the creation of a public-private partnershipto supplement OCNA’s services and outreach.24
