24(4) in case of death in battle accident/ battle casualty - Copy of DO PtII order/battle casualty report.(5) Statement of the case for grant of ex-gratia lump-sum compensation incase death of the Officer took place in the circumstances stated inRegulation 141 of Pension Regulations for the Army, Part- I (2008).(b) The Controller of Defence Accounts (Officers) shall forward the Last Paycertificate and No Demand Certificate to the Principal Controller of Defence Accounts(Pensions) within one month from the date of receipt of casualty report.(c) Next of Kin shall complete the application for family pension and send thesame to the Principal Controller of Defence Accounts (Pensions) along with details ofPension Disbursing Authority viz. place and channel of payment of family pension. Incase of Bank, the full and complete address of the paying branch and saving/current bankaccount number (single only).(d)The Principal Controller of Defence Accounts (Pensions) shall--(i) on receipt of the application duly completed from the next of kin, andsanction of the competent authority regarding attributability of death dueto military service and the nomination for death gratuity from theconcerned branch Directorate as per clauses (a) (ii), (a) above, authorisein Pension Payment Order sanction special family pension to the spouse asper entitlements where cause of death of the Officer has been accepted asattributable to or aggravated by military service for grant of special familypension as per Annexure IV to Appendix VI to these Regulations.(ii) In case death due to battle casualty, liberalised family pension shall begranted.(iii) Where there is delay and in case death of the Officer has neither beenaccepted as attributable to nor aggravated by military service bycompetent authority, the spouse will be granted ordinary family pension.(iv) Before issue of Pension Payment Order, shall adjust against the deathgratuity all dues outstanding against the deceased Officer and alsowithhold 10 percent of the death gratuity or Rs. 1000/- whichever is lessfor adjustment of any unassessed dues but release automatically thewithheld amount of death gratuity after the expiry of six months from thedate of death in case the intimation about the outstanding dues is notreceived by then..(v) Adjust the amount of death gratuity withheld under sub clause (i) above,against the outstanding dues, when intimated.(vi) Sanction dependant pension to parent/brother/sister in case Officer dies asa bachelor or widower with no children after ensuring that theparent/brother/sister have claimed dependant pension duly supported by aself-declaration on the form prescribed in Appendix VII to PensionRegulations for the Army, Part-I (2008).Pension Regulations for the Army, Part II (2008)
25(vii)Authorise ex-gratia lump-sum compensation simultaneously in thePension Payment Order, where payable.SPECIAL FAMILY PENSION OR DEPENDANT PENSION WHEN DEATHOCCURRED AFTER RELEASE/ RETIREMENT/INVALIDMENT35. (a) In case of death of an Officer within 10 years afterrelease/retirement/invalidment, the next of kin shall send an intimation of death, to thePrincipal Controller of Defence Accounts (Pensions) and to the ArmyHeadquarters/AG(MP-5&6) in case of Service Officers, Medical Personnel ServiceRecord (Officers) in case of Army Medical Corps, Army Dental Corps and MilitaryNursing Service Officers or Territorial Army Directorate in the case of Territorial ArmyOfficers.(i) Death certificate issued by competent registering authority.(ii) A death certificate of the deceased in prescribed form as at Annexure I toAppendix IX if he was treated by a medical practitioner. orwith the following documents-His/her statement duly verified by two reliable witnesses in theprescribed form as at Annexure II to Appendix IX if the deceased wasnot treated by a medical practitioner. orDeath certificate (AFMSF-93 Part I) in case of death in the MilitaryHospital.(iii) Claim form for family pension duly completed together with(1) Certificate that the diseased Officer was not re-employed afterrelease/retirement/invalidment as per Annexure-I to Appendix-X.(2) Certificate from the Pension Disbursing Authority of the deceasedOfficer to the effect that arrears of pension in respect of the deceasedOfficer have been paid indicating the date upto and for which paidand the name of the recipient as per Annexure II to Appendix X tothese Regulations.(b) The Army Headquarters/AG (MP-5&6) in case of Service Officers, MedicalPersonnel Service Record (Officers) in case of Army Medical Corps, Army Dental Corpsand Military Nursing Service Officers, Territorial Army Directorate in case of TerritorialArmy Officers shall forward within one month, service/medical documents of thedeceased Officer along with the death intimation/certificate, etc. received from the nextof kin, to Army Headquarters (G S Branch) for the adjudication of death of the retiredOfficer whether attributable to or aggravated by military service.(c) The Principal Controller of Defence Accounts (Pensions) shall, on receiptof completed application forms from the Next of Kin and other necessarydocuments, authorise ordinary family Pension, if the same was not authorised inthe Pension Payment Order of the deceased Officer. In case death has beenaccepted as attributable to or aggravated by military service.
