Executive Director ReportChris Tollefson, Executive Director6Thelast 12 months havebeen a watershedperiod for the ELC and one that we will longremember.It was marked by many highlights. Foremostamong these was our first visit to theHakai Beach Institute and the remarkableopportunity that this provided us to blue-skythe ELC’s future with the Tula Foundation.The renewed partnership that ultimatelyflowed from this visit inspires and challengesus to build on the stable foundation that hasbeen created over the last five years.It was also a year that saw the ELC andenvironmental law at UVic flourish and growas never before. Enrolment in the regularstreamClinic met new all-time highs withwaiting lists to get into the course eachterm. Likewise the intensive-stream Clinic,funded by the Law Foundation of BC, sawall-time high enrolments, and enrolmentin the foundational UVic Law course inEnvironmental Law was over 40 percenthigher than normal. All of these are verypositive indicators of the health and future ofenvironmental law at UVic Law.This high level of interest in the ELC andenvironmental law course offerings at UVicLaw presents us with new challenges andopportunities. As our docket of ELC casesand projects grows, so too does the needto manage our operations in a prudent andsustainable fashion.Part of the answer, of course, is ensuring wehave human and other resources in place toproperly supervise the student work that isbeing done. Thanks to the renewed fundingcommitment by Tula, we are in the happysituation of being able to keep our existingELC staff together and, in key respects, toaugment this capacity. These new resourceswill also allow us to strategically grow ouroperational capacity to provide even richerstudent learning opportunities and clientservice. Of equal importance, however,is continuing to find new ways enhanceour program. We are gratified that Tula issupportive of our desire to implement newprograms that will better support our abilityto incorporate science into our work, to trainstudents in litigation-related skills, and toprovide place-based learning opportunitiesat HBI.The last 12 months were also a period thatsaw many accolades and kudos come our way.Most notable of these were awards receivedby our Legal Director in recognition of hiscitizenship contributions (by the City ofVictoria) and lifetime achievements in theworld of public interest environmental law(by West Coast Environmental Law). In asimilar vein, the stellar work of our LegalAdministrator (both in her multitude of roleswithin the organization, and her volunteerefforts in environmental film-making) andProgram Director (including her liaisonwork with other UVic units, her leadershipin conference organizing and outreach, andher advocacy on land use and sustainabilityissues) have raised our profile and reflectedpositively on the organization as a whole.We are grateful for their commitment to ourshared vision, and their hard work to makeit happen.ELC Annual Report

Moving forward, it is also important toconsolidate our relationships with other publicinterest environmental legal service providersand clients, and forge new ones. Once again,the last 12 months have been an importanttime. Through jointly planning and hostingCanada’s first-ever national public interestenvironmental law conference (in February2011) with Ecojustice Legal Defence Fundand West Coast Environmental Law, we havecollectively gained a much clearer sense of howthe efforts of these three organizations can bealigned and coordinated. Going forward, I amconfident that we will see even more successfulcollaborations with these organizations. Wehave also developed and will continue todevelop client relationships with First Nationson the Central Coast, as well as with keynational and provincial First Nation advocacyorganizations such as Coastal First Nations,the First Nations Summit and the NationalCentre for First Nations Governance.A final dimension of our current and futurework that deserves mention is research.Increasingly, the ELC is becoming known forits careful, thorough and credible research intoenvironmental law issues. More than virtuallyany other organization working in the publicinterest environmental law arena, we areendowed with the capacity to produce workthat significantly contributes to knowledgeand awareness of environmental legal issues,is policyrelevant, and can leverage substantialreal-world change. Recent publications that fitthis bill include our Environmental Tribunalsand Environmental Assessment reports and ourStormwater report (“Reinventing RainwaterManagement”) as well as our forthcomingreport on Mining Practices. President’s ReportThe Environmental Law Club had another productiveyear in 2010. Led by a talented and energeticExecutive, the Club mixed many of the traditionalclub events with new ideas and opportunities.The outgoing Executive, lead by Eric Regehr, did a great jobin the spring - most notably sending another contingent ofUVic Law students to the Public Interest Environmental LawConference in Eugene Oregon. Irene Sattarzdeh and ConnieNesbitt kept the spirit alive over the summer and organized atrip to Sooke Potholes Provincial Park.The new Executive came together in the fall with energy andmotivation and began by kicking the semester off with Biketo School Week, organized by Sam Rappaport. The event wassuccessful in helping students discover the best bike routes toschool from their new homes and wrapped up with a bicyclescavenger hunt. Jenn Cameron organized a group of volunteersto participate in the annual Mill Hill Scotch Broom sweep,and the Club organized a fall hike up Mt. Finlayson.Complimenting all the outdoor activities the Club sponsoredan excellent contingent of lunchtime speakers. We werelucky to host Gary Cazalet, a leading expert from Australiaon Strategic Lawsuits Against Public Participation, speakingon his experiences with the Gunns 20 Case. Devon Page ofEcojustice Legal Defence Fund, Sean Nixon from Woodwardand Company, and Tim Thielman from Devlin Gailus (andformer Environmental Law Club President) hosted a paneldiscussion on the designation of critical habitat under theFederal Species at Risk Act. Ben Parfitt from the CanadianCentre of Policy Alternatives gave a compelling lecture aboutthe oil and gas industry in the north eastern British Columbia.Finally, Manolo Morales, Executive Director of EcoLEXspoke to UVic students about the incorporation of naturalrights for the environment into the Ecuadorian constitution.The ELC was also proud to co-sponsor two symposiumsthis semester. The first, organized by Clinic student JenniCampbell, was on the establishment of a Biosphere Reserve for8ELC Annual Report

the Capital Regional District. The event was complimented bya sustainability fair where groups throughout the region wereable to set up tables and advertise many of the environmentalinitiatives that are ongoing in the area. The event attracted asignificant crowd and was covered by local media. The secondsymposium was organized by Club Vice President EthanKrindle and focused on Coal Mining in BC.The Environmental Law Centre co-sponsored the first PublicInterest Environmental Law Conference in British Columbia,Renewing Environmental Law. The ELC organized morethan 20 student attendees and volunteers for the wellattendedand highly successful conference. In conjunction,the ELC was also able to host a lunchtime lecture by thekeynote speaker Chief Judge Preston of the New SouthWales Land and Environment Court on the Adjudication ofEnvironmental Disputes.These are just the highlights of a very successful year for theELC. I’m inspired by the enthusiasm and energy of UVic’slaw students and proud to be able to work with such a highlymotivated and productive group of people. In September, Micah Carmody finished his term asour second articled student funded by the Law Foundation’sPublic Interest Articling Fellowship program.ELC Society Board MembersIn September, we expressed thanks to resigning DirectorAndrew Newcombe for his years of assistance. We are gratefulto our new UVic Law Faculty representatives Hamar Fosterand Maxine Matilpi, filling in for Gillian Calder duringGillian’s year’s sabbatical.Strategic renewalELCS Board and staff completed a series of consultations in2010 with students, faculty, the UVic community at large,clients and other external supporters. Participants were askedfour questions:• What would strengthen the ELC’s support of the Facultyof Law/UVic/broader community?• What are signature ELC activities that the communitycould not/could live without?• How could the ELC better meet the environmental lawneeds in BC that are not being met?• How can the ELC position itself for organizationalresilience and relevance?Participants stressed the need to continue with our currentprograms and remarked that the quality, depth and rangeof assistance the ELC provides is unique in Canada. Therewere particular expressions of appreciation for the ELC’sinformal advocacy and public legal education, and studentsELC Annual Report

told us they consider it a high priority to keep direct contactbetween students and their clients in the community. Some ofthe suggestions put forward included:• establishing a certificate program to recognize ELC studentqualifications;• recruiting grad students;• providing more communication about ELC cases; and• providing volunteer opportunities for students andcommunity members.With renewed and enhanced funding from the TulaFoundation announced in early 2011, many of the suggestionswill be implemented. We look forward to reporting details ofthese exciting new developments.Associates ProgramIn its fourth year, the Associates Program, which is funded bythe Law Foundation of BC, continued to engage lawyers acrossthe province in continuing legal education-type activitiesand regular teleconferences. Topics in 2010 for Cohort 2teleconferences included current approaches to judicial reviewof government decisions; deregulation of environmentallaws and delegation to registered professionals; the use ofthe precautionary principle in Canadian law; consultationand accommodation, a charter challenge for environmentalhealth and new developments in species at risk protection.See to read thebackgrounders.In addition to the regular teleconferences, the ELC hosted anin-person meeting in Vancouver for Cohort 2 Associates inFeb 2011. On the heels of that meeting, Associates attendedCanada’s first national public interest environmental lawconference, which the ELC developed and organized inpartnership with West Coast Environmental Law Associationand Ecojustice. The fourth crew of Intensive students startedin September. The Intensive Stream differs from the RegularELC Clinic in that each Intensive student manages at leasttwo files per term, and they take the course in two consecutiveterms, providing continuity for clients and the opportunityfor students to hone their knowledge in particular areas ofpublic interest environmental law.In their evaluations, Intensive Stream students noted the valueof working on practical projects that apply law to real factsand issues to ultimately make a difference in the world. Theyalso appreciate gaining experience in public advocacy andworking with the professors in the ELC and Law Faculty tosolve problems. They finished the course having a better senseof how environmental law might fit into their future legalpractice, and commented that they are more optimistic thatenvironmental law will fit into their legal careers in some way.This is due to a more expansive view of what environmentallaw is and the opportunities available for practicing it.Reform Proposals for EnvironmentalAssessment and Administrative TribunalsThe ELC completed two major reports in 2010 and early2011: Environmental Assessment in British Columbia and theEnvironmental Tribunals in British Columbia. Funded by theLaw Foundation of BC, the reports were written by contractlawyer Mark Haddock with the assistance of ELC students,articled students and lawyers.Environmental Tribunals in British Columbia examines BC’stribunals and provides 12 recommendations on how theymight be improved to better serve the public and protect theenvironment. In addition to considering the role, rationaleand mandate of tribunals, the report looks at participant costsand funding, powers and procedures, and analogous courtsand tribunals in other jurisdictions. Who Will Pay for Major Oil Spills on theNorth Coast?The Living Oceans Society asked ELC student Matt Boultonto determine specific corporate financial liabilities for oil spillsfrom ocean-going tankers on the BC Coast. Matt produceda report ( Jan15%2011.pdf) identifying the parties liable for such oil spills (i.e.provincial or federal government, tanker owner, oil company,etc.) and the extent of their financial risk. In particular, hisreport examined why Enbridge Inc. may - or may not - befinancially liable for an oil spill. Matt noted that as Enbridgedoes not plan to own or charter the tankers, the corporationmay not be liable for a marine spill at all.2010Proposed Coal Mine in the Comox ValleyThe ELC is helping CoalWatch Comox Valley, a citizen’sgroup that formed in response to concerns about a proposedunderground coal mine six kilometres west of Buckley Bay onVancouver Island. CoalWatch is researching the issues andeducating the public about the mine, which would yield 2.2million tons of coal annually for 20 years. After screening andwashing, two-thirds of this is to be trucked to Port Alberniand then shipped to Asian steelmakers. Over a 20-year periodthe mine could generate seven million tons of waste rock,sufficient to cover 200 hectares to a depth of 23 metres. Someof this waste could be put back into the mine workings, andmuch of the rest would be stored in tailings piles or ponds.Concerns include potential impacts on the watershed,salmon habitat, human health, and air quality. Citizens areparticularly concerned that contamination from the extensivecoal washing operations and from the tailings piles could taintaquifers, watersheds and the ocean. The mine is only sevenkilometres—and the tailings pond only two kilometres—from Baynes Sound and its renowned shellfish beds. In aworrisome development, Campbell River’s Quinsam CoalMine was recently linked to very high levels of arsenic in LongLake, including in fresh water mussels. Local citizens andthe K’omoks First Nation worry about impacts on hundreds13

Large coal deposits extend from Fanny Bay almostto Campbell River, and people fear this project will lead toother coal mines. Compliance alone has been working ontwo additional open pit coal mine proposals in the area.In the summer of 2010, articled student Sarah Sharp andCalvin Sandborn collaborated with ELC grad Carly Chunickand prepared a detailed submission to federal and provincialEnvironment Ministers requesting that the environmentalassessment be conducted by an independent expert reviewpanel, with full public hearings.ELC’s Geological Engineer Follows UpIn a subsequent project for CoalWatch, ELC student MayaStano – a mining geological engineer who switched to publicinterest environmental law – documented the inadequacy ofthe bonding regime to pay for possible damages and properclosure of the mine.Doing extensive original research and building on an oldAuditor General Report that flagged the problem of inadequatebonding requirements for mines, Maya documented how pastbonds have failed to compensate for the full range of damageto the community and the environment. Clinic Cases & ProjectsFeb 2009 - Feb 20102010 Clinic WorkLike Matt Boulton’s Enbridge report, Maya’s work,Undermining the Value of Clean Land and Water: InadequateSecurities for Mines in BC, highlighted hidden subsidiesfor industry and the systemic failure to implement thecritically important Polluter Pay Principle. Presenting herreport at a public forum at the law school, Maya showedhow the Polluter Pay Principle is being ignored, leading tounnecessary negative environmental impacts and creatingrisk for provincial taxpayers.• The results of on-site (site specific) sea lice monitoring;• The details of the farm management response to high sealice levels;• Quarterly reports on fish health and mortalities;• Suspected or diagnosed outbreaks of significant diseases;• Any farm fish escape or suspected escape within seven days;• Details of any measures to recapture escaped farm fishincluding the estimated number of escaped fish, the numberrecaptured, and any incidental catch of wild fish during therecapture;• Quarterly reports on incidental wild fish harvested fromthe farmed fish net pens; and• Quarterly reports on marine mammals killed including thedate, species and number killed or drowned.All these measures are either new to BC aquacultureregulations or are more stringent and detailed than theprevious provincial requirements.A Success Story: Reforming the Rules onReporting Sea Lice InformationThe ELC worked on submissions to the federal governmentregarding the need for data on fish farm sea lice outbreaksto be made available to scientists and the public. The currentsecrecy about lice outbreaks makes it difficult for independentscientists to analyze specific outbreaks in order to identifypotential links – and potential solutions – to wild salmon liceproblems. ELC student Steve Catania finished a submissionto government citing jurisdictions that provide much moretransparent reporting of sea lice outbreaks.On July 9, 2010 the federal government released draft PacificAquaculture Regulations that provide for public release ofsea lice data. The client, David Lane of the T. Buck SuzukiFoundation, reported that the new federal regulatory regimevastly improves the system of public transparency andreporting. The new Marine Finfish Aquaculture LicenceConditions for fish farms will require that most of theinformation of concern be publicly available. The new regimeincludes enforceable provisions for salmon farmers to reportto DFO:New Parks EstablishedIn March 2010, ELC advocacy for protection of the WesternForest Products lands removed from the Tree Farm Licencewest of Sooke paid off. The Capital Regional Districtannounced plans to purchase land for parks in the JordanRiver, Sooke Potholes and Weeks Lake areas. Partneringwith The Land Conservancy, the CRD reached an agreementin principle to purchase 2,350 hectares of land from WFPfor $18.8 million. The lands will be protected for recreation,conservation and watershed protection for generations tocome and include over 3.5 km of shoreline at the worldfamoussurfing beach at Jordan River and at Sandcut Beach.One of the actions that contributed to this decision wasthe ELC’s 2007 submission on behalf of the Sea-to-SeaGreenbelt Society to the Auditor General, which argued that201015

Clinic2010 Clinic CasesWork& ProjectsFeb 2010 2009 - Feb 2011 2010the provincial government had improperly released the forestlands in question for development ( the new agreement doesn’t cover all forest landsreleased by the provincial government, tens of thousands ofhectares of land in the area have previously been protectedfrom development by rezoning of 300-acre minimum lots inan ELC-advocated initiative legislated last fall. The ELC hastaken a number of other legal actions to advance this cause.Applying to Make the CRD a UN BiosphereReserveIn summer 2010, the Sea-to-Sea Greenbelt Society asked theELC to investigate the concept of designating the CapitalRegional District as a United Nations Biosphere Reserveas a possible way to enhance protection for the formerWestern Forest Products TFL lands. A Biosphere Reserve isa demonstration site designated under the UNESCO Manand the Biosphere Programme in which conservation andsustainable development are reconciled.A Biosphere Reserve consists of three areas or “zones”:• a core legally protected area (e.g., park or conservationareas);• a buffer zone for sustainable uses (including sustainableresource development); and• a transition zone, in which a full range of sustainable andunsustainable human activities can take place.A Biosphere Reserve must fulfill three key functions:• conservation;• development, fostering development which is socioculturallyand ecologically sustainable; and• logistics, providing support for research, monitoring,education and information exchange related to conservationand sustainable development issues.Biosphere Reserves provide a useful framework for engagingcitizens, collaborating with different interest groups andFirst Nations, developing ecological governance, promotingimportant conservation-related research and education,and for conserving natural areas, and fostering sustainabledevelopment.In summer 2010 ELC student Amelia Walsh consulted withBiosphere Reserve experts and First Nations, and workedwith the UVic Geography Department to:16• document the experiences of other Biosphere Reserves –how they were established, their utility for conservation, andinternational best practices;• identify the evidence necessary for a Biosphere Reserveapplication that meets United Nations criteria;• create a persuasive argument as to why a Biosphere Reserveshould be established in the CRD; and• to initiate discussions with potential Reserve collaborators(e.g., First Nations, local governments, conservation groups,scientists and academics, parties involved in the UBC researchforest proposal).Amelia completed a memo on the structure and potential fora Biosphere Reserve for the Capital Regional District. In thefall, ELC student Jennifer Campbell continued to researchthe issue, and to meet with experts and potential stakeholders.She went on to organize a public forum on the issue (http://ELC Annual Report

Clinic Cases & Projects Clinic2010CasesClinic& ProjectsWorkFeb 2009 - Feb 2010 Feb 2010 - Feb 2011Victoria Harbour Mega-Yacht Marina—CutBack to SizeThe ELC continued to challenge the proposal for a massiveMega-Yacht Marina along the Songhees Walkway in VictoriaHarbour. In June 2010, articled student Sarah Sharp workedwith lawyer Irene Faulkner to file a judicial review in FederalCourt, which challenged the federal navigable waterspermit and environmental assessment of the project. Sarahresearched the argument that the Marina would illegallyextinguish the ancient right of the public to paddle throughthe Inner Harbour. She also prepared extensive affidavitsthat allowed members of the public to express their concernsto the court.In September 2010, Victoria City Council committee rezonedthe harbour to reduce the footprint of the proposed Marinaby 40 per cent. This decision goes a long way toward theprotection of heritage viewscapes of the harbour, public accessto the water, and other public Jenny actedas master of ceremonies for the forum, which included anintroductory film by ELC Paralegal Administrator, HollyPattison, and notable speakers Chief Gordon Planes of theT’Sou-ke First Nation, Chairman Geoff Young of the CapitalRegional District, Biosphere Reserve Expert Professor RodDobell and Glenn Jamieson, co-founder of the MountArrowsmith Biosphere Reserve.Having seeded the idea in the community, the ELC andSea-to-Sea Greenbelt Society have now handed it over to acommunity committee, which will hopefully proceed with it.Even after the fall rezoning, the court case continued. ELCstudent Jonathan Lapthorne developed an argument for thecourt, submitting that Government had violated the PublicTrust doctrine by eliminating the right of certain paddlersto navigate in Victoria Harbour. The Public Trust doctrinehas been enormously effective at protecting environmentalinterests in the US, but is undeveloped in Canadian law. Wesaw this case as an ideal set of facts for advancing the doctrine.The judicial review was adjourned just after Jonathan completedhis written argument because the developer submitted new(much smaller) plans based on the new zoning. Civil servants in charge of thestormwater system, a major “green” engineers organization,and key CRD officials all voiced support for the ELCinitiative.On July 28, 2010, ELC student Paddy O’Reilly presentedthe report to a specially convened joint meeting of the CRD’sEnvironment and Liquid Waste Management Committees,including a number of Councillors and Mayors. As part ofher formal submission, Paddy showed the officials a shortdocumentary film on the issue created by Holly Pattison andELC students. (See for the video. The Commissionwill post the Report on its website and has stated it may callthe ELC to provide expert testimony on the issue.Subsequent ELC staff and students made submissionsand presented the report to numerous city councils and atconferences.Orca Protection – Combining Litigationand Law ReformLast December, the Federal Court issued the decision on theDavid Suzuki Foundation case – a decision which requiresOttawa to protect orcas from toxic contamination, loss ofsalmon and whale watching. The ELC was delighted withthis decision, because ELC student Sarah Orr had workedon the case for Ecojustice. In addition, the court decisioncreated an ideal opportunity to launch the proposed whalewatching regulations that the ELC developed in the summerof 2010.Boat traffic has been documented as one of the three mainthreats to the endangered southern resident orcas, along withlack of salmon and pollution contamination (PCBs). For sixmonths of the year, from sunrise to sunset, endangered orcasare pursued everywhere by whale watching scouts on thewater, in the air, and on land.There is a dearth of legislation to protect orcas and othermarine wildlife—and inadequate enforcement of the littlelegislation that exists. However, the Canadian governmentis in the process of developing draft amendments to theMarine Mammal Regulations. The Lifeforce society wantedto propose a set of model regulations before Governmentreleased their proposal—and build support for an optimumset of regulations.Lifeforce asked ELC student Rose Keates to create annotatedmodel legislation to govern whale watching activities.Rose reviewed standards and guidelines from over 30countries around the world. She went on to collaborate withexperts, lawyers and government officials to develop modelregulations—based on local practicality as well as internationalbest practices. The model regulations are annotated with bothscientific and legal arguments in support of the legislation( the Inadequate Regulationof Run-of-River ProjectsThe BC Creek Protection Society asked the ELC todocument the inadequacies of the regulatory regime for runof-riverprojects. This legal analysis was needed because theProvince was claiming that the BC regulatory regime was oneof the toughest in the world in an attempt to convince theState of California to relax standards and allow BC run-ofriverpower to qualify for premium “green” rates. The Societywas concerned that a large new demand for additional runof-riverpower could be premised on faulty information aboutthe BC regulatory system.In April 2010, ELC student Sunny Zhai and articled studentsJill Vivian and Micah Carmody—working with ELC graduateTim Thielmann—finalized a comprehensive review of theenvironmental laws that govern run-of-river hydro projectsin BC. Completed for the BC Creek Protection Society andthe Wilderness Committee, the final legal opinion is foundat: legal opinion clearly demonstrates that Government hasseriously exaggerated the level of environmental protectionprovided by Canadian laws. The memo shows how BC lawsoffer weak protection and environmental standards, whichfall far below acceptable “green premium” standards underCalifornia law.The clients have shared this opinion with state officials andlegislators in Sacramento in order to prevent a relaxation ofCalifornia laws (and the resulting proliferation of BC run-of-201019

Among other things, it is hopedthat the project could eventually motivate the provincialgovernment to strengthen environmental laws.Reducing Cruise Ship Air Pollution inVictoriaVictoria’s James Bay Neighbourhood Association is concernedabout air pollution from the rapidly expanding cruise shipindustry. A recent study showed that sulphur dioxide levelsin James Bay exceeded World Health Organization standardson 24 per cent of the monitored days during the summerwhen cruise ships were in port. The local Medical HealthOfficer has acknowledged that this is creating a health risk forvulnerable individuals in the James Bay area. The Associationwants laws enacted to address this pollution problem.The Association asked ELC student Natalie Payne to considerthe laws and legal remedies available to address the issues ofcruise ship air pollution in Victoria, and recommend a legalstrategy.Controlling Cruise Ship Waste Water on theBC CoastEvery summer one million cruise ship passengers travel upthe BC Coast, through the Inside Passage and on to Alaska.These boats dump large quantities of wastewater into coastalwaters, leaving partially treated sewage, heavy metals andchemical pollutants in their wakes. Most ships are usingolder, dirtier water treatment systems. The resulting pollutionthreatens whales, porpoise and salmon and other marine lifeon the BC Coast. The pollution also creates a threat to FirstNations’ fisheries, commercial shellfisheries and tourism.Natasha Gooch researched and documented the problem, andthen wrote a law reform report. The report considered andanalyzed the state of the legislation in Canada and comparedit to neighbouring US jurisdictions at both the state andfederal levels.In the end, the report came to the conclusion that it would beof benefit for the Canadian legislation regime to be updatedto at least mirror the stricter regulations in the neighbouringstates. Alaska has the most aggressive statutory regimewith respect to cruise ship pollution and it would be in thebest interest of the client if the Canadian legislation met orexceeded Alaskan standards. Currently Natasha’s report isbeing reviewed by experts in the field before being finalized.Natalie produced a memo that recommended a variety ofpotential actions that the Neighbourhood Association couldpromote, including:• measures aimed at federal, provincial and local governments;• measures aimed at the Greater Victoria Harbour Authority;and• actions aimed at instigating a collaboration with othercruise ship ports.Monitoring the Catch of RecreationalFisheriesWith the current decline of fish stocks, it is imperativethat scientists know how many fish are being caught. FirstNations want to propose better rules for monitoring the catchof recreational fishers to address this problem.In other jurisdictions on the Pacific Coast, there are significantrestrictions on the ability of public recreational fishers toharvest various stocks and species. Specific recreationalfisheries in crab, prawn, halibut, shellfish, herring, sardinesand other marine species are licensed, and the harvestreported to Fish and Wildlife Agencies.In contrast, in British Columbia the recreational fisheryis licensed, but the harvest is not adequately reported ormonitored and is restricted simply by openings and closingsof areas to specific fisheries. As a result, there is no accurateway of establishing the harvest levels of any stock or speciestaken in the recreational fishery.20ELC Annual Report

First Nations – as well as progressive membersof the sports fishing community – recognize that reform isneeded. A possible reform proposal could involve a reporting/monitoring system with a mandatory tariff dedicated forfisheries management.The Island and Marine First Nations’ Atlegay FisheriesSociety asked ELC student Laura Sworn to undertake areview of the sport fishing reporting requirements for salmon,invertebrates and shellfish in other jurisdictions along thePacific Coast.The final report ( )outlineddifferent monitoring practices that could be used in BC toensure that recreational fishermen are accountable for theirharvest—and to ensure that rehabilitation funds are directedto specific areas that have been depleted.Legislative Committee Acknowledges ELCSubmissions on FOIThe provincial Freedom of Information and Protection of PrivacyAct (FOIPP Act) is meant to make public bodies moreaccountable to the public and to protect personal privacy. Yetthe Act fails to consistently ensure government transparencyand accountability. This was exemplified in the 2005 ELC FOIappeal that successfully argued that government had made itespecially difficult for environmental groups to obtain publicinformation by creating delays, refusing to disclose relevantdocuments and charging excessive fees. Delays, unnecessaryexcerption of materials, and excessive fees continue to be aproblem for environmental and social justice groups.In 2009, the provincial government appointed a SpecialCommittee of the Legislature to review the Freedom ofInformation and Protection of Privacy Act under section 80 ofthe Act. The Legislative Committee is required to report backto the House by May 31, 2010. As part of its deliberations,the Committee held hearings at the Legislature, acceptingsubmissions from the public in early February 2010.Dogwood Initiative asked ELC student Morgan Blakley toprepare submissions to the Legislative Committee for them.Morgan created a compact, 36-page, fact-filled report thatfeatured his own independent analysis of statistics foundon government websites as well as a great deal of otherresearch (( February 3, he presented his finding at the Legislaturearguing that although access to government records isessential for a healthy democracy, the Act is currently failingthose who need it most. “If only rich and powerful groupsin society can access government information, then howare nonprofit organizations and the majority of people toparticipate meaningfully in our democratic governance?” heargued. While one of the Act’s key purposes is to make publicbodies more accountable to the public, Blakley provided datato indicate how governments have been reluctant to releaseinformation. When they do hand over material, it is oftenafter great delay or with much of the content blocked out. Ina series of examples ranging from fees of $14,000 to almost$174,000, Morgan noted it also can come with an impossibleprice tag even in cases where it is clear that the public interestwould call for release of the information. Almost half of theFOI requests made by public interest group, the media andpolitical parties – groups most critical for holding governmentaccountable – were illegally slow.Morgan showed that the public seems to have been sofrustrated that most people don’t bother to even ask for recordsanymore: there’s been a decline in requests of almost 57 percent from 1995-2007. Morgan went on to make a number ofrecommendations on how to fix the system. In May 2010,the legislative committee released its report ( The Committee expressly cited andused both information and recommendations that Morganhad provided in his submission.201021

This will be the first new Water Act in over100 years, and there is an opportunity to create a Water Act thatis ecologically progressive and addresses the over-allocationof water entitlements in some watersheds. Government hascommitted to addressing the following issues:1. Protect stream health and aquatic environments.2. Improve water governance arrangements.3. Improve the water allocation system.4. Regulate groundwater use.ELC Strategic EngagementA group of environmental non-governmental organizationsare working together to achieve an ecologically soundmodernization of the BC Water Act. The ELC has providedlegal research and assistance to several of these organizations,and Deborah Curran is a member of an ad hoc steeringcommittee for strategizing on further WAM activities. Thead hoc group has held two meeting in the past year withfunders from the Vancouver Foundation, Bullit Foundation,Moore Foundation, and Gordon Foundation to develop anongoing program for Water Act modernization interventions.In addition to a joint statement of principles submitted to theprovincial government, last fall the World Wildlife Fund andVancouver Foundation undertook, on behalf of the group, awater poll in BC. The independent poll conducted by Angus22• 69 percent said that they favour ensuring that the protectionof nature, wildlife and species like salmon are always a toppriority in provincial water rules.The poll garnered over a dozen media stories (print and radio)and is serving as a foundation for further discussions withthe provincial government. Full reporting of the poll canbe found at Act Modernization SubmissionsELC articling students Micah Carmody and Jill Viviancrafted a submission on ecological values under a new WaterAct on behalf of The Land Trust Alliance of BC in the springof 2010. The submission outlined the importance of baselineinstream flows for all watercourses in BC, the need forgroundwater regulation, and the promise of local watershedgovernance structures that can better plan for and adapt tolocal conditions.Deborah Curran will shortly be making a submission onbehalf of Ducks Unlimited in response to another Ministryof Environment discussion paper on the WAM process.Protecting a First Nation’s Interests in theChemainus River WatershedThe ELC has worked on a case to protect the Halalt FirstNation’s groundwater supplies – and Chemainus River salmon– from municipal plans to install groundwater extractionwells adjacent to the Chemainus River and the Reserve.Water flows in the Chemainus River are already criticallylow for sustaining salmon. The Halalt are concerned thatextraction of ground water from the wells, which are adjacentELC Annual Report

To that end, several student projects in 2010and 2011 have supported policy work on a regional the river, will reduce those flows substantially. Theyhave evidence that the groundwater to be extracted plays animportant role in moderating the flow and temperature of theriver.They are also concerned that the wells, which are only 10metres from the Reserve boundary, will extract groundwaterunder the Reserve, which may impact the Reserve’s wells.With ELC help, the Halalt filed a Petition to quash theMinister of Environment’s Environmental AssessmentCertificate that approved the wells on the basis that the wellswould infringe their rights and title, and that governmenthas failed to adequately consult and accommodate them.They allege that government should have developed acomprehensive watershed management plan before approvingthe groundwater withdrawal of water that feeds theChemainus River.The court hearing, involving arguments developed by ELCstudent Steve Catania, was held for several days in summer2010 and finished in the fall. During the fall, ELC studentSamantha Rapoport researched the issue of retroactivity oflegislation, case law on ownership of minerals under IndianReserves, and how such materials could be applied to agroundwater case.Developing a Regional Food SystemStrategyThe Food Policy Working Group of the Capital RegionalDistrict Food and Agricultural Initiatives Roundable isworking with the Capital Regional District on regional foodpolicies. The Group is preparing a series of policy briefs todecision makers and is aiming to have its policy proposals2010Regional Levy to Protect FarmlandSustainable agriculture in the Capital Region is threatenedby the fact that young farmers often cannot afford to buyland. Currently, the capital cost of local farmland is $50,000-150,000 per acre, an urban land value that cannot becapitalized by young farmers solely based on an agriculturalbusiness plan. Similar to the crisis in the affordability ofhousing, there is now market failure regarding the price offarmland and its value for growing food commodities.The Capital Region Food and Agriculture InitiativesRoundtable asked ELC student Patricia Blair to address thefeasibility of establishing a Capital Regional District Levy forFarmland. A levy on property taxes could provide a meansfor the broad community to capitalize its interest in retaininglocal food lands – and take that burden off beginning farmers.There are useful models to consider. The CRD Parklandacquisition fund has been very well received by residents andhas allowed the Region to secure significant natural areas/sensitive eco-systems. In fact the parkland levy was recentlyrenewed at a higher amount (from $10 to $20 per parcel peryear).Under a regional farmland levy system, land would bepurchased with levy funds but would be held and managed bya farmland trust. The land trust would administer farmlandleases to ensure appropriate stewardship is practiced. TheCapital Region Roundtable believes that securing a few23

The Initiative is specifically investigating howhousehold energy efficiency programs can be implemented ina way that is fair to the poor.A number of inequities currently exist in current householdenergy efficiency programs. For example, current programsraise energy rates to all energy consumers (including thepoor), but the benefits of many programs are only accessible toconsumers who are able to pay for energy efficiency upgrades.In effect, low income residents are subsidizing the energyefficiency upgrades of their higher income counterparts.Additional equity issues include those relating to landlord/tenant relationships, time-of-use rates, and two-tiered pricingprograms.Maine and articled student Jill Vivian researched internationalbest practices for encouraging energy efficiency withoutharming the poor. Their 88-page report ( examines thebest low income energy efficiency policies and programs inCanada, the US and Europe and makes recommendations forchanges in law and policy to reform BC programs.This ELC work will become the foundation for the rest of thework of the Energy Poverty Initiative, which will go on toadvocate the reforms that the ELC has developed.residents’ concerns that the Park is being mismanaged andsuffering from environmental degradation. Sunny researchedthe pertinent issues and then made submissions to the Juan deFuca Park & Recreation Commission.She also advocated more effective regulatory tools to monitorenvironmental values and ensure that park use doesn’tdamage sensitive ecosystems. Finally, she called for a morecollaborative and open process in planning park uses andstewardship.Low Income Energy Efficiency ProgramsELC student Maine McEachern worked on the EnergyPoverty Initiative of the Climate Justice Project, a projectthat seeks to advance both environmental and social justicegoals. The ELC submissionprompted the Auditor General to issue a critical report thatled the Capital Regional District Board to make a decisionto permanently set aside 2350 hectares of these lands forrecreation, conservation and watershed protection. Asanother example, an ELC report on transforming storm watermanagement has been widely praised by local governmentofficials, and is leading to significant reform of rainwatermanagement in the Capital Region.Calvin’s leadership through ELC has helped build a publiccommunity of interest and involvement, which focuseson making our region a better place to live with betterenvironmental protection. The team consistedof Naomi Kovak (current ELC Intensive student and ELCStudent Board Chair) and Sunny Zhai (ELC Intensivestudent 2009-2010); and• Representing the faculty/professors on the Fraser BuildingSustainability Action Team for the University of VictoriaBuilding Sustainability Challenge during which six buildingcommunities on campus are competing to reduce their wasteand energy (February to April 2011).Holly PattisonOver the past year, Holly Pattison dedicated numerousvolunteer hours in the creating of films that were usedto enhance and distribute ELC Clinic work (availablehere: and assistcommunities.In May 2010, Holly produced a film to raise public awareness,distinguish the stormwater issue from the contentious localsewage issue and promote the ELC’s stormwater report.Several students and volunteers were involved in theproduction, which was comprised of interviews with experts:a biologist, an engineer, and a local politician. The film hasbeen shown as part of student presentations to the CRD,a variety of municipalities, and the Cohen Commission ofInquiry into the Decline of Sockeye Salmon in the FraserRiver.In October 2010, Holly produced a film to introduce theconcept of Biosphere Reserves.
