SCOPE OF OPERATING REPORTThis Operating Report covers the:1. activities of the Rail, Tram & Bus Union (RTBU) NSW Branch, for the calendar year 1 January 2008 to 31December 2008;RTBU OPERATING REPORT2. results of those activities; and3. significant changes 2. ANY SIGNIFICANT CHANGES IN ACTIVITIESThere were no rule changes certified in 20082008 RESULTS8 Federally registered Agreements2 NSW State AgreementReceived application for admittance of 1313 newmembers (Bus and Rail Division).429 appeals before NSW Transport AppealsBoard (TAB) (415 Rail Division & 14 Bus Division) 6 delegates and alternate delegates (RailDivision) and 1 delegates (Bus Division) 2delegates South Coast Labor Council nominatedto Unions NSW. Attend approximately 30 Unions NSW meetings. 1 submission was made in 2008.107 workplace delegates were trained.36 delegates trained for RailCorp CampaignCommitteeProduced and distributed:- 4 copies of union journal Road & Rail;- 131 membership bulletins- 3 newsletters- 1 Around the Tracks).21 MAY 2009 3Page 24 raIL & ROAD June 2009

DETAILS OF ANY SIGNIFICANT CHANGES IN FINANCIAL AFFAIRSSignificant changes in the Rail, Tram & Bus Union (RTBU) NSW Branch financial affairs (See ATTACHMENT A:FINANCIAL REPORT) included:• Significant changes in the Rail, Tram & Bus Union (RTBU) NSW Branch financial affairs(See ATTACHMENT A: FINANCIAL REPORT) included:• an increase in accumulated funds of $440,243 for the operating year to 31 December 2008;• an decrease in membership contributions of $19,786 for the operating year to 31 December 2008;• increase in income from investments and other $189,894; and• an increase in the following union fees: • there were no changes in union membership fees.Other Relevant Information• The Rail, Tram & Bus Union (RTBU) NSW Branch also managed the New Generation Holiday Camp at Jervis Bayon behalf of the union and its members. (See ATTACHMENT A: FINANCIAL REPORT).5. DETAILS OF THE RIGHTS OF MEMBERS TO RESIGN AFFAIRSAll members of the RTBU (NSW) have the right to resign from the union in accordance with Rule 14, Resignation fromMembership, of the Rules of the Rail Tram and Bus Industry Union as set out below:14 - RESIGNATION FROM MEMBERSHIP(1) A member may resign from membership of the Union by written notice addressed and delivered to the Secretaryof his/her Branch.(2) A notice of resignation from membership of the Union takes effect:-(a) where the member ceases to be eligible to become a member of the Union:-(i) on the day on which the notice is received by the Union; or(ii) on the day specified in the notice, which is a day not earlier than the day when the member ceases to beeligible to become a member;whichever is later; or(b) In any other case:-(i) at the end of two weeks; or(ii) on the day specified in the notice;whichever is later.(3) Any subscriptions, fees, fines and levies owing but not paid by a former member of the Union in relation to a periodbefore the member’s resignation took effect, may be sued for and recovered in the name of the Union in a Court ofcompetent jurisdiction, as a debt due to the Union.(4) A notice delivered to the Branch Secretary shall be deemed to have been received by the Union when it wasdelivered.(5) A notice of resignation that has been received by the Union is not invalid because it was not addressed and deliveredto the Branch Secretary.(6) A resignation from membership of the Union is valid even if it is not effected in accordance with this Rule, if themember is informed in writing by or on behalf of the Union that the resignation has been accepted.RTBU OPERATING REPORT6.
