<strong>LEP</strong> <strong>Checklist</strong>INTRODUCTIONThe United States Department of Labor (USDOL) guidance regarding persons withlimited <strong>English</strong> proficiency requires recipients of federal financial assistance to ensuremeaningful access to their programs and activities by persons with limited <strong>English</strong>proficiency (<strong>LEP</strong>) pursuant to Title VI of the Civil Rights Act of 1964, its implementingregulations, and Section 188 of the Work<strong>for</strong>ce Investment Act of 1998. The guidancedoes not create new legal requirements or change existing requirements. It clarifieswhat the law already requires with respect to ensuring that in<strong>for</strong>mation and services areaccessible to <strong>LEP</strong> persons. Eligible <strong>LEP</strong> individuals must be able to access the fullspectrum of services provided by recipients. The purpose, as stated in the revisedguidance, is “to assist recipients in fulfilling their responsibilities to provide meaningfulaccess to <strong>LEP</strong> persons under existing law.” The USDOL advises that recipients arerequired by Title VI to take reasonable steps to provide meaningful access to federallyassisted programs and activities by <strong>LEP</strong> persons through language assistance that isreasonable, timely, and effective.This checklist was developed <strong>for</strong> the purpose of assisting states inensuring that <strong>LEP</strong> persons receive meaningful access to federallyassisted programs and services. It provides basic steps <strong>for</strong> thedevelopment and implementation of a <strong>LEP</strong> <strong>Plan</strong>. However,adherence to this checklist alone may not allow a recipient todemonstrate compliance with Title VI or Section 188 of WIA. Thischecklist is not a substitute <strong>for</strong> the USDOL guidance, which addressesin much greater detail the elements discussed below.Consider <strong>for</strong>ming a team or committee that includes both internal andexternal representatives to develop a comprehensive plan. The planshould include, but not be limited to, an assessment of the needs ofthe <strong>LEP</strong> population, timeframes, vital documents, resources, etc. Thisplan will serve as a "tool" that will provide guidance in providingservices to <strong>LEP</strong> persons.7-2-03 Page 2
