Cap-tax-and-tradelegislation is stalled <strong>in</strong> <strong>the</strong> United States Senate. A number of developed countries are hav<strong>in</strong>gsecond thoughts about carbon emission rules that raise hydrocarbon costs and restrict economicgrowth amid a global recession.Ch<strong>in</strong>a, India and o<strong>the</strong>r emerg<strong>in</strong>g economies are rapidly expand<strong>in</strong>g <strong>the</strong>ir fossil fuel use, <strong>to</strong> spurjob creation, economic expansion and poverty reduction. Ch<strong>in</strong>a has said it has “no <strong>in</strong>tention” ofcapp<strong>in</strong>g its greenhouse gas (GHG) emissions, though it has committed <strong>to</strong> reduc<strong>in</strong>g carbon<strong>in</strong>tensity per unit of GDP by 40-45% by 2020. India and o<strong>the</strong>r rapidly moderniz<strong>in</strong>g nations havetaken similar positions.Emails from Brita<strong>in</strong>’s Climate Research Unit suggest systematic efforts by lead<strong>in</strong>g “alarmist”scientists <strong>to</strong> cherry-pick and massage data, control and manipulate <strong>the</strong> peer review process, andsquelch requests by “skeptical” scientists <strong>to</strong> exam<strong>in</strong>e <strong>the</strong>ir data, computer codes and analyses.Closer exam<strong>in</strong>ation of <strong>the</strong> 2007 Intergovernmental Panel on Climate Change (IPCC) <strong>report</strong>reveals that most of its “headl<strong>in</strong>er” climate disaster predictions were based on conjecture,anecdotes, papers by environmental activists, and computer models that relied on questionabledata and assumptions.Pew, Rasmussen and o<strong>the</strong>r polls consistently f<strong>in</strong>d that Americans put global warm<strong>in</strong>g dead last <strong>in</strong>any rank<strong>in</strong>g of environmental and o<strong>the</strong>r concerns – far beh<strong>in</strong>d worries about <strong>the</strong> economy, taxes,healthcare, jobs and pollution. Nearly half of US adults now attribute climate change primarily <strong>to</strong>natural forces.And yet, some <strong>in</strong> Congress rema<strong>in</strong> committed <strong>to</strong> enact<strong>in</strong>g cap-tax-and-trade laws similar <strong>to</strong> aEuropean system that has sharply raised energy costs for families and bus<strong>in</strong>esses, causedextensive job losses, but failed <strong>to</strong> stall <strong>the</strong> significant rise <strong>in</strong> greenhouse gas emissions <strong>in</strong> everyEU country s<strong>in</strong>ce 1990.The White House has enlisted numerous Executive Branch agencies <strong>in</strong> a campaign <strong>to</strong> slashdomestic hydrocarbon production and use, emphasize renewable energy, advance its position thathumans are caus<strong>in</strong>g dangerous global warm<strong>in</strong>g, and impose new taxes and regulations oncarbon-based fuels.Lead<strong>in</strong>g <strong>the</strong> White House <strong>in</strong>itiative is <strong>the</strong> Environmental Protection Agency, which has ruled thatcarbon dioxide “endangers human health and welfare.” EPA is implement<strong>in</strong>g regulations <strong>to</strong>control emissions from vehicles and stationary sources and has launched an “environmentaljustice <strong>in</strong>itiative,” promot<strong>in</strong>g <strong>the</strong> view that global climate change has especially deleteriouseffects on “communities of color.” 11

The unalienable rights with which our Crea<strong>to</strong>r has endowed all of us <strong>in</strong>clude “life,liberty and <strong>the</strong> pursuit of happ<strong>in</strong>ess.”Pursuit of justice is a cont<strong>in</strong>u<strong>in</strong>g quest, not a dest<strong>in</strong>ation. It is a commitment <strong>to</strong> “do un<strong>to</strong> o<strong>the</strong>rs asyou would have <strong>the</strong>m do un<strong>to</strong> you,” and “not do un<strong>to</strong> o<strong>the</strong>rs as you would not have <strong>the</strong>m do un<strong>to</strong>you.” In <strong>the</strong> environmental arena, it is an ongo<strong>in</strong>g effort <strong>to</strong> ensure that no racial, ethnic orsocioeconomic group – or people <strong>in</strong> certa<strong>in</strong> companies or <strong>in</strong>dustrial sec<strong>to</strong>rs – bear adisproportionate share of harmful environmental consequences that may result from <strong>in</strong>dustrial,commercial or government policies or activities.In <strong>the</strong> public policy arena, pursuit of justice means improv<strong>in</strong>g opportunities and quality of life forpoor and m<strong>in</strong>ority communities, while safeguard<strong>in</strong>g <strong>the</strong> rights, jobs and liv<strong>in</strong>g standards of allcitizens. It means protect<strong>in</strong>g people from real, demonstrable risks that are based <strong>in</strong> science andevidence, without focus<strong>in</strong>g on speculative risks, creat<strong>in</strong>g new risks, or redef<strong>in</strong><strong>in</strong>g “justice” <strong>to</strong>advance political agendas.These pr<strong>in</strong>ciples must guide state, federal and<strong>in</strong>ternational policies on energy and climatechange.Energy is <strong>the</strong> Master Resource – <strong>the</strong> foundationfor everyth<strong>in</strong>g we eat, make, ship and do. Withabundant, reliable, affordable energy, almostanyth<strong>in</strong>g is possible, and we can improve, enrichand safeguard countless lives. Without it, jobs,liv<strong>in</strong>g standards, basic rights and moderncivilization are imperiled.“Laws and policies that restrict access <strong>to</strong> America’s abundant energy resources drive up <strong>the</strong> priceof energy and consumer goods,” Congress of Racial Equality chairman Roy Innis po<strong>in</strong>ts out.They hobble <strong>the</strong> pursuit of happ<strong>in</strong>ess, “cause layoffs and leave workers and families struggl<strong>in</strong>g <strong>to</strong>survive. They roll back <strong>the</strong> progress for which civil rights revolutionaries like Dr. Mart<strong>in</strong> Lu<strong>the</strong>rK<strong>in</strong>g struggled and died.” 2Such policies block <strong>the</strong> door <strong>to</strong> opportunity, creat<strong>in</strong>g unnecessary and unacceptable obstacles <strong>to</strong><strong>the</strong> natural, justifiable desire of poor and m<strong>in</strong>ority Americans <strong>to</strong> share <strong>in</strong> <strong>the</strong> American Dream.They tarnish <strong>the</strong> golden years of senior citizens, forc<strong>in</strong>g <strong>to</strong>o many <strong>to</strong> choose between heat<strong>in</strong>g andeat<strong>in</strong>g.Land and resource withdrawals, carbon taxes, and restrictions on energy production and use alsoput activist pressure groups, bureaucrats, politicians and courts <strong>in</strong> control of what has madeAmerica a sh<strong>in</strong><strong>in</strong>g beacon for people <strong>the</strong> world over: liberty, economic freedom, and <strong>the</strong> promiseof upward mobility for all, regardless of education, ethnic background or status at birth. Instead of solv<strong>in</strong>gproblems, <strong>the</strong>y create new environmental, economic and civil rights conflicts. The mostpervasive and destructive of <strong>the</strong>se policies are cap-and-trade and endangerment rules, for <strong>the</strong>ywould affect virtually every family, bus<strong>in</strong>ess and activity <strong>in</strong> Wiscons<strong>in</strong> and throughout <strong>the</strong> UnitedStates. • •Both cap-tax-and-trade and EPA “endangerment” regulations are <strong>in</strong>tended <strong>to</strong> drive upenergy prices and restrict <strong>the</strong> use of fossil fuels, especially <strong>the</strong> oil that susta<strong>in</strong>sWiscons<strong>in</strong>’s transportation, agricultural and<strong>to</strong>urism <strong>in</strong>dustries, and <strong>the</strong> coal that generates66% of <strong>the</strong> Dairy State’s electricity.They attempt <strong>to</strong> control and curtail personalchoices, liv<strong>in</strong>g standards and economicactivity via legislative and executive fiat,through micromanagement by unelectedbureaucrats, with m<strong>in</strong>imal bipartisandiscussion or debate by citizens and <strong>the</strong>irelected representatives. • They seek <strong>to</strong> compel a wholesaletrans<strong>format</strong>ion of Wiscons<strong>in</strong>’s and our nation’senergy system, economy, social structure andstandards of justice, <strong>in</strong> <strong>the</strong> name of prevent<strong>in</strong>g disasters that thousands of scientists sayare farfetched and based on conjecture, ra<strong>the</strong>r than actual, testable scientific evidence.Similar <strong>in</strong>itiatives launched at <strong>the</strong> state level would have <strong>the</strong> same effects. • • • • •“Energy is <strong>the</strong> MasterResource – <strong>the</strong> foundationfor everyth<strong>in</strong>g we eat, make,ship and do. Withoutabundant, reliable, affordableenergy, jobs, liv<strong>in</strong>g standards,basic rights and moderncivilization are imperiled.”They are based on <strong>the</strong> assumption that human emissions have replaced <strong>the</strong> natural forcesthat caused climate cycles and changes <strong>in</strong> <strong>the</strong> past – and on <strong>the</strong> assertion that carbondioxide is a “pollutant,” even though we exhale it, plants require it <strong>to</strong> grow, and all life onEarth is dependent on it.The assumption that carbon dioxide emissions are caus<strong>in</strong>g catastrophic climate change isalso driv<strong>in</strong>g renewed demands that countries do more <strong>to</strong> reduce family size andpopulation growth, <strong>to</strong> curb <strong>the</strong> need <strong>to</strong> produce more energy for more people.Energy is <strong>the</strong> foundation of Wiscons<strong>in</strong>’s economy, jobs, liv<strong>in</strong>g standards, and civil rightsprogress for its poor and m<strong>in</strong>ority citizens. High carbon taxes and str<strong>in</strong>gent regulationswill affect every facet of life, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> ability of bus<strong>in</strong>esses <strong>to</strong> avoid layoffs; ofhospitals, schools and local governments <strong>to</strong> operate with<strong>in</strong> tight budgets; and of families<strong>to</strong> afford food, fuel, transportation and hous<strong>in</strong>g.This pa<strong>in</strong>, sacrifice and <strong>in</strong>trusion on our lives will br<strong>in</strong>g no environmental ga<strong>in</strong> – even ifcarbon dioxide does play a major role <strong>in</strong> climate change – because CO2 emissions fromCh<strong>in</strong>a and India will quickly offset any Wiscons<strong>in</strong> and US reductions.The proposed cap-tax-and-trade and endangerment regulations also raise deeply troubl<strong>in</strong>gconcerns about <strong>the</strong> misuse of taxpayer money <strong>to</strong> promote social, environmental andeconomic agendas, ra<strong>the</strong>r than study and predict climate change, and about <strong>the</strong> obligationof taxpayer-f<strong>in</strong>anced scientists, regula<strong>to</strong>rs and <strong>in</strong>stitutions <strong>to</strong> ensure <strong>in</strong>tegrity,transparency <strong>in</strong> <strong>the</strong>ir methodologies and conclusions, and accountability for errors andtransgressions.3


Committee For A Constructive Tomorrow • 1875 Eye Street NW • 5th Floor • Wash<strong>in</strong>g<strong>to</strong>n, DC 20006Cap-tax-and-trade and endangermentUnder cap-tax-and-trade, Congress would place a limit or “cap” on <strong>the</strong> amount of carbon dioxidethat power plants, cars, fac<strong>to</strong>ries, ref<strong>in</strong>eries, shopp<strong>in</strong>g malls, hospitals and o<strong>the</strong>r facilities wouldbe allowed <strong>to</strong> emit. Utilities, companies and bus<strong>in</strong>esses would be issued or sold permits thatstipulate how much carbon dioxide <strong>the</strong>y can put <strong>in</strong> <strong>the</strong> air. The limits would decrease drasticallyover time, driv<strong>in</strong>g <strong>the</strong> cost of hydrocarbon energy higher and higher. Facilities that canno<strong>to</strong>perate with<strong>in</strong> <strong>the</strong> steadily tighten<strong>in</strong>g CO2 emission limits would have <strong>to</strong> switch <strong>to</strong> w<strong>in</strong>d, solar orgeo<strong>the</strong>rmal energy, f<strong>in</strong>d ways <strong>to</strong> capture and s<strong>to</strong>re <strong>the</strong> carbon dioxide, or buy or trade more“allowances” from companies that don’t need as much energy.The Waxman-Markey cap-tax-and-trade bill, narrowly passed by <strong>the</strong> House of Representatives,requires that carbon dioxide emissions be reduced 83% below 2005 levels by 2050. The last timeour nation’s CO2 emissions were that low was 1908! Once <strong>the</strong> population levels andmanufactur<strong>in</strong>g, transportation and electrification systems of that era are taken <strong>in</strong><strong>to</strong> account, an83% reduction would have <strong>to</strong> equal what <strong>the</strong> United States emitted just after <strong>the</strong> Civil War!Gett<strong>in</strong>g <strong>the</strong>re would not be easy. 3“Cap-and-trade is a tax,” Congressman John D<strong>in</strong>gell(D-MI) has noted, “and it’s go<strong>in</strong>g <strong>to</strong> be a great bigone.” It is “<strong>the</strong> most significant revenue-generat<strong>in</strong>gproposal of our time,” says Sena<strong>to</strong>r Ben Card<strong>in</strong> (D-MD). Under cap-and-trade, “electricity rates wouldnecessarily skyrocket,” President Obama has said.“Industry will have <strong>to</strong> retrofit its operations. That will“The last time our nation’sCO2 emissions were 83%below 2005 levels was 1908!”cost money, and <strong>the</strong>y will pass that cost on <strong>to</strong> consumers” <strong>in</strong> every sec<strong>to</strong>r of society, <strong>the</strong> Presidentexpla<strong>in</strong>ed.The soar<strong>in</strong>g cost of energy will affect <strong>the</strong> cost of food, heat<strong>in</strong>g, cool<strong>in</strong>g, transportation,manufactur<strong>in</strong>g and everyth<strong>in</strong>g else we do. It will hurt poor and middle class families and smallbus<strong>in</strong>esses <strong>the</strong> most. Because <strong>the</strong> system would be <strong>in</strong>credibly complex, cap-tax-and-trade wouldbe adm<strong>in</strong>istered by profit-seek<strong>in</strong>g carbon management and trad<strong>in</strong>g firms, and regulated bythousands of government bureaucrats.Not surpris<strong>in</strong>gly, cap-tax-and-trade is highly controversial, especially dur<strong>in</strong>g a recession. Anequally complex US Senate proposal is bogged down <strong>in</strong> that chamber. However, <strong>the</strong> ObamaAdm<strong>in</strong>istration rema<strong>in</strong>s committed <strong>to</strong> implement<strong>in</strong>g a climate change and renewable energyprogram.Thus <strong>the</strong> Environmental Protection Agency has officially declared that carbon dioxide and o<strong>the</strong>rgreenhouse gases “endanger human health and welfare.” EPA Adm<strong>in</strong>istra<strong>to</strong>r Lisa Jackson <strong>in</strong>siststhat <strong>the</strong> science beh<strong>in</strong>d her emerg<strong>in</strong>g climate regulations “is settled, and human activity isresponsible for global warm<strong>in</strong>g.” She says <strong>the</strong> agency has employed “<strong>the</strong> best available science”<strong>in</strong> reach<strong>in</strong>g its determ<strong>in</strong>ation. 4However, literally thousands of clima<strong>to</strong>logists and o<strong>the</strong>r scientists dispute Jackson’s claim,po<strong>in</strong>t<strong>in</strong>g <strong>to</strong> extensive evidence that <strong>the</strong> sun and o<strong>the</strong>r natural forces control Earth’s complex,4

Even Dr. Phil Jones has admitted <strong>to</strong> <strong>the</strong> BBC that <strong>the</strong>re has been no statisticallysignificant global warm<strong>in</strong>g s<strong>in</strong>ce 1995, despite steadily <strong>in</strong>creas<strong>in</strong>g atmospheric carbon dioxidelevels, and <strong>the</strong>re is “no consensus” among scientists about climate change causes and effects. It isJones’s Climate Research Unit that provides <strong>the</strong> temperature data and many of <strong>the</strong> computergeneratedclimate disaster scenarios that underp<strong>in</strong> both <strong>the</strong> EPA decision and <strong>the</strong> UNIntergovernmental Panel on Climate Change <strong>report</strong>s on which EPA relies.Jackson <strong>in</strong>sists that nei<strong>the</strong>r Jones’s admissions, <strong>the</strong>views of <strong>the</strong>se dissent<strong>in</strong>g scientists, <strong>the</strong> scandal over“Climategate” emails, nor refutations of <strong>the</strong> sciencebeh<strong>in</strong>d “flagship” IPCC disaster claims affect herdecision. The new <strong>in</strong><strong>format</strong>ion “doesn’t lead <strong>to</strong> anydifferent conclusion than what we reached <strong>in</strong> <strong>the</strong>Endangerment F<strong>in</strong>d<strong>in</strong>g. And that is that climate ischang<strong>in</strong>g and that mank<strong>in</strong>d is responsible <strong>in</strong> part for thatchange and that we need <strong>to</strong> move aggressively,” she<strong>in</strong>sists. “We need <strong>to</strong> move clean energy legislation. Weneed <strong>to</strong> move <strong>to</strong> address<strong>in</strong>g carbon and putt<strong>in</strong>g a priceon carbon emissions.” 5Therefore, <strong>in</strong> <strong>the</strong> absence of legislation, her agency is act<strong>in</strong>g rapidly, <strong>to</strong> issue strict emissionstandards on mo<strong>to</strong>r vehicles and stationary sources via regulation. EPA’s “endangerment” rul<strong>in</strong>gallows <strong>the</strong> agency <strong>to</strong> use <strong>the</strong> Clean Air Act <strong>to</strong> require emitters of as little as 250 <strong>to</strong>ns per year(tpy) of carbon dioxide <strong>to</strong> <strong>in</strong>stall new technologies or o<strong>the</strong>rwise curb <strong>the</strong>ir emissions, beg<strong>in</strong>n<strong>in</strong>g<strong>in</strong> 2012. However, <strong>the</strong> agency says it will limit its permit requirements, and <strong>the</strong>ir severe impactson <strong>the</strong> economy and jobs, at least <strong>in</strong>itially.It <strong>in</strong>tends <strong>to</strong> issue greenhouse gas emission standards for Model Year 2012-2016 mo<strong>to</strong>r vehiclesby April 2010. It will wait until shortly after <strong>the</strong> 2010 elections <strong>to</strong> impose GHG rules onstationary sources. It will <strong>the</strong>n “tailor” its greenhouse gas rul<strong>in</strong>g, at least <strong>in</strong>itially, limit<strong>in</strong>g it <strong>to</strong>sources emitt<strong>in</strong>g more than 25,000 <strong>to</strong>ns per year – which means primarily power plants,fac<strong>to</strong>ries, ref<strong>in</strong>eries, steel mills and cement makers.EPA plans <strong>to</strong> regulate “no” facilities <strong>in</strong> 2010, and “fewer than 400” dur<strong>in</strong>g <strong>the</strong> first half of 2011.It “does not <strong>in</strong>tend <strong>to</strong> subject <strong>the</strong> smallest sources <strong>to</strong> Clean Air Act permitt<strong>in</strong>g” and strictendangerment regulations for greenhouse gas emissions “any sooner than 2016.” EPA is also“closely follow<strong>in</strong>g” efforts <strong>to</strong> make “carbon capture and s<strong>to</strong>rage” and o<strong>the</strong>r technologies“commercially available” for coal-fired power plants, so that it can raise <strong>the</strong> bar for BestAvailable Control Technology (BACT) on <strong>the</strong> plants, and make its use a condition for issu<strong>in</strong>g orrenew<strong>in</strong>g permits <strong>to</strong> operate <strong>in</strong> <strong>the</strong> future. 6However, <strong>the</strong> Clean Air Act stipulates that EPA must set 250 tpy as <strong>the</strong> threshold for “dangerous”pollutants. Some legal experts say this new “tailor<strong>in</strong>g rule” improperly rewrites <strong>the</strong> Clean Air Actand question <strong>the</strong> agency’s authority <strong>to</strong> set arbitrarily higher limits for carbon dioxide. The higherlimitations may thus be challenged <strong>in</strong> court by activist groups that want all emitters covered, so5


Committee For A Constructive Tomorrow • 1875 Eye Street NW • 5th Floor • Wash<strong>in</strong>g<strong>to</strong>n, DC 20006as <strong>to</strong> delay energy projects, drive hydrocarbon energy prices even higher, and restrict economicgrowth. 7Thus, despite slight delays <strong>in</strong> implementation, <strong>the</strong> rules will have a profound chill<strong>in</strong>g effect oncorporate <strong>in</strong>vestment and hir<strong>in</strong>g. Inves<strong>to</strong>rs and bus<strong>in</strong>esses will not know until 2011 or 2016 howdraconian <strong>the</strong> rules will be, how bus<strong>in</strong>esses will be impacted, or even which <strong>in</strong>dustries,companies, farms and facilities will be most severely affected. They do know, however, thatmore str<strong>in</strong>gent standards will soon be imposed – saddl<strong>in</strong>g US <strong>in</strong>dustries and power genera<strong>to</strong>rswith costs not faced by Ch<strong>in</strong>ese, Indian and o<strong>the</strong>r overseas competi<strong>to</strong>rs; driv<strong>in</strong>g jobs andbus<strong>in</strong>esses out of <strong>the</strong> United States; and add<strong>in</strong>gsignificant additional costs <strong>to</strong> everyth<strong>in</strong>g Americansdrive, make, eat, ship and do. Cap-tax-and-trade woulddo likewise but, say some, could at least be subject <strong>to</strong>some debate and f<strong>in</strong>e-tun<strong>in</strong>g <strong>in</strong> Congress.The National Association of Manufacturers po<strong>in</strong>ts outthat nei<strong>the</strong>r <strong>the</strong> EPA action nor cap-tax-and-tradelegislation would noticeably combat climate change(even if carbon dioxide does drive climate change),because greenhouse emissions from develop<strong>in</strong>gcountries would cont<strong>in</strong>ue <strong>to</strong> <strong>in</strong>crease significantly. 8 Infact, us<strong>in</strong>g <strong>the</strong> IPCC’s own computer models, andassum<strong>in</strong>g that carbon dioxide is <strong>the</strong> primary cause of global warm<strong>in</strong>g, clima<strong>to</strong>logist “Chip”Knappenberger calculated that even an 83% reduction <strong>in</strong> US carbon dioxide emissions wouldresult <strong>in</strong> global temperatures ris<strong>in</strong>g a mere 0.1 degrees F less by 2050 than not cutt<strong>in</strong>g America’sCO2 emissions at all! 9“EPA’s endangerment ruleswould cost a cumulative11.4 million <strong>in</strong> lost Blackand Hispanic jobs by 2030,and <strong>in</strong>crease Black andHispanic families’ energyburden by one-third.”Even if Virg<strong>in</strong>ia elim<strong>in</strong>ated all of its CO2 emissions, at an obviously disastrous cost <strong>to</strong> itseconomy, Ch<strong>in</strong>a’s emissions growth alone would replace all of Virg<strong>in</strong>ia’s <strong>in</strong> just 77 days. 10Replac<strong>in</strong>g even a 100% reduction <strong>in</strong> Wiscons<strong>in</strong>’s carbon dioxide emissions would take roughly<strong>the</strong> same amount of time.The 60 Plus Association stated that <strong>the</strong> EPA decision “would trigger a grow<strong>in</strong>g cascade ofregulations on virtually all sources” of greenhouse gases. “There is clear and substantialscientific, medical and economic evidence that regulations contemplated by EPA wouldadversely affect <strong>the</strong> cost and availability of energy, and thus family <strong>in</strong>comes and access <strong>to</strong> jobs,life and health <strong>in</strong>surance, food, modern liv<strong>in</strong>g standards, and o<strong>the</strong>r components of human healthand welfare,” it argued <strong>in</strong> comments <strong>to</strong> EPA. “Poor, m<strong>in</strong>ority and elderly families would beimpacted most severely of all.” 11Texas, Virg<strong>in</strong>ia and several <strong>in</strong>dustry trade groups have filed lawsuits challeng<strong>in</strong>g <strong>the</strong> EPAdecision and <strong>the</strong> scientific basis for its f<strong>in</strong>d<strong>in</strong>g that carbon dioxide emissions endanger humanhealth and welfare. O<strong>the</strong>r litigation is likely <strong>to</strong> follow, because global warm<strong>in</strong>g regulations,permitt<strong>in</strong>g processes and restrictions on emissions will severely impact manufactur<strong>in</strong>g,transportation, employment, economies, revenues and families, especially poor and m<strong>in</strong>orityfamilies, especially <strong>in</strong> states like Wiscons<strong>in</strong> that rely heavily on oil, coal and natural gas.6


Committee For A Constructive Tomorrow • 1875 Eye Street NW • 5th Floor • Wash<strong>in</strong>g<strong>to</strong>n, DC 20006An extensive study commissioned by <strong>the</strong> Affordable Power Alliance concluded that <strong>the</strong> EPAemission rules will act as “discrim<strong>in</strong>a<strong>to</strong>ry tax based on race, with disproportionately heavyimpacts on African Americans and Hispanics.” The study calculated that <strong>the</strong> Agency’sregulations would cost 430,000 Black and Hispanic jobs by 2015, and a cumulative 11.4 millionlost jobs by 2030; <strong>in</strong>crease poverty rates for <strong>the</strong>se m<strong>in</strong>ority groups by one-fifth; decrease <strong>the</strong>ircumulative household <strong>in</strong>comes by $13,000 <strong>to</strong> $15,000 between 2012 and 2035; and <strong>in</strong>creaseBlack and Hispanic families’ “energy burden” by one-third by 2030. 12 These are potentiallydevastat<strong>in</strong>g consequences for many families and communities.The fundamental issue is not whe<strong>the</strong>r “climate ischang<strong>in</strong>g” or whe<strong>the</strong>r “mank<strong>in</strong>d is responsible<strong>in</strong> part for that change.” Earth’s climate isalways chang<strong>in</strong>g. It warmed, <strong>the</strong>n cooled, <strong>the</strong>nwarmed aga<strong>in</strong> between 1900 and 2000 – even asatmospheric carbon dioxide levels cont<strong>in</strong>ued <strong>to</strong>rise – and temperatures have been stable andeven cool<strong>in</strong>g slightly s<strong>in</strong>ce 1995. Our planet hasexperienced ice ages, a global Medieval WarmPeriod, a Little Ice Age, <strong>the</strong> Dust Bowl ando<strong>the</strong>r droughts, major floods, and cyclicalperiods of frequent and <strong>in</strong>tense hurricanes and<strong>to</strong>rnadoes. There is little doubt that humans and urban centers affect local temperature andclimate; <strong>the</strong>y may even exert some <strong>in</strong>fluence on <strong>the</strong> complex, turbulent, unpredictable worldclimate that is driven primarily by powerful natural forces.The fundamental issue is whe<strong>the</strong>r humans are caus<strong>in</strong>g imm<strong>in</strong>ent and global climate changedisasters – and whe<strong>the</strong>r mov<strong>in</strong>g “aggressively,” <strong>in</strong>creas<strong>in</strong>g <strong>the</strong> price of carbon emissions, anddramatically curtail<strong>in</strong>g hydrocarbon use will “control Earth’s <strong>the</strong>rmostat” and prevent futureclimate changes and disasters.However, <strong>the</strong>re is no consensus <strong>in</strong> <strong>the</strong> scientific community that humans, carbon dioxide andmethane are <strong>the</strong> primary forces driv<strong>in</strong>g climate change; that any forthcom<strong>in</strong>g climate change willbe disastrous; or that significant human-caused changes are imm<strong>in</strong>ent on a regional or globalscale.The burden of prov<strong>in</strong>g this is on <strong>the</strong> EPA, IPCC, politicians and o<strong>the</strong>rs who urge draconianrestrictions on our fossil fuel energy use. Assertions, computer models and seriously flawedIPCC <strong>report</strong>s do not meet that burden. Nor do <strong>the</strong>y address a fundamental question fac<strong>in</strong>gWiscons<strong>in</strong> and <strong>the</strong> United States:What happens if coal and o<strong>the</strong>r fossil fuels are regulated or priced out of <strong>the</strong> picture? Whathappens <strong>to</strong> manufactur<strong>in</strong>g, transportation, agriculture, jobs, liv<strong>in</strong>g standards, civil rights,environmental justice, and all <strong>the</strong> o<strong>the</strong>r benefits that hydrocarbons bes<strong>to</strong>w upon us?7

But few citizens, even <strong>in</strong> Wiscons<strong>in</strong>, understand how significantly <strong>the</strong>ir lives trulydepend on hydrocarbons.Wiscons<strong>in</strong> relies on coal <strong>to</strong> generate 66% of itselectricity. Ano<strong>the</strong>r 10% comes from natural gas,19% via nuclear, and 3% from hydroelectric. Lessthan 2% is generated by w<strong>in</strong>d and solar power. 13As a result, Wiscons<strong>in</strong> consumers, manufacturers andbus<strong>in</strong>esses pay an average of 9 cents per kilowatthour, compared <strong>to</strong> 14 cents per kWh <strong>in</strong> CA, NY andNJ, which get less than 15% of <strong>the</strong>ir electricity fromcoal. It means companies can makeproducts and offer services <strong>in</strong> competition with foreign companies – and employ workers whosupport <strong>the</strong>ir families.It means Wiscons<strong>in</strong> citizens enjoy civil rights progress, justice and improved economicopportunity.This reliable, affordable, mostly coal-based electricity creates hundreds of thousands of highpay<strong>in</strong>gjobs, which provide health <strong>in</strong>surance, rent and mortgage money, nutrition, cloth<strong>in</strong>g,college tuition, vacation options and retirement benefits for countless families. Those companiesand <strong>the</strong>ir employees also pay <strong>the</strong> taxes that support federal, state and local governments andgovernment services. They also make contributions <strong>to</strong> numerous churches, synagogues andcharities.Because of Wiscons<strong>in</strong>’s talented, experienced workforce and access <strong>to</strong> affordable electricity, fuel,parts and raw materials, <strong>the</strong> state ranks among <strong>the</strong> <strong>to</strong>p five states <strong>in</strong> <strong>the</strong> percentage of its economybased on manufactur<strong>in</strong>g. In fact, one of every six Wiscons<strong>in</strong> workers is employed directly <strong>in</strong> itsmanufactur<strong>in</strong>g sec<strong>to</strong>r, which generates upwards of $45 billion annually, over 20% of <strong>the</strong> GrossState Product. Many of <strong>the</strong> state’s best pay<strong>in</strong>g service jobs also depend directly onmanufactur<strong>in</strong>g, much of it centered on local, privately owned firms. These few examples are just<strong>the</strong> tip of <strong>the</strong> proverbial iceberg <strong>in</strong> Wiscons<strong>in</strong>. 14Boats and mar<strong>in</strong>e equipment. Oldenburg Group Incorporated provides commercial light<strong>in</strong>gsystems; eng<strong>in</strong>eer<strong>in</strong>g and logistics services; rock drills, roof bolters and booms for <strong>the</strong> m<strong>in</strong><strong>in</strong>g<strong>in</strong>dustry; and cranes, cargo transfer systems, moor<strong>in</strong>g systems, unmanned underwater vehicles,modular causeways and o<strong>the</strong>r mar<strong>in</strong>e equipment for nuclear power plants, submar<strong>in</strong>es, surfaceships, and o<strong>the</strong>r defense and commercial programs. Every grocery, cloth<strong>in</strong>g and department s<strong>to</strong>re – from Kohl’s and Sears <strong>to</strong> Land’s End,Shopko and Menard’s – requires hydrocarbon-based fuel <strong>to</strong> build, heat and cool build<strong>in</strong>gs,manufacture and transport <strong>the</strong> products <strong>the</strong>y sell, power computers, and operate warehouses andequipment.That means o<strong>the</strong>r companies must provide that energy. In Wiscons<strong>in</strong>, <strong>the</strong> bulk of <strong>the</strong> powercomes from companies like Alliant Energy, Integrys, Wiscons<strong>in</strong> Energy and Wiscons<strong>in</strong> PublicService, which provide electric, natural gas, hydroelectric and steam energy, transportation andaviation fuels, along with a dollop of w<strong>in</strong>d-based electricity, for millions of consumers. Theykeep <strong>the</strong> lights on, <strong>the</strong> mach<strong>in</strong>ery operat<strong>in</strong>g, <strong>the</strong> paychecks com<strong>in</strong>g and <strong>the</strong> economicopportunities grow<strong>in</strong>g throughout <strong>the</strong> state.Simply put, dependable, affordable energy is <strong>the</strong>backbone and lifeblood of an economy that<strong>in</strong>cludes thousands of family owned and publiclyheld companies, large and small, of everydescription. Noth<strong>in</strong>g runs, noth<strong>in</strong>g happens,without energy. And <strong>the</strong> products and services<strong>the</strong>se companies provide will not be so readilyavailable and affordable for so many families –and certa<strong>in</strong>ly will not be made <strong>in</strong> Wiscons<strong>in</strong> orAmerica – if energy prices are driven steadilyupward by policies that deliberately deny access <strong>to</strong>plentiful, reliable, affordable, mostly fossil fuelenergy.Dairy State farmers depend on oil and natural gas as fuels for vehicles, feeds<strong>to</strong>cks for fertilizers,and heat for build<strong>in</strong>gs and hot houses, <strong>to</strong> produce dairy products, beef, pork, eggs, honey, corn,cranberries, pota<strong>to</strong>es, vegetables and a host of o<strong>the</strong>r nutritious agricultural products for hungryconsumers all over America. Electricity and fuels enable bakeries and breweries <strong>to</strong> make a hos<strong>to</strong>f familiar products, produc<strong>in</strong>g and emitt<strong>in</strong>g prodigious amounts of carbon dioxide <strong>in</strong> <strong>the</strong>process. And thousands of smaller Wiscons<strong>in</strong> companies provide countless additional goods,services, jobs and revenues.Hydrocarbon fuels keep people warm (and alive) on freez<strong>in</strong>g nights, and comfortable dur<strong>in</strong>gsummer heat waves, like <strong>the</strong> 2003 scorcher that killed 15,000 elderly French citizens who didn’thave air-condition<strong>in</strong>g.Heat waves and heat-related deaths are not due <strong>to</strong> global warm<strong>in</strong>g. The tragic deaths result frompoor families be<strong>in</strong>g unable <strong>to</strong> afford air-condition<strong>in</strong>g, and from families and health officials10

Any actions that make energy less accessible, reliable oraffordable – especially <strong>in</strong> <strong>the</strong> absence of clear and conv<strong>in</strong>c<strong>in</strong>gproof that we face an imm<strong>in</strong>ent manmade climate crisis – areimmoral and must be rejected.Governments, corporations and foundations act immorally when<strong>the</strong>y fund only research that is designed <strong>to</strong> prove humans arecaus<strong>in</strong>g catastrophic climate change. Researchers act immorallywhen <strong>the</strong>y stigmatize, ignore or exclude contradic<strong>to</strong>ry researchthat po<strong>in</strong>ts <strong>to</strong> natural causes – or <strong>to</strong> only moderate temperature,wea<strong>the</strong>r and climate changes. The Congress, EPA, IPCC, NASAand o<strong>the</strong>r governmental bodies act immorally when <strong>the</strong>yadvance <strong>report</strong>s, disaster scenarios, laws and regulations that arebased on speculation, flimsy evidence, and computer models thatcannot even profile current climates accurately or replicate past climates, much less predictclimate changes five or fifty years <strong>in</strong> <strong>the</strong> future.Ethical, responsible scientific research seeks <strong>to</strong> determ<strong>in</strong>e what (human and natural) forces driveclimate cycles and changes, so that we can better forecast future changes. It seeks <strong>to</strong> assess howcommunities can adapt <strong>to</strong> those changes and develop <strong>the</strong> technologies that enable us <strong>to</strong> do so.Cap-tax-and-trade, endangerment, land and resource withdrawals, and similar governmentactions would hit already reel<strong>in</strong>g companies, employees and families hard. Poor people,m<strong>in</strong>orities and <strong>the</strong> elderly <strong>in</strong> developed nations would be particularly hard hit, for little or noenvironmental ga<strong>in</strong>. Poor families <strong>in</strong> <strong>the</strong> world’s most impoverished countries would facedevastat<strong>in</strong>g consequences, for <strong>the</strong>y would cont<strong>in</strong>ue <strong>to</strong> be denied access <strong>to</strong> technologies thatwould improve, enrich and safeguard <strong>the</strong>ir lives.The risks from global warm<strong>in</strong>g are at best highly speculative. But <strong>the</strong> risks from alarmist globalwarm<strong>in</strong>g policies are real, demonstrable, substantial, immediate and often fatal.The fundamental purpose of global warm<strong>in</strong>g legislation and regulation is <strong>to</strong> curtail greenhousegas emissions – by driv<strong>in</strong>g up <strong>the</strong> cost of hydrocarbon energy, mak<strong>in</strong>g it less accessible andaffordable, and controll<strong>in</strong>g manufactur<strong>in</strong>g, economic growth, liv<strong>in</strong>g standards, transportation andconsumption habits.13

Th<strong>in</strong>k about <strong>the</strong> role of energy <strong>in</strong> your life, <strong>the</strong> importance of affordable electricity foryour home and workplace, for local schools and hospitals, and for <strong>the</strong> most important employers<strong>in</strong> your region. Ponder how you would slash your carbon footpr<strong>in</strong>t 17% over <strong>the</strong> next ten years,and 83% over <strong>the</strong> next 40 years, under Waxman-Markey – and how all <strong>the</strong>se o<strong>the</strong>r energy userswill do likewise. It won’t be easy.Environmental or economic justice is supposed <strong>to</strong> be about creat<strong>in</strong>g jobs and improv<strong>in</strong>g <strong>the</strong>quality of life for poor and m<strong>in</strong>ority communities. But we cannot drive up energy costs andcurtail energy use, without adversely impact<strong>in</strong>g bus<strong>in</strong>esses,<strong>in</strong>dustries, jobs, families, opportunities, civil rights and <strong>the</strong>pursuit of ecological-social-economic justice.All Americans would feel <strong>in</strong>tense pa<strong>in</strong>, for littleenvironmental ga<strong>in</strong>, if <strong>the</strong>se bills and regulations become <strong>the</strong>law of <strong>the</strong> land. The restrictions would affect all citizens, buthit seniors, blue-collar workers, and poor and m<strong>in</strong>orityfamilies especially hard. They would transfer trillions ofdollars from energy users <strong>to</strong> f<strong>in</strong>ancial <strong>in</strong>stitutions and <strong>the</strong>government, and <strong>the</strong>n <strong>to</strong> <strong>in</strong>dustries, companies, organizationsand activities favored and chosen by <strong>the</strong> government.“Waxman-Markeywould add – not just$50 or $500 a year –but $1,500 <strong>to</strong> $3,000 <strong>to</strong><strong>the</strong> average family’sannual energy bill.”Poor and m<strong>in</strong>ority families may have global warm<strong>in</strong>g “on <strong>the</strong>ir radar screen.” However, a WilsonResearch Strategies poll of black Americans found that 76% are unwill<strong>in</strong>g <strong>to</strong> pay more than anadditional $50 per year for electricity, <strong>to</strong> reduce greenhouse gas emissions. 17 Analysts emphasizethat <strong>the</strong> actual impact would be much higher.Waxman-Markey would add – not just $50 or $500 a year – but $1,500 <strong>to</strong> $3,000 <strong>to</strong> <strong>the</strong> averagefamily’s annual energy bill. The legislation would raise energy costs by $350 billion <strong>to</strong> $400billion or more per year, accord<strong>in</strong>g <strong>to</strong> studies by <strong>the</strong> Brook<strong>in</strong>gs Institution, CRA International,Congressional Budget Office, Heritage Center for Data Analysis, Science ApplicationsInternational Corporation (SAIC) and o<strong>the</strong>r experts. It would also cost 1 million <strong>to</strong> 4 millionjobs, mostly <strong>in</strong> <strong>the</strong> manufactur<strong>in</strong>g sec<strong>to</strong>r, and raise electricity rates 90-130% and gasol<strong>in</strong>e prices60-140% after adjust<strong>in</strong>g for <strong>in</strong>flation, <strong>the</strong>se experts say. 18Farms, fac<strong>to</strong>ries, bus<strong>in</strong>esses, hospitals and schools would be hit with extra energy costs ten <strong>to</strong>fifty times this per-family amount – <strong>to</strong> power mach<strong>in</strong>ery, operate trac<strong>to</strong>rs and trucks; heat, lightand air condition offices, s<strong>to</strong>res and operat<strong>in</strong>g rooms; refrigerate foods and medic<strong>in</strong>es; transportraw materials and f<strong>in</strong>ished products; and support all <strong>the</strong> o<strong>the</strong>r operations that require affordable,reliable energy.Bus<strong>in</strong>esses would have little choice but <strong>to</strong> pass those costs on <strong>to</strong> consumers. That means <strong>the</strong>average family would have <strong>to</strong> pay a cumulative additional $4,000 or more every year <strong>in</strong> higherheat<strong>in</strong>g, cool<strong>in</strong>g, cook<strong>in</strong>g, transportation, food, cloth<strong>in</strong>g, school, medical and o<strong>the</strong>r expenses,analysts say.14

That would meanhigher taxes – or reduced music, sports, language and special education programs.Hospitals would have <strong>to</strong> charge more for diagnostics, treatments, surgeries and rehabilitation.Churches and charities would see contributions plummet, just as more jobless families seek foodand assistance.Food stamp and unemployment compensation programs serve millions who are downtrodden orout of work. Cap-tax-and-trade and endangerment programs would drive up energy costs, createuncerta<strong>in</strong>ty for <strong>in</strong>ves<strong>to</strong>rs and employers, and postpone <strong>the</strong> day when unemployed workers havenew jobs. They would mean thousands more workers will lose <strong>the</strong>ir jobs, <strong>the</strong>reby expand<strong>in</strong>gwelfare rolls and <strong>in</strong>creas<strong>in</strong>g <strong>the</strong> cost of government, while reduc<strong>in</strong>g state and federal taxrevenues. States, communities, churches and charities will be far less able <strong>to</strong> help people, if <strong>the</strong>irrevenues and budgets contract fur<strong>the</strong>r.The average household spends 5% of its budget on fuel. But families at <strong>the</strong> bot<strong>to</strong>m of <strong>the</strong>economic scale “spend half or more of <strong>the</strong>ir <strong>in</strong>comes on gasol<strong>in</strong>e, heat<strong>in</strong>g and cool<strong>in</strong>g,” notesBishop Harry Jackson, Jr., pas<strong>to</strong>r of Hope Christian Church <strong>in</strong> Maryland. Poor families also havelonger commutes <strong>to</strong> work, and will be especially hard hit by <strong>the</strong> $1-per-gallon gas tax <strong>in</strong>creasethat cap-tax-and-trade would br<strong>in</strong>g.Difficult economic times and steadily ris<strong>in</strong>gglobal oil prices are send<strong>in</strong>g costs even higher.A 2010 study found that families earn<strong>in</strong>g lessthan $10,000 annually spend 69% of <strong>the</strong>ir<strong>in</strong>come on energy! Families earn<strong>in</strong>g less than$50,000 – <strong>the</strong> majority of all Americanhouseholds – must spend an average of 19% of<strong>the</strong>ir after-tax <strong>in</strong>come on heat<strong>in</strong>g, cook<strong>in</strong>g andtransportation. 19M<strong>in</strong>ority-owned firms are disproportionatelynew and small – and startup companies faceespecially large obstacles. They typically havefew employees and limited experience navigat<strong>in</strong>g complex state and federal regula<strong>to</strong>ry systems.Cap-and-trade and endangerment rules would create a much more massive, <strong>in</strong>trusive, expensiveregula<strong>to</strong>ry system than <strong>the</strong>y already confront.Many Wiscons<strong>in</strong> communities depend on <strong>to</strong>urism as ma<strong>in</strong>stays of <strong>the</strong>ir economies, andenvironmental groups have long argued that states should replace m<strong>in</strong><strong>in</strong>g, oil, timber and evenranch<strong>in</strong>g with <strong>to</strong>urism. Tourism, <strong>the</strong>y argue, is “eco-friendly and susta<strong>in</strong>able.” Global warm<strong>in</strong>g,15

These assertionshave no basis <strong>in</strong> fact.I grew up <strong>in</strong> Wiscons<strong>in</strong>, attended college <strong>in</strong> Apple<strong>to</strong>n, and spent a decade <strong>in</strong> Colorado, Wyom<strong>in</strong>gand o<strong>the</strong>r Western states. Cycles of snow and drought are common. I skied out West dur<strong>in</strong>gw<strong>in</strong>ters when plows had <strong>to</strong> clear deep snow from under ski lifts, and o<strong>the</strong>rs when I rounded abend <strong>to</strong> f<strong>in</strong>d noth<strong>in</strong>g but rocks ahead of my <strong>to</strong>ur<strong>in</strong>g skis. I remember <strong>the</strong> 1975 Time andNewsweek s<strong>to</strong>ries cit<strong>in</strong>g <strong>the</strong> “unassailable evidence” and “near-unanimous consensus” that globaltemperatures were fall<strong>in</strong>g, due <strong>to</strong> fossil fuel emissions, and <strong>the</strong> world faced a potential new LittleIce Age.Tourism requires plentiful, affordable energy – forcars, tra<strong>in</strong>s, buses, boats, airplanes and hotels. Andthat requires tak<strong>in</strong>g resources out of <strong>the</strong> ground:extractive <strong>in</strong>dustries. It also requires a populationthat can afford <strong>to</strong> take vacations far from home.Prohibit drill<strong>in</strong>g and m<strong>in</strong><strong>in</strong>g, hike energy taxes,destroy jobs, squeeze family budgets, boost travelcosts – and millions will have no choice but <strong>to</strong> stayhome. Send energy and operat<strong>in</strong>g costs upward, andmany hotels, resorts and restaurants will face thoseadditional problems, as well, and will be forced <strong>to</strong>raise rates, lay people off or close <strong>the</strong>ir doors.“In 2010, <strong>the</strong> energy-switch<strong>in</strong>gcompany uSwitch calculatedthat British household gas andelectricity bills will rocketfrom $1,620 annually <strong>in</strong> 2005<strong>to</strong> $8,110 by 2020.”Indoor pools, slides, spas and o<strong>the</strong>r facilities now make vibrant <strong>to</strong>urism a year-round <strong>in</strong>dustry,susta<strong>in</strong><strong>in</strong>g jobs and local economies throughout long, frigid Wiscons<strong>in</strong> w<strong>in</strong>ters, attract<strong>in</strong>gfamilies and mak<strong>in</strong>g resorts like <strong>the</strong> Chula Vista Resort <strong>in</strong> Wiscons<strong>in</strong> Dells wonderful jump<strong>in</strong>goffpo<strong>in</strong>ts for cross country ski<strong>in</strong>g, snowmobil<strong>in</strong>g and o<strong>the</strong>r activities. However, year-roundoperations also mean higher energy costs, and electricity and natural gas already represent up <strong>to</strong>10% of <strong>the</strong>ir gross annual revenue.Send<strong>in</strong>g energy costs steadily upward, as cap-tax-and-trade and endangerment rules seek <strong>to</strong> do,would hammer bot<strong>to</strong>m l<strong>in</strong>es and force <strong>the</strong> reduction or cessation of many w<strong>in</strong>ter and o<strong>the</strong>ractivities. Significant layoffs <strong>in</strong> resorts, restaurants and o<strong>the</strong>r local bus<strong>in</strong>esses would severelyaffect <strong>the</strong>se communities, and <strong>the</strong>ir significant capital <strong>in</strong>vestments and leverag<strong>in</strong>g could threaten<strong>the</strong> viability of many operations.Moreover, some environmental groups are now target<strong>in</strong>g air travel and <strong>to</strong>urism, becauseairplanes and cars emit greenhouse gases. They don’t want people travel<strong>in</strong>g – except, it seems, <strong>to</strong>climate change meet<strong>in</strong>gs <strong>in</strong> Montreal, Bali, Rio and Copenhagen.In <strong>the</strong> United K<strong>in</strong>gdom, punitive climate taxes, <strong>the</strong> closure of coal-fired power plants, and forcedreliance on “green” energy have already sent energy prices soar<strong>in</strong>g and put 5.5 millionhouseholds <strong>in</strong> “fuel poverty.” The National Hous<strong>in</strong>g Federation <strong>report</strong>ed that average annualenergy bills climbed from $1,620 <strong>in</strong> 2005 <strong>to</strong> a predicted $2,250 by <strong>the</strong> end of 2009. People havebeen “shocked” by <strong>the</strong> enormity of <strong>the</strong>ir heat<strong>in</strong>g bills, and anger is ris<strong>in</strong>g over “<strong>in</strong>sidious stealth16


Committee For A Constructive Tomorrow • 1875 Eye Street NW • 5th Floor • Wash<strong>in</strong>g<strong>to</strong>n, DC 20006taxes” that are hammer<strong>in</strong>g households at a time of ris<strong>in</strong>g unemployment, fall<strong>in</strong>g <strong>in</strong>comes andeconomic uncerta<strong>in</strong>ty, said <strong>the</strong> Daily Mail. 20In 2009, UK utility regula<strong>to</strong>r Ofgem predicted that average household gas and electricity pricescould double <strong>to</strong> $3,245 (£2,000) between 2005 and 2020, <strong>to</strong> pay for new nuclear, w<strong>in</strong>d and wavepower. By January 2010 it admitted that it had“severely underestimated” <strong>the</strong> cost of cutt<strong>in</strong>gcarbon emissions, and <strong>the</strong> energy-switch<strong>in</strong>gcompany uSwitch calculated that household billswill rocket <strong>to</strong> $8,110 (£5,000) by 2020. Cashstrappedpensioners are already burn<strong>in</strong>g hardbackbooks <strong>to</strong> stay warm, because <strong>the</strong>y cost far lessthan “carbon-priced” coal used <strong>in</strong> small homeheaters. Energy-<strong>in</strong>tensive <strong>in</strong>dustries expect <strong>the</strong>ircosts <strong>to</strong> rise even more dramatically. 21In Oc<strong>to</strong>ber 2009, Brita<strong>in</strong>’s TaxPayers’ Allianceconcluded that <strong>the</strong> European Union EmissionsTrad<strong>in</strong>g Scheme cost British and Europeanconsumers over $100 billion between January 2005 and December 2008. Consumers suffered,while energy and f<strong>in</strong>ancial companies made w<strong>in</strong>dfall profits, <strong>the</strong> TPA says.Large swa<strong>the</strong>s of “badly <strong>in</strong>sulated, ugly” 1960s and 70s era commercial build<strong>in</strong>gs <strong>in</strong> UK citiesmay soon be demolished, <strong>to</strong> meet new carbon emission standards. That means more unnecessarydemolition and construction, <strong>to</strong> meet what British citizens <strong>in</strong>creas<strong>in</strong>gly see as unnecessarycarbon reduction mandates. 22Worst of all, accord<strong>in</strong>g <strong>to</strong> <strong>the</strong> National Hous<strong>in</strong>g Federation, 25,000 more people died dur<strong>in</strong>g <strong>the</strong>2007-2008 w<strong>in</strong>ter than dur<strong>in</strong>g <strong>the</strong> summer. Most were elderly people, who had circula<strong>to</strong>ry orrespira<strong>to</strong>ry problems, and couldn’t afford adequate heat. 23 The lethal cycle is be<strong>in</strong>g repeatedaga<strong>in</strong> this year.No wonder British citizens have become less worried about global warm<strong>in</strong>g than about policiesimplemented <strong>in</strong> <strong>the</strong> name of prevent<strong>in</strong>g planetary warm<strong>in</strong>g, especially as Climategate unfoldsand <strong>the</strong> case for human-caused warm<strong>in</strong>g disasters grows weaker almost by <strong>the</strong> week.Cap-tax-and-trade and endangerment schemes would subject nearly every aspect of Americanenergy, economics, life and society <strong>to</strong> government review and control. “Every aspect of our livesmust be subjected <strong>to</strong> an <strong>in</strong>ven<strong>to</strong>ry of how we are tak<strong>in</strong>g responsibility” for reduc<strong>in</strong>g carbonemissions, House Speaker Nancy Pelosi <strong>to</strong>ld students at Beij<strong>in</strong>g University <strong>in</strong> June 2009.The <strong>in</strong>ven<strong>to</strong>ry, review and control programs would be expensive, regressive, pervasive, <strong>in</strong>trusive,abusive and punitive. They would destroy jobs and force companies <strong>to</strong> close <strong>the</strong>ir doors. Theywould restrict freedom and free enterprise, and let government determ<strong>in</strong>e how much energy wecan use, how warm or cool we can keep our homes, what k<strong>in</strong>d of car we can own and how far wecan drive it. They would hamper, ra<strong>the</strong>r than advance, opportunity, civil rights and environmentaljustice.17

Anumber of mills have already closed, and thousands of jobs have been lost, due <strong>to</strong> high taxes, adepressed national and world economy, global supply-demand imbalances, and <strong>in</strong>tensecompetition from foreign companies that have newer equipment and are not obligated <strong>to</strong> operateunder <strong>the</strong> same regulations and threats of CO2 emissionrestrictions and taxes that face <strong>the</strong> state’s paper mills.The situation is precarious for many of Wiscons<strong>in</strong>’srema<strong>in</strong><strong>in</strong>g mills. Over 160 years of paper-mak<strong>in</strong>gexcellence is on <strong>the</strong> l<strong>in</strong>e. The companies and <strong>the</strong>ir<strong>in</strong>ves<strong>to</strong>rs and employees would be severely affected byany scheme <strong>to</strong> slash carbon dioxide emissions and raiseenergy prices, especially if it is done at <strong>the</strong> state level orby Executive Branch fiat. Forc<strong>in</strong>g <strong>the</strong>se companies <strong>to</strong>spend what limited capital <strong>the</strong>y still have, <strong>to</strong> pay forsoar<strong>in</strong>g energy costs and carbon reduction mandates,could be <strong>the</strong> death knell for many.Every Wiscons<strong>in</strong> company and <strong>in</strong>dustry is at risk from <strong>to</strong>day’s energy and climate policies.Renewable energy myths and realities“An ICF Internationalstudy concluded thatdevelop<strong>in</strong>g all US oil andgas resources on federallands could generate morethan $4 trillion <strong>in</strong> bonuses,rents, royalties and taxes.”The extensive benefits that fossil fuels br<strong>in</strong>g <strong>to</strong> Wiscons<strong>in</strong> make it easier <strong>to</strong> understand howAmerica’s oil and natural gas <strong>in</strong>dustries susta<strong>in</strong> 9 million direct and <strong>in</strong>direct American jobs, andcontribute well over $1 trillion <strong>to</strong> <strong>the</strong> US economy, and how coal generates similar economic andsocial well-be<strong>in</strong>g. 24One can only imag<strong>in</strong>e <strong>the</strong> economic, employment, social and environmental justice benefits wewould receive, if state and federal governments allowed greater development of <strong>the</strong> vast energyresources that still lie untapped right here <strong>in</strong> <strong>the</strong> United States. Instead of send<strong>in</strong>g $350 billion ormore a year <strong>to</strong> foreign countries, petroleumconsumers would be <strong>in</strong>vest<strong>in</strong>g those funds <strong>in</strong>Wiscons<strong>in</strong> and America. Instead of runn<strong>in</strong>g deficits– <strong>in</strong>stead of hav<strong>in</strong>g <strong>to</strong> cut government services,school sports and music programs, aid <strong>to</strong> localities,and fund<strong>in</strong>g for transportation and roads – <strong>the</strong>recould be revenue surpluses.Accord<strong>in</strong>g <strong>to</strong> a 2008 Department of <strong>the</strong> Interior<strong>in</strong>ven<strong>to</strong>ry of federal energy resources, 163 millionacres of US public lands are off limits <strong>to</strong> oil and gasleas<strong>in</strong>g. The land withdrawals make 62% of <strong>the</strong> oiland 41% of <strong>the</strong> natural gas <strong>in</strong> our nation’s onshore public lands unavailable. Ano<strong>the</strong>r 65 millionacres are severely restricted, affect<strong>in</strong>g an additional 30% of US onshore federal oil and 49% ofour gas. 2518


Committee For A Constructive Tomorrow • 1875 Eye Street NW • 5th Floor • Wash<strong>in</strong>g<strong>to</strong>n, DC 20006That means an area <strong>the</strong> size of Texas and Oklahoma, 92% of our onshore publicly owned oilpotential, 90% of our onshore natural gas prospects, and all <strong>the</strong> jobs, revenues and o<strong>the</strong>r benefitsassociated with develop<strong>in</strong>g those vital untapped resources are off limits <strong>to</strong> <strong>the</strong> American familiesthat own <strong>the</strong>m.Offshore <strong>the</strong> situation is similar. The vast majority of Alaskan and Lower 48 offshore publiclands and resources outside <strong>the</strong> Gulf of Mexico are unavailable for leas<strong>in</strong>g and drill<strong>in</strong>g, even offstates that are <strong>in</strong> dire need of jobs and revenues, and states like Virg<strong>in</strong>ia that actually supportdrill<strong>in</strong>g. Moreover, <strong>the</strong> offshore areas that rema<strong>in</strong> available <strong>in</strong> <strong>the</strong> Gulf are <strong>in</strong>creas<strong>in</strong>gly <strong>in</strong>extremely deep waters, where costs are exorbitant and only “monster” fields can be producedeconomically. 26Compound<strong>in</strong>g <strong>the</strong> problem, <strong>in</strong> early 2009, Secretary of <strong>the</strong> Interior Ken Salazar canceled 77 Utahoil and gas leases that had gone through seven years of studies, negotiations and land useplann<strong>in</strong>g. The canceled leases represented a third of a Utah land parcel estimated <strong>to</strong> conta<strong>in</strong>enough oil <strong>to</strong> fuel 3 million cars and enough natural gas <strong>to</strong> heat 14 million homes for 15 years.His rationale: drill<strong>in</strong>g rigs might be “visible” from national parks over a mile away. Globalwarm<strong>in</strong>g, not petroleum development, he declared,was <strong>to</strong> be <strong>the</strong> <strong>to</strong>p priority for every Department of<strong>the</strong> Interior agency. 27Secretary Salazar has also canceled lease sales andfur<strong>the</strong>r delayed new offshore drill<strong>in</strong>g plans that hadundergone years of environmental review. O<strong>the</strong>rplans would permanently foreclose access <strong>to</strong> over10 million acres of energy-rich lands <strong>in</strong> Westernstates, under <strong>the</strong> 1906 Antiquities Act – <strong>in</strong> somecases specifically <strong>to</strong> prevent energy development. 28These withdrawals impose huge economic impacts. An ICF International study calculated thatdevelop<strong>in</strong>g America’s off-limits oil and natural gas resources could generate more than $1.7trillion <strong>in</strong> government revenues, create thousands of new jobs, and enhance national security byoffsett<strong>in</strong>g nearly a fifth of <strong>the</strong> oil that <strong>the</strong> United States currently imports. Develop<strong>in</strong>g all US oiland gas resources on federal lands could generate more than $4 trillion <strong>in</strong> bonuses, rents,royalties and taxes, ICF concluded. 29The onshore and offshore energy impoundments also translate <strong>in</strong><strong>to</strong> grow<strong>in</strong>g oil and gas imports,as proven reserves cont<strong>in</strong>ue <strong>to</strong> be depleted and we fail <strong>to</strong> replace <strong>the</strong>m with new fields. TheUnited States now imports over half of its crude oil, at a cost of some $350 billion annually,tak<strong>in</strong>g from world markets oil that we could produce here <strong>in</strong> <strong>the</strong> USA. 30 Deny<strong>in</strong>g Americansaccess <strong>to</strong> our own energy, jobs and revenues, reflects <strong>the</strong> apparent (and ludicrous) assumptionsthat burn<strong>in</strong>g domestic oil and gas causes carbon dioxide emissions and global warm<strong>in</strong>g, butburn<strong>in</strong>g imported fuels does not – and that we can easily replace oil, gas and coal with w<strong>in</strong>d andsolar power, which currently provide 1% of our energy.The United States also has 600 coal-based electrical generat<strong>in</strong>g facilities, which produce nearlyhalf of all US electricity, and nearly 262 billion <strong>to</strong>ns of recoverable coal reserves (a 235-year19

Utiliz<strong>in</strong>g <strong>the</strong>se resources <strong>in</strong> new state-of-<strong>the</strong>-art, low-pollutionfacilities could produce 100 gigawatts of new generation capacity, 4 trillion cubic feet per day ofnatural gas, 2.5 million barrels of oil daily and 1.4 million new jobs – with a <strong>to</strong>tal net presentvalue of almost $3 trillion, accord<strong>in</strong>g <strong>to</strong> <strong>in</strong>dustry and government analysts. 31 But politicalenvironmentalis<strong>to</strong>pposition <strong>to</strong> coal m<strong>in</strong><strong>in</strong>g and coal-fired power plants is unrelent<strong>in</strong>g andmount<strong>in</strong>g, and cap-tax-and-trade rules would fur<strong>the</strong>r restrict <strong>the</strong>se options.America’s 104 nuclear power plants generate 20% of <strong>the</strong> nation’s electricity, while emitt<strong>in</strong>g nocarbon dioxide or pollutants. Three reac<strong>to</strong>rs at <strong>the</strong> Palo Verde Nuclear Power Station nearPhoenix, Arizona alone provide <strong>the</strong> equivalent of six Hoover Dams <strong>in</strong> electrical power, from lessthan 140 acres of facilities on a 4,000-acre site, utiliz<strong>in</strong>g city wastewater <strong>to</strong> cool <strong>the</strong> reac<strong>to</strong>rs. 32But US uranium deposits are largely off limits, work on <strong>the</strong> Yucca Mounta<strong>in</strong> nuclear wastereposi<strong>to</strong>ry has been shut down, and regula<strong>to</strong>ry uncerta<strong>in</strong>ty makes it unlikely that America willbuild new nuclear power plants anytime soon.In <strong>the</strong> ideological struggle over America’s energy future, safety and pollution control recordsmean little. • • •S<strong>in</strong>ce 1970, unhealthy power plant pollutants have plummeted 95% per unit of energyproduced. Total US particulate emissions (soot) decreased 90% below 1970 levels, evenas coal use tripled, and new technologies and regulations will nearly elim<strong>in</strong>ate most coalrelatedpollution by 2020. 33Cars <strong>to</strong>o are some 95% cleaner than <strong>in</strong> 1970, mean<strong>in</strong>g tailpipe emissions have plungedthat far. 34As a result of technological and regula<strong>to</strong>ryimprovements s<strong>in</strong>ce <strong>the</strong> <strong>in</strong>famous 1969Santa Barbara oil spill, offshoreoperations spill an average of only 3,778barrels of oil per year – out of 14 billionbarrels pumped from <strong>the</strong> OuterCont<strong>in</strong>ental Shelf s<strong>in</strong>ce 1980. That’s a99.999% safety record. By contrast,Mo<strong>the</strong>r Nature oozes 620,000 barrels ofoil <strong>in</strong><strong>to</strong> America’s OCS waters every year,from cracks <strong>in</strong> <strong>the</strong> sea floor. 35 Hav<strong>in</strong>gexplored <strong>the</strong> magnificent artificial reefecosystems beneath a dozen oil and gas production platforms off <strong>the</strong> California andLouisiana coasts, <strong>in</strong> scuba gear, I have seen firsthand how <strong>the</strong>se structures actually<strong>in</strong>crease fish, shellfish and o<strong>the</strong>r mar<strong>in</strong>e populations.But <strong>in</strong> <strong>the</strong> battle <strong>to</strong> remove hydrocarbon fuels (and <strong>the</strong>ir benefits) from <strong>the</strong> world’s energy mix,<strong>the</strong>se facts are viewed as irrelevant. Politicians and environmentalists want <strong>to</strong> transformAmerica’s “brown” energy system <strong>in</strong><strong>to</strong> a “green” system, by penaliz<strong>in</strong>g hydrocarbon use andlegislat<strong>in</strong>g taxpayer subsidies for renewable energy, <strong>to</strong> harness <strong>the</strong> w<strong>in</strong>d and sun, via thousandsof w<strong>in</strong>d turb<strong>in</strong>es and solar arrays.20

The United States is blessed – not just with vast,untapped, largely off-limits s<strong>to</strong>rehouses of hydrocarbons and uranium – but with vast stretches ofw<strong>in</strong>d-swept pla<strong>in</strong>s and mounta<strong>in</strong> passes, sun-baked deserts, and enormous geo<strong>the</strong>rmal potential<strong>in</strong> <strong>the</strong> form of hot and super-heated rocks and water. They have excellent potential for generat<strong>in</strong>grenewable electricity – though go<strong>in</strong>g from 2% of US electricity <strong>to</strong>day <strong>to</strong> 20% or 50% anytimesoon is highly doubtful.It is much more likely that <strong>the</strong>se “alternative” energy resources will rema<strong>in</strong> “supplements” <strong>to</strong>conventional energy for decades <strong>to</strong> come, because many questions rema<strong>in</strong> regard<strong>in</strong>g how “ecofriendly”and “susta<strong>in</strong>able” <strong>the</strong>y are, how “free” and “affordable” <strong>the</strong>ir energy is, and how many“green jobs” <strong>the</strong>y will actually create.Citizens and legisla<strong>to</strong>rs must care<strong>full</strong>y weigh <strong>the</strong> prosand cons, costs and benefits of <strong>the</strong>se technologies, before<strong>in</strong>vest<strong>in</strong>g heavily <strong>in</strong> <strong>the</strong>m or discard<strong>in</strong>g <strong>the</strong> energy thatmakes our nation’s jobs and liv<strong>in</strong>g standards possible<strong>to</strong>day.Proposals <strong>to</strong> expand geo<strong>the</strong>rmal energy use are met withobjections that <strong>the</strong> best resources are located near naturalwonders like Lassen, Yellows<strong>to</strong>ne and Hawaii VolcanoesNational Parks. O<strong>the</strong>rs worry that deep-drill<strong>in</strong>g forgeo<strong>the</strong>rmal has caused small earthquakes <strong>in</strong> Californiaand Switzerland, or that it could result <strong>in</strong> groundwatercontam<strong>in</strong>ation or o<strong>the</strong>r problems. 36“Generat<strong>in</strong>g 20% of USelectricity with w<strong>in</strong>dwould require some186,000 turb<strong>in</strong>es,18,000,000 acres of land,and 270,000,000 <strong>to</strong>ns ofconcrete, steel, copper,fiberglass and rare earthm<strong>in</strong>erals.”Many object <strong>to</strong> w<strong>in</strong>d turb<strong>in</strong>es on <strong>the</strong> ground that <strong>the</strong>y kill birds and bats, and despoil scenicviews off Cape Cod or <strong>in</strong> mounta<strong>in</strong> and grassland areas. O<strong>the</strong>rs are concerned that cont<strong>in</strong>uousvibration and puls<strong>in</strong>g, low-frequency noise from <strong>the</strong> turb<strong>in</strong>es causes irritability, headaches, sleepdeprivation and o<strong>the</strong>r ill health effects. People also worry that health and ecological problemswill become much more pronounced if Congress mandates that <strong>the</strong> US must somehow produce20% of its electricity from w<strong>in</strong>d by 2020. 37Spa<strong>in</strong>’s multi-billion-dollar w<strong>in</strong>d energy program <strong>report</strong>edly created or saved 50,000 jobs.However, most <strong>in</strong>volved <strong>in</strong>stall<strong>in</strong>g w<strong>in</strong>d turb<strong>in</strong>es, and each “green” job cost $754,000 <strong>in</strong>subsidies. Moreover, because <strong>the</strong> pricey “renewable” electricity forced manufacturers and o<strong>the</strong>rcompanies <strong>to</strong> lay off workers, <strong>the</strong> w<strong>in</strong>d energy subsidies destroyed 2.2 regular jobs for eachgreen job <strong>the</strong>y created. 38 By contrast, though <strong>the</strong>y receive some limited subsidies, oil, natural gasand coal actually generate significant revenue.W<strong>in</strong>d systems only work 35% of <strong>the</strong> time on average; 25% of <strong>the</strong> time <strong>in</strong> many locations; and10% of <strong>the</strong> time on freez<strong>in</strong>g Midwestern w<strong>in</strong>ter nights and swelter<strong>in</strong>g Texas summer afternoons– compared <strong>to</strong> 95% for coal and nuclear power. They thus require gas-fired backup genera<strong>to</strong>rs(“peak<strong>in</strong>g units”) runn<strong>in</strong>g on sp<strong>in</strong>n<strong>in</strong>g reserve 24/7/365, for <strong>in</strong>stantaneous power every time <strong>the</strong>w<strong>in</strong>d s<strong>to</strong>ps blow<strong>in</strong>g. This adds <strong>to</strong> <strong>the</strong> land and raw material needs, <strong>to</strong>tal cost, fuel use andpollution.21

That translates<strong>in</strong><strong>to</strong> roughly: • •18,000,000 acres of farm, scenic and habitat land – one-half of Wiscons<strong>in</strong>, and270,000,000 <strong>to</strong>ns of concrete, steel, copper, fiberglass and rare earth m<strong>in</strong>erals – <strong>the</strong>equivalent of 197,000,000 Toyota Priuses (not count<strong>in</strong>g <strong>the</strong> necessary gas-fired backup orpeak<strong>in</strong>g units). 39That is far more land and raw materials than required <strong>to</strong> generate and transmit equivalentamounts of (far more reliable) electricity with coal, natural gas or nuclear power. In fact, w<strong>in</strong>dpower’s <strong>in</strong>frastructure requires five <strong>to</strong> ten times <strong>the</strong> steel and concrete than does nuclear. 40Intense opposition <strong>to</strong> m<strong>in</strong><strong>in</strong>g and drill<strong>in</strong>g means those raw materials will probably not be m<strong>in</strong>ed<strong>in</strong> America. Instead, <strong>the</strong>y will be m<strong>in</strong>ed – and <strong>the</strong> turb<strong>in</strong>es, blades and <strong>to</strong>wers manufactured – <strong>in</strong>Ch<strong>in</strong>a and o<strong>the</strong>r foreign countries, under <strong>the</strong>ir pollution control laws. In fact, that is alreadyhappen<strong>in</strong>g.The US Renewable Energy Group is us<strong>in</strong>g $1.5 billion <strong>in</strong> federal stimulus funds <strong>to</strong> erect 240gargantuan 3-megawatt w<strong>in</strong>d turb<strong>in</strong>es on a Wash<strong>in</strong>g<strong>to</strong>n, DC-sized area <strong>in</strong> West Texas. Theproject will create 2,800 jobs. But 2,400 of <strong>the</strong>m will be <strong>in</strong> Ch<strong>in</strong>a; only 400 will be Americanworkers – mostly truckers, <strong>in</strong>stallers, supervisors, lawyers, accountants and regula<strong>to</strong>rs. 41Similarly, <strong>to</strong> meet even 5% of America’s electricity needs with pho<strong>to</strong>voltaic panels would meanblanket<strong>in</strong>g thousands of square miles with expensive solar arrays across Southwestern deserthabitats. A new solar array at Nellis Air Force Base <strong>in</strong> Nevada covers 140 acres, <strong>to</strong> produce 30gigawatt hours of electricity per year.By comparison, <strong>the</strong> Palo Verde Nuclear Power Station near Phoenix generates 26,780 Gwh ofelectricity annually. Thus, while <strong>the</strong> three Palo Verde reac<strong>to</strong>rs cost 124 times more than <strong>the</strong> Nellissolar array (<strong>in</strong> constant dollars), <strong>the</strong>y generate 893 times more electricity – and do so 90% of <strong>the</strong>time, year after year, versus 30% of <strong>the</strong> time for <strong>the</strong> Nellis array, and on less land. Moreover, <strong>the</strong>Nellis electricity is 15 times more expensive per k Wh than Palo Verde’s – and generat<strong>in</strong>g <strong>the</strong>nuclear power station’s annual electrical output via Nellis technology would require solar arraysacross some 390,000 acres of land – an area ten times larger than Wash<strong>in</strong>g<strong>to</strong>n, DC. 42“We should pay <strong>the</strong> true costs for fossil-fuel energy sources, <strong>in</strong>clud<strong>in</strong>g all associatedenvironmental costs,” says UCLA professor Neil Morley. Few would disagree, if we are talk<strong>in</strong>gabout actual costs, ra<strong>the</strong>r than speculative, exaggerated or lawsuit-<strong>in</strong>spired costs.However, <strong>the</strong> same standard should apply <strong>to</strong> w<strong>in</strong>d and solar power. Their land, water, rawmaterial, resource extraction, bird, wildlife habitat, visual and environmental costs shouldlikewise be evaluated and paid for – along with <strong>the</strong> f<strong>in</strong>anc<strong>in</strong>g, raw material and fuel costs ofbackup genera<strong>to</strong>rs; <strong>the</strong> impacts of ultra-long transmission l<strong>in</strong>es from w<strong>in</strong>d and solar facilities <strong>to</strong>distant urban centers; and <strong>the</strong> expensive, unreliable nature of <strong>the</strong> electricity <strong>the</strong>y generate.22


Committee For A Constructive Tomorrow • 1875 Eye Street NW • 5th Floor • Wash<strong>in</strong>g<strong>to</strong>n, DC 20006Under any reasonable def<strong>in</strong>ition, <strong>the</strong>se costs are not “susta<strong>in</strong>able.” They certa<strong>in</strong>ly raise <strong>the</strong>question of whe<strong>the</strong>r <strong>the</strong>se technologies and associated electricity can be characterized as“affordable” or “eco-friendly.” If <strong>the</strong> “precautionary pr<strong>in</strong>ciple” were applied <strong>to</strong> <strong>the</strong> projects, <strong>the</strong>ywould be rejected.If <strong>the</strong> transition <strong>to</strong> a “green” economy is driven primarily by government mandates andsubsidies, it will exact a heavy, unjustifiable <strong>to</strong>ll on energy-dependent bus<strong>in</strong>esses, employees andfamilies. By forc<strong>in</strong>g America <strong>to</strong> depend far more on expensive, unreliable energy, it will alsoimpose unacceptable costs on job creation, personal liberties, liv<strong>in</strong>g standards, and <strong>the</strong> civilrights of poor and m<strong>in</strong>ority families.If <strong>the</strong> transition is driven by assertions that our nation and planet face unprecedented risks of airand water pollution, species losses and climate change catastrophes, <strong>the</strong>n <strong>the</strong>re had better besolid, <strong>in</strong>controvertible evidence that those risks are imm<strong>in</strong>ent and real – and that <strong>the</strong> “green”energy can actually replace <strong>the</strong> electricity and o<strong>the</strong>r energy that Wiscons<strong>in</strong> currently gets fromhydrocarbons.However, <strong>the</strong>re is no evidence <strong>to</strong> support ei<strong>the</strong>r of <strong>the</strong>se claims.Climategate and climate sciencePlanet Earth has endured, flourished <strong>in</strong> or been battered by wea<strong>the</strong>r events and climate changesthroughout its his<strong>to</strong>ry. Ice ages sent mile-thick glaciers across Europe and North America,carv<strong>in</strong>g out mounta<strong>in</strong> valleys, scrap<strong>in</strong>g cont<strong>in</strong>ents down <strong>to</strong> bare rock, and pull<strong>in</strong>g so much waterout of <strong>the</strong> oceans that sea levels fell 400 feet below present day levels. Wiscons<strong>in</strong> has gonethrough several glacial and <strong>in</strong>ter-glacial periods over <strong>the</strong> last two million years that periodicallycrushed <strong>the</strong> state under billions of <strong>to</strong>ns of slowly mov<strong>in</strong>g ice.Roman and Medieval Warm Periods produced agricultural bounties and flourish<strong>in</strong>g civilizations.The Little Ice Age <strong>in</strong>flicted frigid w<strong>in</strong>ters, s<strong>to</strong>rms, crop failures, fam<strong>in</strong>es, and glaciers bear<strong>in</strong>gdown on alp<strong>in</strong>e villages. Four thousand years ago, verdant valleys <strong>in</strong> North Africa became <strong>the</strong>Sahara Desert. America’s Dust Bowl forced thousands of families <strong>to</strong> flee <strong>the</strong>ir farms and cities.And over <strong>the</strong> past 110 years, our planet warmed, cooled, warmed and cooled aga<strong>in</strong>, whileatmospheric carbon dioxide levels climbed from 0.0250% of <strong>the</strong> atmosphere (250 ppm) <strong>to</strong>0.0387% (387 ppm). 43Carbon dioxide is essential for all life on Earth, and nei<strong>the</strong>r EPA nor IPCC pronouncements cantransform it <strong>in</strong><strong>to</strong> a “dangerous pollutant.” Higher CO2 levels benefit agriculture, by foster<strong>in</strong>gfaster, more robust plant growth, even dur<strong>in</strong>g droughts or <strong>in</strong> times of cooler temperatures andshorter grow<strong>in</strong>g seasons. Adverse impacts on species and ecosystems will not result from climatechange, but from need<strong>in</strong>g <strong>to</strong> farm more acreage <strong>to</strong> meet grow<strong>in</strong>g food demands, especially ifactivists cont<strong>in</strong>ue <strong>to</strong> oppose chemical fertilizers and biotechnology. 44Hundreds of climate scientists say <strong>the</strong>re is no conv<strong>in</strong>c<strong>in</strong>g evidence that <strong>in</strong>creases <strong>in</strong> atmosphericCO2 beyond pre-<strong>in</strong>dustrial levels will cause dangerous global warm<strong>in</strong>g. Moreover, <strong>the</strong> entirebody of climate change science – far from be<strong>in</strong>g “settled” or a matter of “near unanimousconsensus” – is roil<strong>in</strong>g with debate and dissent. Indeed, thousands of climate and o<strong>the</strong>r scientists23

They are not supported by actual data and observations regard<strong>in</strong>g his<strong>to</strong>ric andcurrent global temperatures, ice caps, sealevels, polar bears, tropical diseases, wea<strong>the</strong>rand s<strong>to</strong>rm patterns, and o<strong>the</strong>r matters.The soundness, validity and predictive value ofmodels depend on <strong>the</strong> assumptions, data andoverall knowledge on which <strong>the</strong>y are based.Exist<strong>in</strong>g models help scientists study wea<strong>the</strong>rand climate processes. But <strong>the</strong>y are useless aspredictive <strong>to</strong>ols because: <strong>the</strong>y focus on carbondioxide and largely ignore changes <strong>in</strong> solarenergy output; his<strong>to</strong>ric and recent temperaturedata are unreliable; our understand<strong>in</strong>g ofpositive and negative feedbacks due <strong>to</strong> cloudcover and precipitation is still limited; and weknow little about oceanic currents and howoceans absorb CO2 and heat.“Carbon dioxide is a m<strong>in</strong>orplayer <strong>in</strong> climate change –compared <strong>to</strong> natural fac<strong>to</strong>rslike water vapor andperiodic shifts <strong>in</strong> cloudcover, ocean currents and jetstreams, <strong>the</strong> shape of Earth’sorbit, solar energy outputand cosmic ray levels.”Carbon dioxide is a m<strong>in</strong>or player <strong>in</strong> climate change – compared <strong>to</strong> water vapor andnatural forces and <strong>in</strong>fluences that drive shifts <strong>in</strong> our planet’s complex, chaotic andunpredictable wea<strong>the</strong>r and climate patterns. Those forces <strong>in</strong>clude cont<strong>in</strong>ental movementsand volcanoes, and changes or periodic shifts <strong>in</strong> ocean currents and jet streams, watervapor and cloud cover, evaporation and precipitation, planetary alignments and <strong>the</strong> shapeof <strong>the</strong> Earth’s orbit, <strong>the</strong> tilt and wobble of Earth’s axis, and solar energy output andcosmic ray levels.Right now, <strong>the</strong> Sun appears <strong>to</strong> be enter<strong>in</strong>g a less vigorous phase, as evidenced by adramatic drop <strong>in</strong> sunspots, and average annual planetary temperatures have fallen slightlys<strong>in</strong>ce <strong>the</strong> strong El Niño-driven peak <strong>in</strong> 1998. If this cool<strong>in</strong>g is prolonged, it would be farmore threaten<strong>in</strong>g for humanity than moderate warm<strong>in</strong>g – because it could worsen w<strong>in</strong>tersand reduce both grow<strong>in</strong>g seasons and arable farmland, as it did from 1450 <strong>to</strong> 1850. 47 • Although carbon dioxide is <strong>in</strong>deed a m<strong>in</strong>or greenhouse gas, <strong>the</strong> recent (1975-1995)correlation between ris<strong>in</strong>g CO2 and ris<strong>in</strong>g temperatures simply is not a cause-effectrelationship; nor was it of <strong>the</strong> magnitude predicted by <strong>the</strong> IPCC. Instead, <strong>the</strong>se o<strong>the</strong>rcomplex, <strong>in</strong>terrelated natural forces are now caus<strong>in</strong>g stable or decl<strong>in</strong><strong>in</strong>g average globaltemperatures, even as atmospheric carbon dioxide levels cont<strong>in</strong>ue <strong>to</strong> rise. Some scientistssay that, as <strong>the</strong> Sun’s energy output and magnetic field reach record lows for <strong>the</strong> modernera, <strong>in</strong>creased cosmic rays reach Earth’s lower atmosphere over <strong>the</strong> oceans and ionize24

As<strong>to</strong>nish<strong>in</strong>gly, however,those hotly contested IPCC views form <strong>the</strong> pr<strong>in</strong>cipal basis and justification for – • • • •Congressional “climate protection” bills, fossil fuel restrictions, and renewable energymandates and subsidies;The EPA endangerment decision and regula<strong>to</strong>ry scheme;Proposed global climate treaties; andEvery demand that mank<strong>in</strong>d must slash emissions, reduce liv<strong>in</strong>g standards, putbureaucrats <strong>in</strong> charge of energy use, economies, <strong>in</strong>dustries and lives, and acceptrestrictions and <strong>in</strong>trusions on our freedoms, opportunities, free enterprise system, andcivil rights.If <strong>the</strong> IPCC science is wrong – or far worse, if it is manipulated and fraudulent – <strong>the</strong>n thisunprecedented attempt <strong>to</strong> control our energy, economy and lives is unjust and unjustifiable.Mount<strong>in</strong>g evidence suggests that this is <strong>the</strong> case.The IPCC consistently selects <strong>to</strong>pics and studies, issues <strong>report</strong>s and press releases, and presentsapocalyptic climate disaster scenarios that emphasize “<strong>the</strong> risks of human-<strong>in</strong>duced climatechange.” This <strong>in</strong>tentionally narrow focus is used <strong>to</strong>justify ignor<strong>in</strong>g or exclud<strong>in</strong>g non-human, natural causes– and emphasiz<strong>in</strong>g only human causes, as “highly likely”sources of measured, perceived, speculated andexaggerated warm<strong>in</strong>g and associated “crises.” It alsogives many researchers a vested <strong>in</strong>terest <strong>in</strong> promot<strong>in</strong>gand defend<strong>in</strong>g <strong>the</strong> “manmade global warm<strong>in</strong>gcatastrophe” hypo<strong>the</strong>sis, vilify<strong>in</strong>g and <strong>in</strong>timidat<strong>in</strong>gscientists who disagree with <strong>the</strong>m, and dismiss<strong>in</strong>gskeptics’ analyses and conclusions. 48‘Why should I make <strong>the</strong>data available, when youraim is <strong>to</strong> try and f<strong>in</strong>dsometh<strong>in</strong>g wrong with it?’Even worse, recently released emails reveal that global-warm<strong>in</strong>g-catastrophe scientists activelyand systematically manipulated data and computer models; lost or destroyed raw (orig<strong>in</strong>al)temperature data, so that it could not be exam<strong>in</strong>ed by o<strong>the</strong>r scientists; utilized data and studiesthat <strong>the</strong>y knew were unreliable; disregarded and excluded <strong>in</strong><strong>format</strong>ion that contradicted <strong>the</strong>irresults and conclusions; hijacked <strong>the</strong> peer review process, <strong>to</strong> ensure that only friendly scientistsexam<strong>in</strong>ed <strong>the</strong>ir papers, and “skeptical” research was excluded from scientific journals relied onby <strong>the</strong> IPCC and world governments; and will<strong>full</strong>y ignored and subverted legitimate Freedom ofIn<strong>format</strong>ion requests.25

Excerpts from just a few of <strong>the</strong> “Climategate”emails reveal an abuse of trust that is at best unscientific, and at worst fraudulent and crim<strong>in</strong>al. 49 • • • •British Climate Research Unit chief Phil Jones <strong>to</strong> Australian scientist Warwick Hughes,“Why should I make <strong>the</strong> data available, when your aim is <strong>to</strong> try and f<strong>in</strong>d someth<strong>in</strong>gwrong with it?” Jones subsequently “lost” extensive raw temperature that had beenentrusted <strong>to</strong> <strong>the</strong> CRU’s care.Jones <strong>to</strong> Penn State clima<strong>to</strong>logist Michael Mann of “hockey stick” fame: “Can you deleteany e-mails you may have had with Keith [Briffa] re AR4 [<strong>the</strong> IPCC’s Fourth AssessmentReport and Briffa’s suspect tree-r<strong>in</strong>g data]. Keith will do likewise.”Jones: “I’ve just completed Mike [Mann]'s trick of add<strong>in</strong>g <strong>in</strong> <strong>the</strong> real temps <strong>to</strong> each series[of tree r<strong>in</strong>g data], <strong>to</strong> hide <strong>the</strong> decl<strong>in</strong>e” [<strong>in</strong> average global temperatures, as shown <strong>in</strong> <strong>the</strong>same tree r<strong>in</strong>g data after 1960]. US climate scientist Kev<strong>in</strong> Trenberth later groaned thatalarmists still “can’t account for <strong>the</strong> lack ofwarm<strong>in</strong>g and it is a travesty that we can’t.”Climate scientist Tom Wigley <strong>to</strong> Mann: “If youth<strong>in</strong>k [Geophysical Research Letters edi<strong>to</strong>rJames] Saiers is <strong>in</strong> <strong>the</strong> greenhouse skeptics’camp, <strong>the</strong>n, if we can f<strong>in</strong>d documentaryevidence of this, we could go through officialAGU channels <strong>to</strong> get him ousted.” (Saiers wassubsequently dismissed.) • Anonymous CRU programmer, <strong>in</strong> notesappended <strong>to</strong> a segment of computer code: <strong>the</strong>only way <strong>the</strong> models can produce “<strong>the</strong> properresult” is when programmers “apply a VERYARTIFICIAL correction” [emphasis <strong>in</strong> orig<strong>in</strong>al], use “low pass filter<strong>in</strong>g at century andlonger time scales,” and “<strong>in</strong>clude a load of garbage.”These emails prompted scientists and journalists <strong>to</strong> reexam<strong>in</strong>e <strong>the</strong> IPCC <strong>report</strong>s, analyses,background studies and conclusions. They discovered numerous examples of questionable,speculative, unsubstantiated and even fabricated “research,” suggest<strong>in</strong>g a deliberate andsystematic effort <strong>to</strong> buttress claims of an imm<strong>in</strong>ent global warm<strong>in</strong>g cataclysm, while exclud<strong>in</strong>gcontrary evidence. •Satellite temperature measurements show stable and <strong>the</strong>n slightly decl<strong>in</strong><strong>in</strong>g temperaturess<strong>in</strong>ce 1995. So alarmist scientists have focused on surface temperature data. However,nearly half of <strong>the</strong> world’s ground-based moni<strong>to</strong>rs are <strong>in</strong> <strong>the</strong> United States, and most of<strong>the</strong>m are close <strong>to</strong> air condition<strong>in</strong>g exhausts, tarmac, black<strong>to</strong>p and o<strong>the</strong>r urban heat sources– which makes <strong>the</strong>m <strong>report</strong> measurements that are much higher than true ambient andrural temperatures. The alarmist scientists also “cherry-picked” <strong>the</strong>ir moni<strong>to</strong>r<strong>in</strong>g stationsand data, exclud<strong>in</strong>g more rural and high latitude measurements, fur<strong>the</strong>r skew<strong>in</strong>g trendsupward. 5026

This cherry-pick<strong>in</strong>g of data made it appearthat Russia had experienced a dist<strong>in</strong>ct warm<strong>in</strong>g trend, <strong>in</strong> response <strong>to</strong> ris<strong>in</strong>g CO2 levels.Similarly, scientist Keith Briffa selected just twelve tree-r<strong>in</strong>g cores, <strong>to</strong> “prove” a dramaticrecent temperature spike, while ignor<strong>in</strong>g over 250 o<strong>the</strong>r Siberian cores that did notsupport his <strong>the</strong>sis. 51NOAA’s National Climate Data Center and NASA’s Goddard Institute for Space Studiesselected temperature data from only 36 Canadian moni<strong>to</strong>r<strong>in</strong>g stations, <strong>in</strong>clud<strong>in</strong>g just onefrom above <strong>the</strong> Arctic Circle – even though Canada operates 1,400 stations, 100 of <strong>the</strong>m<strong>in</strong> <strong>the</strong> Arctic. The cherry-picked datawere fur<strong>the</strong>r altered <strong>to</strong> generate warm<strong>in</strong>gtrends that may not exist <strong>in</strong> <strong>the</strong> <strong>full</strong>dataset. 52 • In Australia, researchers “radicallyaltered” data from temperature stationDarw<strong>in</strong> Zero <strong>to</strong> create a pronouncedwarm<strong>in</strong>g trend, whereas <strong>the</strong> unadjusteddata showed a slight cool<strong>in</strong>g trend over<strong>the</strong> same period. They achieved this byarbitrarily add<strong>in</strong>g 2-6 degrees C (4-11degrees F) <strong>to</strong> <strong>the</strong> raw data, at timesjustify<strong>in</strong>g <strong>the</strong> added warmth by referr<strong>in</strong>g<strong>to</strong> data from stations 1,000 km from <strong>the</strong>Darw<strong>in</strong> station. 53“The IPCC claim that Himalayanglaciers would ‘disappear by <strong>the</strong>year 2035’ was based on a WorldWildlife Fund press release, whichwas based on a magaz<strong>in</strong>e article,which was based on a statementby a glaciologist, who lateradmitted it was pure speculation.”This data manipulation was <strong>the</strong>n compounded by “errors” <strong>in</strong> and deliberate skew<strong>in</strong>g of IPCC<strong>report</strong>s, especially <strong>the</strong> 2007 Fourth Assessment Report and Summary for Policy Makers, whichserved as <strong>the</strong> supposedly scientific foundation for congressional cap-tax-and-trade bills, <strong>the</strong> EPAendangerment decision and <strong>the</strong> proposed Copenhagen treaty. • • •The IPCC claimed Himalayan glaciers would “disappear by <strong>the</strong> year 2035,” caus<strong>in</strong>gnumerous communities <strong>in</strong> <strong>the</strong> region <strong>to</strong> be deprived of water. In reality, this disaster-of<strong>the</strong>-centuryassertion was based solely on a press release from <strong>the</strong> environmental pressuregroup World Wildlife Fund – which was based on a non-peer-reviewed 1999 article <strong>in</strong> apopular scientific magaz<strong>in</strong>e, which was based on an email <strong>in</strong>terview statement by a s<strong>in</strong>gleglaciologist, who later admitted his prediction was pure “speculation.” 54The IPCC lead author <strong>in</strong> charge of this section subsequently said <strong>the</strong> Himalayan glaciermeltdown had been <strong>in</strong>cluded – despite <strong>full</strong> knowledge of its bogus pedigree – because hethought highlight<strong>in</strong>g it would “impact policy makers and politicians and encourage <strong>the</strong>m<strong>to</strong> take some concrete action” on global warm<strong>in</strong>g. 55IPCC assertions about snow and ice disappear<strong>in</strong>g from mounta<strong>in</strong>s all over <strong>the</strong> worldlikewise had no scientific basis. One source was an article published <strong>in</strong> a magaz<strong>in</strong>e forclimbers and based solely on anecdotal statements by mounta<strong>in</strong>eers; <strong>the</strong> o<strong>the</strong>r was a27

Once aga<strong>in</strong>, <strong>the</strong> “expert” source was <strong>the</strong>World Wildlife Fund, which had provided “research” by two young activists, who basedit on a science journal article that was not even about ra<strong>in</strong>fall or climate change, but about<strong>the</strong> logg<strong>in</strong>g and burn<strong>in</strong>g of forest areas by humans. 57The 2007 Assessment Report also claimedthat a worldwide <strong>in</strong>crease <strong>in</strong> hurricane-forces<strong>to</strong>rms like Katr<strong>in</strong>a s<strong>in</strong>ce 1970 was l<strong>in</strong>ked <strong>to</strong> “The IPCC’s assumptions,global warm<strong>in</strong>g, and significant <strong>in</strong>creases <strong>in</strong> analyses, computer models and<strong>the</strong> frequency and <strong>in</strong>tensity of such s<strong>to</strong>rmswere likely over <strong>the</strong> com<strong>in</strong>g century, unless disaster scenarios are be<strong>in</strong>ggreenhouse gas emissions are dramatically used <strong>to</strong> justify governmentreduced. But research available <strong>the</strong>n and actions that will destroy jobssubsequently concludes that <strong>the</strong> rise <strong>in</strong>and roll back civil rightshurricane frequency s<strong>in</strong>ce 1995 was just par<strong>to</strong>f a natural cycle, and that similar <strong>in</strong>creases progress.”have been recorded <strong>in</strong> <strong>the</strong> past, each timefollowed by a decl<strong>in</strong>e. 58A recent horror s<strong>to</strong>ry holds that <strong>the</strong> oceansare becom<strong>in</strong>g more acidic, threaten<strong>in</strong>g <strong>to</strong> dissolve mollusks and plank<strong>to</strong>n that formcritical parts of <strong>the</strong> food cha<strong>in</strong>. The claim is based on several studies that <strong>in</strong>appropriatelyadded weak hydrochloric acid <strong>to</strong> seawater <strong>in</strong> fish tanks, ra<strong>the</strong>r than bubbl<strong>in</strong>g CO2 through<strong>the</strong> water, <strong>to</strong> simulate natural conditions. In fact, o<strong>the</strong>r studies found that <strong>in</strong>creasedatmospheric CO2 actually causes s<strong>in</strong>gle-celled algae and phy<strong>to</strong>plank<strong>to</strong>n <strong>to</strong> produce morecalcium carbonate, and that such organisms were abundant throughout past periods ofocean acidification and high atmospheric carbon dioxide. 59Perhaps most apocalyptic of all was <strong>the</strong> claim that ra<strong>in</strong>-based agriculture could plummetby up <strong>to</strong> 50% by 2020 <strong>in</strong> some African countries. African villagers became conv<strong>in</strong>cedthat global warm<strong>in</strong>g threatens <strong>the</strong>ir lives even more than deadly malaria. Only later did<strong>the</strong> world learn that <strong>the</strong> source was ano<strong>the</strong>r non-peer-reviewed article, which discussedcereal crops <strong>in</strong> North Africa dur<strong>in</strong>g drought years, and said noth<strong>in</strong>g about Sub-SaharanAfrica. 60 This scientific exaggeration, manipulation,fabrication, falsification and <strong>in</strong>timidation does notdisprove <strong>the</strong> manmade global warm<strong>in</strong>g disaster<strong>the</strong>sis. Nor does it demonstrate that <strong>the</strong> entireIPCC process or 2007 <strong>report</strong> is erroneous orfraudulent.However, it does demonstrate unprecedented,systemic and systematic problems that need <strong>to</strong> be<strong>in</strong>vestigated thoroughly, and rooted out, beforeIPCC or EPA f<strong>in</strong>d<strong>in</strong>gs can be allowed <strong>to</strong> buttress28


Committee For A Constructive Tomorrow • 1875 Eye Street NW • 5th Floor • Wash<strong>in</strong>g<strong>to</strong>n, DC 20006legislative and regula<strong>to</strong>ry schemes, and justify draconian regulation of our economies and lives.It is not simply that <strong>the</strong>se errors and falsifications were carried out by environmental activists andalarmist climate scientists, who manipulated <strong>the</strong> peer review process <strong>to</strong> validate <strong>the</strong>ir work, hide<strong>the</strong>ir actual data and methodology, and exclude “skeptical” scientists from <strong>the</strong> review process.Nor is it only that <strong>the</strong>se transgressions were fur<strong>the</strong>r compounded by an IPCC hierarchy thatpermitted and published only alarmist views <strong>in</strong> its Summaries for Policy Makers.The IPCC’s false data, analyses, assumptionsand <strong>report</strong>s were also fed <strong>in</strong><strong>to</strong> computermodels that conjured up dozens of terrify<strong>in</strong>gdisaster scenarios. The scare s<strong>to</strong>ries andscenarios <strong>the</strong>n formed <strong>the</strong> basis for countlesssummaries, press releases and news s<strong>to</strong>ries.Even worse, <strong>the</strong>y are be<strong>in</strong>g used <strong>to</strong> justifycongressional, EPA, Interior, EU, UN and<strong>in</strong>ternational legislative, regula<strong>to</strong>ry, treaty,subsidy and spend<strong>in</strong>g proposals – as well asdrastic actions at <strong>the</strong> state and local level. 61“We cannot have justice withou<strong>to</strong>pportunity, or opportunity withoutenergy. We cannot have justice byshar<strong>in</strong>g scarcity and poverty moreequally. We cannot help poor nationsby penaliz<strong>in</strong>g rich nations for <strong>the</strong>irtechnology and success.”But <strong>the</strong> worst travesty is that <strong>the</strong>se non-validated and <strong>in</strong>accurate climate models are be<strong>in</strong>g used <strong>to</strong>justify government actions that will destroy jobs, make government <strong>the</strong> primary arbiter of energyand employment decisions, roll back civil rights progress, shackle <strong>the</strong> hopes and dreams of hardwork<strong>in</strong>gpoor and m<strong>in</strong>ority American families, keep Third World families deprived of energy andmired <strong>in</strong> poverty, disease and despair – and perpetrate gross <strong>in</strong>justices on bus<strong>in</strong>esses and familiesall over <strong>the</strong> world.A lucky few will become wealthy and powerful. Their lobby<strong>in</strong>g and connections will enable<strong>the</strong>m <strong>to</strong> corner markets for renewable energy technologies, subsidies, carbon offsets andemissions trad<strong>in</strong>g.The vast majority will face skyrocket<strong>in</strong>g energy and food bills, unemployment and reducedliv<strong>in</strong>g standards. Poor, m<strong>in</strong>ority, elderly and blue collar families will be penalized severely.The most destitute people on <strong>the</strong> planet will face literally life-or-death risks, because climatedisaster claims are be<strong>in</strong>g used <strong>to</strong> justify deny<strong>in</strong>g <strong>the</strong>m access <strong>to</strong> hydrocarbon-based technologies,economic development, healthcare and liv<strong>in</strong>g standards.Every exaggerated, misrepresented or falsified IPCC scare s<strong>to</strong>ry was designed <strong>to</strong> re<strong>in</strong>force claimsthat human carbon dioxide emissions are caus<strong>in</strong>g Earth <strong>to</strong> warm dangerously. Every error, everydecision <strong>to</strong> <strong>in</strong>clude or exclude a study, po<strong>in</strong>ted <strong>to</strong> more warm<strong>in</strong>g – never <strong>to</strong> less. And yet <strong>the</strong>IPCC and its supporters cont<strong>in</strong>ue <strong>to</strong> <strong>in</strong>sist that <strong>the</strong>se were just m<strong>in</strong>or errors, which do not alter <strong>the</strong>“central fact” that human hydrocarbon use poses an imm<strong>in</strong>ent threat <strong>to</strong> habitats, species, humancivilization and <strong>the</strong> planet.These <strong>report</strong>s and analyses cannot be allowed <strong>to</strong> guide energy and economic policy, or <strong>to</strong> set <strong>the</strong>standard for “climate justice.” The scientists and organizations beh<strong>in</strong>d <strong>the</strong>m must be <strong>in</strong>vestigated29

If found guilty of misus<strong>in</strong>g of public funds and abus<strong>in</strong>g <strong>the</strong> public trust, <strong>the</strong>y must beheld accountable.Conclusions – What should Wiscons<strong>in</strong> do?Earth’s climate is constantly chang<strong>in</strong>g, <strong>in</strong> response <strong>to</strong> natural forces and cycles that we are onlybeg<strong>in</strong>n<strong>in</strong>g <strong>to</strong> understand. Human actions, activities and emissions certa<strong>in</strong>ly affect temperatureand perhaps even wea<strong>the</strong>r and climate at a local level, especially by creat<strong>in</strong>g “urban heat islands”<strong>in</strong> and around cities, and through agricultural practices that change or replace forest, grasslandand o<strong>the</strong>r ecosystems.Whe<strong>the</strong>r and <strong>to</strong> what extent people affect <strong>the</strong> regional or global climate is still <strong>the</strong> subject of<strong>in</strong>tense debate. That question – and <strong>the</strong> broader question of our ability <strong>to</strong> predict, prepare for andadapt <strong>to</strong> future climate change, from natural and/or human causes – should be <strong>the</strong> focus ofongo<strong>in</strong>g studies.However, <strong>in</strong> <strong>the</strong> realm of public policy, it is vital that <strong>the</strong> issue before us is stated and unders<strong>to</strong>odclearly.Regardless of what certa<strong>in</strong> scientists, politicians and activists may say, <strong>the</strong> fundamental issue isnot whe<strong>the</strong>r “climate is chang<strong>in</strong>g” or whe<strong>the</strong>r “mank<strong>in</strong>d is responsible <strong>in</strong> part for that change.” 62This is a simplistic and mislead<strong>in</strong>g proposition, designed <strong>to</strong> skew <strong>the</strong> debate and preorda<strong>in</strong> policyresponses.The fundamental issue is this: Are humans are caus<strong>in</strong>g imm<strong>in</strong>ent and global climate changedisasters? And can we prevent future climate changes and disasters, by mov<strong>in</strong>g “aggressively,”dramatically <strong>in</strong>creas<strong>in</strong>g <strong>the</strong> price of carbon, drastically curtail<strong>in</strong>g hydrocarbon production, useand emissions, and impos<strong>in</strong>g government control over <strong>in</strong>dustries and people’s lives?Some cont<strong>in</strong>ue <strong>to</strong> argue that <strong>the</strong> debate is over, <strong>the</strong> manmade climate crisis question has beenanswered <strong>in</strong> <strong>the</strong> affirmative, and it is time <strong>to</strong> take aggressive action <strong>to</strong> prevent a loom<strong>in</strong>g globalwarm<strong>in</strong>g disaster. However, as <strong>the</strong> Climategate and IPCC <strong>report</strong> scandals, and <strong>the</strong> <strong>in</strong>creas<strong>in</strong>gweight of scientific evidence and op<strong>in</strong>ion make clear, that is emphatically not <strong>the</strong> case.At this time, <strong>the</strong>re is no clear or conv<strong>in</strong>c<strong>in</strong>g evidence and observational data demonstrat<strong>in</strong>g that“recent changes <strong>in</strong> climate differ substantially from changes observed <strong>in</strong> <strong>the</strong> past and are well <strong>in</strong>excess of normal variations caused by solar cycles, ocean currents, changes <strong>in</strong> <strong>the</strong> Earth's orbitalparameters and o<strong>the</strong>r natural phenomena.” 63 There is <strong>the</strong>refore still no justification for tax<strong>in</strong>g andration<strong>in</strong>g energy use, and unleash<strong>in</strong>g extensive adverse un<strong>in</strong>tended consequences that will sendshockwaves through our economy and society, and impair our civil rights, freedoms, and pursui<strong>to</strong>f justice and happ<strong>in</strong>ess.It is vital that we protect and manage our Earth and its resources as wise stewards. Do un<strong>to</strong>o<strong>the</strong>rs, as we would have <strong>the</strong>m do un<strong>to</strong> us. We cannot andmust not attempt <strong>to</strong> replace our “brown” economy with a “green” economy, before sufficient,dependable, affordable, eco-friendly renewable technologies are actually available – orregardless of <strong>the</strong> costs that a forced trans<strong>format</strong>ion of our energy and economic system wouldimpose on our citizens.Government actions promoted <strong>in</strong> <strong>the</strong> name of “stabiliz<strong>in</strong>g <strong>the</strong>climate” and “prevent<strong>in</strong>g global warm<strong>in</strong>g disasters” would affectnot just one-sixth of our economy, as <strong>in</strong> <strong>the</strong> case of nationalhealthcare “reform.”They would affect 100% of our economy, every bus<strong>in</strong>ess, everyaspect of our lives.America can ill afford activist, court and government control of itsenergy and economic systems, <strong>to</strong> promote “environmentaljustice,” “planetary protection” or “<strong>the</strong> national <strong>in</strong>terest” –narrowly def<strong>in</strong>ed <strong>to</strong> serve an anti-hydrocarbon, anti-economicgrowth agenda. It cannot afford a program that is imposed byexecutive fiat or enacted through bait-and-switch tactics, armtwist<strong>in</strong>g,vote buy<strong>in</strong>g, or special deals carved out by activists,politicians and corporate executives who have “seats at <strong>the</strong> negotiat<strong>in</strong>g table,” while <strong>the</strong> rest of<strong>the</strong> nation is not represented but will be severely impacted by <strong>the</strong> decisions.We cannot have justice without opportunity, or opportunity without energy. We cannot havejustice by shar<strong>in</strong>g scarcity and poverty more equally. We cannot help poor nations by penaliz<strong>in</strong>grich nations for <strong>the</strong>ir technology and success.We cannot help our own disadvantaged citizens achieve <strong>the</strong> American Dream if our economy isdictated by false science, expensive and unreliable renewable energy, and over-taxed, overregulated,over-priced conventional energy.Environmental justice based on global warm<strong>in</strong>g alarmism and opposition <strong>to</strong> hydrocarbons is aperversion of any ethics- and reality-based concept of justice, fairness, civil rights and commonsense.What can Wiscons<strong>in</strong> citizens and legisla<strong>to</strong>rs do <strong>to</strong> ensure real energy, justice and civil rights?Exam<strong>in</strong>e <strong>the</strong> IPCC <strong>report</strong> and EPA analysis. Determ<strong>in</strong>e how much more of its “science” issuspect, biased, <strong>in</strong>defensible or even fraudulent. Assess how much of its evidence is honest,testable and verifiable – how much credibly and persuasively supports claims that human carbondioxide and greenhouse gas emissions are caus<strong>in</strong>g an imm<strong>in</strong>ent global warm<strong>in</strong>g crisis. Askclimate crisis proponents hard questions about <strong>the</strong>ir asserted science, evidence and models; <strong>the</strong>economic, employment, social and environmental impacts of <strong>the</strong> purported solutions <strong>the</strong>yadvocate; and <strong>the</strong> effects of energy restrictions on personal freedoms, civil rights and justice.Demand verifiable proof that humans are caus<strong>in</strong>g an immediate global warm<strong>in</strong>g disaster – and31

Scientists of <strong>in</strong>tegrity support and encouragedebate and criticism, <strong>in</strong> <strong>the</strong>ir quest for truth. There can be no excuse for scientists cherry-pick<strong>in</strong>gand fudg<strong>in</strong>g data; refus<strong>in</strong>g <strong>to</strong> share data, computer codes and methodologies; fail<strong>in</strong>g <strong>to</strong> discussand debate all aspects of <strong>the</strong>ir work; and refus<strong>in</strong>g <strong>to</strong> allow <strong>the</strong>ir work <strong>to</strong> be exam<strong>in</strong>ed by o<strong>the</strong>rscientists, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong>ir sharpest critics – especially when <strong>the</strong>ir work is funded by taxpayersand energy consumers, and <strong>the</strong>ir claims, results and conclusions are used <strong>to</strong> justify wholesaletrans<strong>format</strong>ions of our society and economic system. Insist that wrongdoers be punished withf<strong>in</strong>es, suspension, term<strong>in</strong>ation or imprisonment, as appropriate.Demand and ensure debate on all matters of climate science, economics and justice. Utilizelegislative hear<strong>in</strong>gs, <strong>to</strong>wn hall meet<strong>in</strong>gs, radio and television programs, articles and o<strong>the</strong>ropportunities <strong>to</strong> compel global warm<strong>in</strong>g alarmists and dissenters <strong>to</strong> defend <strong>the</strong>ir methods,f<strong>in</strong>d<strong>in</strong>gs and recommendations. Do not allow any scientist, politician or activist <strong>to</strong> speak at highschool, college, legislative or regula<strong>to</strong>ry events, unless you first secure agreements that <strong>the</strong>y willforthrightly and respect<strong>full</strong>y respond <strong>to</strong> all questions and counter arguments, and will not seek orbe granted <strong>the</strong> right <strong>to</strong> pre-approve such questions.Educate voters, legisla<strong>to</strong>rs and regula<strong>to</strong>rs about <strong>the</strong> vital role of abundant, reliable, affordableenergy <strong>in</strong> your lives and bus<strong>in</strong>esses – and thus <strong>in</strong> creat<strong>in</strong>g and sav<strong>in</strong>g jobs, provid<strong>in</strong>g vital goodsand services, ensur<strong>in</strong>g a steady revenue stream for essential government services, andsafeguard<strong>in</strong>g liv<strong>in</strong>g standards, health and welfare, and civil rights and justice for all.Safeguard jobs and state budgets. Scrut<strong>in</strong>ize and regulate <strong>the</strong> activities of CERES, <strong>the</strong> Centerfor Climate Strategies and o<strong>the</strong>r activist groups whose anti-hydrocarbon <strong>in</strong>itiatives, renewableenergy proposals, <strong>in</strong>surance <strong>in</strong>dustry “climate risk disclosure” programs and o<strong>the</strong>r efforts arebased on assertions that carbon dioxide emissions are caus<strong>in</strong>g global warm<strong>in</strong>g disasters. Exam<strong>in</strong>e<strong>the</strong>ir fund<strong>in</strong>g and alliances, make <strong>the</strong>m accountable <strong>to</strong> voters, legisla<strong>to</strong>rs and regula<strong>to</strong>rs, anddemand that <strong>the</strong>y provide honest, clear and conv<strong>in</strong>c<strong>in</strong>g evidence that <strong>the</strong> world faces animm<strong>in</strong>ent manmade climate disaster, before mov<strong>in</strong>g forward on any of <strong>the</strong>ir proposals. Demandadditional oversight for any climate scientists and activist groups that receive public fund<strong>in</strong>gfrom local, state, federal or <strong>in</strong>ternational sources.Care<strong>full</strong>y analyze green job claims. Exam<strong>in</strong>e methodologies used <strong>to</strong> support claims thatclimate change laws and renewable energy mandates and subsidies will create “green-collarjobs.” Ensure that <strong>the</strong>y <strong>full</strong>y and accurately assess how many exist<strong>in</strong>g jobs will likely be lost ifhydrocarbon energy costs soar, or companies are forced <strong>to</strong> switch <strong>to</strong> more expensive, less reliablew<strong>in</strong>d or solar power. Evaluate land use, wildlife, raw material and em<strong>in</strong>ent doma<strong>in</strong> requirementsfor renewable energy projects. Determ<strong>in</strong>e how promoters def<strong>in</strong>e “green jobs” and calculate jobcreation benefits from renewable energy projects. 64Challenge <strong>the</strong> EPA endangerment rul<strong>in</strong>g. Jo<strong>in</strong> Texas, Virg<strong>in</strong>ia and o<strong>the</strong>r states andorganizations that have gone <strong>to</strong> court <strong>to</strong> prevent EPA from promulgat<strong>in</strong>g and enforc<strong>in</strong>gregulations on stationary and mobile sources of carbon dioxide and o<strong>the</strong>r greenhouse gases.32

Reverse exist<strong>in</strong>g withdrawals and speak outaga<strong>in</strong>st fur<strong>the</strong>r restrictions on energy and m<strong>in</strong>eral development. Insist that all future land useproposals are addressed through <strong>full</strong> and open public hear<strong>in</strong>gs and legislative processes – not viaexecutive fiat under laws like <strong>the</strong> Antiquities Act. Demand more hydrocarbon and nuclear energydevelopment, under reasonable environmental regulations.Understand and defend <strong>the</strong> true mean<strong>in</strong>g of justice and civil rights. Recognize that <strong>the</strong>re isstill no conv<strong>in</strong>c<strong>in</strong>g evidence that we face a manmade global warm<strong>in</strong>g catastrophe.
