Les exonérations et limitationsprévues par la présente Conventionsont applicables à toute actioncontre le transporteur en réparationde pertes ou dommages à des marchandisesfaisant l’objet d’uncontrat de transport, que l’actionsoit fondée sur la responsabilitécontractuelle ou sur une responsabilitéextra-contractuelle.2. Si une telle action est intentéecontre un préposé du transporteur,ce préposé pourra se prévaloir desexonérations et des limitations deresponsabilité que le transporteurpeut invoquer en vertu de laConvention.3. L’ensemble des montants mis àla charge du transporteur et des sespréposés ne dépassera pas dans cecas la limite prévue par la présenteConvention.4. Toutefois le préposé ne pourrase prévaloir des dispositions duprésent article, s’il est prouvé que ledommage résulte d’un acte oud’une omission de ce préposé qui aeu lieu soit avec l’intention de provoquerun dommage, soit témérairementet avec conscience qu’undommage en résulterait probablement.ARTICLE 4 BISNew article adopted by the 1968Protocol1. The defences and limits of liabilityprovided for in this Conventionshall apply in any action against thecarrier in respect of loss or damageto goods covered by a contract ofcarriage whether the action befounded in contract or in tort.2. If such an action is broughtagainst a servant or agent of the carrier(such servant or agent not beingan independent contractor),such servant or agent shall be entitledto avail himself of the defencesand limits of liability which the carrieris entitled to invoke under thisConvention.3. The aggregate of the amountsrecoverable from the carrier, andsuch servants and agents, shall inno case exceed the limit providedfor in this Convention.4. Nevertheless, a servant or agentof the carrier shall not be entitled toavail himself of the provisions ofthis Article, if it is proved that thedamage resulted from an act oromission of the servant or agentdone with intent to cause damageor recklessly and with knowledgethat damage would probably result.
