Parconséquent, nous estimons que ce retouren arrière est une erreur.Nous demandons à la conférence plénièrede voter le texte que nous avons proposéavec, éventuellement, l’amendementfrançais pour la “clause Paramount” - quipeut le plus peut le moins - quoique nousestimions que ce n’est pas nécessaire.M. Monsieurle Président, Messieurs, qu’il me soitpermis tout d’abord, au nom de la délégationpolonaise, de faire brièvement l’analysedu texte soumis à notre examen par lamajorité de la Commission.Les points a) et b) pris ensemble neforment à vrai dire qu’une seule dispositionqui peut être à peu près compriméedans une phrase, par exemple: “LaConvention s’applique quand le connaissementest délivré au port de chargement”.[70]Le point c) qui dit que la Conventionsera applicable si les deux parties stipulentdans leur contrat de transport la “Paramountclause” n’apporte à vrai direrien de neuf. Cette disposition confirmeseulement la liberté des parties d’arrangerleurs relations selon leur volonté, cequi ne peut pas du tout être mis en douteet ce qui n’exige aucune permission ouacceptation particulière de la part du législateur.Cette stipulation est donc superflueet inutile.Par conséquent si les deux premierspoints, a) et b), basent l’application de laConvention sur la délivrance de connaissementau port de chargement et si lepoint c) n’apporte rien de neuf, la concluferenceto reject amendment CONN.25, even in <strong>the</strong> way it is modified now,because this will not amount to much,to reject it because it has no basis. Nobodyhas explained to us <strong>the</strong> real reasonbehind <strong>the</strong> amendment. I suppose thatit is for different maritime interests, butwhy not say so? In Committee, we werehoping to have some explanations butwe had none. Consequently, we believethat this step backwards is a mistake.We ask <strong>the</strong> plenary session to voteon <strong>the</strong> text that we have submitted wi<strong>the</strong>ventually, <strong>the</strong> French amendment for<strong>the</strong> “Paramount clause” - one takeswhat one can get - even though we donot think it is necessary.Mr. Suchorzewski (Poland). Mr.Chairman, Gentlemen, allow me first,in <strong>the</strong> name of <strong>the</strong> Polish delegation,briefly to analyze <strong>the</strong> text submitted tous by <strong>the</strong> majority of <strong>the</strong> Committee.Points (a) and (b) taken toge<strong>the</strong>r actuallyform <strong>the</strong> single provision that canbe more or less compressed in one sentence,for instance “The Conventionshall apply when <strong>the</strong> bill of lading is issuedin <strong>the</strong> port of loading”.[70]Point (c), which says that <strong>the</strong> Conventionshall apply if <strong>the</strong> two parties include<strong>the</strong> “Paramount clause” in <strong>the</strong>ircontract of carriage, really adds nothingnew. This provision is only <strong>the</strong>re to confirm<strong>the</strong> freedom of <strong>the</strong> parties toarrange <strong>the</strong>ir relations in accordancewith <strong>the</strong>ir will, which cannot be questionedat all and which requires no permissionor particular approval on <strong>the</strong>part of <strong>the</strong> legislator. This stipulation is<strong>the</strong>n superfluous and useless.Consequently, if <strong>the</strong> two first points,(a) and (b), base <strong>the</strong> application of <strong>the</strong>Convention on <strong>the</strong> issuance of bills oflading in <strong>the</strong> port of loading and if point(c) brings nothing new, <strong>the</strong> conclusion is
