Market surveillance can be done at any stage after the completion ong>ofong> the equipment design, assoon as the product is made available ong>forong> distribution or use in the Republic ong>ofong> Serbia. Equipment canbe inspected at the premises ong>ofong> manufacturers, importers, distributors or companies that rent, as well asin transit.What does relevant market surveillance authority checks?- Conong>forong>mity mark and declaration ong>ofong> conong>forong>mity- Instructions- Where applicable, documents on conong>forong>mity to which Declaration ong>ofong> Conong>forong>mity refers to- Technical documentation - if the relevant market surveillance authority has reasonable doubt inconong>forong>mity with the essential health and safety requirements, it may require the submission ong>ofong> technicaldocumentation. Such a request may be submitted at any stage ong>ofong> market surveillance procedure.Actions and measures undertaken by the relevant market surveillance authority in the case ong>ofong> noncomplianceong>ofong> all the products with the requirements from every technical regulation, including noncomplianceong>ofong> equipment with the requirements from the Rulebook, are prescribed by the Law on TechnicalRequirements ong>forong> Products and Conong>forong>mity Assessment, and in the absence ong>ofong> some surveillance measures inthat Law, other surveillance measures from the Law on General Product Safety are applied.10. CONCLUSIONContrary to the Old Approach, the philosophy ong>ofong> the New Approach implies that the Europeandirectives define only essential requirements ong>forong> product safety, and that the detailed technical content,i.e. elaboration ong>ofong> the essential requirements is contained in the so-called harmonized Europeanstandards. When requirements ong>ofong> the harmonized standards are met, it is considered that themanufacturer fulfils the essential requirements contained in the New Approach directives (presumptionong>ofong> conong>forong>mity). Having in mind that fulfilment ong>ofong> requirements from standards is not the only way toensure conong>forong>mity with essential requirements; manufacturer can meet essential requirements inanother manner. This way the voluntary application ong>ofong> standards is preserved.Another element ong>ofong> the New Approach represents a way to verify compliance with the essentialrequirements. Conong>forong>mity assessment is based on the so-called Global Approach, i.e. modules ong>forong>conong>forong>mity assessment. Unlike the Old Approach, compliance with the requirements ong>ofong> the directive isconfirmed by the manufacturer – with a declaration ong>ofong> conong>forong>mity or document ong>ofong> conong>forong>mity whichwere issued by designated conong>forong>mity assessment body, and the government is completely left out fromthe process ong>ofong> conong>forong>mity assessment with the prescribed requirements.Since the Rulebook transposed one ong>ofong> the New Approach directives - EMC 2004/108/EC, thespirit ong>ofong> the New and Global approach is also transferred into technical legislation ong>ofong> the Republic ong>ofong>Serbia. In addition to these basic principles, the Rulebook temporarily introduced, as an additionalmechanism ong>forong> consumer protection, verification ong>ofong> conong>forong>mity ong>ofong> products perong>forong>med by thedesignated bodies.In accordance with Directive 2004/108/EC, as the so-called New Approach directive in the fieldong>ofong> technical legislation ong>ofong> the EU, as well as the law governing the technical requirements ong>forong> productsand conong>forong>mity assessment, this Rulebook prescribes essential new solutions in the field ong>ofong>electromagnetic compatibility requirements ong>forong> equipment that can cause electromagnetic disturbanceand/or that such disturbances do not affect its normal operation; the new solutions in regards tooperators that carry out or participate in the conong>forong>mity assessment and the types ong>ofong> documents ong>ofong>conong>forong>mity, as well as in regards to the voluntary application ong>ofong> Serbian standards that transposeharmonized (European) standards in this field (presumption ong>ofong> conong>forong>mity). This concept differs fromconcept from earlier ong>rulebookong>s and ordinances in the field ong>ofong> electromagnetic compatibility, whichong>ofong>ten contained out ong>ofong> date, inconsistent and too detailed technical and technological solutions andrules, which have, in recent years, started to show unnecessary restrictions and burdens ong>forong> themanufacturers.20

RULEBOOK ON ELECTROMAGNETIC COMPATIBILITY("Official Gazette ong>ofong> RS”, issue No. 13/2010)I INTRODUCTIONScopeArticle 1This Rulebook stipulates the essential requirements that shall be met with regard to theelectromagnetic compatibility prior to placing ong>ofong> equipment on the market and/or putting it into service;presumption ong>ofong> conong>forong>mity; procedures ong>forong> assessing the conong>forong>mity ong>ofong> apparatus; conong>forong>mity mark andconong>forong>mity marking; the content ong>ofong> Declaration ong>ofong> Conong>forong>mity and technical documentation; safeguardclause and criteria that shall be met by a conong>forong>mity assessment body to be notified ong>forong> conong>forong>mityassessment.ApplicationArticle 2This Rulebook applies on equipment liable to cause electromagnetic disturbance, and/or theperong>forong>mance ong>ofong> which is liable to be affected by such disturbance.The application ong>ofong> this Rulebook shall not affect the application ong>ofong> specific regulations regulating thesafety ong>ofong> equipment.Equipment and products to which this Rulebook does not applyArticle 3The provisions ong>ofong> this Rulebook does not apply to following equipment and products:1) Radio and telecommunications terminal equipment regulated by specific regulation;2) Aeronautical products, parts and appliances regulated by specific regulations in the field ong>ofong> civilaviation;3) Radio equipment used by radio amateurs which is not placed on the market as a single unit;4) Equipment, the inherent nature ong>ofong> the physical characteristics ong>ofong> which is such that:(1) it is incapable ong>ofong> generating or contributing to electromagnetic emissions which exceed a levelallowing radio and telecommunication equipment and other equipment to operate as intended;(2) it will operate in compliance with its intended use in the presence ong>ofong> electromagneticdisturbances without unnaceptable degradation ong>ofong> its characteristics.Kits ong>ofong> components to be assembled by radio amateurs and commercial equipment modified by andong>forong> the use ong>ofong> radio amateurs shall not be regarded as radio equipment as per Paragraph 1 (3) ong>ofong> this Article.This Rulebook shall not apply to equipment ong>forong> which essential requirements ong>forong> electromagneticcompatibility under Annex 1 – Essential requirements ong>forong> electromagnetic compatibility, printed with thisRulebook as its integral part, is more specifically regulated by other regulations.21
