DefinitionsArticle 4For the purpose ong>ofong> this Rulebook, the following definitions apply:1) “equipment” means any apparatus or fixed installation;2) “apparatus” means any finished appliance or combination thereong>ofong> with the function intended ong>forong> theend user and intended to be placed on the market as a single commercial unit and liable to generateelectromagnetic disturbances or the perong>forong>mance ong>ofong> which is liable to be affected by such disturbances, aswell as:(1) “components” or “sub-assemblies” intended ong>forong> incorporation into an apparatus by the end user,which are liable to generate electromagnetic disturbances, or the perong>forong>mance ong>ofong> which is liable to beaffected by such disturbances;(2) “mobile installations” defined as a combination ong>ofong> apparatus referred to in Item 2 ong>ofong> this Article,and, where applicable, other apparatus intended to be moved and operated in different locations.3) “fixed installation” means a particular combination ong>ofong> several types ong>ofong> apparatus and/or otherdevices which are assembled, installed and intended to be used permanently at a predefined location;4) “electromagnetic compatibility” means the ability ong>ofong> equipment to function satisfactory in itselectromagnetic environments without introducing intolerable electromagnetic disturbances to otherequipment in that environment;5) “electromagnetic disturbance” means any electromagnetic phenomenon which may degrade theperong>forong>mance ong>ofong> equipment, such as electromagnetic noise, an unwanted signal or a change in the propagationmedium itself;6)”immunity” means the ability ong>ofong> equipment to perong>forong>m as intended without degradation in thepresence ong>ofong> an electromagnetic disturbance;7) “safety purpose” means the purpose ong>ofong> safeguarding human life or property;8) “electromagnetic environment” means all electromagnetic phenomena observable in a givenlocation;9) “placing on the market” means making available ong>forong> the first time in the Republic ong>ofong> Serbia aproduct ong>forong> the purpose ong>ofong> distribution or use, in return ong>forong> payment or free ong>ofong> charge;10) “putting into service” means the first use ong>ofong> equipment ong>forong> its intended purpose in the territory ong>ofong>the Republic ong>ofong> Serbia;11) „manufacturer” means any natural or legal person or entrepreneur who designs and/ormanufactures equipment with a view to its being placed on the market, under his own business name ortrademark or other recognisable label or ong>forong> his own use. In the absence ong>ofong> a manufacturer as defined above,any natural or legal person or entrepreneur who places equipment on the market or puts into service shall beconsidered a manufacturer;12) „authorised representative” means any legal entity or entrepreneur registered in the Republic ong>ofong>Serbia or natural person who is resident in the Republic ong>ofong> Serbia who has been authorised by themanufacturer to perong>forong>m on his behalf all or part ong>ofong> the obligations under this Rulebook;13) “harmonised standard” means a standard adopted by European Standards Bodies, such as: theEuropean Committee ong>forong> Standardisation (CEN); the European Committee ong>forong> ElectrotechnicalStandardization (CENELEC) or the European Telecommunications Standards Institute (ETSI) on the basisong>ofong> an order ong>ofong> European Commission which is published in the Official Journal ong>ofong> the European Union;14) “good engineering practice” means confirmed (verified) solution from the practice with regard todesign, manufacturing or assembly ong>ofong> equipment whose application ensures that the equipment meets safetyrequirements if it used ong>forong> its intended purpose.Terms used in this Rulebook which are not defined under Paragraph 1 ong>ofong> this Article, have meaningsstipulated by laws regulating technical requirements ong>forong> products, general safety ong>ofong> products andstandardisation.22

II PLACING ON THE MARKET AND/ OR PUTTINGINTO SERVICEPlacing on the market and/or putting into serviceArticle 5The equipment to which this Rulebook applies shall be placed on the market and/or put into service inthe Republic ong>ofong> Serbia only if it is in conong>forong>mity with the essential requirements ong>forong> electromagneticcompatibility specified in Annex1 provided that it is properly installed, maintained and used ong>forong> its intendedpurpose.Free movementArticle 6Equipment which complies with requirements under this Rulebook shall be placed on the marketand/or put into service freely, without limitations.The requirements stipulated by this Rulebook shall not affect the application ong>ofong> the following specialmeasures concerning the putting into service or use ong>ofong> equipment:site;1) measures to overcome an existing or predicted electromagnetic compatibility issue at a specific2) measures taken ong>forong> safety reasons to protect public telecommunications networks or receiving ortransmitting stations when used ong>forong> safety purposes in well-defined spectrum situations.The equipment which does not comply to the requirements ong>ofong> this Rulebook may be displayed at tradefairs, exhibitions or similar events, provided that a visible sign clearly indicates that such equipment will notbe placed on the market and /or put into service until it has been brought into conong>forong>mity.Public display and presentation ong>ofong> the equipment referred to in Paragraph 3 ong>ofong> this Article shall beperong>forong>med provided that adequate measures are taken to avoid electromagnetic disturbances.III PRESUMPTION OF CONFORMITYSerbian standards transposing harmonised standardsArticle 7Equipment shall be considered to comply with the essential requirements set out in Annex 1, if it isdesigned and manufactured in accordance with Serbian standards relating to electromagnetic compatibilitywhich transposed relevant harmonised standards, the list ong>ofong> which (hereinafter referred to as: List ong>ofong>standards) is made and published in accordance with the law governing technical requirements ong>forong> productsand conong>forong>mity assessment and the regulation adopted on the basis ong>ofong> that law.This presumption ong>ofong> conong>forong>mity as per Paragraph 1 ong>ofong> this Article is limited to the scope ong>ofong> theharmonised standard(s) applied from the list ong>ofong> standards and the relevant essential requirements covered bysuch standard(s).IV PROCEDURES FOR ASSESSING THE CONFORMITYOF APPARATUSConong>forong>mity assessment procedure applied by manufactureArticle 8Assessment ong>ofong> conong>forong>mity ong>ofong> apparatus with the essential requirements under Annex 1 shall bedemonstrated by the manufacturer by means ong>ofong> the internal production control as set out in Annex 2 –23
