Crl.A.Nos.2295-2296 of 2010 -22-Arabia were instigated to retaliate for theincidents which happened during the monthsof March and April, 2002 and were enticed tofund the terrorist attack. The Fidayeenswere recruited by the said masterminds whotraveled to Ahmedabad by train from Kashmirvia Bareily and they were provided withrifles, hand grenades, gun-powder and otherweapons. The said accused persons joinedthem in providing necessary hide-outs in thecity of Ahmedabad and also provided themtransport to go in and around the city ofAhmedabad and helped them in selecting theplace and time for carrying out the attack.The accused persons also helped in givingthem last rites of namaaz for their wellbeing (Hifazat).”15. The High Court further held that a criminalconspiracy was hatched to strike terror amongst theHindus in the State of Gujarat. The accused personsand the absconding accused, were in connivance, hadgathered the Indian Muslims working in the towns ofJiddah, Shiffa and Riyadh of Saudi Arabia at theresidence of A-3. A-1, A-3 and A-5 and the abscondingaccused Nos. 3 to 5 and 12 to 22, who at the instanceof the ISI of Pakistan became members of the terrorist

They showedthe cassettes of the loss caused to the Muslims in theState of Gujarat and the gruesome photos and thevideos of the dead bodies of Muslim men, women andchildren, at the residence of A-3; distributed thecassettes and made enticing statements to damage theunity and integrity of India and to cause loss to theperson and property of Hindu people. It was alsoobserved by the High Court that to carry out thecriminal conspiracy, the absconding accused No. 16visited the relief camps run at Ahmedabad during thecommunal riots.16. The statements of the injured witnesses wereexamined, which is also adverted to in the impugnedjudgment and the High Court stated that the casualtiesare also proved by the postmortem notes Exs. 170 and171 and by examining various doctors and prosecutionwitnesses.
