freedoms committed by <strong>on</strong>e family member <strong>in</strong> relati<strong>on</strong>to other family member, through physical, psychological,ec<strong>on</strong>omic, sexual abuse or violence, with which thelegal grounds were prepared for issu<strong>in</strong>g protective andrestrictive orders” 33 .The Law requires a large-scale preventi<strong>on</strong> effort thro ughcooperati<strong>on</strong> of government m<strong>in</strong>istries, cour ts, prosecutors,and other stakeholders. The new Law calls for theuse of adm<strong>in</strong>istrative, crim<strong>in</strong>al and civil penalties whereappropriate, and provides two new remedies: a protectiveorder and a restrictive order, to be issued by courtsand police to provide immediate protecti<strong>on</strong> for the victim.The Law requires the establishment of shelter andsocial services and requests that the government ofGeorgia approve an Acti<strong>on</strong> Plan to support these measureswith<strong>in</strong> four m<strong>on</strong>ths of publicati<strong>on</strong> of the new Law 34 .In December 2008, the Presidential Decree establi shedthe advisory and coord<strong>in</strong>ati<strong>on</strong> body <strong>on</strong> DV entitled theState Inter-agency Council <strong>on</strong> <strong>Domestic</strong> <strong>Violence</strong> (theCouncil) to support and strengthen the implementati<strong>on</strong>of the Law <strong>on</strong> DV. This step is widely viewed as a dem<strong>on</strong>strati<strong>on</strong>of the political will and state commitment to theelim<strong>in</strong>ati<strong>on</strong> of DV. The Council, composed of the representativesof the l<strong>in</strong>e m<strong>in</strong>istries, <strong>in</strong>ternati<strong>on</strong>al organizati<strong>on</strong>s,and <strong>in</strong>dependent experts, is tasked with foster<strong>in</strong>gthe effective implementati<strong>on</strong> of the governmental functi<strong>on</strong>sand coord<strong>in</strong>at<strong>in</strong>g the multi-stakeholder efforts <strong>in</strong>prevent<strong>in</strong>g, eradicat<strong>in</strong>g and elim<strong>in</strong>at<strong>in</strong>g all forms of domesticviolence.Furthermore, <strong>in</strong> December 2008 the Statute of the StateFund for Protecti<strong>on</strong> and Assistance of (Statutory) Victimsof Human Traffick<strong>in</strong>g (here<strong>in</strong>after – State Fund) wasalso amended to <strong>in</strong>clude <strong>in</strong> its mandate the work withvictims of domestic violence and implementati<strong>on</strong> of therespective preventive mechanisms. In March, 2009, with the <strong>in</strong>itiative ofthe Interagency Coord<strong>in</strong>ati<strong>on</strong> Council <strong>on</strong> DV, and <strong>in</strong> partnershipwith the Young Lawyers Associati<strong>on</strong> of Georgia(GYLA), UNFPA Georgia co-funded the efforts to developthe <str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g> Referral Mechanisms for the Victims of DV(NRM), which was adopted by the Inter-Agency Council<strong>in</strong> the summer of 2009The absence of the legislative basis for <strong>in</strong>troducti<strong>on</strong>and regulat<strong>in</strong>g the <strong>in</strong>stitute of social workers qualifiedto deal with domestic violence issues, the lack ofshelters, as envisaged by the Law, as well as <strong>in</strong>sufficient<strong>in</strong>volvement of the health care system <strong>in</strong> the preventi<strong>on</strong>and resp<strong>on</strong>se mechanisms rema<strong>in</strong> a barrier to adequatelysupport victims.In 2010 UNIFEM Launches with the generous supportof the Swedish Internati<strong>on</strong>al Development Cooperati<strong>on</strong>Agency (Sida) implementati<strong>on</strong> of the project “Enhanc<strong>in</strong>gPreventi<strong>on</strong> and Resp<strong>on</strong>se to <strong>Domestic</strong> <strong>Violence</strong>” –ShiEld. In the frame of the project UNIFEM will Supportthe State Fund for Protecti<strong>on</strong> and Assistance of (Statutory)Victims of Human Traffick<strong>in</strong>g to build two sheltersfor DV victims <strong>in</strong> Tbilisi and Gori.There are number of NGOs, work<strong>in</strong>g <strong>on</strong> the <strong>Domestic</strong><strong>Violence</strong> issues with relatively extensive experience ofcombat<strong>in</strong>g domestic violence and implemented manyprojects <strong>in</strong> the field.The activities of these agencies, as well as other newand useful <strong>in</strong>formati<strong>on</strong> about efforts to end the most36. With the support of the UNFPA implemented “Combat<strong>in</strong>gGender-based <strong>Violence</strong> <strong>in</strong> the South Caucasus Project”37. NRM-The acti<strong>on</strong> plan for the preventi<strong>on</strong> of domestic violence andthe protecti<strong>on</strong> and rehabilitati<strong>on</strong> of victims of domestic violence is adocument for cooperati<strong>on</strong> and mutual agreement between GeorgianState Instituti<strong>on</strong>s, <strong>in</strong>ternati<strong>on</strong>al organizati<strong>on</strong>s and NGOs work<strong>in</strong>g<strong>on</strong> the issues of domestic violence. The objective of the <str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g>Referral Mechanism is to determ<strong>in</strong>e acti<strong>on</strong>s to be taken to preventdomestic violence as well as to protect and support victims.20
