22. The State issued its Cause Finding onMay 16,2007, and since that time the State,<br />

2 Wyler, and Defendants have not entered into a Conciliation Agreement. The State, having<br />

exhausted its administrative remedies, brings this <strong>Complaint</strong> pursuant to the ACRA, A.R.S. §§<br />

4 41-1471 and 41-1472.<br />

5 COUNT ONE<br />

6 Religious Discrimination in Violation of A.R.S. § 41-1442(A)<br />

7 23.<br />

The State realleges and incorporates by reference the allegations contained in<br />

8 paragraphs 1 through 22 of this <strong>Complaint</strong>.<br />

9 24. Defendants owned and operated Big Dan's, which is and at all relevant times was<br />

10 a place of public accommodation within the meaning of A.R.S. § 41-1441(2);<br />

11 25. Defendants discriminated against Wyler, Andrew Chatwin, Michelle Chatwin,<br />

12 Levi Chatwin, and Michael Chatwin in a place of public accommodation because of religion, in<br />

13<br />

violation of A.R.S. § 41-1442(A).<br />

14 26. As a result of Defendants' discrimination, upon information and belief, Wyler,<br />

15 Andrew Chatwin, Michelle Chatwin, Levi Chatwin, and Michael Chatwin suffered actual and<br />

16 compensatory damages, including damages for emotional distress, and are entitled to and<br />

17 should be compensated in an amount to be determined at trial pursuant to A.R.S. § 41-1472.<br />

The State is entitled to preventive relief, including a permanent injunction or<br />

19 other order against Defendants and any other persons responsible for violation of A.R.S. § 41-<br />

20 1442.<br />

21 28. Pursuant to A.R.S. § 41-1472(B)(4), a civil penalty against Defendants of not<br />

22 more than five thousand dollars for a first violation and ten thousand dollars for any subsequent<br />

23 violation is appropriate to vindicate the public interest.<br />

24 COUNT TWO<br />

25 Religious Discrimination in Violation of A.R.S. § 41-1442(B)<br />

26 29. The State realleges and incorporates by reference the allegations contained in<br />

27 paragraphs 1 through 28 of this <strong>Complaint</strong>.<br />
