No installing, dismantling, rearranging, repairing, servicing, removing, or supplementing of exhibits will bepermitted during the exposition hours.Displays must remain intact and manned until 1:30 p.m., Tuesday, October 28. Exhibitors agree by signingthe Exhibit Rules and Regulations Contract that they (or their staff) will remain on the exhibit hall floor untilthe official close of the trade show, as published in their Exhibitor manual. Product and Literature Distribution: All demonstrations or other activities must be confined to the limitsof the Exhibitor’s booth space and not permitted in the aisles or within the buildings public areas.Distribution of trade publications, invitations, circulars, business cards, stickers, novelties, etc. may bemade only within the space assigned to the Exhibitor distributing such materials.D. General Regulations: No part of the building shall be defaced in any manner, nor shall signs or other articlesbe posted, nailed or otherwise affixed to any pillars, walls, doors, or other parts of the building. No helium balloonswill be allowed. Exhibitors shall be responsible for damage to property. Exhibitors are required to comply withState and Local Fire Codes. Electrical wiring must conform to National Electrical Codes and pass inspection bybuilding staff electricians. Cloth and all other decorating materials must pass fire codes. No flammable liquids willbe allowed inside the facility without approval of the Fire Marshal. Cooking and food/beverage distribution musthave prior approval. Unions Requirements and Labor: Arizona is a “right-to-work” state. To arrange for display labor or materialhandling, complete the order forms found in the Exhibitor’s Manual.A. Display and Exhibit Work - Installation, Dismantling and Decorating: Fulltime employees of anexhibiting firm may install and dismantle their own and respective company displays. Any outside oradditional labor required for installation and dismantle or decorating is to be performed by RenaissanceGlendale Hotel or by exhibitor appointed contractors under the guidelines established by the InternationalAssociation for Exposition Management.B. Materials Delivered to or Picked up From Show/Job Site: All materials received, other than those inexhibitor owned vehicles as described below, will be handled by Renaissance Glendale Hotel. Please referto the shipping instructions and material handling information in the Exhibitor’s Manual.C. Exhibitor Owned Vehicles: Exhibitors, show organizers and other clients may handle their own materials,which can be carried by hand by one person. Exhibitors may not bring or use carts, pallet jacks or othermaterial handling equipment that would interfere with the operations of Renaissance Glendale Hotel. Theabove will be strictly followed.D. All materials, other than exhibitor-handled materials as described above, are chargeable as materialhandling and will be handled through Renaissance Glendale Hotel. To ensure the orderly move in and move out of the show, all docks andvehicle traffic are under the exclusive control of Renaissance Glendale Hotel. Non-Liability: It is expressed, understood, and agreed by each and every contracting Exhibitor, his agents,and his guest that neither NACOL, its employees, its contractors, nor the operator of the local convention centerpremises, its agents, or its employees shall be liable for loss of damage to the goods or properties of Exhibitors. Insurance: The Exhibitor agrees to obtain the following insurance coverage during the dates of the NACOLexposition, including installation and dismantle days, and be prepared to furnish a certificate of insurance toNACOL if requested: (a) comprehensive general liability insurance coverage including protective and contractualliability overage of $250,000/$500,000 for bodily injury and $50,000 property damage; (b) employers liabilityinsurance with minimum limits of $100,000 per accident; (c) worker’s compensation/occupational disease coveragein full compliance with federal and state laws; (d) comprehensive general automobile liability insurance coveringowned, non-owned, and hired vehicles, including loading/unloading hazards with bodily injury limits of$250,000/$500,000 and property damage limits of $100,000.21. Conference Postponement and/or Cancellation: NACOL, in its discretion, shall have the right to postpone orcancel the conference and exhibit and shall be liable in no way to the Exhibitor for losses resulting from such delayor cancellation. The Association will not be liable for the fulfillment of this contract as to the delivery of exhibitspace if non-delivery is due to any of the following causes: by reason of the facility being damaged or destroyed byfire, act of God, public enemy, war or insurrections, strikes, the authority of the law, postponement or cancellation ofthe exposition, or for any cause beyond its control.22. STANDARD CONDITIONS FOR EXHIBITS AND DISPLAYSNon-Flammable Material: All materials used in the Renaissance Hotel & Spa and/orConference Center MUST be non-flammable and conform to the fire regulations of the city ofGlendale. Electrical wiring and equipment installation must conform to city of Glendale codes.Material not conforming to such regulations will be removed immediately at the exhibitor’sexpense. Electric motors of any kind may be operated only with the consent of the Director ofEngineering and approval of the Fire Marshal.Storage: The Renaissance Hotel & Spa has no storage facilities for exhibit materials. All freightmust be shipped to the exhibit contractor for delivery to the hotel when the exhibits are to be setup. Shipments that arrive prior to show time will be refused and/or forwarded to the officialdrayage company at the exhibitor’s expense. In cases where there is no exhibit contractor,exhibitors may ship materials weighing no more than 50 lbs. total. Any shipments over 50 lbs.total may be refused. Shipments will also not be accepted any earlier than three (3) business days(72 hours) prior to exhibit set up day. Shipments arriving earlier will be charged a storage fee of$75.00 per day by Event Management.Liability: The Renaissance Hotel & Spa will not be responsible for any injury, loss or damagethat may occur to the exhibitor, the exhibitor’s employees or property, or to any other personprior, during, or subsequent to the period covered by the exhibit contract. Each exhibitorexpressly releases the Hotel from such liabilities and agrees to indemnify the hotel against anyand all claims for such injury, loss, or damage. Each exhibitor must carry appropriate insuranceto cover any loss or damage to the hotel.Insurance: Exhibitors who desire to carry insurance on their exhibits must place it at their ownexpense.Building Care: The use of nails, staples, tacks, tape, etc. on walls, ceiling, and millwork isstrictly prohibited. Upon participation of any Conference Services International show or event, the exhibitor and its agents shall be bound by the terms and conditions setforth in sections 1 through 14 below. Likewise, once Conference Services International has accepted and approved the exhibitor's offer, any shipper consigning or delivering a shipment toConference Services International or its subcontractors on behalf of the Exhibitor shall be bound by the terms and conditions set forth in sections 1 though 14 below.1. Conference Services International and its subcontractors shall not be liable for damage, loss or delay to uncrated freight, freight improperly packed, glass breakage or concealeddamage as determined by Conference Services International.2. Relative to inbound shipments, there may be lapse of time between the delivery of shipment(s) to the booth by Conference Services International or its subcontractors and the arrival ofthe Exhibitor's representative at the booth. Similarly, relative to outgoing shipment(s), it is possible that there will be a lapse of time between the completion of packing and the actual pickupof material from the booth for loading onto a carrier. It is understood that during such times the shipment(s) will be left in the booths unattended. Therefore, it is agreed that ConferenceServices International and its subcontractors shall not be liable for the loss of, disappearance of, or damage of any items left in the booth unattended at any time. consequently, all bills oflading covering outgoing shipment(s) submitted to Conference Services International or its subcontractors by the Exhibitor will be checked at the time of pickup from the booth and correctedwhere discrepancies exist.3. Conference Services International and its subcontractors shall not be liable for any damage incurred during the handling of materials or equipment requiring special devices toproperly load, place, or reload unless 14 days advance notice has been given to Conference Services International in time to obtain the proper equipment.4. Conference Services International and its subcontractors shall not be responsible for any loss, delay, or damage due to events beyond their reasonable control which cannot beavoided by the exercise of due care and prudence, including without limitation, strikes, labor disputes, lockouts or work stoppages of any kind, fire, theft, windstorm, water, vandalism,terrorism, acts of war, utilities, and other events of force majeure. Any and all work performed by Conference Services International or its subcontractors up to and including the occurrenceof any of the above must be paid in full.5. Conference Services International and its subcontractors shall not be liable for ordinary wear and tear in handling of materials and/or equipment.6. Conference Services International and its subcontractors are not insurers; i.e., Conference Services International does not insure the Exhibitor's property against loss or damage, nordoes it provide for full replacement value should loss or damage occur. Insurance, if any, shall be obtained by the Exhibitor. Amounts payable by Conference Services International underthis paragraph are based on the scope of the liability as herein set forth and are unrelated to the value of the Exhibitor's property. Provisions of this paragraph shall apply if Exhibitor'sproperty is lost of damaged through performance or nonperformance of services by Conference Services International, or from the negligence of Conference Services International, itssubcontractors or their respective employees. If such loss or damage occurs, the liability of Conference Services International and it subcontractors shall be limited to a sum equal to $.30per pound per article, with a maximum liability of $50.00 per item or $1,000.00 per shipment, whichever is less. This amount shall be considered Exhibitor's agreed-upon damages andexclusive remedy.7. Conference Services International and its subcontractors shall not be liable to any extent whatsoever for any indirect, special, incidental, or consequential damages which mayinclude, but are not limited to any actual, potential or assumed loss of profits of revenues, loss of use of equipment or products, or any collateral costs that may result from any loss ordamage to Exhibitor's materials or any injury to Exhibitor's personnel which may make it impossible or impractical for Exhibitor to exhibit its materials.8. Conference Services International will not be bound to honor any claim or action brought against Conference Services International or its subcontractors more than 60 days after thedate of incident.9. The Exhibitor agrees, in connection with the receipt , handling, temporary storage and reloading of its freight, that Conference Services International and its subcontractors will providethese services as Exhibitor's agent and not as bailee or shipper. If any employee of Conference Services International or its subcontractors sign a delivery receipt, bill of lading or otherdocument, the parties agree that Conference Serivces International or its subcontractor will do so as the Exhibitor's agent, and the Exhibitor accepts the responsibility there of10. Conference Services International and its subcontractors shall not be liable for shipments received without receipts, freight bills or specified unit counts on receipts or freightbills. Such shipments will be delivered to booth without guarantee of pice count or condition.11. Empty container labels will be available at the Conference Services International Service Desk. Affixing the labels is the sole responsibility of the Exhibitor or its representative. Itis understood that these labels are used for EMPTY STORAGE ONLY, and Conference Services International and its subcontractors assume no responsibility of liability for loss ordamage to contents while containers are in storage or for mislabeled containers.12. In order to expedite removal of freight from the show site, Conference Services International shall have the authority to change designated carriers, if assigned carriers do not pickup on time. Where no disposition is made by the exhibitor, freight will be taken to a warehouse and forced shipped on a carrier determined by Conference Services International and theExhibitor agrees to be responsible for payment of charges relating to such handling and shipping. Conference Services International assumes no liability as a result of rerouting orhandling.13. Dry and cold Storage - Exhibitor stores products at its own risk. Conference Services International assumes no liability or responsibility for dry or cold storage14. The Exhibitor agrees, in the event of a dispute with Conference Services International or its subcontractors related to any loss or damage to any of the Exhibitor's freight orequipment, that the Exhibitor will not withhold payment in any amount due to Conference Services International for freight handling services or any other services provided byConference Services International or its subcontractor as an offset against the amount of the alleged loss or damage. Instead, the Exhibitor agrees to pay Conference ServicesInternational prior to the close of the show for all such charges and further agrees that any claim the Exhibitor may have against Conference Services International or its subcontractorshall be pursued independently by the Exhibitor as a completely separate transaction to be resolved on its own merits.
