Memorandum of UnderstandingBetween TheUnited States Postal ServiceAnd TheAmerican Postal Workers Uni<strong>on</strong>, AFL-CIORE: <strong>Transfer</strong> <strong>Opportunities</strong> to Mlnimize ExcessingPursuant to :he Memorandum of Understanding (MOU) <strong>on</strong> <strong>Transfer</strong> <strong>Opportunities</strong> to MinimizeExcessing dated September 12,2005, tle parties held a series of meetings to discuss themethods by which this understanding would be implemented. As a result of these meetings theparties agree to the foilowing:1. All <str<strong>on</strong>g>APWU</str<strong>on</strong>g> employees in the irstallatt<strong>on</strong> and affected craftexperiencing excessing fromthe craft or installati<strong>on</strong> may volunlarily submit a request for transfer through eseassign.These employees will be placed <strong>on</strong> a preferred listing within eReassign by date order.These volunteers will be allowed to transf?r out of their impacted installati<strong>on</strong> inaccordance with the MOU <strong>on</strong> <strong>Transfer</strong> Opporiunities to M nimize Excessing and theprocedures described herein.A. Affected employees requesting transfer must meet the minimum qualificali<strong>on</strong>sfor the positi<strong>on</strong> being c<strong>on</strong>sidered.0. In accordance with applicable provisi<strong>on</strong>s of the EL-312 Handbook, nepotismrules are still in effect.C. The following secti<strong>on</strong>s of the <strong>Transfer</strong> Memorandum of Understanding (page305, of the 2000-<strong>2006</strong> Nali<strong>on</strong>al <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>) are modified in order toaccommodate transfer opportunities to minimize excessing. Specifically:1. Secyi<strong>on</strong> B & C (page 305-306) - Ratios c<strong>on</strong>tained in :he <strong>Transfer</strong> MOU arenot applicable to affected employees applying for transfer as a result ofimpending excessing.2. Secti<strong>on</strong> D (page 306)-Affected employees work, attendance and safstyrecords will not be c<strong>on</strong>sidered when appiyirg for transfer as 2 res'~!t ofImpending excessing3. Secti<strong>on</strong> 0.1 (page 305-307) -Affected employees will not be required tohave 18 or 12 m<strong>on</strong>ths of sewice (as appiicable) In their present installati<strong>on</strong>prior to requesting a transfer to another installati<strong>on</strong>. Additi<strong>on</strong>a!ly, any craftlock in period will also not appiy to affected employees that qualify for priorityc<strong>on</strong>siderati<strong>on</strong>.4. Secl~<strong>on</strong> E (page 307)-Am~nlmum of 30 days not~ce to the losinginslallati3n will be afforded if possible. Neither tle gaining nor losinginstallati3n wn p:ace a hoid <strong>on</strong> the employee. The affected employee willbe allowed to transfer prior to lhe excessinc if they desire and choose theireffective date of transfer will coincide with the start of a pay pariod at t?egaining installati<strong>on</strong>. The losing installali<strong>on</strong> ivill coordinate betNeen theemployee and the gaining installati<strong>on</strong>.D. The Postal Service will not provide affected employees copies of vacancies atpostal fac~lities in advance of transfer reqcests. Installati<strong>on</strong>s with hard-to-fillvacancies post them in eReassign as Reassignment Opprtunties.


Employees can requesi raassignrnent to these specific positr<strong>on</strong>s. 11 1s theresp<strong>on</strong>sioility of the affscted employee to check <strong>on</strong> a regslar basis ineReassign for Reassignment <strong>Opportunities</strong>. Employees may also requesttransfers to offlces that do not have reassignment opportunities listed <strong>on</strong>eReassign.2. Seiecti<strong>on</strong>s by installati<strong>on</strong>s accepting transfer :eqLests will be <strong>on</strong> a senior~ty basis usingcraft installati<strong>on</strong> seniority irom the losing ins:allati<strong>on</strong>.A. In the event of a seniority tie, the tie breaker method will be as iollows: a). to:al careerpostal time, and b). entered <strong>on</strong> d~ty aate.8. An empioyee's senbrily in the gain~ng installa!~<strong>on</strong> is eslablishea by the respectivegaining craft anicle in the collective bargainin0 agreement based <strong>on</strong> the emdovee . . beinsa voluntary transfer(not excessed) emiloyee:- .3. An employee accepting a transfer tinder the priority c<strong>on</strong>siderati<strong>on</strong> will have their nameremoved from the priority *Reassign pending request list at ail iocati<strong>on</strong>s. Affectedemployees requesting transfer can change their mind and decline a !ransferopportunity. By doing so, the affected employee's name will be removed from thepriority eReassign pending request list at the declined locatior; and the affectedemployee becomes immediately available for involuntary Article 12 reassignment.4. Employees may transfer across <str<strong>on</strong>g>APWU</str<strong>on</strong>g> craft lines. <strong>Transfer</strong>s outslde crafi lines will beprocessed in accordance with applicable provisior,s of the collective bargainingagreements and postal reguiati<strong>on</strong>s. Affected employees requesting transfer must meetthe minimum qualificati<strong>on</strong>s forthe positi<strong>on</strong> being c<strong>on</strong>sidered. The firs: selecti<strong>on</strong> willcome from sane craf! to same craft prior to making cross craft select~<strong>on</strong>s. There is nopriority c<strong>on</strong>siderati<strong>on</strong> lo n<strong>on</strong>-<str<strong>on</strong>g>APWU</str<strong>on</strong>g> craft positi<strong>on</strong>s.5. Simultaneous (duplicate) iequests for transfer by the same employee to the same craftand installati<strong>on</strong> in eReassign are not parrnitted.6. Empioyee may recsive a printed c<strong>on</strong>firmal<strong>on</strong> of their request through eReassign7, Impacted crafts or occupab<strong>on</strong>al groups in installati<strong>on</strong>s under Anicle 12 withboiding arenot available fcr transfer requests.8. As a result of the MOU, there are ro changes lo the Article 12 time frames farnotficati<strong>on</strong> to the un:<strong>on</strong>.a. D~sputes arising frcm the applicaiicn of Trznsfer Opportun,tles to Minimize ExcessingMCU wiii be processed at the Area level.
