** Ex-serviceman (with arms and without arms) will be allowedout of the above mentioned category. They will be allowed to jointheir duty only after submission of proof like Discharge certificate& Last recorded Photo I.D. which can be verified from relevantquarters.All deployed Security persons must be physically/mentally fit toperform their duty. They can be examined by our Medical Officerwhen required.2. Eligibility Criteria: ( To be eligible in Technical Bid )a) Security agency should be registered with Govt. of India, or anyOther State Govt. or Ministry of Defense, or DGR .They should havelicense under The Private Security Agencies (Regulation) Act, 2005with The Gujarat Private Security Agencies Rules 2007 as amendedfrom time to time. Valid license certified copy along with registrationcertificates needs to be submitted.b) Security agency is requested to submit minimum three work orders.Each work order should be a single work order for minimum of150 security persons. The work order(s) must be of the last threefinancial years i.e. 2010-11, 2011-12 and 2012-13. The above workorders should be of Central/ State PSUs, Medium/Large PrivateIndustrial Organizations, Limited/ Private Companies, National/ Statelevel Autonomous Institutes, , Universities/Educational Institutes etc.c) Security agency is required to submit copy of existing Labour licensepertaining to Work under Contract Labour (Regulation and Abolition)Act 1970.d) Security agency must have PF Registration No with RegionalProvident Fund Commissioner and Service tax Registration Numberwith appropriate authority.e) The Security agency must submit acknowledgement of I-T return filedfor the three financial year‟s i.e F/Y 2009-10, 2010-11 & 2011-12.(Assessment year 2010-11, 2011-12 & 2012-13.).f) Security agency must submit Tender fee of Rs 1000/ and EMD of Rs5,00,000 ( Rs. Five lacs ) by DD/Pay Order.g) Security agency will have to submit last 3 financial years balancesheet (2009-10,2010-11 & 2011-12) along with Profit & Loss accountduly certified by Chartered Accountant.h) The turn-over including other income of the Security agency in anyone of the last 3 financial years i.e. 2009-10, 2010-11 & 2011-12should be Rs. Fifty Lacs or more.i) The agency must submit address proof of the office in the Gujarat.….7

The documents as stated at Point no 2( a) to 2(i) are required to besubmitted in Physical form only and within the stipulated time limit .NOTE: Submission of false or incorrect information, reports ofunprofessional conduct among other things, shall be sufficient groundfor disqualification in this technical bid.3) Other Terms & Conditions:The security work of GMDC is divided into four zones namely Zone-1(Nanichher Power Project / Lignite Project Panandhro Kutchh),Zone-2 (Matanomadh, Gadhasisa, Mandvi-Maska Kutchh), Zone-3(Kadipani, Rajpardi, Tadkeshwar, Shivrajpur), and Zone-4(Bhavnagar, Bhatia, Corporate Office, Ambaji). It is pre decided bythe GMDC management that above four zones would be given to thedifferent four parties and no single party would manage the securityarrangement for more than one zone. As such the agencies have toparticipate in the tender commonly.The four zones would cover the following projects / areas.Zone 1 ( (i) Nanichher Power Project (ii) Lignite Project PanandhroKutchh ) Projects of GMDC Power Project Nanicher (approx 155 Kmfrom Bhuj) At Each Project the required Security personnel are shownat Annex-A which may increase or decrease.Zone 2 (i) Lignite project Mata No Madh (approx 100 Km from Bhuj) (ii)Calcined Bauxite project Ghadshisha (approx 70 Km from Bhuj) (iii)Kranti Veer Shyamji Krishna Varma Smarak, Maska-Mandvi.At Each Project the required Security personnel are shown at Annex-Bwhich may increase or decrease.Zone 3 Projects of GMDC(i) Fluorspar Project Kadipani, Dist : Baroda (ii) Lignite project RajpardiDist Bharuch (iii) Lignite project Tadkeshwar Dist Surat (iv) ManganeseProject , Shivrajpur Dist PanchmahalAt Each Project the required Security personnel are shown at Annex-Cwhich may increase or decrease.Zone 4 Projects of GMDC(i) Lignite Project Bhavnagar, Dist : Bhavnagar (ii) Bauxite projectBhatia Dist Jamnagar (iii) Corporate Office, Ahmedabad (iv) Multi MetalProject, Ambaji Dist Banaskantha.At Each Project the required Security personnel are shown at Annex-Dwhich may increase or decrease.a) The assignment of the security contract is for a period of One year fromthe Date of work order/contract. GMDC reserves the right to extend thework order/ contract tenure on the same terms and conditions foranother one year or more on mutual agreement basis. This will bepurely based on the requirement of the Corporation and againstsatisfactorily genuine performance of the security agency during thetenure.…..8

(f)b) The Security agency will be required to comply with allGovernment/Municipal/Statutory Bodies, Regulations in force pertainingto the work awarded to them by the GMDC. They shall also have tocarry out, perform and observe the provisions of all enactments passedby the Parliament or State Legislature and any rules made there underwill be applicable to them.(g)(h)(i)c) Security agency would issue photo I-cards to each security personnel(at the time of joining) and will provide the names of securitypersonnel along with their complete address to project office/HO ofGMDC. Further suitable and impressive Uniforms (two pairs)along with shoes, cap, belt, torch lathi & whistle will be provided by theagency to the security personnel on joining of his duty. Without abovementioned complete uniform, attendance will not be considered.d) The Agency will perform as per the scope of work and wield results asper the scope, It will execute the Jobs undertaken by it directly and withits own resources and will not give out any part of the assignment onsub-contract.e) Security personnel will have to make their own arrangement forboarding & lodging at the place of duty.All statutory deductions (like Income tax & other taxes) will be madeFrom the bills as per applicable rules.In case Security personnel are found guilty for mis-conduct or is notproviding effective or not adhering to the code of conduct, the agency willchange / remove the Security personnel on intimation from GMDCOfficials. Further in case of any accident and / or death occurring to theSecurity person partial / complete disability, the Security Agency wouldbe liable to pay the compensation as per applicable Govt of India / Govtof Gujarat acts. Security agency will be responsible to take necessaryinsurance policies to cover all risks as per the Statutory Act of Govt. ofIndia / State Government, and will be responsible for payment of thesame.On acceptance of the offer of the selected Security agency, a work order/ legal agreement will be made..In case of any dispute or difference of opinion in the interpretation of anyof the terms & conditions of this tender, the decision of the ManagingDirector of GMDC would be final and the matter may also be referred tothe Sole Arbitrator to be appointed with the consent of both the parties.The proceedings of the said arbitration will be held in Ahmedabad only.The language of the arbitration proceedings will be in English. In case ofany legal proceedings, the court at Ahmedabad only shall haveexclusive.(j) Overtime is not applicable for payment under any circumstances Butone Security personnel can be allowed 12 hours duty in a day.On opening of the price-bid, if there are two equal offers (Percentage ofService Charges) the parties would be selected as under :The Party who is having highest Turnover including other income forF.Y. 2011-12 would be treated as L-1 (First Lowest) and the other partywith lower turnover would be treated as L-2 (Second Lowest)…..9

(t) The agency shall all times during the currency of the contract indemnifyGMDC against all claims damages or compensation for personnelemployed by the agency under the provision of Employees‟Compensation Act as, amended from time to time and shall takeinsurance policy covering all risks, claims, damages or compensationpayable under the E.C.Act or under any other law in relation thereto.The agency shall insure that the insurance policies are kept alive till theexpiry of the contract by timely payment of premiums.4 The Tender & the offera) The present tender is a three bid system. The Corporation may at its discretion seek from any or allbidders, clarification(s) including technical information,documents and materials after the Technical Bid opening butbefore opening price-bid. But no change in the final price orsubstance of the Bid shall be permissible.5. The L1 rate will be considered for all four zones on the basis ofservice charge submitted on line in Annexure-H. It is furtherclarified that any single agency would not be given the work orderfor more than one zone as stated above.Selection of agency for awarding work will be strictly on L1 basis.L1 will be offered to select choice of any one zone. Than L2 will beoffered to select his choice of zone out of rest three availablezones, Similarly L3 and last available zone will be awarded to L4.L1, L2, L3, and L4 will be considered as selected agencies. Allfour parties will have to accept rate offered by L1. Means the rateof L1 will be applicable to all four parties.In case, any party (L2) or (L3) or (L4) is not ready to accept therate of L1, next will be offered i.e L5, L6, L7 accordingly.Rate quoted shall remain valid for 90 days from the date of opening ofthe Technical-Bid, which shall have to be extended unconditionally forfurther maximum period of 30 days, as deem fit by the Corporation11. At the time of scrutiny/ evaluation of the technical bid the Corporationmay, at its discretion, seek any clarification from any of the securityagency but before opening of the Price Bid. 18. Termination: In the event of services rendered being foundunsatisfactory the contract is liable to be terminated by giving 90 daysnotice and security deposit will be forfeited. The decision of the GMDCin this regard will be final.PENALTY :19. Under any circumstances selected security agency will have to deployrequired security persons as per our requirement & work order, If therequired Guard/ Ex-servicemen are not engaged in totality within 15days from the date of our work order, then a penalty of Rs.50/- perGuard per day and Rs.100/- per Ex-serviceman per day would belevied on the Security agency whenever the Security Agency does notprovide their services. This Penalty would be applicable till the currencyof the contract period.At the time of extension of contract, above penalty clause can beconsidered as poor performance.The rates finalized by GMDC are firm and no escalation in the ratewould be allowed during the whole contract period.Service tax will be paid / adjusted / reimbursed to the party as perprevailing rates & rules as per Service Tax Act to the extent directlyrelated to the service rendered by the party under the said contractsubject to production of documentary proof and party will mention theservice tax amount separately in the invoice / bill after considering theabatement if any. Submission of last month‟s certified and verifiedproject-wise separate challan as a proof of depositing the same withthe Government.20. While protecting Theft, Manpower/ Machinery & Assets of theCorporation as well as to protecting encroachment within the leasearea of the concerned Project/Head Office any cognizable incidentoccurs, respective departmental heads & H.R. Head along withresponsible security person/In charge shall have registered F.I.R. withPolice Authority.Against any theft or financial loss/damage of the corporation,equal amount will be recovered from the contractor’s bill. FIR forthe same must be lodged.21. If the security personnel fail to report to the duty in time, agency will notallowed to deploy Security personnel.22. For breach of any of the conditions of the contract there will betermination of contract and forfeiture of performance security.23. The security personnel engaged by the agency shall be dressed inneat and clean uniform (including proper name badges) failing which itwill not allowed to perform in duty.24. For persistent breach or unsatisfactory services there shall betermination of contract along with forfeiture of security deposit andblacklisting.. …17/-
