President Schmitz summarized the Gravel Pit License for MR Paving and ExcavatingInc Councilor Schultz state he understands there are some complaints Tim RayeMR Pavingappeared to answer questions concerning the gravel pit operation He stated they have about 10more years of mining remaining in this pit and added they won t be digging any deeper than theyalready have Councilor Schultz asked how close to the surrounding properties you are able todig Tim Raye explained they can dig within 6 feet of the properties Much discussion ensuedCity Manager Gramentz provided additional information regarding the surrounding propertiesand how close MRPaving may dig to their properties He stated they may dig 6 feet from theCity rightofway which therefore is 66 feet from the actual surrounding property lines on thesouth side of the pit Glenn Wech 1314 Oak Street appeared to state his concern regarding hisproperty in location to this pit He feels it reduces his home value and is quite deep that it causesa danger Mr Wech feels there should be more rules including a continuous 45 degree slope atall times even as they are working in a certain area of the pit Councilor RockVam moved toapprove the issuance of a Gravel Pit License for MR Paving Excavating Inc for periodJanuary 1 2012 through December 31 2012 The motion was duly seconded by CouncilorSchultz and passed by unanimous vote of all membersRESOLUTION 11 111 adopted approving the application of Gary Aschenbrenneron behalf of the New Ulm Girls Fast Pitch Softball Association for a ConditionalUse Permit to operate a batting and pitching recreational facility on propertyzoned 12 General Industrial District at 400 South Valley Street with oneconditionRESOLUTION 11112 adopted authorizing hanging Fasching decorations onMinnesota Street from the south side of Center Street to Second North Street inobservance of the season of Fashing beginning February 6 2012 to approximatelyFebruary 21 2012Councilor Schultz moved to authorize the City Manager to purchase 22 MotorolaXTS2500 Model II portable radios through the Minnesota State Cooperative PurchasingProgram The motion was duly seconded by Councilor Webster and passed by unanimous voteof all membersRESOLUTION 11 113 adopted to accept a 2012 Minnesota Department of PublicSafety Office of Justice Programs Task Force grant in the amount of174 125City Manager Gramentz summarized the request from the Minnesota Music Hall of Fameto place additional signage on the Old Library Museum at 27 North Broadway and authorize thesubmittal of an application to the Heritage Preservation Commission Charlie Braunreiter spokeon behalf of the Minnesota Music Hall of Fame explained their position their wishes and aproposal Much discussion ensued Councilor Webster moved to authorize the signage asCITY OF NEW ULMREGULAR MEETING 118 DECEMBER 6 2011

indicated by the lower of the two to be placed on the Old LibraryMuseum building provided thatHistoric Preservation Commission approves provided that as part of any agreement that the CityAttorney might think would be appropriate for this to occur that there is a provision that whentheir lease expires they would remove the sign and repair any indication or damage caused bythis sign and also that they would remove the existing sign from the planter provided HeritagePreservation Commission approves and provided there is an agreement approved by the CityAttorney where the Minnesota Music Hall of Fame is responsible for removal and repair at theend of the lease and that they take down the existing sign The motion was duly seconded byCouncilor RockVam and passed by unanimous vote of all membersRESOLUTION 11 114 adopted to not waive the monetary limits on municipaltort liability established by Minnesota Statutes 466 04 accepting liabilitycoverage limits of1500 000 from LMCTT effective January 1 2012 andauthorize the City Manager to execute the waive for and on behalf of the City ofNew UlmRESOLUTION 11 115 adopted approving an Easement Agreement with PrairieLand Development LLP for access and utility purposes across the northeasterly80 of Outlot 38RESOLUTION 11 116 adopted approving the Second Addendum to BusinessSubsidy Agreement with Elkay Wood Products CompanyCouncilor Webster moved to approve a general wage adjustment for non unionized fulltime employees of 3 percent with no change in benefit levels for 2012 and that the 2012 feeschedule for City Attorney services provided by Nierengarten and Hippert Ltd remain the sameas approved in 2011 except for increase in 3rd party rate and to authorize the City Manager tomake adjustments to the parttime hourly rated classifications as needed The motion was dulyseconded by President Schmitz Councilor Schultz stated we have hard cuts to make and wouldnot approve this increase Councilor RockVam and Olson agreed that we need to tighten thebelts a bit Councilor Webster stated we need to treat the union and nonunion equally and fairlybut the union wages continue to increase and nonunion wages have not She also noted theamount of inflation and feels we should approve the increase for this year since it has alreadybeen built into the budget Councilor Webster added that the Assistant City Manager positionmay not be filled and these are the employees picking up that slack President Schmitz added histhoughts regarding the unions having representatives and he feels the nonunion employees arebeing used He added we cannot keep doing this or eventually we will see another union torepresent this group of employees President also added pay equity comments CouncilorWebster added more comments on pay equity More discussion ensued Councilor Olsonmoved to table this item to see where pay equity calculation is The motion was duly secondedby Councilor Schultz and passed by unanimous vote of all membersCITY OF NEW ULMREGULAR MEETING 119 DECEMBER 6 2011

DECEMBER 13 2011The ADJOURNED BUDGET HEARING of the City Council of the City of New Ulm BrownCounty Minnesota was duly called and held in the City Hall Council Chambers on the 13 dayof December 2011 at600 pm Present at said meeting were Mayor Beussman City ManagerGramentz Assistant City Engineer Stadheim Finance Director Vorwerk and the followingmembers of the City Council Councilors Olson RockVam Schultz Webster and PresidentSchmitzCity Manager Gramentz summarized the changes that have been made to this pointCouncilor Webster briefly discussed the pay equity compliance City Manager Gramentz offeredsome explanation concerning the pay equity and added information about the PRA fund beingdepleted so it will be an automatic increase of around 65 000 for next year in taxes CouncilorWebster stated she has changed her mind and is now in favor of hiring the second officerCouncilor RockVam stated he would like to see the second Police Officer hired now Discussionensued Councilor Olson added comments about the nonunion wage increase He said he didcalculations and feels we need a minimum of275 because for it to be equivalent with union itshould be at least a 5 increase to catch up with union Councilor Schultz questioned whynegotiating committee doesn t know about this before hand with pay equity Some Councilorsagreed we need to do a better job negotiating with unions City Manager Gramentz discussedhow the negotiations with unions work Councilor Webster stated maybe we just need morecommunications with council concerning the negotiation process More discussion ensuedCouncilor RockVam added discussion regarding the budget and is willing to go with275increase for nonunion employees Jeremy Reed 312 S Washington appeared to state onbehalf of coworkers at the Police Department the hiring of 2 members was a big plus and thankscouncil for following thru with that Councilor RockVam moved to approve revenue andexpenditure adjustments as presented to the Preliminary 2012 Budget by adding 3a of a year of apolice officer and adjustment to275 for nonunion rather than 3 and keep the tax increase atthe 538 and allow staff flexibility in further minor changes needed in arriving at the finalindividual 2012 Budget numbers The motion was duly seconded by Councilor Schultz andpassed by unanimous vote of all membersThe Council thereupon adjourned at650pmReginald K VorwerkFinance DirectorApproved January 3 2012Joel T Albrecht MayorApproved by Council January 3 2012Charles E Schmitz PresidentCity CouncilCITY OF NEW ULM ADJOURNED MEETING 123 December 13 2010

Anniversary celebration of the opening of the New Ulm Public Library The painting wasfunded by a group of about 20 families and businesses in New UlmThe Children sarea had attendance of 209 for seven events during December includingtwo successful visits by Mrs ClausThe Children sServices Librarian worked on an agreement with Early Childhood FamilyEducation in which the New Ulm Public Library will serve as a registration site for a newEarly Childhood Initiative The1000 Books Before Kindergarten program will beginwith a kickoff event at the Library on January 10 from600 700pm The Initiative isopen to all Brown County residents The New Ulm Public Library will be one of severalregistration sites within the countyThe Adult Services Librarian reported that New Ulm Public Library seems to be the onlylibrary in the immediate area providing proctoring services One student drives fromMapleton to New Ulm every time she needs to take a test noting it is closer than drivingto North Dakota where she is taking classes Approximately 65 tests have beenproctored at the Library during 2011The Library received an increase in reference questions this month regarding theDakota Conflict of 1862 With the 150 Anniversary of the event coming up next yearstaff expects a continuing interest in this topic throughout 2012PARK AND RECREATION DEPARTMENT ACTIVITIESRecreation Center To date there are 43 annual pool members 163 SilverSneakersmembers 1249 annual ultimate members and 2756 punch card membersMembership sales for December were approximately34 500Civic Center There are currently 50 annual Civic Center members along with the 77punch card members The ice season is in full swing with association and high schoolpractices and games along with regular figure skating lessons The New Ulm HockeyAssociation hosted two tournaments Ice sales brought in just under 29 200 inrevenue This is an increase from 27 200 in December 2010 The energy efficiencylighting project in both arenas was completed during December Staff continues workingon ice plant repairsThe Park and Recreation Department cosponsored its first ever Skate with SantaProgram on December4 along with AMPI Kraft and Hearts Beat Back Heart of NewUlm Project The event was free with a donation to the New Ulm Area Food Shelf or 1donation The event raised 70 and 230 pounds of food The Department rented out110 pairs of skates Approximately 178 skated but there were around 300 people thatattended the event Special thanks to volunteers Brian and Isabella Foster LaurenDocherty and Kendra KormannActivity Report 5 December 2011

Community Center Staff is working on obtaining pricing and options to refurbish thestage floor The floors were stripped and waxed and carpet was shampooed Therewere several weddings and private events held at the Community CenterParks Staff halted flooding outdoor skating rinks at Harman Park due to the warmtemperatures They also continued working on buckthorn removalclean up at SouthParkSTREET DEPARTMENT ACTIVITIESThe only downtown Snow Emergency during the month was declared on December StnThere was approximately 4 of snow and temperatures were just below freezing andrising One other nuisance snow event required ice control operations during DecemberOtherwise it has been a very warm monthStaff have been kept busy performing much needed tree pruning on the northwestsection of the City Boulevard trees are pruned so maintenance equipment will not hitand break branches pedestrians can use sidewalks unimpeded and sight lines areopened up for safetyCemetery staff are performing maintenance on Cemetery equipment pruning trees andshrubs and performing building maintenance They also assisted with four intermentsThey dig the grave and haul the dirt away prior to the service then haul the dirt back andfill and level the grave after the service In the winter they must also thaw the ground atthe site of the grave prior to diggingELECTRIC DISTRIBUTION DEPARTMENT ACTIVITIESElectric Distribution Department activities during December included coordinated withStreet Department staff to hang Christmas decorations downtown began tree trimmingon residential services and updated and documented system maps to reflect projectsinstalled or upgraded during the yearThe pad mount capacitor banks for the Center Street Substation arrived during the firstweek of December Staff is in the process of completing the final connections andwaiting for proposals from contractors to perform the final acceptance tests on thebanks before they are put into serviceA contractor was on site to test all newly installed large commercial customer metersand current transformersMaintenance activities included 562 hours for maintenance of the overhead system sixhours on the underground system and 46 hours on the street lighting systemTo date 79 service applications have been processed for new underground residentialservices in 2011 Of those 76 have been installed and 73 have been completedActivity Report 6 December 2011

The system experienced no feeder breaker operations and crews responded to threeisolated trouble calls throughout the monthELECTRIC PRODUCTION DEPARTMENT ACTIVITIESElectric Production Department activities during December included rebuilt thefeedwater regulator for the No 2 Boiler serviced the fans pumps and motorsassociated with the No 4 Boiler assisted with the inspection of the fire protectionsystem for the gas turbines and the Administration building and installed a safety tripfor the fans on the No 1 BoilerThe interior floor scan of the 200 000 gallon fuel oil tank used for the gas turbinesrevealed seven areas of corrosion that required 12 diameter seal welded patch plateswhich have been installed The internal data also shows that the edge breakoverexceeds the allowable limits established by American Petroleum Institute 653regulations A contractor has been hired to analyze the excessive settlement of the floorbottom to determine if further repairs are needed or if the tank can be returned toserviceIn the interim staff has arranged for a temporary on site fuel storage facility to facilitatethe operation of the Combustion Turbines into the MISO market to maintain the revenuestream from the units A test run was done on both units on December 13 and theyworked very wellA contractor was on site to inspect the air and oil coolers on the No 4 GE TurbineGenerator and the readings indicate that the tubes are in good shapeThe city peak for November was 275 megawatts which occurred on November 29The Plant purchased 150 megawatt hours and exported 860 Mlbs of steam duringNovemberThe No 2 Boiler is on line fueled with natural gas providing steam to process anddistrict energy customersGAS DEPARTMENT ACTIVITIESGas Department activities during December included completed the monthly sniff testcontinued regulator and valve maintenance continued meter replacement and ERTinstallation and continued equipment maintenanceThe Gas Department Supervisor and a Mechanic Welder attended the Prairieland UtilityCoordinating Committee meeting held in Mankato on December 14Activity Report7 December 2011
