<strong>MIL</strong>-<strong>HDBK</strong>-<strong>502</strong>: ACQUISITIONALOGISTICSconform to the design <strong>and</strong> manufacturing requirements; (b) are free from alldefects in materials <strong>and</strong> workmanship at the time of acceptance or delivery; <strong>and</strong>(c) conform to the essential performance requirements. In effect, the warrantyis an obligation of the contractor to repair or replace equipment found defectiveduring the course of the warranty period. FAR <strong>and</strong> DFARS also providepolicies <strong>and</strong> procedures for tailoring the required warranties to thecircumstances of a particular procurement <strong>and</strong> for obtaining waivers whenneeded. For supplies <strong>and</strong> services—like spares <strong>and</strong> data—that do not meet thedefinition of a weapon system, warranties are elective provided they meet orexceed the foregoing requirements <strong>and</strong> are advantageous to the government. Awarranty of technical data (extended liability) should be included in thesolicitation <strong>and</strong> evaluated on its merits during the source selection.Consideration should also be given to whether non-conforming data should bereplaced or subject to a price adjustment. In designing the contract warrantyclauses, the support systems manager should follow these guidelines:• Provide a realistic mechanism for readministering the warranty.• Maximize the government's ability to use the warranty,considering PHS&T factors.8.4.11 Section J: List of AttachmentsLists of attachments are developed to exp<strong>and</strong> on other sections of thesolicitation <strong>and</strong> contract. Particular attention needs to be given to theconsistency of definitions, the compatibility of cost eliminatingrelationships, the interface of equations, the establishment of contractmilestones, <strong>and</strong> the Order of Precedence clause. Areas of concern to thelogistician in Section J would be:• Logistics portion of the preliminary contract work breakdownstructure• Data requirements, both logistics data items <strong>and</strong> related dataupon which logistics actions are based• Support inputs to the life cycle cost math model• Support equipment exhibits8.4.12 Section K: Representations, Certifications, <strong>and</strong> OtherStatements of Offerors <strong>and</strong> QuotersThis section notifies contractors that they must submit selectedcertifications <strong>and</strong> statements as required by the Federal AcquisitionRegulation <strong>and</strong> other federal laws. Submittals like identification of theparent company, agreeing to abide by the Clean Air <strong>and</strong> Water Act, <strong>and</strong>identifying an authorized signatory for the contract are required. Thelogistician is not responsible for any of the information requested in thissection.8-15
