Legislation that applies to <strong>asbestos</strong> removalRemoval of friable ACM57. Removal (ie collection/clean-up) of any amount of friable ACM that is notfixed or <strong>in</strong>stalled is regarded as greater than a m<strong>in</strong>or contam<strong>in</strong>ation. A classA-licensed removalist is required for this type of removal.Removal of non-friable ACM58. A m<strong>in</strong>or contam<strong>in</strong>ation is where non-friable ACM that is not fixed or <strong>in</strong>stalledcan be removed:(a) with<strong>in</strong> a period of time not exceed<strong>in</strong>g one hour <strong>in</strong> total for the entire removaljob (this period is the cumulative total time for which the removal is carriedout by all employees)(b) the total cumulative time over which all removal jobs undertaken by theemployer or self-employed person does not exceed one hour <strong>in</strong> any periodof seven days (this period is the cumulative total time for which the removalsare carried out by all employees).59. Where the time limits outl<strong>in</strong>ed <strong>in</strong> paragraph 58 (a) or (b) have been or arelikely to be exceeded, the job is greater than a m<strong>in</strong>or contam<strong>in</strong>ation anda class A-licensed removalist is required.How to determ<strong>in</strong>e when the removal job starts and f<strong>in</strong>ishes60. The removal job starts as soon as respiratory protection is required to beworn by persons who will remove (ie collect/clean-up) the <strong>asbestos</strong>.61. The removal job is f<strong>in</strong>ished when respiratory protection is no longer requiredto be worn as part of the removal task.Example of non-friable ACM that is a m<strong>in</strong>or contam<strong>in</strong>ationAn employee f<strong>in</strong>ds an unfixed flue <strong>in</strong> a roof space and some <strong>asbestos</strong> cementdebris. Removal will take 20 m<strong>in</strong>utes <strong>in</strong> total. An employer or self-employedperson is permitted to carry out the removal provided that any other removal ofunfixed or un<strong>in</strong>stalled non-friable ACM does not result <strong>in</strong> the total cumulativetime exceed<strong>in</strong>g one hour over a seven-day period.Example of non-friable ACM that exceeds a m<strong>in</strong>or contam<strong>in</strong>ationA pile of <strong>asbestos</strong> cement roof sheet<strong>in</strong>g is found at the rear of a factory. Theroof sheet<strong>in</strong>g was recently removed from a factory roof and removal will takemore than one hour.
