REPORT ON THE TRAINING WORKSHOP FOR PARALEGALS, NCCK STAFF & PARTNER ORGANISATIONS1.0 EXECUTIVE SUMMARYKenya Legal and Ethical Issues Network <strong>on</strong> HIV and AIDS (KELIN) is a nati<strong>on</strong>al network, which was established to address and resp<strong>on</strong>d to Legal, Ethical and human rights issues relating tohealth. It is <strong>on</strong>e of <strong>the</strong> few organizati<strong>on</strong>s in Kenya and East Africa working in this area. KELIN seeks to fully participate in <strong>the</strong> processes of <strong>for</strong>mulating and implementing global and regi<strong>on</strong>alhealth policies and programs, in order to influence <strong>the</strong>m to factor <strong>the</strong> relevant legal, human rights and ethical perspectives <strong>for</strong> better delivery of <strong>the</strong> programs.The Nati<strong>on</strong>al Council of Churches of Kenya (NCCK) is a family of Christian communi<strong>on</strong>s and organizati<strong>on</strong>s in fellowship and witness. In keeping with <strong>the</strong>ir missi<strong>on</strong> and objectives, NCCKwith support from <strong>the</strong> Nati<strong>on</strong>al AIDS C<strong>on</strong>trol Council through its TOWA project organized a two-day residential <strong>workshop</strong> <strong>for</strong> capacity building of its membership. KELIN facilitated<strong>the</strong> <strong>training</strong> with a focus <strong>on</strong> Human Rights and Legal & Ethical issues in relati<strong>on</strong> to HIV and AIDS. The 51 participants who attended <strong>the</strong> <strong>training</strong> comprised of NCCK <strong>staff</strong>, regi<strong>on</strong>alrepresentatives, faith-based NGOs and community health care workers.The aim of <strong>the</strong> <strong>training</strong>, held at Jumuia C<strong>on</strong>ference Centre, Limuru <strong>on</strong> 8 th & 9 th February 2001, was to streng<strong>the</strong>n <strong>the</strong> capacities of <strong>the</strong> participants in fulfilling <strong>the</strong>ir obligati<strong>on</strong>s towardsaddressing issues relating to HIV within <strong>the</strong>ir various communities. The following were set out as <strong>the</strong> objectives of <strong>the</strong> <strong>training</strong>.The objectives of <strong>the</strong> <strong>training</strong> were:• Introduce/clarify basic human rights c<strong>on</strong>cepts;• Enable an understanding of <strong>the</strong> link between Human Rights and HIV & AIDS;• Understand and articulate gender and gender related c<strong>on</strong>cepts;• Understand <strong>the</strong> legal provisi<strong>on</strong>s in relati<strong>on</strong> to HIV & AIDS;• Understand <strong>the</strong> role of <strong>the</strong> Church in <strong>the</strong> protecti<strong>on</strong> and promoti<strong>on</strong> of health rights;The <strong>training</strong> was facilitated by Mr. Allan Maleche (Coordinator), Ms. Melba Katindi (Advocacy & Training Officer) and Ms. Emma Day (Volunteer), from KELIN. REPORT ON THE TRAINING WORKSHOP FOR PARALEGALS, NCCK STAFF & PARTNER ORGANISATIONS• Case Studies;The <strong>workshop</strong> commenced <strong>on</strong> 8 th February 2011 with introductory remarks from Ms. Imelda Namayi a Program Officer (Educati<strong>on</strong>, Family & Community health) NCCK. This wasfollowed by a 1-hour bible sessi<strong>on</strong>. The participants <strong>the</strong>n introduced <strong>the</strong>mselves and noted down <strong>the</strong>ir expectati<strong>on</strong>s <strong>for</strong> <strong>the</strong> <strong>workshop</strong>, which were <strong>the</strong>n read out be<strong>for</strong>e <strong>the</strong> sessi<strong>on</strong>s begun.The participant’s expectati<strong>on</strong>s were as follows:• To familiarize <strong>the</strong>mselves with legal provisi<strong>on</strong>s <strong>on</strong> HIV and <strong>the</strong>ir applicati<strong>on</strong>• To understand successi<strong>on</strong> laws <strong>for</strong> those bereaved as a result of HIV related deaths• Know how to approach issues affecting <strong>the</strong> c<strong>on</strong>gregati<strong>on</strong> as a result of HIV• To compare best advocacy practices in relati<strong>on</strong> to HIV• To learn more <strong>on</strong> how to care <strong>for</strong> PLWH• To understand Gender disparities in HIV and AIDS• To learn about Human Rights• To learn about health rights• To be empowered <strong>on</strong> HIV issues• To know <strong>the</strong> provisi<strong>on</strong>s of <strong>the</strong> HIV Laws• To gain legal knowledge to be able to advice o<strong>the</strong>rs• To understand <strong>the</strong> role of a paralegal1• To gain an understanding <strong>on</strong> HIV issues and <strong>the</strong> Church• To know how to go about <strong>the</strong> challenges of my work• To know <strong>the</strong> systems in place <strong>for</strong> <strong>the</strong> protecti<strong>on</strong> of PLWH and <strong>the</strong> referral mechanisms• To gain skills <strong>on</strong> how to practically apply <strong>the</strong> knowledge within <strong>the</strong> Church setting• How to give support in terms of eliminating HIV related stigma• Understand <strong>the</strong> role of different partners in <strong>the</strong> implementati<strong>on</strong> of TOWA1 Is a term that is used in most jurisdicti<strong>on</strong>s to describe a legal assistant who supports lawyers in <strong>the</strong>ir legal work. In Kenya, Paralegal is a term loosely used <strong>for</strong> community members who have been legally empowered to be able to givelegal advice community educati<strong>on</strong> and encourage communities to resolve <strong>the</strong>ir own justice issues. Matters bey<strong>on</strong>d <strong>the</strong>ir capacity ought to be referred to a qualified lawyer/advocate.6 Back to <strong>the</strong> top


REPORT ON THE TRAINING WORKSHOP FOR PARALEGALS, NCCK STAFF & PARTNER ORGANISATIONS• To embark <strong>on</strong> a healthy discussi<strong>on</strong> <strong>on</strong> human rights of community members and issues of HIV and AIDS affecting our people• To get a certificate• To networkMr. Allan Maleche <strong>the</strong>n took <strong>the</strong> lead <strong>on</strong> <strong>the</strong> sessi<strong>on</strong> where he introduced his team to <strong>the</strong> participants. He <strong>the</strong>n explained <strong>the</strong> background of KELIN and gave a detailed explanati<strong>on</strong> of <strong>the</strong>organizati<strong>on</strong>’s work. He encouraged active participati<strong>on</strong> during <strong>the</strong> sessi<strong>on</strong>s to ensure better comprehensi<strong>on</strong> of <strong>the</strong> topics.Besides <strong>the</strong> facilitators’ power-point presentati<strong>on</strong>s, <strong>the</strong> approach of <strong>the</strong> <strong>training</strong> was both participatory and interactive; this included questi<strong>on</strong> & answer sessi<strong>on</strong>s, experience sharing, videodocumentaries and interactive debates am<strong>on</strong>g <strong>the</strong> participants.At <strong>the</strong> end of <strong>the</strong> <strong>training</strong>, <strong>the</strong> participants were each provided with a <strong>training</strong> manual prepared by KELIN and copies of all <strong>the</strong> relevant statutes <strong>for</strong> reference and guidance in <strong>the</strong>ir paralegalwork. The participants were assigned various case studies to take with <strong>the</strong>m and work <strong>on</strong> at a regi<strong>on</strong>al level as this was felt would help assist <strong>the</strong>m gauge <strong>the</strong>ir individual competency inaddressing various legal and ethical issues similar to those <strong>the</strong>y are likely to encounter at community level.It was impressive to observe that <strong>the</strong> attendance was gender balanced. We also noted that most of <strong>the</strong> participants were well versed <strong>on</strong> advocacy issues relating to HIV and its preventi<strong>on</strong>, careand management which made <strong>the</strong> discussi<strong>on</strong>s very detailed and in<strong>for</strong>med. However, it was unanimously observed, both by <strong>the</strong> participants and <strong>the</strong> facilitators that <strong>the</strong> time allocated <strong>for</strong> <strong>the</strong><strong>training</strong> was not sufficient to adequately cover <strong>the</strong> modules and comprehensively discuss <strong>the</strong> issues <strong>on</strong> <strong>the</strong> ground.2.0 SUMMARY OF WORKSHOP MODULESThe following is a summary of <strong>the</strong> <strong>workshop</strong> modules/sessi<strong>on</strong>s.2.1 MODULE 1 - INTRODUCTION TO HUMAN RIGHTSParticipants’ thoughts <strong>on</strong> Human Rights:• Rights of human beings• Obligati<strong>on</strong>s of <strong>the</strong> state7 Back to <strong>the</strong> top


REPORT ON THE TRAINING WORKSHOP FOR PARALEGALS, NCCK STAFF & PARTNER ORGANISATIONSIt was explained to <strong>the</strong> participants that an adult of sound mind and understanding has <strong>the</strong> right to refuse treatment in accordance with <strong>the</strong> right to aut<strong>on</strong>omy. This is <strong>the</strong> right every pers<strong>on</strong>has to make <strong>the</strong>ir own decisi<strong>on</strong>s about <strong>the</strong>ir body. This means that a PLWH can decide whe<strong>the</strong>r or not <strong>the</strong>y want to be put <strong>on</strong> ART. This right is however enjoyable as l<strong>on</strong>g as he/she isnot endangering <strong>the</strong> health/lives of o<strong>the</strong>r pers<strong>on</strong>s as provided in <strong>the</strong> Public Health Act. That means if you begin to pose a danger to public health e.g. as is <strong>the</strong> case of some<strong>on</strong>e who hasc<strong>on</strong>tracted Multi-Drug Resistant TB and does not adhere to treatment, <strong>the</strong>n <strong>the</strong> Public Health Act makes provisi<strong>on</strong> <strong>for</strong> that pers<strong>on</strong> to be held in isolati<strong>on</strong> in a medical facility until <strong>the</strong>y stopbeing infectious.There<strong>for</strong>e, if a pers<strong>on</strong> simply refuses treatment but does not do anything intenti<strong>on</strong>ally to aggravate <strong>the</strong> c<strong>on</strong>diti<strong>on</strong> or endanger <strong>the</strong> Public, <strong>the</strong>n <strong>the</strong>y are acting within <strong>the</strong>ir rights. In <strong>the</strong> case ofchildren, involvement of <strong>the</strong> Children’s Department and NGOs working <strong>on</strong> children’s issues is vital especially in cases of difficult parents who decline to administer prescribed medicati<strong>on</strong>.2.2 MODULE 2 - HIV AND GENDER RELATED RIGHTSThis module was designed to impart to <strong>the</strong> participants knowledge <strong>on</strong> gender and <strong>the</strong> gender related principles. It was also designed to visualise <strong>the</strong> feminisati<strong>on</strong> of <strong>the</strong> HIV and AIDSscourge in Kenya and <strong>the</strong> need <strong>for</strong> all interventi<strong>on</strong> to address <strong>the</strong> gender aspects of <strong>the</strong> epidemic. The objective was to enable <strong>the</strong> participants understand and articulate gender and genderrelated c<strong>on</strong>cepts, understand <strong>the</strong> factors relevant to <strong>the</strong> current huge gender disparity relating to HIV and AIDS and <strong>for</strong> <strong>the</strong>m to be able to adopt strategies that fully address gender c<strong>on</strong>cernswithin <strong>the</strong>ir area of work. The presentati<strong>on</strong> by Mr. Maleche addressed <strong>the</strong> increasing feminizati<strong>on</strong> of <strong>the</strong> HIV and AIDS epidemic due to <strong>the</strong> gender gap between men and women andarticulated gender and gender related c<strong>on</strong>cepts. This helped <strong>the</strong> participants appreciate <strong>the</strong> issues of access and c<strong>on</strong>trol in relati<strong>on</strong> to <strong>the</strong> gender roles and fur<strong>the</strong>r how to address genderdiscriminati<strong>on</strong> to enhance community development.Plenary:• The participants discussed in detail <strong>the</strong> various gender disparities that c<strong>on</strong>tributed to women’s vulnerability to HIV, especially in <strong>the</strong> cultural setup. This included practices such aswife inheritance, early childhood marriages, polygamy and patriarchy.2.3 MODULE 3 - STIGMA & DISCRIMINATIONThis module was designed to impart to <strong>the</strong> participants knowledge <strong>on</strong> issues of stigma and discriminati<strong>on</strong> in <strong>the</strong> c<strong>on</strong>text of HIV and AIDS. It is also designed to visualise <strong>the</strong> effect andimpact of stigma <strong>on</strong> HIV and AIDS treatment and preventi<strong>on</strong>. The objective was <strong>for</strong> <strong>the</strong> participants to understand <strong>the</strong> meaning of <strong>the</strong> term stigma and <strong>the</strong> <strong>for</strong>ms and types of stigma thatexist and to distinguish <strong>the</strong> term stigma from <strong>the</strong> term discriminati<strong>on</strong> which are often misperceived to mean <strong>on</strong>e and <strong>the</strong> same thing.The participatory analysis of <strong>the</strong> case Midwa –v- Midwa Case No. 197/2000 [EALR] EA453 (CAK) followed by <strong>the</strong> presentati<strong>on</strong> enabled <strong>the</strong> participants to visualize <strong>the</strong> effect and impactof stigma and discriminati<strong>on</strong> <strong>on</strong> pers<strong>on</strong>s living with HIV, <strong>on</strong> treatment and preventi<strong>on</strong>. Finally <strong>the</strong> participants were enlightened <strong>on</strong> how to support PLHIV to cope with stigma and how to10 Back to <strong>the</strong> top

The participants <strong>the</strong>n discussed <strong>the</strong> initiatives <strong>the</strong>y could take to get <strong>the</strong> community involved.Plenary:• One of <strong>the</strong> participants shared a pers<strong>on</strong>al experience of being a Bishop who is openly and positively living with HIV. He recounted how he discovered his HIV status and that ofhis wife, <strong>the</strong> negative reacti<strong>on</strong>s by <strong>the</strong> church membership, his banishment from <strong>the</strong> Church, his struggle to secure alternative employment and <strong>the</strong> impact of stigma <strong>on</strong> his life andthat of his family. He shared how he finally was able to overcome stigma and live a healthy and productive life. He <strong>the</strong>n explained <strong>the</strong> c<strong>on</strong>troversial work he was now undertakingas a Bishop to educate <strong>the</strong> public about <strong>the</strong> HIV Virus, its preventi<strong>on</strong> and management.• The participants admitted that acceptance of HIV related issues within <strong>the</strong> Church is a difficult task.• The participants also noted <strong>the</strong> stigma associated with basic sex educati<strong>on</strong>, and effective c<strong>on</strong>dom use <strong>for</strong> safe sex.Bishop James Okombo shares his experience <strong>on</strong> stigma and discriminati<strong>on</strong>2.4 MODULE 4 - LEGAL AND ETHICAL ISSUES IN THE CONTEXT OF HIV & AIDSThis sessi<strong>on</strong> basically encompassed <strong>the</strong> legal and ethical aspects of HIV and AIDS focusing <strong>on</strong> In<strong>for</strong>med C<strong>on</strong>sent, Testing <strong>for</strong> HIV and <strong>the</strong> place of c<strong>on</strong>fidentiality of HIV results in variousfields of life such as medical practice, in <strong>the</strong> family, at <strong>the</strong> work place and within <strong>the</strong> community. There was extensive reference to <strong>the</strong> Midwa V Midwa Case No. 197/2000 [EALR] EA45311 Back to <strong>the</strong> top


REPORT ON THE TRAINING WORKSHOP FOR PARALEGALS, NCCK STAFF & PARTNER ORGANISATIONSThe Sexual Offences Act 2006 and The HIV and AIDS Preventi<strong>on</strong> and C<strong>on</strong>trol Act, 2006. O<strong>the</strong>r relevant provisi<strong>on</strong>s of <strong>the</strong> Children’s Act, 2001 and The Successi<strong>on</strong> Act were explained.Plenary:• The participants raised c<strong>on</strong>cern over <strong>the</strong> rate of violati<strong>on</strong>s involving property rights of bereaved women and children. They sought guidance <strong>on</strong> how <strong>the</strong>y could assist.The participants were provided with a detailed list of NGOs working <strong>on</strong> human rights issues and were encouraged to reach out to <strong>the</strong> relevant organizati<strong>on</strong>s <strong>for</strong> assistance <strong>on</strong> such matters.• The c<strong>on</strong>troversial issue of compulsory pre-marital testing of HIV was discussed at length with majority of <strong>the</strong> participants admitting that it was <strong>on</strong>going in most Churches.After a heated debate <strong>on</strong> its appropriateness, <strong>the</strong> legal provisi<strong>on</strong>s were explained to <strong>the</strong> participants. The participants were advised to encourage voluntary testing by couples through spiritualcounseling as opposed to compelling <strong>the</strong> same. It was however advised that HIV specific counseling ought to be referred to qualified health pers<strong>on</strong>nel.• The myth surrounding spiritual healing was demystified.It was firmly stated that, to date, <strong>the</strong>re has been no proof of spiritual healing <strong>for</strong> HIV and <strong>the</strong>re exists no cure <strong>for</strong> HIV. The participants felt that several c<strong>on</strong> artists were maximizing <strong>on</strong>people’s fears to extort m<strong>on</strong>ey from PLWH in <strong>the</strong> promise of a miracle cure! The participants were relieved to learn about <strong>the</strong> existence of <strong>the</strong> Equity Tribunal and proposed a case beinstituted against such pers<strong>on</strong>s.• The participants were finally encouraged to c<strong>on</strong>tact KELIN <strong>for</strong> any guidance, legal advice or legal representati<strong>on</strong> in identified cases of violati<strong>on</strong>s of health and HIV related rights.At <strong>the</strong> close of <strong>the</strong> <strong>training</strong> <strong>workshop</strong>, <strong>the</strong> participants were shown some video documentaries highlighting some projects which as <strong>paralegals</strong> <strong>the</strong>y could c<strong>on</strong>sider replicating within <strong>the</strong>ircommunities <strong>for</strong> <strong>the</strong> protecti<strong>on</strong> of women’s property rights, m<strong>on</strong>itoring of CDF funding within c<strong>on</strong>stituencies, etc. The facilitators made time to discuss with individual participants issuesthat required fur<strong>the</strong>r clarificati<strong>on</strong>s and cases cited by <strong>the</strong>m in which assistance was needed.The <strong>workshop</strong> came to a close <strong>on</strong> Wednesday 9 th February 2011, at 1.45 PM.3.0 TRAINING METHODOLOGYThe participants received maximum opportunity <strong>for</strong> learning through a participatory learning process including structured presentati<strong>on</strong>s, questi<strong>on</strong> & answer sessi<strong>on</strong>s, experience sharing,video documentaries, healthy debates am<strong>on</strong>g <strong>the</strong> participants and case studies.
