(lM[J!m(!p. )..MP.HnING TIlE OFFICIAL ZONE DISTRICT MAP#O6CUOSWHEREAS, the application of Home Places, LLC, petitioner, for the rezoning of lands hereinafterdescribed was duly filed with the office of the Planning Director and thereafter public hearings were heldhereon on the 10111 day of April, 2006 before the Planning Board and the 2nd day of May, 2006, before theTown Council, respectively, pursuant to due notice mailed and published pursuant to G.S. § 160A-384.Thereafter, the Planning Board submitted its final report to the Town Council recommending approval ofsaid application for the rezoning of the lands hereinafter described, all in accordance with the requirementsof the Town of Apex Unified Development Ordinance and the provisions of Chapter 160A, Article 19, of theNorth Carolina General Statutes; NOW, THEREFORE,BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF APEXSection I: The Town of Apex Unified Development Ordinance, including the Town of Apex NorthCarolina Official Zone District Map which is a part of said Ordinance, is hereby amended by changing thezoning classification of the lands hereinafter described from R-40W (Wake County Zoning Designation)to MD-CU ( Medium Density Residential Conditional Use) District, said lands so rezoned being describedas follows:See Attachment " A "....Maximum Density of 3 dwelling units per acre.Detached single family units only.No vinyl siding is allowed.All homes shall have crawl spaces. No slab on grade is allowed in home except for garages.
