Homeless students do not need to wait until academic and healthrecords arrive to attend the new school. The law requires the IMMEDIATEENROLLMENT of homeless students.”“A pers<strong>on</strong> who has not been fully immunized against <strong>on</strong>e or more of the diseaseslisted in Secti<strong>on</strong> 120335 may be admitted by the governing authority <strong>on</strong> c<strong>on</strong>diti<strong>on</strong>that within time periods designated by regulati<strong>on</strong> of the department he or shepresents evidence that he or she has been fully immunized against all of thesediseases.”“Kindergarten entrants, 7th grade entrants, and entrants from outside the U.S. mustpresent the record at or before entry; no ‘grace period’ of attendance is allowed forthese pupils if they do not have a record. The parentor guardian of a homeless child or youth or a homeless child or youth: 1. Offers astatement signed by a doctor… specifying that in the doctor’s opini<strong>on</strong> theimmunizati<strong>on</strong>s required would be injurious to the health and well-being of the childor youth or to any member of the child or youth’s family or household. 2. Providesan affidavit stating that the immunizati<strong>on</strong> c<strong>on</strong>flicts with the tenets and practices of arecognized religious denominati<strong>on</strong>…. 3. Has begun the required immunizati<strong>on</strong>s andis c<strong>on</strong>tinuing to receive the necessary immunizati<strong>on</strong>s as rapidly as is medicallyfeasible, or 4. Is a transfer student from any other school. The school district shallmake every effort to locate or verify the official immunizati<strong>on</strong> records of ahomeless child or youth based <strong>on</strong> informati<strong>on</strong> supplied by the child, youth, parent,or guardian. In circumstances where it is admitted that the homeless child or youthhas not received some or all of the immunizati<strong>on</strong>s required by state law forenrollment and n<strong>on</strong>e of the exempti<strong>on</strong>s listed above is applicable, the district shallrefer the child, youth, and parent or guardian to the local board of health for thepurpose of immunizati<strong>on</strong>, and the school shall provisi<strong>on</strong>ally enroll the child oryouth in accordance with item 3 or 4.”“Pupils who have not completed the required inoculati<strong>on</strong>s may enroll or remainenrolled while completing the required inoculati<strong>on</strong>s if a physician or local healthdepartment certifies that the pupil has received the most recent appropriateinoculati<strong>on</strong>s in all required series…. Ifthe homeless child has not begun his immunizati<strong>on</strong> series, the district homelesseducati<strong>on</strong> coordinator shall take the necessary arrangements with the local publichealth department for immunizati<strong>on</strong>. (An attorney general’s opini<strong>on</strong> 79-420, statesthat a school child who has begun, but not completed, the immunizati<strong>on</strong> schedulemay be permitted to attend classes for a limited period of time as necessary for thecompleti<strong>on</strong> of the immunizati<strong>on</strong> schedule.)“Each local school district’s homeless child educati<strong>on</strong> coordinator or liais<strong>on</strong> shallassist the homeless student in obtaining essential records that may or may not be inexistence. This includes an immunizati<strong>on</strong> certificate. The parent provides the school with a written assurance that the children will beimmunized by private effort within ninety days of enrolling (officially registering)in school or first attendance in school classes, whichever date is the earliest. Thegranting of a 90-day grace period is a <strong>on</strong>e-time provisi<strong>on</strong>. A child transferringfrom <strong>on</strong>e school to another within the state may not be granted a sec<strong>on</strong>d 90-dayperiod. A period of 21 calendar days may be granted to allow for the transfer ofhealth records from <strong>on</strong>e school to another.2. The parent grants written c<strong>on</strong>sent for the child’s immunizati<strong>on</strong> by a publichealth officer, physician, nurse or other authorized pers<strong>on</strong> in the employ, or actingas an agent of the school, where such immunizati<strong>on</strong> programs are in effect.”“The Department is aware that this new requirement may c<strong>on</strong>stitute a departurewith respect to school districts’ enrollment policies. The immunizati<strong>on</strong> statute,G.L.c. 76§15, generally requires students to provide proof of immunizati<strong>on</strong> prior toenrollment. Since McKinney-Vento is a federal law, its requirements override thestate immunizati<strong>on</strong> law. However, it should be noted that the immunizati<strong>on</strong> lawallows, in the absence of a Department of Health declared epidemic or emergency,the enrollment of students who have not been immunized if they have religiousobjecti<strong>on</strong>s to immunizati<strong>on</strong>. Moreover, the Department has c<strong>on</strong>sulted with theDepartment of Public Health (DPH) regarding this issue and DPH agrees that, inthe absence of an emergency or epidemic of disease, the health risk of enrollinghomeless students prior to receiving proof of immunizati<strong>on</strong> is minimal.If a homeless child or youth arrives lacking immunizati<strong>on</strong>s or immunizati<strong>on</strong> ormedical records, refer the parent/guardian to the district’s Homeless Educati<strong>on</strong>Liais<strong>on</strong>, who has the resp<strong>on</strong>sibility to obtain relevant academic records,immunizati<strong>on</strong>s or immunizati<strong>on</strong> or medical records and to ensure that homelessstudents are attending school while the records are obtained.”“The McKinney-Vento Act requires:• All local school districts to immediately enroll students in homeless situati<strong>on</strong>s,even if they do not have required documents, such as immunizati<strong>on</strong> or medicalrecords…. There is no 30-day limit <strong>on</strong> submitting records for a homeless student.Federal law supercedes this state law.)• The local school district’s homeless liais<strong>on</strong>… to immediately assist in obtainingimmunizati<strong>on</strong>s or immunizati<strong>on</strong> or medical records for those students who do nothave them. Students must be enrolled in school during the interim, this includesunaccompanied youth.”“McKinney-Vento states that children and youth experiencing homelessness are notto be excluded from enrolling (and attending) school…. McKinney-Vento does notnegate NH’s statutes for immunizati<strong>on</strong>s, but rather requires students to be enrolledimmediately recognizing that in the vast majority of the cases, students attendedschool previously and a ph<strong>on</strong>e call for records will address immunizati<strong>on</strong> c<strong>on</strong>cernswith hard copies of records to follow…. McKinney-Vento requires the localhomeless educati<strong>on</strong> liais<strong>on</strong> to assist the parent or guardian in obtaining thenecessary immunizati<strong>on</strong>s or medial records. If there are no (medical) recordsavailable, or some immunizati<strong>on</strong>s are missing, McKinney-Vento states that theschool’s local liais<strong>on</strong> must then ensure that the necessary immunizati<strong>on</strong>s and/ormedical records are obtained in a timely manner – by assisting the parents/guardianor youth to agencies where they can be obtained.More homeless children are remaining in their school of origin. The problems withrecord attainment will be minimized. In the event that immunizati<strong>on</strong>s or requiredmedical records are missing: Homeless students are to be enrolled in schoolimmediately. The local liais<strong>on</strong> will work with the school nurse to assist the familyin obtaining, in a timely manner, all the necessary paperwork and/or immunizati<strong>on</strong>sor immunizati<strong>on</strong> records. 30 days is acceptable as a reas<strong>on</strong>able length of time tolocate immunizati<strong>on</strong> records. If a child withdraws, ispromoted, or transfers to another school, preschool, or child care center, theimmunizati<strong>on</strong> record, or a certified copy thereof… shall be sent to the new schoolby the original school or shall be given to the parent or guardian up<strong>on</strong> request,within 24 hours of such a request.“For a child who has begun the process of immunizati<strong>on</strong> and the process is beingaccomplished in accordance with the current NM immunizati<strong>on</strong> schedule, s/he mayenroll in and attend school. For a child who has no documentati<strong>on</strong> and wasformerly enrolled in a school in the US, a ph<strong>on</strong>e call requesting records to verifyimmunizati<strong>on</strong> status is sufficient to be c<strong>on</strong>sidered in process.
