<strong>Residence</strong> Hall <strong>Terms</strong> & <strong>Conditions</strong> 2014-15The following terms <strong>and</strong> conditions shall prevail when a <strong>Residence</strong> Hall <strong>Housing</strong> <strong>and</strong><strong>Dining</strong> Contract is accepted for room <strong>and</strong> board in the residences under the jurisdiction<strong>of</strong> the University <strong>of</strong> California, Berkeley. Please note that this is a room <strong>and</strong> boardcontract; room-only contracts are only available for University apartments.1. PERIOD OF RESIDENCEThe Fall <strong>and</strong> Spring Semesters 2014-2015, as defined by the <strong>of</strong>ficial UniversityAcademic Calendar for graduate <strong>and</strong> undergraduate studentsshall constitute the period <strong>of</strong> residence, except for the semester breakperiod listed below. Room <strong>and</strong> board fees are based upon the <strong>of</strong>ficialUniversity Academic Calendar. All residence halls will remain open forthe Thanksgiving holiday <strong>and</strong> the Spring recess without dining service.<strong>Residence</strong> hall contracts signed for the Spring Semester shall be in effectfor that semester only.2. SEMESTER BREAKAll residence halls will be closed during the Semester Break(12/20/14 - 01/13/15) <strong>and</strong> all residents must vacate the halls uponcommencement <strong>of</strong> the Semester Break on Saturday, December 20,2014 by 10 a.m. Students are not allowed to reside in buildings duringsemester break due to energy curtailment. However, residents areallowed to leave their belongings in the halls over the semester breakat their own risk. Students may move back into the halls beginning at8 a.m. on Wednesday, January 14, 2015.3. PAYMENTSThe $300 advance payment must be submitted when you completeyour room <strong>and</strong> board contract. The balance <strong>of</strong> the annual room<strong>and</strong> board fee may be paid in a lump sum prior to occupancy, or inmonthly installments. Installment payments are due on the 15th<strong>of</strong> each month from August 2014 through May 2015. Five housinginstallments for each semester will be shown on Campus AccountsReceivable System (CARS) e-Bill account on Bear Facts StudentInformation System; sis.berkeley.edu/bearfacts. Your account willindicate the specific date your payment is due. It is your responsibilityto ensure that payments are received by the Campus Billing <strong>and</strong>Payment Office on time or you will be subject to late fines <strong>and</strong> othersanctions. These late fines <strong>and</strong> other sanctions will be shown on yourCARS e-billing statement. Fees will also be assessed for any returnedchecks, <strong>and</strong> you are liable under Civil Code section 1719 for triple theamount <strong>of</strong> the check (a minimum <strong>of</strong> $100 <strong>and</strong> a maximum <strong>of</strong> $1,500)if you have not provided funds necessary to cover th e check within 30days following a written dem<strong>and</strong>.Any additional miscellaneous charges, which include damage orkey replacement charges that may accrue on your account during agiven month are payable in the following month. These charges willappear on the Campus Accounts Receivable System (CARS) e-billingstatement. It is your responsibility to pay any charges that you incur.The same deadlines, service charges, <strong>and</strong> penalties apply to delinquentaccounts as detailed above.If your account becomes delinquent, it may be referred for collectionwith the assessment <strong>of</strong> collection costs, late fees, <strong>and</strong> any additional legalcosts incurred in collecting the outst<strong>and</strong>ing balance. Notwithst<strong>and</strong>ingany referral to a collection agency, the University retains the rightto serve any resident with a Three-Day Notice to Perform Covenant orQuit. In the event that you do not pay the required room <strong>and</strong> boardfees by the established deadline, your contract may be cancelled.Should your account become delinquent, action will be takento lapse your status, block registration, withhold the issuance <strong>of</strong>transcripts, <strong>and</strong>/or withhold meal service. If meal service is withheld,you will not receive a refund for missed meals due to sanctions.To prevent such sanctions, you should contact the Billing <strong>and</strong>Payments Office at (510) 664-9181 prior to the payment deadline.According to Federal policy, residents withdrawing from the Universitywho are entitled to a housing refund may have a portion <strong>of</strong>the refund deducted from their refund check if they received anyFederal Financial Assistance. The funds deducted from the refundwill be returned to the granting agency.4. FEESIn case <strong>of</strong> late occupancy, the room <strong>and</strong> board fee will be adjustedproportionately to the date when you actually move in, provided thatthe delayed occupancy has been approved in writing by Cal <strong>Housing</strong>Assignments Office. There will be no refund if cancellation <strong>of</strong> theresidence hall contract occurs after December 1 for Fall Semester <strong>and</strong>May 1 for Spring Semester.The residence hall rates include a $45 non-refundable fee.A portion <strong>of</strong> each fee is allocated to the <strong>Residence</strong> Hall Assembly<strong>and</strong> the balance is distributed to each hall association. Each hallassociation reserves some monies to cover the repair <strong>of</strong> damages inthe common areas caused by residents or residents’ guests. Damagecharges in excess <strong>of</strong> the reserved amount shall also be billed tothe hall association where individual liability cannot be established.Remaining funds will be used for activities, programs <strong>and</strong>/or improvementsin each residence hall. For Spring Semester only contracts, thenon-refundable fee is $23.The University reserves the right to change the fees for room<strong>and</strong> board, provided the announcement is made 30 days prior to thebeginning <strong>of</strong> the academic year. An increase in fees may not exceed 5percent <strong>of</strong> the fees quoted for residence halls for the Fall <strong>and</strong> SpringSemesters 2014-2015.The advance payment, August, September, October, November <strong>and</strong>December payments cover the cost <strong>of</strong> residence for the Fall Semesteras defined in the <strong>of</strong>ficial University Academic Calendar. The January,February, March, April <strong>and</strong> May payments cover the cost <strong>of</strong> residencefor the Spring Semester as defined in the foregoing calendar.5. TELEPHONE SERVICE PROVIDED BY UNIVERSITY —Resident Telephone <strong>Services</strong>Each room (with the exception <strong>of</strong> Clark Kerr Campus <strong>and</strong> MartinezCommons) has one active telephone jack connected to the University’stelephone network providing basic telephone service. A m<strong>and</strong>atorytelephone service fee <strong>of</strong> $32 is charged to all residents living inUniversity housing. This charge is billed to your CARS account onceeach semester. LIQUIDATED DAMAGESLiquidated damages are imposed under certain conditions as set forthelsewhere in these “<strong>Terms</strong> <strong>and</strong> <strong>Conditions</strong> <strong>of</strong> <strong>Residence</strong>”. The residentagrees that the noted liquidated damages are reasonable <strong>and</strong> arepresumed to be the amount <strong>of</strong> damage sustained by the University becauseit is impracticable or extremely difficult to fix the actual damage.7. TRANSFERSResidents who wish to transfer from one room or residence hall toanother may submit a written transfer request to the Cal <strong>Housing</strong>Assignments Office. Upon written approval by the Cal <strong>Housing</strong> Office,transfers shall be made on a space available basis.8. CANCELLATION OF RESIDENCE HALL CONTRACTA. Contract Cancellation • By Student<strong>Housing</strong> Contract cancellation is not guaranteed <strong>and</strong> is contingenton an eligible replacement accepting your housing contract. Contractholders <strong>and</strong> residents requesting cancellation shall continueto be liable for room <strong>and</strong> board fees until an eligible replacementis found <strong>and</strong>/or the request is approved by the housing <strong>of</strong>ficein writing. If an eligible replacement is not found, the contractholder or resident is financially responsible for the entire balance<strong>of</strong> the contract. Exceptions to the policy <strong>and</strong> approved reasons forcontract cancellation include:1. Revoked admission, withdrawal, graduation before end <strong>of</strong>academic year, dismissal, or leave <strong>of</strong> absence from the Universityfor verified academic or medical reasons with appropriate documentation.2. Marriage after execution <strong>of</strong> the residence hall contract <strong>and</strong>upon presentation <strong>of</strong> the marriage certificate to the Cal <strong>Housing</strong>Assignments Office.All requests for cancellation <strong>of</strong> a residence hall contract MUST BESUBMITTED IN WRITING TO THE RESIDENCE HALL ASSIGNMENTSOFFICE ON THE “RESIDENCE HALL CONTRACT CANCELLATION RE-QUEST” FORM. This form is available at the Cal <strong>Housing</strong> Office locatedat 2610 Channing Way or online at housing.berkeley.edu/housing.In the event <strong>of</strong> contract cancellation approval, the effective cancellationdate will be the date <strong>of</strong> the University approval. Once a replacementis found, <strong>and</strong>/or the request for cancellation is approved, a ContractCancellation Fee will be imposed as liquidated damages, <strong>and</strong> willbe included in the billing statement. A $150 contract cancellation feewill be imposed if the cancellation approval date is prior to occupancy<strong>and</strong> a $300 contract cancellation fee will be imposed for cancellationapproved subsequent to occupancy. The resident agrees that this feeis reasonable <strong>and</strong> is to cover estimated University damages, which aredifficult or impractical to determine. The liquidated damages chargeshall be in addition to the prorated room <strong>and</strong> board fees for whichthe resident will remain liable until a replacement is found <strong>and</strong>/or therequest for termination is approved. A Contract Cancellation Fee shallnot be imposed in the following circumstances:a. Resident will graduate before the end <strong>of</strong> the contract term.b. Resident has been denied admission to the University.c. Resident has completed a medical withdrawal approved bythe Tang Center.Appropriate documentation must be submitted to the Cal <strong>Housing</strong>Assignments Office in the cases <strong>of</strong> graduation <strong>and</strong> non-admission.All other reasons for requesting cancellation <strong>of</strong> the residence hallcontract will be reviewed on an individual basis <strong>and</strong> you are responsiblefor room <strong>and</strong> board fees until a replacement is found, <strong>and</strong>/or therequest is approved. Requests for contract cancellation will not beconsidered until the cancellation is requested in writing <strong>and</strong> you havesubmitted the appropriate supporting documents.B. Contract CANCELLATION • By the UniversityThe University may cancel the residence hall contract <strong>and</strong> all attendantrights <strong>of</strong> occupancy upon 30 days notice to the resident. You maybe subject to a Three-Day Notice to Perform Covenant or Quit or aThree-Day Notice to Quit for any reason allowed by law, including thefollowing:1. If you cease to be a registered student as defined by theUniversity’s Office <strong>of</strong> the Registrar.2. If you violate the terms <strong>of</strong> this residence hall contract,these “<strong>Terms</strong> <strong>and</strong> <strong>Conditions</strong> <strong>of</strong> <strong>Residence</strong>”, provisions <strong>of</strong> BearNecessities Guide to Living On Campus, (see guide online at:issuu.com/gobears/docs/bn1314) or are found guilty <strong>of</strong>misconduct.C. Contract CANCELLATION • No OccupancyIf you do not move in by September 1, 2014, for the Fall Semester <strong>and</strong>by January 23, 2015, for the Spring Semester without previously obtainingapproval in writing from the Cal <strong>Housing</strong> Assignments Office <strong>of</strong> yourintent not to move in, you will be liable for payment <strong>of</strong> room <strong>and</strong> boardfees until a replacement is found, at which time your contract will becancelled <strong>and</strong> a $150 Contract Cancellation Charge will be imposed.D. Failure to MoveIf you do not vacate the residence hall by the designated move-out date<strong>and</strong> time, you will be liable for $100 per day liquidated damages in additionto a prorated room <strong>and</strong> board fee until you actually move out.9. DAMAGESAll residents are individually responsible for loss or damage totheir rooms. All residents <strong>of</strong> a residence hall floor or suite, under theUniversity’s discretion, shall be jointly <strong>and</strong> severally liable for loss ordamage to common areas where individual responsibility cannot bedetermined.You will be given a Room Condition Report at the time <strong>of</strong> occupancy<strong>and</strong> you will compare the actual condition <strong>of</strong> the room with that onthe report, <strong>and</strong> note discrepancies, if any. Unless the report is returnedto the residence halls staff within three days <strong>of</strong> occupancy, with exceptionsproperly noted, it will be assumed that the room <strong>and</strong> its contentsare in the condition indicated on the Room Condition Report. At theend <strong>of</strong> the term, or upon vacating the room for any other reason, youshall be responsible for restoring the premises <strong>and</strong> furniture to thesame condition <strong>and</strong> location they were in at the time <strong>of</strong> occupancy.Reasonable wear <strong>and</strong> tear is expected.10. CAL DININGMeal plan “points” are the currency with which residents use theirmeal plans. <strong>Residence</strong> Hall <strong>Terms</strong> & <strong>Conditions</strong> 2014-15*Ultimate access meal plan holders are not debited meal points forone “all-you-care-to-eat” meal during each meal period.In our retail locations <strong>and</strong> late night service, meal plan points have apurchasing power <strong>of</strong> $1 each. For example, a purchase <strong>of</strong> $2.01 wouldcost 2.01 points.A. <strong>Dining</strong> FacilitiesMeal plan “points” can be used at Cal <strong>Dining</strong>’s residence hall diningcommons, residential retail locations, on-campus restaurants <strong>and</strong>weekly produce st<strong>and</strong>s. Meal points are also accepted at Haas Pavilion,California Memorial Stadium <strong>and</strong> select Cal Athletic venues.<strong>Residence</strong> hall dining commons are Crossroads, Café 3, Foothill <strong>and</strong>Clark Kerr.Cal <strong>Dining</strong> operates four residential retail locations on campus: TheDen, featuring a Peet’s C<strong>of</strong>fee <strong>and</strong> Tea store with made-to-order deli<strong>and</strong> smoothies, Bear Market, a market <strong>of</strong>fering grocery-like options,Cub Market, a convenience store, <strong>and</strong> the CKCub, a grab-<strong>and</strong>-go kioskat Clark Kerr Campus.Cal <strong>Dining</strong> also operates seven on-campus restaurants: Pat Brown’s,Ramona’s Café, Terrace Café, the Golden Bear, Common Grounds, QualcommCyberCafe, <strong>and</strong> The Pro Shop at RSF <strong>of</strong>fer a variety <strong>of</strong> grab-<strong>and</strong>go <strong>and</strong> hot-meal options.B. Meal Plan OptionsWe provide a choice <strong>of</strong> three meal plans for maximum flexibility.Please choose your meal plan carefully since certain meal changes canonly be made from January 1-31, 2015. [See Section C for details.]St<strong>and</strong>ard Plan:The st<strong>and</strong>ard residence hall dining plan gives customers 2500 points touse within the academic year [1250 per semester]. This plan is includedin your housing fees. It provides approximately. 10-12 meals per week.Premium Plan:The premium meal plan <strong>of</strong>fers a higher discount for more points, givingcustomers 3000 points to use within the academic year [1500 per semester]at $350 annually [$175 per semester]. This plan provides a morecomprehensive option, covering more meals, snacks <strong>and</strong> groceries <strong>and</strong>is designed for the student who will be eating many meals on campus.Ultimate Access Plan: The ultimate access meal plan is for studentsthat plan to eat three meals a day <strong>and</strong> have beverages <strong>and</strong> snacksoccasionally. This plan provides 1000 points per academic year [500per semester] <strong>and</strong> unlimited single “all-you-care-to-eat” meal periodentry to the residence hall dining commons. This means that you haveaccess to one “all-you-care-to-eat” meal per meal period at the diningcommons. (ie. breakfast is one, dinner is one, <strong>and</strong> so on). Points areused for retail purchases, guest meals, <strong>and</strong> late night. The cost <strong>of</strong> theultimate access plan is an additional $750 per academic year.Additional points can be added at any time to all plans at 110 percentvalue [for example, $50 would purchase 55 additional points.]Each semester, 50 percent <strong>of</strong> the points are credited to your account.Should the student not use all the Fall points, up to 100 unusedpoints will carry over from the fall to the spring. Points will not carryover from academic year to academic year, therefore all points notused by the last day <strong>of</strong> the spring semester will be forfeited. NOTE: Ifyou cancel your housing contract, your meal points will not rollover.Your meal plan will be cancelled <strong>and</strong> all meal plan points are forfeited.Students can use the points in all residence hall dining commons,campus restaurants or weekly produce st<strong>and</strong>s.FOR ALL CONTRACTS SIGNED AND RETURNED WITHOUT A DININGPLAN INDICATED, the St<strong>and</strong>ard plan will AUTOMATICALLY be assigned.The residence hall housing contract includes room <strong>and</strong> board. If thestudent cancels the housing contract, there is NO REFUND or CREDIT forunused meal plan points. The meal plan will be cancelled, including anyfall rollover points. Over usage <strong>of</strong> your meal plan points upon cancellationmay result in additional charges to your CARS account.C. Meal Plan ChangesMeal plan changes can be made for the spring semester, howeverthere are limited changes that can be made during the fall. Pleasechoose your meal plan carefully. Change meal plans online by completingthe “Meal Plan Change Request Form” available from January 1, 2015to January 31, 2015. A $50 administrative fee will be imposed for any approvedmeal plan downgrade. Point <strong>and</strong> dollar amount credits, refundsor charges will be adjusted based on actual point usage, minus yourchange fee. Outside <strong>of</strong> the <strong>of</strong>ficial change period, you may only upgradeyour meal plan from st<strong>and</strong>ard to premium. You will be assessed $175per semester for the premium plan. No other meal plan change requestswill be approved outside <strong>of</strong> the <strong>of</strong>ficial change period.D. Meal Plan CancellationStudents living in the residence halls are required to have a mealplan <strong>and</strong> cannot cancel their meal plan for any reason. We have acombined room <strong>and</strong> board program <strong>and</strong> cannot separate the cost <strong>of</strong>the meal plan from your room fees.11. Cal 1 CardResidential <strong>and</strong> Student Service Programs uses a computerized systemto control access to its facilities <strong>and</strong> services. Your Cal 1 Card (i.e.your photo ID card) is used to gain access to residence hall <strong>and</strong> diningfacilities. You may deposit money onto your Cal 1 Card debit account onlineby going to cal1card.berkeley.edu. You may use those funds to payfor laundry/vending services in the residence halls, printing/copying servicesat the library <strong>and</strong> IST computing centers, <strong>and</strong> for purchasing food,supplies, textbooks, Cal Gear, etc. at more than 70 on- <strong>and</strong> <strong>of</strong>f-campusmerchant locations. For a complete list <strong>of</strong> accepted Cal 1 Card merchantlocations <strong>and</strong> applicable discounts/promotions <strong>and</strong> to learn more aboutthe benefits <strong>of</strong> using your Cal 1 Card, visit cal1card.berkeley.edu.Campus policy makes it m<strong>and</strong>atory for all campus community membersto obtain a Cal 1 Card ID <strong>and</strong> prohibits custody transfer <strong>of</strong> the ID. If yourcard is lost, stolen, or willfully damaged, you may obtain a replacementcard from the Cal 1 Card <strong>of</strong>fice for a $25 nonrefundable replacement fee.Lost or stolen Cal 1 Cards should also be reported immediately by goingto cal1card.berkeley.edu <strong>and</strong> deactivating your card.The Cal 1 Card <strong>of</strong>fice located at 180 Cesar Chavez Student Center inlower Sproul Plaza <strong>and</strong> is open Monday–Friday from 9 a.m. to 4:30p.m. To get your Cal 1 Card, you MUST provide your Student ID Number(SID) <strong>and</strong> present a current government-issued photo identification card(e.g. driver’s license or passport). University ParkingThere are not enough parking spaces for all <strong>of</strong> the faculty, staff<strong>and</strong> students who work <strong>and</strong> study at the University <strong>of</strong> California,Berkeley. A limited number <strong>of</strong> parking spaces will be allocated toresidents on the basis <strong>of</strong> demonstrated compelling need. Permits willbe issued, on the sole discretion <strong>of</strong> the University, based upon consideration<strong>of</strong> medical needs, job requirements, academic needs, or otherextenuating circumstances. In the 2013-2014 academic year, the maximum Room & Board allocation was $14,232. The cost for some room types are higher thanthe allocation.
