Public ContractDelivery of postal and courier itemsWe, <strong>New</strong> <strong>Zealand</strong> <strong>Post</strong> Limited, will use reasonablecare and skill to provide our services to you. You agreeto pay us the full price for all of our services. We willdeliver postal and courier items correctly addressed toaddresses within our delivery network, which complywith the requirements set out in our <strong><strong>Post</strong>al</strong> Users’<strong>Guide</strong>.You agree not to give us for delivery any itemwhich:is illegal, explosive, dangerous or destructive tosend.is inadequately packaged, or contains anything thatis capable, as packed, of causing injury, or damageto property.contains cash, currency, bullion, traveller’scheques, deeds, negotiable instruments (includingany bearer security, bill of exchange or uncrossedcheque), bonds or shares, credit or bank cards,vouchers, gift cards or tickets for games of chance.is any other type of Prohibited item under the<strong><strong>Post</strong>al</strong> Users’ <strong>Guide</strong>.Unless you have complied with our specifiedconditions of carriage (and the item is notclassified as prohibited for a particular service),you agree not to give us for delivery any itemwhich is:fragile or Restricted (including any precious metalor stone, jewellery, watch, any collectible or antiqueor any painting, sculpture or other work of art); ora postal item with a value of over $250 or aninternational courier item with a value of over$2,000.If you give us for delivery any postal or courieritem referred to above, or in any other way you donot comply with the <strong><strong>Post</strong>al</strong> Users’ <strong>Guide</strong>:you understand that we and our employees andagents are not liable to pay any compensation toyou for any loss or damage to that item; andyou agree to pay us for any resulting liability, costs,damage or loss of any kind.Subject to the conditions set out in our <strong><strong>Post</strong>al</strong>Users’ <strong>Guide</strong>, we limit our liability to you for lossof, or damage to, any item up to a maximum(including GST) of:$250 for any postal item whether for domestic orinternational delivery (other than a letter posted for80c or less (including GST) for which we have noliability under the <strong><strong>Post</strong>al</strong> Services Act 1998). Ourliability for domestic carriage of a postal item is onthe basis of “declared value risk” under theCarriage of Goods Act 1979;$1,500 for any courier item for domestic delivery;and$2,000 for any courier item for internationaldelivery;plus reimbursement of postage if the item has beenlost.We have no liability to you for delay in the delivery ofany item. Our delivery targets are a guide only.However, we will endeavour to ensure that your postalor courier item arrives within our delivery targets.Except as set out above and detailed further in our<strong><strong>Post</strong>al</strong> Users’ <strong>Guide</strong>, we have no liability to you for anydirect or indirect loss, damage or cost, however itarises (including as a result of intentional acts ornegligence by us), subject only to the contrary terms ofany statute including the Consumer Guarantees Act1993 (where applicable).You agree that, where you acquire goods or servicesfrom us for the purpose of your business, theprovisions of the Consumer Guarantees Act 1993which would otherwise apply to the supply by us of anyof our goods or services to you, do not apply.The <strong><strong>Post</strong>al</strong> Users’ <strong>Guide</strong> forms part of this PublicContract and is available for viewing on our website,www.nzpost.co.nz, or at all <strong>Post</strong>Shop stores andselected <strong>New</strong> <strong>Zealand</strong> <strong>Post</strong> retail outlets.Brian RocheChief ExecutiveJuly 2013 Page 1 of 1
