High-speed craft

1 April 20084. “Craft constructed” means a craft the keel of which is laid or which is at a similar stage ofconstruction.5. “Similar stage of construction” means a stage at which:5.1. construction identifiable with a specific craft begins; and5.2. assembly of that craft has commenced comprising at least 50 tonnes or 3% of the estimatedmass of all structural material, whichever is the less.Regulation 2 – Application1. This chapter applies to high-speed craft constructed on or after 1 January 1996, as follows:1.1. passenger craft which do not proceed in the course of their voyage more than 4 h atoperational speed from a place of refuge when fully laden; and1.2. cargo craft of 500 gross tonnage and upwards which do not proceed in the course of theirvoyage more than 8 h at operational speed from a place of refuge when fully laden.1.3. Cargo craft with a gross tonnage below 500 the keels of which are laid on or after 1 January2002 and which do not proceed on their voyage for more than 8 hours at operational speedfrom a place of refuge when fully laden.2. Any craft, irrespective of the date of construction, which undergoes repairs, alterations,modifications and outfitting related thereto shall continue to comply with at least the requirementspreviously applicable to the craft. Such a craft, if constructed before 1 July 2002, shall, as a rule,comply with the requirements for a craft constructed on or after that date to at least the same extentas it did before undergoing such repairs, alterations, modifications or outfitting. Repairs, alterationsand modifications of a major character, and outfitting related thereto, shall meet the requirementsfor a craft constructed on or after 1 July 2002 in so far as the Administration deems reasonable andpracticable.Regulation 3 – Requirements for high-speed craft 3) , 4)1. Notwithstanding the provisions of chapters I to IV and regulations V/18, 19 and 20:1.1. a high-speed craft constructed on or after 1 January 1996 but before 1 July 2002 whichcomplies with the requirements of the High-Speed Craft Code, 1994 in its entirety and whichhas been surveyed and certified as provided in that Code shall be deemed to have compliedwith the requirements of chapters I to IV and regulations V/18, 19 and 20. For the purpose ofthis regulation, the requirements of that Code shall be treated as mandatory;1.2. a high-speed craft constructed on or after 1 July 2002 which complies with the requirementsof the High-Speed Craft Code, 2000 in its entirety and which has been surveyed and certifiedas provided in that Code shall be deemed to have complied with the requirements of chaptersI to IV and regulations V/18, 19 and 20.2. The certificates and permits issued under the High- Speed Craft Code shall have the same force andthe same recognition as the certificates issued under chapter I.3) Reference is made to MSC/Circ.911 as well as MSC/Circ.911/Add.1 which contain interpretations of the provisions onfire safety contained in the International Code of Safety for High-Speed Craft (HSC Code). The interpretations shall be usedas guidelines in connection with compliance with the relevant requirements of the HSC Code for constructive fire safety aswell as installations, arrangements and equipment installed on board high-speed craft after 21 May 1999.4) Reference is also made to MSC/Circ.1001, Interim Guidelines for a simplified evacuation analysis of high-speedpassenger craft.2
