INTRODUCTORYTHE scheme <strong>of</strong> the Trust under whose auspices I havethe privilege <strong>of</strong> deliver<strong>in</strong>g these lectures speaks <strong>of</strong> thefurtherance among the <strong>Common</strong> People <strong>of</strong> the UnitedK<strong>in</strong>gdom <strong>of</strong> the knowledge <strong>of</strong> the Comparative Jurisprudence<strong>of</strong> the chief European countries. <strong>The</strong> theme<strong>of</strong> these lectures has perhaps a wider scope. We shallundoubtedly be <strong>in</strong> the realm <strong>of</strong> comparative jurisprudence;but the comparison will be between thebasic pr<strong>in</strong>ciples which have been the foundation <strong>of</strong>the public <strong>and</strong> private law <strong>of</strong> Engl<strong>and</strong>, <strong>and</strong> thesystem <strong>of</strong> laws <strong>and</strong> adm<strong>in</strong>istration <strong>of</strong> justice calledthe Anglo-<strong>India</strong>n or the Indo-British system <strong>in</strong>towhich these basic English pr<strong>in</strong>ciples have <strong>in</strong> thecourse <strong>of</strong> over two centuries grown <strong>and</strong> developed.Beg<strong>in</strong>n<strong>in</strong>g with its application <strong>in</strong> the seventeenthcentury to British subjects <strong>in</strong> small areas <strong>in</strong> certa<strong>in</strong>parts <strong>of</strong> <strong>India</strong> which were known as the Company'sfactories, the common law <strong>of</strong> Engl<strong>and</strong> with its statutorymodifications <strong>and</strong> the doctr<strong>in</strong>es <strong>of</strong> the Englishcourts <strong>of</strong> equity has deeply coloured <strong>and</strong> <strong>in</strong>fluencedthe laws <strong>and</strong> the system <strong>of</strong> judicial adm<strong>in</strong>istration <strong>of</strong>a whole sub-cont<strong>in</strong>ent <strong>in</strong>habited by nearly four hundredmillion people. <strong>The</strong> law <strong>and</strong> jurisprudence <strong>of</strong>this vast community <strong>and</strong> its pattern <strong>of</strong> judicialadm<strong>in</strong>istration are <strong>in</strong> many matters different from1
