From “Ginny” the Flying Squirrel to <strong>Friends</strong> <strong>of</strong> <strong>Blackwater</strong>:<br />
This has been a “stressful Spring” here in the <strong>Blackwater</strong><br />
<strong>Canyon</strong>!<br />
Late in March, as I was nursing my babies, in my nest<br />
high in an old cherry tree, I heard the engines <strong>of</strong> large trucks<br />
heading up the <strong>Blackwater</strong> River. Then came the whine <strong>of</strong><br />
chainsaws and loud crashing sounds, as some <strong>of</strong> the largest<br />
trees in the <strong>Canyon</strong> were cut to the ground, and hauled away!<br />
187 acres <strong>of</strong> the <strong>Canyon</strong> were timbered. The loggers came<br />
near my nest and my babies, and may have affected other flying<br />
squirrels’ nests.<br />
PLEASE, PLEASE, help save my babies from this chainsaw<br />
madness!<br />
The <strong>Blackwater</strong> <strong>Canyon</strong> is the ideal home for us flying squirrels. The northern hardwoods and conifers,<br />
the cool north-facing slopes, and the shaded mountain streams grow the best mushrooms around for me and<br />
my brood (and for their father, wherever he may be).<br />
As you know, we squirrels can’t vote, and we can’t make donations or write letters. It’s going to take<br />
your “people power” to keep the magnificent <strong>Canyon</strong> intact for future generations <strong>of</strong> squirrels and people<br />
to enjoy. Only you have the power to pressure politicians and agencies to protect us endangered species.<br />
Only you can make the government come up with the money to purchase the <strong>Blackwater</strong> <strong>Canyon</strong> for the public<br />
to enjoy.<br />
Please support <strong>Friends</strong> <strong>of</strong> <strong>Blackwater</strong> as they work for solutions to this assault on my mountain home.<br />
Contact your representatives in Charleston and Washington and ask for permanent protection for <strong>Blackwater</strong><br />

TAKEN THE FIRST STEP AGAINST THE LOGGING!<br />
Logging Halted in <strong>Blackwater</strong> <strong>Canyon</strong><br />
On March 25, 2008 Allegheny Wood Products<br />
began logging in the heart <strong>of</strong> the <strong>Blackwater</strong> <strong>Canyon</strong> – right<br />
across from Big Run. The company did not give required<br />
notice to the Fish and Wildlife Service or the West Virginia<br />
Division <strong>of</strong> Natural Resources, who had given AWP<br />
$171,257 <strong>of</strong> taxpayer dollars to survey for endangered species<br />
locations. AWP also failed to notify the West Virginia<br />
Sierra Club, which has a legally binding contract with AWP<br />
requiring a 60-day notice before logging can begin.<br />
Luckily, a Friend <strong>of</strong> <strong>Blackwater</strong> member learned <strong>of</strong> the log-<br />
ging and notified<br />
us. We obtained<br />

lawyers confirmed that the timbering was illegal.<br />
When AWP was confronted with their illegal<br />
conduct, the company stalled -- they said that<br />
they weren’t hurting anything, and that the “feds”<br />
had been informed back in February (Fish and<br />
Wildlife Service denies this). Then, on Wednesday,<br />
June 4, after logging 174 acres, AWP stated<br />
that they were moving out <strong>of</strong> the <strong>Canyon</strong> – but<br />
that they plan to return and resume logging in 60<br />
days! AWP has also filed notices for two more<br />
timber jobs that have not been reported to the<br />
Fish and Wildlife Service or the Sierra Club.<br />
The bottom line: AWP broke its promises, and<br />
has pr<strong>of</strong>ited from an illegal logging job. They<br />
need to face real consequences for such misconduct.<br />
We are consulting with our partners and<br />
legal advisers and on June 10th we filed a Sixty<br />
Day Notice <strong>of</strong> Intent to Sue under the Endangered<br />
Species Act to protect Ginny the Flying<br />
squirrel -- as well as the Indiana bat, Virginia<br />
big-eared bat, the Cheat mountain salamander<br />
and their spectacular mountain home, the<br />
Mountain Biking Rules the <strong>Canyon</strong> & the highlands<br />
For ten years FOB has been building a<br />
powerful circle <strong>of</strong> love and protection around the<br />

in the <strong>Blackwater</strong> <strong>Canyon</strong>.<br />
BLACKWATER CANYON!! We have been<br />
joined by the Sierra Club, Heartwood, Inc., the<br />
Blue Heron Network, Stewards <strong>of</strong> the Potomac<br />
Highlands, American Lands Alliance, Center<br />
for Biological Diversity, Wild Virginia, the<br />
West Virginia Highlands Conservancy, and the<br />
Maryland Conservation Council.<br />
Some History: This latest action by Allegheny<br />
Wood Products takes us back to 1998, when<br />
the Fish and Wildlife Service first warned the<br />
company that they were building logging roads<br />
that could harm endangered species in <strong>Blackwater</strong><br />
<strong>Canyon</strong>. This led to a lawsuit by the WV<br />
Highlands Conservancy and others demanding<br />
that the company get a Habitat Conservation<br />
Plan (HCP) to protect the four federally listed<br />
species on their property. The company refused.<br />
A hearing in December <strong>of</strong> 1999 to stop a logging<br />
job below the <strong>Blackwater</strong> Trail revealed that the<br />
company had suppressed information about endangered<br />
species. Fish and Wildlife then acted<br />
to reduce the size <strong>of</strong> the log job. Shortly after-<br />
<strong>Blackwater</strong> <strong>Canyon</strong>; and working with others to<br />
build a sustainable, prosperous and resource<br />
stewardship economy in the Allegheny Highlands<br />
and <strong>Blackwater</strong> region.<br />
Part <strong>of</strong> our vision and goal for the<br />
<strong>Canyon</strong>, in public ownership, is as a bicycling<br />
“magnet.” The easy but thrilling 10 mile ride<br />
through the <strong>Blackwater</strong> <strong>Canyon</strong> is one <strong>of</strong> Tucker<br />
County’s and West Virginia’s signature rides.<br />
The <strong>Canyon</strong> hosts a number <strong>of</strong> other spectacular<br />
routes that appeal to riders <strong>of</strong> all abilities.<br />
Promoting and advancing mountain<br />
biking in the <strong>Blackwater</strong> region -- in all its diverse<br />
expressions -- is part <strong>of</strong> the mission <strong>of</strong> <strong>Friends</strong><br />
<strong>of</strong> <strong>Blackwater</strong>. FOB would not support any plan<br />
<strong>of</strong> protection for the <strong>Blackwater</strong> <strong>Canyon</strong> that<br />
would prohibit mountain biking. To the contrary,<br />
FOB’s thousands <strong>of</strong> supporters, including many<br />
businesses like bike shops that distribute our<br />
newsletter, know that we regularly feature<br />
mountain bike events in the region.<br />
Moreover, the <strong>Blackwater</strong> region<br />
--- including Canaan Valley --- has magnetic<br />
properties for bicycling recreation, for thousands<br />
<strong>of</strong> outdoor experience seekers. From repeatvisitor<br />
second home “easy riders,” to hot-dogger<br />
extreme bikers, the forested slopes, broad vistas,<br />
and unparalleled amenities <strong>of</strong> the <strong>Blackwater</strong><br />
region <strong>of</strong>fer diverse challenges and experiences<br />
to bicyclists and their friends and families.<br />

wards the company agree to work on an HCP.<br />
It has been six long years since the agreement<br />
between Fish and Wildlife and AWP on the HCP<br />
was signed. Some research on Ginny the West<br />
Virginia flying squirrel and the other rare “critters”<br />
has been done, but nothing has been made<br />
available for public comment, and no review by<br />
the agency has been completed. The public<br />
and <strong>Friends</strong> <strong>of</strong> <strong>Blackwater</strong> were willing to support<br />
the HCP process (if it is done right!) -- but the<br />
trust has been broken by AWP.<br />
The current economic effects <strong>of</strong> bicycling in the<br />
<strong>Blackwater</strong> region are positive -- but they still<br />
have great untapped potential. Increases in<br />
gas prices will have an overall positive effect<br />
on bicycling in America, including recreational<br />
bicycling. Infrastructure for bicycling is lowcost<br />
and environmentally friendly and additional<br />
infrastructure that supports bicycling can be<br />
created that does not conflict with the most<br />
sensitive ecosystems and habitat. Research<br />
shows that even competitive bicycling events can<br />
be made compatible with sensitive landscapes.<br />
In Virginia, a mountain biking component has<br />
recently been incorporated in a wilderness plan,<br />
and this is a positive development.<br />
One question people <strong>of</strong>ten ask is - What<br />
about biking in the Canaan Valley National<br />
Wildlife Refuge (CVWR)? FOB does not have<br />
expertise in the diverse habitats and landscapes<br />
<strong>of</strong> the Refuge. But FOB does believe that<br />
generally speaking recreational bicycling can<br />
be compatible with the mission and proper<br />
management <strong>of</strong> the CVWR, and the other<br />
remarkable landscapes <strong>of</strong> the Highlands.<br />

G A O Questions Fish and Wildlife’s Proposed Delisting <strong>of</strong> WVNFS<br />
Here’s what West Virginia Congressman<br />
Rahall said at the House Natural Resources<br />
Committee hearing on May 21: “At this point the<br />
best hope for endangered species may simply<br />
be to cling to life until after January when this<br />
president and his cronies, at long last, hit the<br />
unemployment line”.<br />
Rahall’s remarks follow a Government<br />
Accounting Office (GAO) report critical <strong>of</strong> the way<br />
the Department <strong>of</strong> Interior oversees the Endangered<br />
Species Act. One <strong>of</strong> the “critters” to which<br />
Congressman Rahall was referring is “Ginny,”<br />
the West Virginia northern flying squirrel -- a<br />
“poster child” for Wild, Wonderful, West Virginia’s<br />
boreal forests. The GAO report states, “The<br />
West Virginia northern flying squirrel, whose final<br />
delisting decision was pending at the time <strong>of</strong> our<br />
review, <strong>of</strong>fers an example <strong>of</strong> a species proposed<br />
for delisting even though the recovery criteria<br />
have not been met.”<br />

ice age -- a cute, furry, big-eyed nocturnal creature,<br />
who feeds on fungi that grow on the roots <strong>of</strong><br />
trees.<br />
Ginny has been on the endangered species<br />
list since 1986, and she is a symbol <strong>of</strong> West<br />
Virginia’s magnificent Highlands, and a “poster<br />
child” for the diverse ecology <strong>of</strong> the <strong>Blackwater</strong><br />
<strong>Canyon</strong>.<br />
Last year the U.S Fish and Wildlife<br />
Service refused let the public see 196 pages <strong>of</strong><br />
documents about the Service’s wacky proposal<br />
to remove all federal protection from Ginny and<br />
her species. (What can be so secret about a<br />
squirrel?) Congressman Nick Rahall held hear-<br />

The failure <strong>of</strong> Fish and Wildlife to follow<br />
its own rules has become a common problem at<br />
the agency. The Service failed to remove prominent<br />
appointees who colluded with Julie McDonald,<br />
a disgraced former employee who left the<br />
agency after changing scientific reports to reduce<br />
protection to rare species.<br />
Chairman Rahall summarized what he<br />
learned from the GAO’s review, “I am forced<br />
to conclude that not only has the endangered<br />
species program been sorely politicized but effort<br />
after effort supposedly designed to correct<br />
the mishandling <strong>of</strong> the program by this Administration<br />
and its agencies has also been badly<br />
bungled.” Rahall has been a wonderful champion<br />
for Ginny, and we thank him. We hope that this<br />
exposure for Ginny will stop the delisting proposal<br />
in its tracks -- but if not, the “SOS -- Save<br />
Our Squirrel!“ Coalition is prepared to fight for<br />
her continued protection!!<br />

ings that revealed improper political interference<br />
in scientific decisions on species like Ginny.<br />
In a recent interview in our <strong>Friends</strong> <strong>of</strong><br />
<strong>Blackwater</strong> newsletter, Ginny was quoted as<br />
saying she was counting on us humans to keep<br />
her legally protected, since at the moment she’s<br />
pregnant!<br />
So, what are we humans doing to protect<br />
Ginny? Well, more than twenty-five groups have<br />
formed the “SOS! - Save Our Squirrel”<br />
Coalition, and have pledged to protect Ginny<br />
and her family. All <strong>of</strong> the public and expert comments<br />
on the “de-listing” proposal have said that<br />
it would be wrong to remove protection from<br />
“Ginny” and her species.<br />
Now an important scientific opinion about<br />
Ginny has been submitted to Fish and Wildlife by<br />
the distinguished scientist Dr. Robert Leo Smith,<br />
West Virginia University Pr<strong>of</strong>essor Emeritus in<br />
Wildlife Ecology. Dr. Smith has an international<br />
reputation in wildlife population studies,<br />
and he is the author <strong>of</strong> a standard textbook in the<br />
field.<br />
Dr. Smith’s 25 page report concludes:<br />
“Thus, with very weak data on all aspects <strong>of</strong> the<br />
species’ recovery, and lacking any data whatsoever<br />
on the actual population status <strong>of</strong> the<br />
species, the Fish and Wildlife proposal is not<br />
supported by acceptable and provable scientific<br />
evidence showing that the species is no longer<br />
endangered, so as to warrant the removal <strong>of</strong><br />

The “Save Our Squirrel” Coalition welcomes<br />
Dr. Robert Leo Smith’s important scientific<br />
contribution on behalf <strong>of</strong> Ginny, her species,<br />
and those who love the West Virginia Highlands.<br />
Now that a scientist <strong>of</strong> Dr. Smith’s stature has<br />
weighed in solidly on behalf <strong>of</strong> continued protection<br />
for “Ginny,” we hope that Fish and Wildlife<br />
will drop this flawed de-listing proposal<br />
completely. To push ahead with a proposal that<br />
lacks any shred <strong>of</strong> scientific credibility, and that is<br />
bound to be defeated, would be a major waste <strong>of</strong><br />
taxpayer dollars.
FOB Comments on Tier 3.0 Interpretive Rule<br />
On June 3rd <strong>Friends</strong> <strong>of</strong> <strong>Blackwater</strong>’s<br />
Brandae Mullins, Judy Rodd and Sandy Fisher<br />
attended a DEP hearing on West Virginia’s new<br />
anti-degradation (Tier 3.0) rule for protecting<br />
what is termed our state’s most unspoiled rivers<br />
and streams. Waterways protected under the<br />
rule cannot receive further pollution from<br />
industry or development or municipalities.<br />
However, timbering, oil and gas drilling, and<br />
agriculture are exempt from this law. The law<br />
must meet the federal Clean Water Act<br />
standards and be approved by the EPA. The<br />
new rule passed the WV Legislature in March<br />
and is now being finalized by the DEP. Brandae<br />
read the FOB comments which state:<br />
As the “Mother <strong>of</strong> Rivers”, West Virginia is<br />
in the incredibly unique position to protect major<br />
headwater resources in the Mid-Atlantic. In<br />
addition, our rivers, streams and other waterways<br />
provide significant economic, scenic, recreational<br />
and ecological value not only to West Virginia<br />
residents but to all <strong>of</strong> those that visit and enjoy<br />
them.<br />
It is for this reason that we should<br />
indeed all be concerned that they are provided<br />
the utmost protection afforded them under the<br />
Clean Water Act by providing solid anti-degradation<br />
policies that leave few if any gray areas.<br />
These laws must be clear and concise if they are<br />
to be enforceable and as such we must be careful<br />
that they meet at least the minimum federal<br />
requirements. The WVDEP has taken a huge<br />
step forward with these policies and is<br />
moving to the forefront <strong>of</strong> the<br />
anti-degradation questions that plague<br />
many states, by providing clarification<br />
and a well publicized public comment<br />
period.<br />
The concerns raised included:<br />
1. Waters with certain public lands<br />
on both side get Tier 3 protection and so<br />
should waters with public land on only<br />
one side.<br />
2. The definition <strong>of</strong> protected waters<br />
should be expanded to those flowing<br />
through all units <strong>of</strong> the National Park<br />
Service and state forests and cover all rivers that<br />
have met the criteria for Wild and<br />
Scenic River Status.<br />
3. Reproducing trout streams need to be<br />
determined using all available data not just<br />
benthic macroinvertebrates.<br />
4. Degradation <strong>of</strong> a Tier 3.0 section <strong>of</strong><br />
stream is not allowed regardless <strong>of</strong> the source<br />
location <strong>of</strong> the impact.<br />
FOB also advocated for the inclusion <strong>of</strong> the<br />
entire length <strong>of</strong> the <strong>Blackwater</strong> River under Tier 3<br />
by saying:<br />
The <strong>Friends</strong> <strong>of</strong> <strong>Blackwater</strong> believes that all <strong>of</strong> the<br />
<strong>Blackwater</strong> River should receive Tier 3<br />
protection from its headwaters in Canaan Valley<br />
to its confluence with the Dry Fork at Hendricks.<br />
The <strong>Blackwater</strong> River and its tributaries<br />
FOB Strategic Planning: The Next Five Years<br />
Members <strong>of</strong> <strong>Friends</strong> <strong>of</strong> <strong>Blackwater</strong>’s Board and Advisory Board met<br />
in Canaan Valley over the weekend <strong>of</strong> April 11-13, to plan our next five<br />
years <strong>of</strong> work. We met at two beautiful homes at Timberline, donated by the<br />
Foster Family <strong>of</strong> St. Albans, and were led by great consultants from the River<br />
Network, thanks to a grant from the Environmental Support Center. We were<br />
hosted for dinner by the Herz family at Timberline, and were given breakfast<br />
makings by the Charleston Bread Store, Chesapeake Bagels, and Brandae’s<br />
mom. Lunch was catered by Hellbender Burritos <strong>of</strong> Davis.In this spectacular<br />
setting, we discussed<br />

flow through the Canaan Valley Wildlife Refuge,<br />
Monongahela National Forest, Canaan Valley<br />
State Park and <strong>Blackwater</strong> Falls State Park. The<br />
<strong>Blackwater</strong> River is treated as a Wild and Scenic<br />
River by the US Forest Service, has been nominated<br />
as a national natural landmark, and is an<br />
important trout fishery where trout survive year<br />
round. This tourism magnet for outdoor recreation<br />
deserves the highest possible protection by<br />
the state <strong>of</strong> West Virginia.<br />

The 75th Anniversary <strong>of</strong> the CCC<br />

It’s been 75 years since FDR set up a series <strong>of</strong> programs called “The<br />
New Deal” in order to help a financially struggling nation, including West Virginia.<br />
<strong>Friends</strong> <strong>of</strong> <strong>Blackwater</strong> has joined in The New Deal Celebration and is<br />
working with The Preservation Alliance to create a WV New Deal Trail that will<br />
highlight New Deal sites across the state.<br />
When Franklin Delano Roosevelt sent West Virginia his “Tree Army”,<br />
hundreds <strong>of</strong> young men arrived in West Virginia to reduce the number <strong>of</strong> forest<br />
fires that had been raging out <strong>of</strong> control for a number <strong>of</strong> years because <strong>of</strong> the<br />
clear-cutting by lumber companies. “Roosevelt’s Tree Army” gathered hundred<br />
<strong>of</strong> bushels <strong>of</strong> seeds to grow into seedlings to be planted to replace the<br />
forest destroyed in previous years. This and other work done by the Civilian<br />
Conservation Corps Camps laid the basis for our modern day park system.<br />
<strong>Blackwater</strong> Falls State Park and the <strong>Blackwater</strong> <strong>Canyon</strong> Area reaped<br />
the benefits <strong>of</strong> manpower and the $50,200,000 that was invested in the CCC in<br />
our state. In the spring <strong>of</strong> 1933, the CCC took over the reforestation <strong>of</strong> the top<br />
<strong>of</strong> Canaan Mountain. A system <strong>of</strong> trails called The Plantation Trail was carved<br />
out <strong>of</strong> the mountain by the CCC. Before the CCC arrived the land was completely<br />
barren, covered only by roots and stumps. The basic trail network was<br />
built by the CCC; it was a major part <strong>of</strong> their reforestation program. In order to<br />
prevent and control further forest fires, a series <strong>of</strong> fire breaks and a network <strong>of</strong><br />
pump changes were built on the mountain.<br />
Ponds were created by dams so that during a fire a portable pump carried<br />
by the CCC firefighters could be dropped in to siphon water to put out the<br />
fire. The vestiges <strong>of</strong> this network <strong>of</strong> “pump change” dams can still be found on<br />
top <strong>of</strong> Canaan Mountain. A fire tower was built on the mountain called Lookout<br />
Rock Fire Tower. The rock on which the tower stood can be seen today; the<br />
tower is gone.<br />
Years later, in 1943, servicemen used the same area for training maneuvers<br />
during WWII. By the time they arrived, the trees had grown to about<br />
the height <strong>of</strong> a man and the mountain was covered with Red Pine and Spruce,<br />
which had been planted by the CCC. A few random hardwoods had also<br />
grown up, but the forest would not have existed if it hadn’t been for the CCC.<br />
The CCC also trained men to be game managers. Trees were planted<br />
in order to encourage the growth <strong>of</strong> wildlife; stream rehabilitation was also<br />
practiced by the men. Dams were built, hatcheries were stocked.<br />
From 1933-1942 West Virginia housed the CCC. We’re wondering if any<br />
<strong>of</strong> our <strong>Blackwater</strong> <strong>Friends</strong> were members <strong>of</strong> the CCC or had friends or relatives<br />
that were. We’d love it if you could write to us about your experience.<br />

“Harry” Gidley. He was a civil engineer and graduated from UNC in Sanitary<br />
Engineering, today called Environmental Engineering. He was honored by<br />
WVU and is in the WVU Hall <strong>of</strong> Fame for Engineers. As a civil engineer he<br />
worked with the Civilian Conservation Corps (CCC) . According to Susan “My<br />
dad always said that one <strong>of</strong> the crowning glories <strong>of</strong> his career was designing<br />
many <strong>of</strong> the WPA outhouses that were built here in our state during the New<br />

the <strong>Blackwater</strong> Region 1933-1942<br />

This year marks the 75th Anniversary <strong>of</strong> the founding <strong>of</strong> the Civilian Conservation<br />
Corps, familiarly known as the CCC. The Depression years<br />
were not only a time <strong>of</strong> economic distress, but an era <strong>of</strong> vast areas <strong>of</strong> the<br />
American landscape suffering from drought or deforestation. The need<br />
for widespread conservation measures coupled with the lack <strong>of</strong> employment<br />
for young men resulted in the CCC as a part <strong>of</strong> FDR’s plan for<br />
national economic improvement.<br />
The seeds were sown for the need <strong>of</strong> the CCC nearly a half century<br />
or more prior to its creation. The prevailing timbering method <strong>of</strong> the<br />
early Twentieth Century was clear-cutting which seems ruthless mistreatment<br />
<strong>of</strong> the earth by shaving it bear <strong>of</strong> every tree!<br />
Following years <strong>of</strong> logging, the scene on almost every hand<br />
throughout much <strong>of</strong> the Alleghenies was one <strong>of</strong> almost total devastation.<br />
This was especially true in eastern Tucker County where fires following<br />
in the wake <strong>of</strong> loggers even laid bare the bedrock.<br />
Henry Gassaway Davis had vested interests in the timber business<br />
and watched its built-in demise, but he hoped another enterprise<br />
would rise from the ashes <strong>of</strong> the old. Now that the land was rid <strong>of</strong> trees,<br />
it could be sown in grass to feed livestock as a step toward a beef industry<br />
not unlike the American West.<br />
Nothing came <strong>of</strong> the venture because the rock under much <strong>of</strong> the<br />
area doesn’t create soil that grows lush grass. For decades, about the<br />
only green was bracken fern covering seeminly endless acres.<br />
The value <strong>of</strong> trees for slowing run<strong>of</strong>f to aid in flood prevention was<br />
given little thought until a disastrous flood occurred on the Monongahela<br />
River in 1907. Many <strong>of</strong> the mountains at the headwaters <strong>of</strong> the river<br />
were devoid <strong>of</strong> trees by this time and added to the magnitude <strong>of</strong> flooding.<br />
The need to protect and reforest the Monongahela headwaters<br />
was given great impetus with federal legislation in 1911 authorizing the<br />
purchase <strong>of</strong> land for creating the Monongahela National Forest. Fire<br />
suppression and reforestation were given priority among projects initiated<br />
with the establishment <strong>of</strong> the national forest.<br />
Enrollees <strong>of</strong> the CCC had to be unemployed, unmarried and<br />
between the age <strong>of</strong> 18 and 25. Upon acceptance by the corps, recruits<br />
were required to enlist for 6 months and for their service received food,<br />
clothing and living accommodations. Camp Parsons was built at Parsons<br />
near the federal tree nursery with over two hundred recruits from<br />
across West Virginia.<br />
CCC recruits played a key role in halting the spread <strong>of</strong> the white<br />
pine blister rust. Their responsibility was the eradication <strong>of</strong> gooseberry<br />
and currant bushes that serve as the alternate host for the tree disease.<br />
A worker carried a tray <strong>of</strong> seedlings and planted them about six feet<br />
apart as he made his way up a slope. The work was monotonous, tiring<br />
under a hot sun and difficult in rocky terrain. Workers had to be constantly<br />
vigilant in looking out for copperheads and rattlesnakes when<br />
reaching close to the ground!<br />
In 1934, the Conservation Commission leased over 400 acres<br />
including the site <strong>of</strong> <strong>Blackwater</strong> Falls in the first step in the creation <strong>of</strong><br />
<strong>Blackwater</strong> Falls State Park. CCC workers were soon reforesting the<br />
area and it was even necessary to bring in topsoil to cover places that<br />
had been totally denuded.<br />
Reforestation was carried out on a seasonal basis with the magnitude<br />
revealed in figures for the spring <strong>of</strong> 1937. More than 1500 acres<br />
were planted with nearly a half million red pine seedlings.

Lawsuit to be filed to Protect Wildlife from NedPower Industrial Wind Project near Dolly Sods Wilderness<br />
On May 8th 2007, eleven citizens’ groups<br />
filed a Sixty Day Notice <strong>of</strong> Intent to Sue regarding<br />
the company NedPower Mt. Storm, and its<br />
corporate owners Dominion Resources, and<br />
Shell Wind Energy. The Notice alleges violations<br />
<strong>of</strong> the Endangered Species Act, involving the<br />
West Virginia northern flying squirrel, the Indiana<br />
bat, and the Virginia big-eared bat. The Notice<br />
also raises concerns about impacts to bald and<br />
golden eagles and migrating birds that are protected<br />
under the Migratory Bird Treaty Act.<br />
The citizens’ groups are demanding<br />
that the industrial wind corporation apply for<br />
an incidental take permit, and modify or stop<br />
construction <strong>of</strong> this project, before irreparable<br />
harm is done to West Virginia’s natural heritage.<br />
“NedPower has ignored the huge number <strong>of</strong><br />
birds and bats that will be killed each year by the<br />
project, ignored the golden eagles that will be<br />
decapitated as they try to return to their winter<br />

homes near Mt. Storm Lake, and ignored<br />
threats to bald eagles that catch fish at the<br />
Lake” said Judy Rodd <strong>of</strong> <strong>Friends</strong> <strong>of</strong> <strong>Blackwater</strong>.<br />
“NedPower is clearing acres <strong>of</strong> land<br />
in endangered flying squirrel habitat just a<br />
few miles north <strong>of</strong> the Dolly Sods Wilderness<br />
area. We believe that this project is in<br />
violation <strong>of</strong> federal law.”<br />
<strong>Friends</strong> <strong>of</strong> <strong>Blackwater</strong>, <strong>Friends</strong> <strong>of</strong><br />
the Allegheny Front, <strong>Friends</strong> <strong>of</strong> the Appalachian<br />
Highlands, <strong>Friends</strong> <strong>of</strong> Backbone<br />
Mountain, <strong>Friends</strong> <strong>of</strong> Beautiful Pendleton<br />
County, Highlanders for Responsible<br />
Development, Laurel Mountain Preservation<br />
Association, the Maryland Alliance for<br />
Greenway Improvement and Conservation,<br />
the Maryland Conservation Council, Mountain<br />
Communities for Responsible Energy, and Stewards<br />
<strong>of</strong> the Potomac Highlands are challenging<br />
NedPower’s claim that the project will have no<br />
impact on these rare species.<br />
The groups point out that researchers<br />
estimate that 4,000 bats<br />
were killed in one year at the Mountaineer<br />
Wind Project less than 14 miles<br />
away -- and this killing continues. Dr.<br />
Thomas Kunz, bat expert from Boston<br />
University, has raised the alarm over<br />
the double threat to bats from industrial<br />
wind turbines and white nose syndrome<br />
in the national media.(see NPR Talk<br />

<strong>of</strong> the Nation 4/18/08). Dr. Kunz concludes that<br />
the NedPower project “is quite likely to result in<br />
the deaths <strong>of</strong> … bats from one or both <strong>of</strong> these<br />
endangered species.” His support letter is attached<br />
to the notice letter.<br />
In addition to threats to endangered bats,<br />
the groups raise concerns that the NedPower<br />
project has already damaged the habitat <strong>of</strong> the<br />
West Virginia northern flying squirrel. A scientific<br />
analysis <strong>of</strong> the impacts <strong>of</strong> the project, written by<br />
WVU Pr<strong>of</strong>essor Emeritus Robert Leo Smith, and<br />
also attached to the notice letter, states that the<br />
young <strong>of</strong> these endangered squirrels could be<br />
killed as land is cleared for roads, power lines<br />
and turbine pads.<br />
We recently heard from William H. “Marty” Martin, one <strong>of</strong> our favorite researchers. Marty has been studying the life cycle <strong>of</strong> the<br />
timber rattlesnake for 25 years. He regularly visits several dens that have been in existence on the Allegheny Front for thousands <strong>of</strong> years -- to check<br />
on the emergence <strong>of</strong> snakes in the spring. Marty had been concerned about the possible disruption <strong>of</strong> the snake dens by the construction <strong>of</strong> the Ned-<br />
Power Industrial Wind Turbines, but he was assured that the dens, located in rock piles, with crevasses going into the earth, would not be disturbed.<br />
When Marty returned to his study site this Spring, this is what he found: “It is finished. There is nothing left to save. The nicest part <strong>of</strong> the entire<br />
Allegheny Front is gone -- a victim <strong>of</strong> mountaintop removal for “green energy.” The center <strong>of</strong> the study area -- what I called the middle knoll where you<br />
could look north about 150 meters to Wildcat Rocks-- is now a pad for a turbine. This was a globally rare environment-- the scrub oak heath barren<br />
grading to a red spruce stand on Wildcat Rocks itself.<br />
“As you know, the area was the site <strong>of</strong> a long-term study on the Timber Rattlesnake (MARTIN. W. H. 2002. Life history constraints on the Timber<br />
Rattlesnake (Crotalus horridus) at its climatic limits. Pp. 285-306 in G. A. Schuett, M. Hoggren,<br />
M. E. Douglas, and H. W. Greene (Eds.) Biology <strong>of</strong> the Vipers, Eagle Mountain, Utah. I have<br />
never experienced anything like this. A civilized people would not do this. The maps that I saw<br />
showing the location <strong>of</strong> proposed turbines did not show any turbines on the study sites. To me this<br />
a personal 9/11 -- millions <strong>of</strong> years <strong>of</strong> natural history now destroyed.”<br />
Here at <strong>Friends</strong> <strong>of</strong> <strong>Blackwater</strong>, we oppose the standardless and unregulated siting <strong>of</strong> industrial<br />
wind turbines. Why? Because, as Marty Martin’s story so vividly shows us, without strict<br />
regulation <strong>of</strong> wind turbine siting, the unique ecology <strong>of</strong> the Allegheny Highlands will be destroyed!<br />

1916-2007<br />

While a student at WVU, I was privileged to go birding with<br />
George and learn from his skill at identification. I realized the reason<br />
he didn’t take along a field guide is he didn’t need one!<br />
His devotion to birds dated from boyhood when growing up in<br />
western Pennsylvania. His undergraduates studies were undertaken<br />
at WVU and he earned a Ph. D. from Ohio State University.<br />
He joined the staff <strong>of</strong> the Department <strong>of</strong> Chemistry at WVU where<br />
he taught for many years.<br />
His devotion to undertakings was Herculean such as the banding<br />
operation at Dolly Sods in which he played a key role in establishing<br />
in 1958, He joined Dr. Ja y Buckelew in producing the “WV<br />
Breeding Bird Atlas” from a mountain <strong>of</strong> data compiled by Atlas<br />
workers.<br />
His field work <strong>of</strong> many years and scholarly approach saw fruition in “West Virginia<br />
Birds” published by Carnegie Museum in 1983. The volume is the first comprehensive<br />
treatment <strong>of</strong> the birds <strong>of</strong> the state.<br />
He was president <strong>of</strong> the Brooks Bird Club in 1954 and editor <strong>of</strong> “The Redstart”<br />
1956-1963. He was also president <strong>of</strong> the Wilson Ornithological Society and editor <strong>of</strong> “The<br />
Wilson Bulletin.”<br />
Through his monumental field work, writings and leadership, George earned a premier<br />
place in the history <strong>of</strong> West Virginia ornithology.<br />

Davis Memories from bill burger<br />
July 2008<br />
William “Billy Boy” Burger was born in Pendleton, WV, a town near Davis, but spent most <strong>of</strong> his young life on Fairfax Avenue right in Davis in a house<br />
built by his great-grandfather. He is quick to tell you that he was poor as far as money goes, but not when it comes to goals. He regularly contributes<br />
to <strong>Friends</strong> <strong>of</strong> <strong>Blackwater</strong> in his mother’s name. His father died when he was three and left nine children for his mother Nina to raise. She took a<br />
job that was to become life- long at the <strong>Blackwater</strong> Hotel and saw to it that all nine children graduated from high school. Her advice to all was “study<br />
hard” and Burger will proudly tell you that none <strong>of</strong> his family got into any kind <strong>of</strong> trouble. Well, maybe once, but that time most <strong>of</strong> his school mates<br />
joined him.<br />
The towns <strong>of</strong> Thomas and Davis definitely were in an uproar when it was announced<br />
that Davis High School was going to merge with Thomas High School in 19.<br />
Burger freely admits that the merger was not a friendly one. The schools were rivals, so<br />
about half <strong>of</strong> the Davis High School students went on strike. They would gather daily at<br />
a field across from the Thomas school and refuse to enter the building. It took two weeks<br />
and the school board had had enough. They met and decided to serve all the parents <strong>of</strong><br />
the striking children with subpoenas. That did it! The students went back to school. He<br />
said that he was surprised at his mother’s reaction. She was usually very quiet and composed<br />
but backed him 100% when it came to Davis High.<br />
With one lapse (the strike), well maybe two lapses, Burger contends that the people<br />
<strong>of</strong> Davis were hard working, kind and generous and generally pretty well mannered. The<br />
second lapse was the trick that he and his friends regularly played on the tourists at <strong>Blackwater</strong><br />
Falls. According to him, they would climb the rocks and go up about 35 feet behind<br />
the giant falls. They would hide awhile and then suddenly dive <strong>of</strong>f the rocks and through<br />
the curtain <strong>of</strong> water making up the falls. The tourists were aghast as the young boys appeared<br />
from nowhere and disappeared into the pool below. Burger said it scared the tourists<br />
to death.<br />
In August Burger and his old friends will meet at a Davis High Reunion and he plans to set up a table for <strong>Friends</strong> <strong>of</strong> <strong>Blackwater</strong>. “I’d like some<br />
extra newsletters, I want my friends to see what our organization is about”, he said. Some <strong>of</strong> his friends already belong, but he would like to convince<br />
the others to join.<br />
Without mothers like Nina Burger and “<strong>Friends</strong>” like William there would be no <strong>Blackwater</strong> Newsletter; no <strong>Friends</strong> <strong>of</strong> <strong>Blackwater</strong> <strong>Canyon</strong> Organization.<br />
Thanks to you all for your generous donations and willingness to spread the word. We all agree <strong>Blackwater</strong> <strong>Canyon</strong> is worth saving, even<br />
for those <strong>of</strong> us who didn’t grow up pulling fish out <strong>of</strong> the <strong>Blackwater</strong> River like William Burger.

North Fork Watershed Project Welcomes Christine Kozan to the Team<br />
Christine Kozan <strong>of</strong> Thomas has joined the staff <strong>of</strong> the North Fork Watershed<br />
Project, where she will head up the efforts to develop a report and begin planning<br />
for future work along the North Branch <strong>of</strong> the Potomac. Underground this waterway<br />
shares it headwaters with the North Fork <strong>of</strong> the <strong>Blackwater</strong> . Both streams are impacted<br />
by acid mine drainage that orginates in the Coketon/Kempton mine pool.<br />
Christine is a native <strong>of</strong> northeastern Ohio and grew up on the shores <strong>of</strong> Lake<br />
Erie. Her early experiences with hiking, camping and swimming blossomed into a<br />
love <strong>of</strong> nature and a desire to preserve and conserve natural wonders.<br />
After graduating from high school, Christine attended Hiram College, where<br />
she interned at the Holden Arboretum which is one <strong>of</strong> the largest arboretums in the<br />
United States. After spending one semester studying abroad in Australia, she graduated<br />
in 2004 with and Environmental Studies Degree. Upon her graduation she<br />
moved to Thomas where she worked as a mentor at the Alldredge Acadamy, counseling<br />
at-risk youth. When asked about that experience, she states it very simply that<br />
she like being outdoors and being a positive influence.<br />

Taking the <strong>Canyon</strong> Campaign to Congress is part <strong>of</strong> our ongoing quest to protect the <strong>Blackwater</strong> <strong>Canyon</strong>. Please take a minute to<br />
