Since 2007, the HEI has been aunique and invaluable resource for all healthcarefacilities seeking to provide lesbian, gay,bisexual and transgender Americans with theequitable and inclusive care they deserve.The HEI is skillfully designed to allow U.S.healthcare facilities to assess the degree towhich they provide LGBT patient-centeredcare, to identify and remedy any gaps andto make public their commitment to LGBTpatients and their families. An unprecedentednumber of facilities participated in the HEI2012 to do just that, using its resources toenhance equitable and inclusive care.The HEI 2012 saw a 40% increase inparticipating facilities—and a striking162% increase in facilities that achievedthe status of Leader in LGBT HealthcareEquality by meeting key criteria. Witha record-breaking 407 facilities rated,the HEI 2012 designated 234 of them, or57%, as Leaders.For the first time, the HEI required participatingfacilities to document that at least fivehigh-level managers in key work areas hadreceived expert training in LGBT healthneeds—and 67% of facilities met this test.The great majority chose to train their staff viaexpert webinars provided free of charge bythe HRC Foundation, resulting in an enormousincrease in LGBT knowledge among hospitaladministrators nationwide.committing themselves to equitable and inclusivecare. Yet as far as healthcare has comein this regard, we believe that it can do better.For example, even among HEI 2012 participants,about 25% do not explicitlyprotect the visitation rights of same-sexpartners and parents, and about 25% donot explicitly include gender identityin their patient and employee nondiscriminationpolicies. Moreover, in 18states no healthcare facility chose to participatein the HEI 2012, leaving LGBT residentswithout a documented source of equitableand inclusive care.With this report on the impressive gains inLGBT equity and inclusion over the last year,we send two messages to U.S. healthcarefacilities. First, we congratulate the recordsetting407 who took steps via the HEI 2012to enhance the care they offer LGBT patientsand their families. HEI 2O12Why the HEI?The Human Rights Campaign Foundationdeveloped the Healthcare Equality Index tomeet a deep and urgent need on the partof lesbian, gay, bisexual and transgenderAmericans: the need for equitable,knowledgeable, sensitive and welcominghealthcare, free from discriminationbased on LGBT status. No one, whenconcerned about personal health, should alsobe concerned about receiving inequitable orotherwise substandard care. Yet it is clear thatmany LGBT Americans have exactly theseconcerns when seeking healthcare. Whateverworry they may feel about their health statusis all too often intensified by fear that they willreceive unequal treatment because of theirLGBT status.29%of LGB patientsbelieved they wouldbe treated differently73%of transgender patientsbelieved they wouldbe treated differentlyBy way of vivid example, in Lambda Legal’slandmark 2010 study When Health Care Isn’tCaring, 73% of transgender respondents and29% of lesbian, gay and bisexual respondentsreported that they believed they would betreated differently by medical personnelbecause of their LGBT status. But afterlearning I wastransgender,the doc keptcalling me ‘she’in front of all thestaff and otherpatients, nomatter how manytimes I correctedhim, and keptasking when I’dbe having ‘thesurgery.’”A transgender manseeking care for adislocated shoulder“When anurse camein and sawme bendingover myboyfriendgiving him aquick kiss—I hadn’t seenhim since hewent in forsurgery—she turnedaround andwalked outof theroom.”A bisexual mancaring for hisrecovering partnerWhy, the study asked, did they have thesetroubling beliefs? The answers were equallydisturbing. More than half of all respondentsreported that they had experienced at leastone of the following types of discriminationin healthcare: being refused neededcare, healthcare professionals refusing totouch them or using excessive precautions,healthcare professionals using harsh orabusive language, being blamed for theirhealth status or healthcare professionalsbeing physically rough or abusive. 70% oftransgender and gender-nonconformingrespondents had one or more of these experiences,and almost 56% of lesbian, gayor bisexual respondents had at least one ofthese experiences.The HEI exists because the HRC Foundationbelieves that the great majority ofAmerican healthcare facilities do not wantLGBT individuals in their community tohave, or worry about having, these kindsof experiences. But facilities often do notknow how to protect their LGBT patientsfrom discrimination, provide them withoptimal care and extend a warm welcometo allay their concerns.The HEI was developed to give thesehealthcare facilities the information andresources they need and want to ensureequitable, inclusive treatment for theirLGBT patients. And it goes further: itrecognizes in this report all facilities thatshow their commitment to LGBT patientcenteredcare by taking the HEI, anddesignates facilities that meet the “CoreFour” HEI criteria as “Leaders in LGBTHealthcare Equality.”In the last year, the HEI has been madeeven more relevant and helpful by the newJoint Commission requirement (surveyedfrom July 1, 2011) that accredited facilitiesprohibit discrimination against patientsbased on sexual orientation and genderidentity or expression.* In addition, bothThe Joint Commission and the Centersfor Medicare and Medicaid Services nowrequire that facilities allow visitation with-6 Healthcare Equality Index 2O12


HEI 2O12out regard to sexual orientation or genderidentity—another giant step toward LGBTequity in healthcare. **The HEI gives facilities a powerful wayto affirm that they comply with theserequirements and wish to offer LGBTpatients an equitable environment. TheHEI also urges facilities to extend nondiscriminationprotection to their LGBTemployees, who can play a key role inensuring sensitive, knowledgeable carefor LGBT patients.Equally important, the HEI provides allparticipating facilities expert training inLGBT health needs, recognizing that staffeducation is critical to the success of anypolicy. Facilities may enroll as many staffmembers as they would like in free onlinetraining that has been hailed as groundbreakingand invaluable.In short, the HEI offers healthcare facilitiesunique and powerful resources forproviding a long-overlooked group ofpatients the care that everyone deserveswhile also complying with new regulatoryrequirements and gaining access to highqualitystaff training.If you’re affiliated with an HEI-rated facility,deepest thanks for your commitmentto LGBT patient-centered care. We’re confident they’ll thankyou for informing them about this vitalresource for ensuring high-quality healthcarefor LGBT Americans!How toParticipatein the HEIThe HEI is an online survey, open to all healthcarefacilities, that has been administered annually since 2007by the Human Rights Campaign Foundation. The surveyperiod opens in October and ends on Jan. 31. Multiplerepresentatives can work on a survey on behalf of a facility,and respondents can log in as many times as neededto complete the survey. Staff members from the HRCFoundation provide assistance and advice throughout thesurvey completion process. The survey is comprisedof four core criteria for LGBT patient-centeredcare, with individual facility responses noted in theannual HEI report, and additional unrated criteria,with only aggregate responses noted in the annualreport.HRC Foundation staff members review each surveysubmitted, then provide each facility with a completeoverview of its survey, highlighting its performance onthe “Core Four” criteria for LGBT patient-centered care,answering any questions and recommending next steps.Facilities that meet the Core Four criteria are awarded HEILeader status for that survey year and receive materialsfor outreach to LGBT community members, as well asfeatured status in that year’s report. Overviewof FindingsThere is a great deal to celebrate in theHealthcare Equality Index 2012. Participationin this unique annual survey of thenation’s hospitals vis-à-vis LGBT equityand inclusion was far broader and deeperthan in past years, by multiple measures.Yet, as in previous years, the survey revealedthat many LGBT Americans still cannot reliablyaccess equitable and inclusive healthcare.8 Healthcare Equality Index 2O12


Overview of FindingsThe HRC Foundation, which administered the HEI 2012 inthe last three months of 2011, was delighted to secure a 40%increase in participating healthcare facilities. The number ofsurvey respondents rose from 87 in 2011 to 122 in 2012,representing a total of 407 individual healthcare facilities.(This number included six networks participating in the HEI forthe first time: Adventist HealthCare, Bon Secours Health System,Bronson Healthcare Group, Grady Health System, Iowa Health–DesMoines and the University of Utah Hospital & Clinics.) There can beno question that the needs of LGBT patients and their families arereceiving increasing attention in healthcare.This progress was matched by an equally impressive rise in thenumber of facilities that not only participated in the HEI but alsoachieved the status of Leaders in LGBT Healthcare Equality inthe 2012 survey. To achieve Leader recognition, these facilitiesdocumented that they met the four foundational criteria for LGBTpatient-centered care, known as the “Core Four.” The number ofthese Leaders rose from 27 to 71—a 162% increase. This meansthat no fewer than 234 of the nation’s healthcare facilities,or 57% of HEI-rated facilities, proved their leadership inLGBT patient-centered care in 2012.Significantly, the Core Four criteria in the HEI 2012 included a newtraining requirement, in recognition of the fact that the policies requiredby the other three criteria depend for their success on meaningful staffeducation. This new requirement called on facilities to enroll at leastfive high-level managers in designated work areas for a minimum of60 minutes of expert training in specific LGBT health concerns—and67% of HEI participants documented that they did just that.Most, in fact, chose to receive training via intensive 90-minutewebinars that the HRC Foundation offered free to all HEI 2012participants. These webinars proved even more successfulthan anticipated: thanks to them, more than 1,000 managersfrom throughout the United States received expert training.This constitutes a huge and unprecedented increase in LGBTknowledge among U.S. healthcare administrators. But it is important to note that, even with these increases,explicit visitation equality and “gender identity” inclusion do not exist inabout 25% of facilities participating in the HEI.Responses to the unrated HEI criteria, which are reported inaggregate, not by facility, also revealed both gains and gaps.For example, 34% of facilities that ask about marital status atadmitting/registration do not also offer a “partner” or “significantother” option, while 25% of facilities located in a state that providessame-sex partnership registration (which confers healthcarerights on registered partners) reported that they do not offerstate-registered partners the opportunity to identify as such atadmitting/registration. In addition, 56% of facilities do not offerpatients at admitting/registration the option of indicating thattheir current gender identity differs from the one on their birthcertificate. Moreover, 90% of facilities do not offer their employeestransgender health coverage, while 20% do not yet provide healthcoverage to employees’ same-sex partners. These and otherresponses to the unrated criteria show the work remaining toensure full equity and inclusion for LGBT patients and their families.The HEI 2012 saw the number of states represented inthe survey increase from 29 to 32, with Kentucky, Nevada,New Hampshire and Utah represented for the first time.In 18 states, however, no healthcare facility participated—leavingtheir LGBT residents without a single facility that has made anexplicit commitment via the HEI to providing equitable care.As this overview of the HEI 2012 indicates, healthcare facilitieshave made tremendous strides toward LGBT equity and inclusion,and the 2012 participants deserve hearty applause for theirattention to the needs of LGBT patients and their families. Mostof the nation’s healthcare facilities, however, have yet to use theHEI to enhance LGBT patient-centered care and to signal theircommitment to LGBT equity and inclusion. HEI 2O1271 survey respondents—14 networks (representing 177 facilities), 43 individualhospitals and 14 individual clinics/outpatient facilities—responded “yes” to all of theCore Four HEI criteria, earning Leader status for 2012. FindingsThe “Core 4”Rating CriteriaThe Healthcare Equality Index 2012 survey asked 24 questions about best practices in LGBTpatient-centered care. A subset of these questions focus on the Core Four policies and practicesconsidered essential for equitable and inclusive LGBT care. The first three are foundationalpolicies ensuring that LGBT patients and their families are welcomed and provided with care freeof discrimination. This group has provided a welcoming place for staff to meet and advocate on behalf of LGBTemployees, patients and their families.This year, the group launched the “Be An Ally” campaign, a high-profile outreach program designed to educate andengage the entire hospital community about the importance of visibly showing support for LGBT patients, familiesand colleagues. We made small rainbow stickers available for employees to append to their ID badges, which areworn by every hospital employee at all times of the day. Through a series of internal news publications and events,we publicized the program, encouraging employees to put the sticker on their ID badge as a visible display of theirdesire to create a safe and welcoming environment for all hospital staff, patients and visitors. To date, we’ve givenaway thousands of these stickers. Among the first to don a “Be An Ally” sticker was our hospital president,Dr. Betsy Nabel, sending a strong message of support from the highest level of leadership.
