[7.] FACTUAL AND LEGAL GROUNDSThis Complaint is based on the following factual and legal grounds:[a.]UDRP Rule 3(b)(ix)(1); UDRP Policy 4(a)(i)[i.] Keith J. Miklas, President of The OVerus Organization("COMPLAINTANT"), is the owner of the OVERUS® United StatesFederal Certification Trademark ("OVERUS®"), registration number3579308. The OVerus Organization uses this certification mark toidentify brands that comply with the requirements set forth in itscertification process. OVERUS® has been in use for almost sevenyears, and its federal registration in force for over four years.[ii.] The OVerus emblem:[iii.] A copy of the trademark can be found in Annexation [A],"Certificate of Registration." The trademark registration can also befound via a "simple TESS trademark search" for "OVERUS" athttp://www.uspto.gov/.[iv.] COMPLAINANT recently discovered that RESPONDENT hasregistered and is holding overus.com as a World Wide Web domainname in violation of the Anticybersquatting Consumer Protection Actof 1999, which is embodied in the Lenham Act. You can find theACPA at http://www.law.cornell.edu/uscode/text/15/1129.[v.] The domain name overus.com both identical and confusinglysimilar to the registered trademark OVERUS®.[vi.] Since this is a certification mark indicating that goods orservice meet certain high standards – then it is even more importantthat the integrity of the mark be maintained and that unauthorizedthird parties not use the mark in a domain name and thereby dilute themark and mislead the public who may depend upon the mark becauseof the quality it implies.UDRPModelComplaint.rtf


[b.]UDRP Rule 3(b)(ix)(2); UDRP Policy 4(a)(ii).[i.] RESPONDENT's current use of the domain name does not havea connection with and is not a bona fide offering of goods or services.RESPONDENT is selling the domain name.[ii.] As seen in Annexation [D], "Current Domain Name Resolution,"at the time of filing this document, the domain currently resolves in one of twoways:(1) Redirecting to "usdots.com," where the domain name isbeing resold, or(2) An error message page entitled "Bandwidth LimitExceeded."Neither of these uses have a connection with or are a bona fideoffering of goods and services. In the former case, RESPONDENT iscybersquatting and leveraging off the brand identity of the OVERUS®certification mark, overus.org, and overus.net to resell overus.com. The latter caseis simply neglect; the site is down and unresponsive.[iii.] RESPONDENT has no trademark or legal rights, has not and isnot commonly known by OVERUS, and has no legitimate business connectionthereto. They are simply reselling the domain name.[iv.] RESPONDENT is making no legitimate use of the domainname; it is being resold and neglected. The only interest that RESPONDENT hasdemonstrated in overus.com is in its resale value, which exists only because of thework of COMPLAINTANT to create it.UDRPModelComplaint.rtf


[c.]UDRP Rule 3(b)(ix)(3); UDRP Policy 4(a)(iii).[i.] There is clear evidence that RESPONDENT has registered or hasacquired the domain name primarily for the purpose of selling, renting, orotherwise transferring the domain name registration to the Complainant who is theowner of the trademark or service mark or to a competitor of that Complainant.[ii.] RESPONDENT is a domain reseller, reselling this andthousands of other other domains. OVERUS is merely one of many that are part ofRESPONDENT's portfolio. See Annexation D, " Current Domain NameResolution." There the domain is being resold through "usdots.com," and the usermay make an offer directly on the Web page.[iii.] According to the "Registrar History" report fromdomainresearch.org (Annexation [D]), overus.com domain name was registered toCOMDots.com years after the OVERUS emblem was registered and used incommerce(1) Aug 29th, 2011, the name was registered to "namage.com"(Page 18).(2) October 10th, 2011, the domain name is first shown asregistered to "COMDots.com"Dynadot on January 14th, 2013. This is[ii.] RESPONDENT's registration of this domain name effectivelyprevents COMPLAINTANT (the owner of the trademark) from reflecting the markin a corresponding domain name. This disrupts business, as customers seeking theOVERUS® trademark and/or The OVerus Organization will be directed to anunrelated and confusingly similar site.[iii.] It is clear that RESPONDENT's use of overus.com is intendedto (and actually does) confuse and misdirect customers seeking The OVerusOrganization and/or the OVERUS certification mark. This activity is actionableunder federal law and causes RESPONDENT to be liable to COMPLAINTANTand The OVerus Organization in every state in which RESPONDENT has madesales. REPONDENT's activites are unlawful and constitute unfair competition,intentional trademark infringement, trademark dilution, false destination of origin,and cybersquatting.UDRPModelComplaint.rtf


[8.] REMEDY SOUGHT[a.] The Complainant requests that the Panel issue a decision that the domain-nameregistration be transferred to Keith J.
