IIWAGES OF GANGERS ETC.The following Notice of Motion was served by Mr. Colfer onthe 30th June <strong>1942</strong>:-"I hereby give notice of my intention to move at the nextmeeting of <strong>Wexford</strong> <strong>County</strong> Council to be held on lOth <strong>August</strong> <strong>1942</strong>that the wages of Road Gangers, Machinery Attendants and othersnot covered by the recent increase, be increased by 5/- per week."This motion was considered by Finance Committee at theirmeeting of 17th July <strong>1942</strong> when the following resolution"That the <strong>Wexford</strong> <strong>County</strong> Council be recommended to agree toan increase of 2/- weekly in the wages of Road Gangers, MachineryAttendants and all others concerned in the producti·on of Road materialand who are not affected by the recent increese of thisamount as sanctioned by the f[inister for Local Government andPublic rlealth."motion.Mr. Colfer moved this recommendation instead of his origins.l~r.Kelly seconded.Tne ChairI!lan, in reply to Col. Quin, said th8 t no change inwages h/i.d been made for a considerable time past beJl,ond the 2/­per week increase granted ordinary road workers, except rockdrillers, who were engaged in very heavy work and in whose casethe <strong>County</strong> Council considered an unanswerable case for an increasenad been made out.tw. Kehoe said the Council relied on the Gangers to haveroad work efficiently carried out.The cost of living had goneup to an extent that would entitle them to the increase proposedby l!r. to do and they now find it was almost impossible to procuretyres for their bicycles.The motion was then put and passed nem. con.EMPIDYMENT OF ~lACHI N ERY MEN1~ . Bowe raised the question of the employment of somemachinery men who, owing to the present emergency, were unableto get more than one quarter of a year's employment.better for them if they could be employed as ordinary roadworkers.The ounty Surveyor said tha~ the Survey staff were doingtheir best to provide employment for the machinery men, but theycould not see their way to put out their own ordinary roadwork~to employ machinery men.best to 3eet the situation.The survey staff were doing theirToo Cnairman said that if the <strong>County</strong> Surveyor was making ,any saVing on the mac!linery account he Sl10uld employ the amountin providing work for the machinery men .The <strong>County</strong> Surveyor said if they were putting money whichwould normally go to maChinery expenses to keep ordinary roadwork going it was only right that the machinery men should getsome of the resultant work .h~.Bowe said that he knew there would be a certainreduction of ordinary road workers but this would not entailemployment for only three months of the year.Tnen again, theunemployment stamps of ~achinery men had been used up while theordinary road workers had full cards.Mr . Ennis stated that it was only during the last sixmontns owing to the lack of coal and explosives that theposition became acute .Tne Chairman said that the full sum for macninery had beenvoted for this and last year and the machinery men should havean opportunity of earning some of that money by working eitheron tne roads .or at engines.The CounCil would ask the <strong>County</strong>Surveyor to do what was possible in the matter and the <strong>County</strong>Surveyor said this would be done .© WEXFORD COUNTY COUNCIL ARCHIVES

110 U 942The Parliamentary Secretary would be glad to learn the earliestdate on which Mr. Treanor will be in a position to receive thegoods. On receipt of this information he will be notified of themethod of delivery at Gorey. The Parliamentary Secretary is, anxious that the goods should be sent out with the least possibledelay. nThe following under date 24th June <strong>1942</strong> was read from Mr. T.Treanor, Assistant Surveyor, Gorey District:-"Yours to hand to-day re above. The premises, 51 Main St.,Gorey, are suitable in every way and I would recommend JohnDempsey, Sraid Eireann, Guaire, as Caretaker at a wage of tenshillings per week. He is an employee of <strong>County</strong> Council butcaretaking work must be done outside working time. Goods may beforwarded any time. F. Daly, <strong>County</strong> Medical Officer of Health:-wI wish to apply to the <strong>County</strong> Council for my Annual Leave of-one month, three weeks of which I propose to take on, and from<strong>August</strong> 4th.Dr. MacDonald, Assistant <strong>County</strong> Medical Officer of Health,will do my duty in my absence. IIThe following resolution was adopted on the motion of MissOIRyan seconded by Mr. Colfer:-"That we recommend the <strong>County</strong> Council to accede to applicationof Dr. Daly, <strong>County</strong> Medical Officer of health relative to hisannual leave of one month as from 4th <strong>August</strong> <strong>1942</strong>."Under date 3rd July <strong>1942</strong> Dr. M. Wilson, Coal Importer, Commercial Quay, <strong>Wexford</strong>:-"I intend constructing out-offices at the back of myDwelling House at Townparks, abutting on to Coolcots Lane, and Ihave instructed Mr. T. Miller to lodge a plan of the proposedbuilding with you, and I will be very glad if you will facilitateme by bringing the matter before the first meeting of the <strong>County</strong>CounCil, in the hope that they will not compel me to build 35teet from the middle of the Road-way, becaase, if so, the matteris going to be made very awkward for me on account of the factthat I want to sink a well at a particular spot, and also forother reaSons.Trusting the <strong>County</strong> Council Members will give the matterfavourable conSideration, and thanking you in antiCipation ofattending to the matter urgently."The follow1ng order was made:-II That Mr. H. Wilson beinformed tnat acting on legal advice it appears that the FinanceCommittee or <strong>County</strong> Council have no power to grant his request toconsent to the erection of out-offices within 30 feet of thecentre of the public road.Section 9 (2) of the Summary JurisdictionAct 1851 (14 and 15 Vic. Cap. 92) states that a personwho builds any house or part of a house within 30 feet of thecentre of the road would be liable to a fine not exceeding £10and to a fine of 10/- per week for the time during which thebuilding was not removed."NOXIOUS WEEDS ACT 1936The follow1ng Wlder date 28th June <strong>1942</strong> (E.28l0/42) hereinwas read from the Department of Agriculture:-"I am directed by the Minister for Agriculture to enclose,for the information of your CounCil, copy of a notice issued totne Press in regard to the requirements of the above-named Act.© WEXFORD COUNTY COUNCIL ARCHIVES


10 YG <strong>1942</strong>Tne Minister hopes that the destruction of noxious weeds onagricultural lands will be effectively and generally carried outduring the present season, and he trusts that your Council .nllco-operate in this matter by having special instructions issuedwith a view to the destraction of noxious weeds on lands androadsides for wnich the Council is responsible."The following is copy of Press Notice referred to in thecommunication from Department of Agriculture:-·pre ss NoticeNoxious Weeds Act. 1936This Act is in force in every county and occupiers, as wellas lessees and other persons responsible for land, are requiredto keep it clear of the schedule noxious weeds, viz., Thistle,Ragwort and Dock. Tnese weeds should not be allowed to reachthe stage when they form seed heads, and in the ordinary courseshould be destroyed in July and early <strong>August</strong>. Thistles shouldbe cut at least twice in the season on badly infested pastures.When cut or pulled, the weeds should not be allowed to lieon the land, but should be collected and burned or otherwisedisposed of to prevent the seeds ripening. DAMAGE TO FENCE NEAR KILTEALY1 UG 942The Secretary submitted the following statement:-"Mr. Peter Tobin, Curraghduff, Kiltealy, called to <strong>County</strong>Council Offices on 24th June <strong>1942</strong> and stated that about 2 yearsago when the road between Kiltealy and Enniscorthy was underreconstruction (and within half a mile of Kiltealy) it was raised.at least It feet and in some places as much as 2 feet.was accordinglybwered -in fact, it was left so low thatThe fencepedestrians could step on to the top quite easily from the roadand any animals passing could trespass on the field.Mr. Tobincontends he is at the loss of a certain amount of material and oftime in temporary repairs whicn he was obliged to carry out inSpring of 1941 and the Spring of <strong>1942</strong>, for the protection of hiscrop.These repairs are, however, of a temporary nature only andMr. Tobin expects that the fence should be restored to its former,effective condition.the case."He said that Mr. Bowe, M.C.C., was cognisant of the facts ofThe Secretary stated he asked Mr. Bowe about the matter at~yls meeting of <strong>County</strong> CounCil and he said he believed thatTobin's statements were true.The <strong>County</strong> Surveyor said he had asked Mr. Ennis, AssistantSurveyor for the district, for a report as regards the statementof Mr. Tobin.He would bring this before the first availablemeeting of the Finance Committee.CLAIM £16 FOR LOSS OF BULLOCKThe following under date 2nd July <strong>1942</strong> was read from Messrs.T. P. and R. G. Wllsh, SoliCitors, 20 North Main St., <strong>Wexford</strong>:-II We are acting for Mrs. Sarah Davis of Ringaheen, Ballycogley lwho instructs us that some time ago the <strong>County</strong> Council re-surfacedthe road adjoining her lands and in so doing diverted the courseof the wurface water.This diversion has resulted in the wearingdown of the parapet of the bridge, with the consequent resultthat the ditch bounding our client's field has been cut away.On Saturday last, the 27th instant, a BUllock belonging to© WEXFORD COUNTY COUNCIL ARCHIVES


1Q AUG \942our client, broke out of her lands at the point where the ditchwas cut away and in passing over the bridge fell over the sideand broke his leg.Our client had the Bullock examined by a Veterinary Surgeonwho ordered its destraction. It would appear tha t the loss ourclient has sustained is due to the negligence of the Council andwe should be glad if you would let us know if the Council admitsliability in the matter.Our client values the Bullock at£16. O. 0 and if the Council admits liability we should be gladif you would arrange to let us nave a cheque for this amount.Onthe other hand, if the Council does not admit liability we havebeen instructed to institute proceedings."It was decided that this claim be referred to <strong>County</strong>Surveyor and <strong>County</strong> Solicitor.BALLINCASH LANEThe <strong>County</strong> Surveyor said he was not yet in a position toreport as to the proposal to take over this lane as a public road.The local people had carried out their agreement with the <strong>County</strong>Council as to the work which wa~to be done by them to improve thelane and he (<strong>County</strong> Surveyor) would make a final inspection ofthe place soon.FLOODING AT BELLEFIELD. ENNISCORTHYThe <strong>County</strong> Surveyor said that the flooding which takes placeoccasionally at Bellefield, Enniscortby, was rather a peculiarIcase.The houses there had been built over a drain which wasnot at all suitable. It took sewerage. The <strong>County</strong> Councilrelaid a pipe running into this drain but s ~~ the report of Mr.EnniS, Assistant Surveyor, went /it would appear that the floodingwas ce.used because the drain may have been partly stopped.It was decided to ask Mr. Ennis for a further report when hehas seen the place, particularly in regard to any bearing whichthe pipe which <strong>County</strong> Council relaid there may have on theflooding.© WEXFORD COUNTY COUNCIL ARCHIVES


BALLYCONNIaAR STRAND110 AUG 19 2 IThe <strong>County</strong> Surveyor submitted the following report from Mr.T. Cullen, Assistant Surveyor for the district, relative to above:-liOn recent inspection of approach to Ballyconnigar Strand Ifound the right-of-way completely cut off, even for foot traffic.During storms last Winter -temporary bridge erected some time agoover Blackwater River on Strand was damaged, and now requiresextension, or erection of a new permanent bridge.It does notappear advisable to attend to bridge when there is no road tostrand.I could make a pass down the cliff, but there is such adanger of claim under Public Liability that I am doing nothingpending instructions."The <strong>County</strong> Surveyor said this was the place at which the<strong>County</strong> Council wanted to purchase some land for the constructionof a roadway from Mr. John Keating, Ballyconnigar, but the priceasked by Mr. Keating was regarded as prohibitive.But, a newroad down to the snore was the only way to meet the situation.The present roadway was perfectly impassible.The following resolution was adopted on the motion of theChairman seconded by Mr. KelJ.y:-"That a further report be obtained from Mr. Cullen, Assistant-Surveyor, re road at Ballyconnigar Strand. Tha t the <strong>County</strong>Surveyor be requested to communicate with Mr. Cullen relative tointerview with Mr. Keating as to purchase of land necessary toconstruct a new road to the shore at Eallyconnigar."POUNDAGE FEESThe following resolution was adopted on the motion of Mr.Colfer seconded by Mr. Keegan:-"That the Minister for Local Government and Public Health berequested to sanction payment of the balance of poundage fees toate Collectors in respect of their lodgments for the 1941-42warrants. n© WEXFORD COUNTY COUNCIL ARCHIVES

LEEThe following under date 4th July <strong>1942</strong> was read from Mr.Elgee, <strong>County</strong> Solicitor:-"In this case, as you are aware, owing to Mr. Fawsitt whoformerly acted for the <strong>County</strong> Council in this matter, having beentransferred temporarily to the Bench,I ~~ instructed N~. KingsmillMoore, K.C., to advise as to the necessary proofs whichwould be required to be given on benalf of the <strong>County</strong> Councilon the hearing of the Action.Mr. Kingsmill Moore required, that he should have a Consultationwith Mr. Barry, Mr. Delap, who reported on the matterand myself, and accordingly, such a Conference was held. Mr.Delap, however, at that time was seriously ill, and 1w. Maconchy,his <strong>Part</strong>ner, attended the ConSUltation in his place.having gone fully into the matter, Mr. Kingsmill Mooresuggested that it would be advisable, in order that he mighthave the fullest possible infprmation on the subject before him,that Mr. Barry and Mr. Macon~ should make a furtner inspectionof the place, and report thereon, in view of the facts whichappeared to be inconclusive to him at the ConSUltation.Mr. Barry and Mr. Maconcby accordingly attended at the Siteof the Damaged Bridge - Mr.Treanor and I were also in attendance,Mr. M~conchy made outlis Report thereon, from which itappeared that the Foundations of both the Arches of the Bridgehad, to a certain extent, been washed out by flood water, andthat it was doubtful, if it could be now stated when thiswashing out took place.I sent tnis Heport on to Mr. Kingsmill Moore and he then~te and asked me to ascertain from Mr. Barry and ]Ar. Macon~ywhether they were prepared to swear that in their opinion thefall of the Bridge was due to the operations of lw. Mr. Barry stated, that having regard to his latest in~pction,he was not now satisfied tnat his previous opinion wascorrect, and that it appeared to him to be an even chance as towhicn of the causes above mentioned were the cause of thecollapse.I have again written to !~ . Kingsmill Moore, and nowenclose copy of his£eply, from which you will see that heconsiders Mr. Maconc31s report to be rather argumentative andtheoretical and that if Mr. Barry is not prepared to bedefinitely on the side of the Council, he fears, that ourchances of success are very small, which means discontinuingthe Action and paying 1w. Leets Costs up to the date ofdiscontinuance, or arranging with Mr. Lee for a Settlement.Before approaching Mr. Lee on the matter, I will, ofcourse, require the directions of the Council, so perhaps, thebest thing to do is to bring the matter before a meeting of theFinance Committee for their consideration.
