<str<strong>on</strong>g>APPENDIX</str<strong>on</strong>g><str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>agreement</str<strong>on</strong>g> <strong>on</strong> <strong>arranging</strong> <strong>on</strong>-<strong>the</strong>-<strong>job</strong><strong>training</strong> <strong>and</strong>/<strong>or</strong> <strong>the</strong>ses at <strong>the</strong> w<strong>or</strong>kplaceMUTUAL CONTRACTUAL TERMSStipulati<strong>on</strong>s applied <str<strong>on</strong>g>to</str<strong>on</strong>g> <strong>on</strong>-<strong>the</strong>-<strong>job</strong> <strong>training</strong> <strong>and</strong> <strong>the</strong>sesOn-<strong>the</strong>-<strong>job</strong> <strong>training</strong> <strong>and</strong> <strong>the</strong>ses are stipulated by <strong>the</strong> act <strong>and</strong> decree <strong>on</strong> vocati<strong>on</strong>al educati<strong>on</strong> includingamendments <str<strong>on</strong>g>to</str<strong>on</strong>g> <strong>the</strong>m (L 630/1998, L 479/2003, L 601/2005, A 811/1998, A 603/2005) as well as by <strong>the</strong> studyplans. Theses are stipulated by <strong>the</strong> act <strong>and</strong> decree <strong>on</strong> vocati<strong>on</strong>al adult educati<strong>on</strong> (L 631/1998, A 812/1998).All <strong>the</strong> stipulati<strong>on</strong>s are available in <strong>the</strong> Finlex legislative database at: www.finlex.fiOn-<strong>the</strong>-<strong>job</strong> <strong>training</strong> <strong>and</strong> <strong>the</strong>ses are also stipulated by, am<strong>on</strong>g o<strong>the</strong>r things, recommendati<strong>on</strong>s <strong>and</strong> c<strong>on</strong>tenti<strong>on</strong>sby trade uni<strong>on</strong>s <strong>and</strong> field-specific employment c<strong>on</strong>tracts, <strong>the</strong> W<strong>or</strong>king Hours Act, Employment C<strong>on</strong>tracts Act,Occupati<strong>on</strong>al Safety <strong>and</strong> Health Act, Young W<strong>or</strong>kers' Act, Decree <strong>on</strong> Protecting Employees, Ministry ofEmployment <strong>and</strong> <strong>the</strong> Ec<strong>on</strong>omy's decisi<strong>on</strong>s <strong>on</strong> <strong>job</strong>s suitable f<strong>or</strong> <strong>the</strong> young <strong>and</strong> hazardous <str<strong>on</strong>g>to</str<strong>on</strong>g> young w<strong>or</strong>kers,T<strong>or</strong>t Liability Act, Employment Accidents Act, as well as Student Financial Aid Act.Cooperati<strong>on</strong>The representative of <strong>the</strong> w<strong>or</strong>kplace <strong>and</strong> teacher men<str<strong>on</strong>g>to</str<strong>on</strong>g>ring <strong>the</strong> student (teacher-in-charge) agree <strong>on</strong><strong>arranging</strong> <strong>on</strong>-<strong>the</strong>-<strong>job</strong> <strong>training</strong> <strong>and</strong> <strong>the</strong>ses in m<strong>or</strong>e detail in student-specific plans <strong>and</strong> inf<strong>or</strong>m each o<strong>the</strong>r of anychanges in <strong>the</strong>m.The college <strong>and</strong> employees cooperate <strong>on</strong> developing <strong>the</strong> c<strong>on</strong>tents <strong>and</strong> executi<strong>on</strong> of <strong>on</strong>-<strong>the</strong>-<strong>job</strong> <strong>training</strong>periods <strong>and</strong> <strong>the</strong>ses. An essential part of this development is m<strong>on</strong>i<str<strong>on</strong>g>to</str<strong>on</strong>g>ring <strong>the</strong> regi<strong>on</strong>al w<strong>or</strong>kf<strong>or</strong>ce dem<strong>and</strong>s <strong>and</strong>changes in employees' competence requirements. The college appoints a vocati<strong>on</strong>al c<strong>on</strong>sultative committee- c<strong>on</strong>sisting of teachers <strong>and</strong> representatives of local business life - <str<strong>on</strong>g>to</str<strong>on</strong>g> co<strong>or</strong>dinate cooperati<strong>on</strong>.Student's status <strong>and</strong> obligati<strong>on</strong>sThe student is not covered by an employment relati<strong>on</strong> <strong>and</strong> he/she is not paid wages, unless o<strong>the</strong>rwiseagreed in <strong>the</strong> employment c<strong>on</strong>tract. The student is obliged <str<strong>on</strong>g>to</str<strong>on</strong>g> follow <strong>the</strong> <strong>or</strong>der of <strong>the</strong> w<strong>or</strong>kplace as well asinstructi<strong>on</strong>s <strong>and</strong> regulati<strong>on</strong>s related <str<strong>on</strong>g>to</str<strong>on</strong>g> w<strong>or</strong>k <strong>and</strong> safety. The student is not entitled <str<strong>on</strong>g>to</str<strong>on</strong>g> disclose <str<strong>on</strong>g>to</str<strong>on</strong>g> a third partyany business secrets <strong>or</strong> o<strong>the</strong>r c<strong>on</strong>fidential inf<strong>or</strong>mati<strong>on</strong>.College's obligati<strong>on</strong>s <strong>and</strong> resp<strong>on</strong>sibilityThe college appoints a teacher men<str<strong>on</strong>g>to</str<strong>on</strong>g>ring <strong>the</strong> student (teacher-in-charge) <strong>and</strong> supp<strong>or</strong>ts <strong>the</strong> w<strong>or</strong>kplace inexecuting <strong>on</strong>-<strong>the</strong>-<strong>job</strong> <strong>training</strong> <strong>and</strong> <strong>the</strong>ses.The teacher-in-charge prepares <strong>the</strong> student f<strong>or</strong> <strong>the</strong> w<strong>or</strong>kplace <strong>and</strong> ensures <strong>on</strong> his/her part that <strong>the</strong> student isaware of his/her obligati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> follow <strong>the</strong> <strong>or</strong>der of <strong>the</strong> w<strong>or</strong>kplace as well as instructi<strong>on</strong>s <strong>and</strong> regulati<strong>on</strong>s related<str<strong>on</strong>g>to</str<strong>on</strong>g> w<strong>or</strong>k <strong>and</strong> safety.Employer's obligati<strong>on</strong>s <strong>and</strong> resp<strong>on</strong>sibilityThe employer appoints a w<strong>or</strong>kplace instruc<str<strong>on</strong>g>to</str<strong>on</strong>g>r with sufficient facilities <str<strong>on</strong>g>to</str<strong>on</strong>g> perf<strong>or</strong>m <strong>the</strong> task. The instruc<str<strong>on</strong>g>to</str<strong>on</strong>g>r actsas <strong>the</strong> representative of <strong>the</strong> w<strong>or</strong>kplace in planning, executing <strong>and</strong> assessing <strong>on</strong>-<strong>the</strong>-<strong>job</strong> learning <strong>and</strong> <strong>the</strong>ses.The employer gives <strong>the</strong> college <strong>the</strong> required inf<strong>or</strong>mati<strong>on</strong> <strong>on</strong> <strong>the</strong> c<strong>on</strong>diti<strong>on</strong>s, tasks <strong>and</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g>ols related <str<strong>on</strong>g>to</str<strong>on</strong>g> <strong>the</strong>w<strong>or</strong>k <strong>and</strong> w<strong>or</strong>k envir<strong>on</strong>ment. The employer ensures that <strong>the</strong> w<strong>or</strong>kplace instruc<str<strong>on</strong>g>to</str<strong>on</strong>g>r <strong>and</strong> o<strong>the</strong>r staff membersare sufficiently aware of <strong>the</strong> <str<strong>on</strong>g>agreement</str<strong>on</strong>g> as well as of <strong>the</strong> plans <strong>and</strong> tasks related <str<strong>on</strong>g>to</str<strong>on</strong>g> <strong>the</strong> student's <strong>on</strong>-<strong>the</strong>-<strong>job</strong>learning <strong>and</strong>/<strong>or</strong> <strong>the</strong>sis.Occupati<strong>on</strong>al safetyThe employer is resp<strong>on</strong>sible f<strong>or</strong> <strong>the</strong> student's occupati<strong>on</strong>al safety during <strong>on</strong>-<strong>the</strong>-<strong>job</strong> learning periods <strong>and</strong><strong>the</strong>sis as required by <strong>the</strong> Occupati<strong>on</strong>al Safety <strong>and</strong> Health Act <strong>and</strong> Young W<strong>or</strong>kers' Act. The student shall beinducted in<str<strong>on</strong>g>to</str<strong>on</strong>g> <strong>the</strong> c<strong>on</strong>diti<strong>on</strong>s <strong>and</strong> w<strong>or</strong>k <strong>and</strong> producti<strong>on</strong> methods of <strong>the</strong> w<strong>or</strong>kplace. The student must beinstructed in <strong>the</strong> use of <str<strong>on</strong>g>to</str<strong>on</strong>g>ols <strong>and</strong> safe w<strong>or</strong>k methods. Special attenti<strong>on</strong> shall be paid <str<strong>on</strong>g>to</str<strong>on</strong>g> guidance <strong>and</strong>supervisi<strong>on</strong>. The employer is resp<strong>on</strong>sible f<strong>or</strong> <strong>the</strong> w<strong>or</strong>king c<strong>on</strong>diti<strong>on</strong>s, equipment, devices, as well asarrangement of guidance <strong>and</strong> supervisi<strong>on</strong>. The employer is also resp<strong>on</strong>sible f<strong>or</strong> ultimately ensuring that <strong>the</strong>student has <strong>the</strong> required protective equipment <strong>and</strong> that he/she uses <strong>the</strong>m. Particularly imp<strong>or</strong>tan<str<strong>on</strong>g>to</str<strong>on</strong>g>ccupati<strong>on</strong>al safety issues are entered in <strong>the</strong> student's <strong>on</strong>-<strong>the</strong>-<strong>job</strong> learning <strong>and</strong>/<strong>or</strong> <strong>the</strong>sis plan.A pers<strong>on</strong> under 18 is covered by special protecti<strong>on</strong> (<strong>the</strong> Young W<strong>or</strong>kers' Act, Decree <strong>on</strong> Jobs EspeciallyDetrimental <strong>or</strong> Hazardous <str<strong>on</strong>g>to</str<strong>on</strong>g> Young W<strong>or</strong>kers, as well as <strong>the</strong> Occupati<strong>on</strong>al Safety <strong>and</strong> Health Act).Never<strong>the</strong>less, a pers<strong>on</strong> who is 16 years <strong>or</strong> older can c<strong>on</strong>duct w<strong>or</strong>k listed by <strong>the</strong> Ministry of Employment <strong>and</strong><strong>the</strong> Ec<strong>on</strong>omy as hazardous, provided that <strong>the</strong> industrial safety district supervising <strong>the</strong> w<strong>or</strong>kplace is notified<strong>and</strong> provided that <strong>the</strong> hazard is prevented by taking safety measures. A pers<strong>on</strong> under 16 may not perf<strong>or</strong>msuch hazardous <strong>job</strong>s that are listed in <strong>the</strong> Ministry of Employment <strong>and</strong> <strong>the</strong> Ec<strong>on</strong>omy's decree 128/2002.
Accidents <strong>and</strong> insuranceThe college's resp<strong>on</strong>sibility <strong>and</strong> obligati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> insure against accident is based <strong>on</strong> <strong>the</strong> Employment AccidentsAct <strong>and</strong> <strong>the</strong> Decree <strong>on</strong> Compensati<strong>on</strong> f<strong>or</strong> Accidents <str<strong>on</strong>g>to</str<strong>on</strong>g> Students. The compensati<strong>on</strong> obligati<strong>on</strong> is determined<strong>on</strong> <strong>the</strong> basis of <strong>the</strong> Employment Accidents Act. The student is covered by <strong>the</strong> college's accident insurancewhen <strong>on</strong>-<strong>the</strong>-<strong>job</strong> <strong>training</strong> is not covered by an employment relati<strong>on</strong>. If <strong>on</strong>-<strong>the</strong>-<strong>job</strong> <strong>training</strong> is covered by anemployment relati<strong>on</strong>, <strong>the</strong> student is covered by <strong>the</strong> w<strong>or</strong>kplace's accident insurance.During an <strong>on</strong>-<strong>the</strong>-<strong>job</strong> <strong>training</strong> period <strong>the</strong> student is c<strong>on</strong>sidered an employee, <strong>and</strong> <strong>the</strong> w<strong>or</strong>kplace's liabilityinsurance secures <strong>the</strong> student acc<strong>or</strong>ding <str<strong>on</strong>g>to</str<strong>on</strong>g> <strong>the</strong> vicarious liability principle.Varia's's liability insurance covers <strong>the</strong> student's pers<strong>on</strong>al compensati<strong>on</strong> obligati<strong>on</strong> within <strong>the</strong> E.U. in case that<strong>the</strong> student has caused <strong>the</strong> employer <strong>or</strong> a third pers<strong>on</strong> damage - damage <str<strong>on</strong>g>to</str<strong>on</strong>g> pers<strong>on</strong> <strong>or</strong> goods - by an actdeemed m<strong>or</strong>e serious than a mild act. The insurance compensates f<strong>or</strong> <strong>the</strong> damage <strong>on</strong>ly as far ascompensati<strong>on</strong> cannot be acquired <strong>on</strong> <strong>the</strong> basis of o<strong>the</strong>r insurance.The student may be pers<strong>on</strong>ally obliged <str<strong>on</strong>g>to</str<strong>on</strong>g> compensate f<strong>or</strong> damage if he/she has due <str<strong>on</strong>g>to</str<strong>on</strong>g> negligence causeddamage at <strong>the</strong> w<strong>or</strong>kplace, <str<strong>on</strong>g>to</str<strong>on</strong>g> an employee of <strong>the</strong> w<strong>or</strong>kplace, <strong>or</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> a third pers<strong>on</strong>.W<strong>or</strong>k arrangement <strong>and</strong> w<strong>or</strong>king hoursDuring <strong>on</strong>-<strong>the</strong>-<strong>job</strong> <strong>training</strong> <strong>and</strong> <strong>the</strong>ses <strong>the</strong> student is included in study-related social benefits <str<strong>on</strong>g>to</str<strong>on</strong>g> <strong>the</strong> extentstipulated.If <strong>the</strong> employer does not provide <strong>the</strong> student with meals, <strong>the</strong> employer charges <strong>the</strong> college f<strong>or</strong> <strong>or</strong> <strong>the</strong> collegepays <strong>the</strong> student <strong>the</strong> valid price of a student meal based <strong>on</strong> <strong>the</strong> meal-compensati<strong>on</strong> f<strong>or</strong>m.W<strong>or</strong>k clo<strong>the</strong>s, protective equipment <strong>and</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g>olsIf <strong>the</strong> employer cannot provide <strong>the</strong> required w<strong>or</strong>k clo<strong>the</strong>s <strong>or</strong> protective equipment, <strong>the</strong> student uses his own<strong>or</strong> <strong>the</strong> college's clo<strong>the</strong>s during <strong>on</strong>-<strong>the</strong>-<strong>job</strong> <strong>training</strong>. If <strong>the</strong> student is required <str<strong>on</strong>g>to</str<strong>on</strong>g> use his/her pers<strong>on</strong>al <str<strong>on</strong>g>to</str<strong>on</strong>g>ols, thisfact is menti<strong>on</strong>ed in <strong>the</strong> student-specific <strong>on</strong>-<strong>the</strong>-<strong>job</strong> learning <strong>and</strong>/<strong>or</strong> <strong>the</strong>sis plan.AssessmentThe w<strong>or</strong>kplace instruc<str<strong>on</strong>g>to</str<strong>on</strong>g>r, student <strong>and</strong> teacher assess <strong>on</strong>-<strong>the</strong>-<strong>job</strong> learning <strong>and</strong> <strong>the</strong>sis acc<strong>or</strong>ding <str<strong>on</strong>g>to</str<strong>on</strong>g> <strong>the</strong>principle of tripartism.O<strong>the</strong>r issues agreedThe employer is entitled <str<strong>on</strong>g>to</str<strong>on</strong>g> terminate an <strong>on</strong>-<strong>the</strong>-<strong>job</strong> learning period if <strong>the</strong> student is incapable of perf<strong>or</strong>ming<strong>the</strong> tasks agreed; if <strong>the</strong> student disregards rules <strong>and</strong> safety regulati<strong>on</strong>s; <strong>or</strong> if <strong>the</strong> student intenti<strong>on</strong>ally <strong>or</strong> bygross negligence causes damage <str<strong>on</strong>g>to</str<strong>on</strong>g> <strong>the</strong> employer's property, pers<strong>on</strong>nel, <strong>or</strong> cus<str<strong>on</strong>g>to</str<strong>on</strong>g>mers. The w<strong>or</strong>kplaceinstruc<str<strong>on</strong>g>to</str<strong>on</strong>g>r shall c<strong>on</strong>tact <strong>the</strong> teacher-in-charge if he/she is prematurely terminating an <strong>on</strong>-<strong>the</strong>-<strong>job</strong> learningperiod.In case of industrial acti<strong>on</strong>, <strong>the</strong> college is entitled <str<strong>on</strong>g>to</str<strong>on</strong>g> immediately transfer <strong>the</strong> student <str<strong>on</strong>g>to</str<strong>on</strong>g> ano<strong>the</strong>r w<strong>or</strong>kplace.Validity of <strong>the</strong> <str<strong>on</strong>g>agreement</str<strong>on</strong>g>A fixed-term <str<strong>on</strong>g>agreement</str<strong>on</strong>g> terminates at <strong>the</strong> end of <strong>the</strong> c<strong>on</strong>tractual period without a period of notice. An<str<strong>on</strong>g>agreement</str<strong>on</strong>g> valid until fur<strong>the</strong>r notice is valid f<strong>or</strong> three years after signing of <strong>the</strong> <str<strong>on</strong>g>agreement</str<strong>on</strong>g> <strong>and</strong> au<str<strong>on</strong>g>to</str<strong>on</strong>g>maticallyc<strong>on</strong>tinues <strong>on</strong>e year at a time unless it is canceled at least two (2) m<strong>on</strong>ths bef<strong>or</strong>e <strong>the</strong> terminati<strong>on</strong> of <strong>the</strong>c<strong>on</strong>tractual period.Interpretati<strong>on</strong>s of <strong>the</strong> <str<strong>on</strong>g>agreement</str<strong>on</strong>g>Any dis<str<strong>on</strong>g>agreement</str<strong>on</strong>g>s over interpreting <strong>the</strong> <str<strong>on</strong>g>agreement</str<strong>on</strong>g> will primarily be solved by negotiati<strong>on</strong>s between <strong>the</strong>c<strong>on</strong>tracting parties. If c<strong>on</strong>sensus cannot be reached, arbitrati<strong>on</strong> proceedings will be commenced. A pers<strong>on</strong>approved by <strong>the</strong> c<strong>on</strong>tracting parties is invited <str<strong>on</strong>g>to</str<strong>on</strong>g> act as arbitra<str<strong>on</strong>g>to</str<strong>on</strong>g>r.
