INTRODUCTIONThe Lycée Français de Singapour LTD (« LFS ») is a private company, registered as a school withthe Singaporean Ministry of Education. This private education institution (“PEI”) has to comply withthe obligations under the Pivate Education Act 2009 and the Regulations made thereunder. 1.10 School Fees:The School Fees shall be apportioned as set out in Schedule 2 (“School Fees”) andshall, subject to Clauses 2 and 3, be payable on or before the dates set out therein.1.11 Payment of School Fees:The School Fees (inclusive Miscellaneous Fee) set out in Schedule 2 shall be paid onor before the dates specified as set out in Schedule 4.1.12 Issue of Receipts:For every payment made by the Student to the PEI, the PEI will issue a receipt ondemand.2. REFUND POLICY2.1 Notification and ArrangementPEI shall inform the Student immediately within three (3) working days if(i)(ii)(iii)It fails, for any reason, to commence the Course on the Course CommencementDate;It terminates the Course, for any reason, prior to the Course CommencementDate;The Student’s Pass application is rejected by Immigration and CheckpointAuthority (ICA).The PEI shall, within seven (7) working days of notifying the Student in writing of abovecircumstances (i) to (iii), provide the Student with information and details of thealternative confirmed course arrangement to allow the Student to make timely andappropriate decision on the alternative arrangement.2.2 Withdrawal for Cause:Subject to Clause 7, the Student shall be entitled to immediately withdraw from theCourse by giving written notice to the PEI of his/her intention to do so if the PEI is inbreach of any of its obligations under this Agreement or fails to perform its obligation(s)under the circumstances in Clause 2.1 (i) to (iii).2.3 Refunds for Withdrawal for Cause:For circumstances under Clause 2.1, the PEI shall, within thirty (30) working days afternotifying the Student, refund to the Student the amount of the School Fees, for coursesnot consumed by the Student.The PEI shall also, as soon as practicable after receiving the Student’s notice ofwithdrawal under Clause 2.2 (and in any event no later than thirty (30) working daysafter receiving such notice) refund to the Student the amounts stated in this Clause 2.3.2.4 Refunds for Withdrawal Without Cause:Where the Student withdraws from the Course for any reason other than those set outin Clause 2.2 or Clause 7, the PEI shall as soon as practicable after receiving theStudent’s written notice of withdrawal (and in any event no more than thirty (30)working days after receiving such notice) refund to the Student the following sums:Update : June 2013 7

The Executive Committee of the French School may take legal action againstdefaulters, should the need arise.2.6 Deemed Withdrawal:A Student who transfers from the Course to another course with the PEI shall, for thepurposes of this Clause 2, be deemed to have withdrawn from the Course and theprovisions of Clause 2.4 shall apply save as otherwise agreed between the PEI andthe Student.2.7 Change of Course:Further to Clause 2.6, a fresh PEI-Student Contract under this format shall beexecuted between the PEI and the Student for any change of Course.Update : June 2013 8


3. GOVERNING LAW AND DISPUTE RESOLUTION3.1 Governing Law:This Agreement shall be governed by, and construed in accordance with, the laws ofSingapore.3.2 Grievance Procedure:The terms of this contract shall take precedence over any provision in the studenthandbook or any other document provided by the PEI. Nothing in the student’shandbook or any other document provided by the PEI shall limit or restrict the Studentfrom filing a complaint at any time with the Singapore Mediation Centre (SMC) orSingapore Institute of Arbitrators (SIArb) through the CPE Student Services Centrepursuant to Clause 3.3, or to seek other legal redress against the PEI as the Studentmight deem fit.3.3 Third Party Mediation:In the event that the Student and the PEI are unable to resolve a dispute, the Studentand the PEI may refer the dispute to the Singapore Mediation Centre (SMC) orSingapore Institute of Arbitrators (SIArb) through the CPE Student Services Centre formediation prior to instituting any legal action. The Student and the PEI hereby agree tosuch procedures and to pay such fees as the Singapore Mediation Centre (SMC) orSingapore Institute of Arbitrators (SIArb) may prescribe from time to time for thepurpose of resolving their dispute.3.4 Jurisdiction:The parties hereby irrevocably agree that the courts of Singapore are to havejurisdiction to settle any disputes which may arise out of or in connection with thisAgreement which cannot be settled successfully through the Singapore MediationCentre (SMC) or Singapore Institute of Arbitrators (SIArb) and that, accordingly, anylegal action arising out of or in connection with this Agreement (“Proceedings”) maybe brought in those courts and the parties irrevocably submit to the jurisdiction ofthose courts PROVIDED THAT nothing in this Clause shall limit the right of any partyto take Proceedings in any other court of competent jurisdiction nor shall the taking ofProceedings in one or more jurisdictions preclude that party from taking Proceedingsin any other jurisdiction, whether concurrently or not.Update : June 2013 9


4. INTERNATIONAL STUDENTS (where applicable)4.1 Student’s Pass Application: The PEI undertakes to use best efforts to assist theStudent if he/she requires a Student’s Pass from the ICA.4.2 Student’s Pass Not Transferable: The Student’s Pass issued under Clause 4.1 isnot transferable and will expire upon the Student ceasing to be a student of the PEI.The PEI is under an obligation to inform the ICA of the Student’s withdrawal from, orcompletion of his/her course of study at the PEI, and the Student shall deliver to thePEI, within 20 working days of the Student ceasing to be a student of the PEI, thepassport and Student’s Pass of the Student for cancellation of the Student’s Pass.4.3 Withdrawing from the PEI: A Student who withdraws from the PEI to enrol withanother school shall be deemed to have withdrawn from the PEI under Clause 4.2 andthe provisions of Clause 4.2 shall apply.5. CHANGE IN OWNERSHIP / MANAGEMENTThe PEI shall inform the Student in the event of any :(a) Change in ownership or shareholding structure of the PEI, and/or(b) Change in the management of the PEI.The PEI shall inform the Student of such changes as soon as practicable, and in anyevent no later than thirty (30) days after the change has been effected.6. CONFIDENTIALITYThe PEI is committed to maintaining the confidentiality of all information provided bythe student and undertakes not to divulge any of this information to any third partywithout the prior written consent of the Student.7. FORCE MAJEUREIn the event that any party shall be rendered unable to carry out the whole or any partof its obligations under this Agreement for any reason beyond the control of that party,including but not limited to acts of God, force majeure, strikes, war, riot and any othercauses of such nature, then the performance of the obligations hereunder of that partyor all the parties as the case may be and as they are affected by such cause shall beexcused during the continuance of any inability so caused, but such inability shall asfar as possible be remedied with all reasonable despatch. For the avoidance of doubt,this Clause shall not apply to cases where:(i)The PEI is declared to be insolvent and/or a winding-up order made orbankruptcy issued by the Singapore court against the PEI (or, any partner of thePEI if the PEI is a partnership); and(ii) The relevant authority(ies) issue(s) an order to cease and/or terminate theoperations of the PEI, or the happening of anything of a similar nature under thelaws of Singapore.Update : June 2013 10


8. PRECEDENCE TO OTHER AGREEMENTSIn the event of there being any inconsistency between the terms of this Agreementand the terms of any other agreement (oral or written) entered into between the PEIand the Student either before or after the making of this Agreement, the terms of thisAgreement shall prevail and the terms of such other agreement shall be deemed to beamended to the extent necessary for it to be read as being consistent with thisAgreement.The PEI shall not be allowed to enter into any other contractual agreement with theStudent without the prior express written permission of the Council, and anyagreements so executed shall be void, and any payments made by the Studentsthereunder shall be refunded to the Students in full. Students are advised, prior tosigning any other agreements with the PEI, to ask to be shown a copy of the Council’swritten approval of such agreements.Update : June 2013 11


9. MISCELLANEOUS9.1 Indulgence, Waiver, etc.: No failure on the part of any party to this Agreement toexercise and no delay on the part of any party in exercising any right hereunder willoperate as a release or waiver thereof, nor will any single or partial exercise of anyright under this Agreement preclude any other or further exercise of it.9.2 Remedies: No remedy conferred by any of the provisions of this Agreement isintended to be exclusive of any other remedy which is otherwise available at law, inequity, by statute or otherwise, and each and every other remedy shall be cumulativeand shall be in addition to every other remedy given hereunder or now or hereafterexisting at law, in equity, by statute or otherwise. The election of any one or more ofsuch remedies by any of the parties to this agreement shall not constitute a waiver bysuch party of the right to pursue any other available remedies.9.3 Severability of Provisions: If any provision of this Agreement or part thereof isrendered void, illegal or unenforceable by any legislation to which it is subject, it shallbe rendered void, illegal or unenforceable to that extent and it shall in no way affect orprejudice the enforceability of the remainder of such provision or the other provisionsof this Agreement.9.4 Successors and Assigns: This Agreement shall be binding upon, and ensure for thebenefit of, the successors, personal representatives and permitted assigns of theparties PROVIDED THAT neither the PEI nor the Student shall be entitled to assign itsrights and/or obligations under this Agreement without the prior written consent of theother party. SCHOOL FEES STRUCTURE, TERMS OF PAYMENT AND EXISTING SCHOLARSHIPRegistration and re-enrollment at the LFS implies agreement to the present FinancialRegulation.1 – SCHOOL FEES ADVANCEA school fees advance must be settled at the time of first registration to the LFS and every yearwhen re-enrolling the student. The amount of the school fees advance is indicated on the “tarifdes écolages – school fees” table given to parents and updated every year on the LFS website.This school fees advance is offset against the third term invoice of the current academic year. Anew school fees advance is charged in the 3 rd term as part of the re-enrollment for the nextacademic year.The school fees advance is reimbursed when the LFS has received the completed departureform, usually during the 3 rd term of the academic year for a departure at the end of the academicyear, or earlier if the departure occurs before the end of the academic year.Example for a family with 2 children registered for the academic year 2013-2014:This family will pay a school fees advance of SGD12,000 at the time of first registration to theLFS, or as part of the 3 rd term invoice for the academic year 2012-2013 if it is a re-enrollment.This advance is offset against the 3 rd term invoice of the academic year 2013-2014, and a newadvance of SGD12,000 is charged at the same time for the academic year 2014-2015. Thefinancial impact of the school fees advances for the family is therefore nil for the 3 rd term in caseof a re-enrollment.No student will be accepted in the school without prior payment of the school fees advance, beinga first registration or a re-enrollment.Exemption from school fees advance is granted to founding shareholders (O.D.F.), one schoolfees advance for each share that the company subscribes to (refer to page 6), and for children forwhom a deposit has been settled at the time of registration (children registered before theacademic year 2010/2011).2 – ANNUAL REGISTRATION FEES (First time and re-enrollment)Annual registration fees must be paid for each child registering at the LFS. The amount isreduced for re-enrollment. The amount of registration fees is indicated on the “tarif des écolages -school fees” table given to parents and updated every year on the website of the LFS.Annual registration fees must be paid together with the first instalment of school fees for theforthcoming year.For new comers, the first time registration fees must be settled at the time of registration.No new student will be accepted in the school without prior payment of these fees.Registration fees are waived for founding shareholders: one annual registration fee for eachshare that the company subscribes to (refer to page 6 of these Financial Regulations).However, to take into account the registration of a child, the annual registration fees have to bepaid at the time of the registration for children under ODF. There will be no partialpayment or refund should the child arrive or leave during the school year.3 – QUARTERLY SCHOOL FEESThe School fees’ annual amount is indicated on the “tarif des écolages – school fees” tableupdated annually and given to parents every year.School fees are to be paid at the beginning of each quarterly term.The school fees comprise : Kindergarten : Schooling, school stationery, various insurance costs. Primary School : Schooling, school books, exercise books, various insurance costs. Middle School (“6ème” to “3ème” levels) : Schooling, school books, French curriculumexams registration fees and various insurance costs. High School (“2nde” to “Terminale” levels) : Schooling, French curriculum examsregistration fees and various insurance costs.School fees do not include : Meals at the school canteen which are compulsory. School bus services. Optional Extra-curricular activities. Various school stationery: pens, compasses, rulers, etc… Educational trips: if a student is not taking part to a trip, his family or the companywhich incurs school fees cannot claim for any pro-rated school fees refund.Concessions:Companies having loan agreements with the LFS can benefit from an annual concessionamounting to a maximum of SGD 1,000 per child, per academic year and for every loan of SGD10,000. This concession is deducted from the first instalment of school fees in the school year.Fees for any term started has to be paid in full. No partial payment or refunds will be madefor those who arrive or leave during the school term.4 – QUARTERLY CANTEEN FEESThe Canteen fees’ annual amount is indicated on the “tarif des écolages – school fees” tableupdated annually and given to parents every year.Canteen fees are to be paid at the beginning of each quarterly term together with the schoolfees, for students having registered at the kindergarten, primary school and middle school(“6ème” to “3ème” levels). Students registered at the high school (“2nde” to “Terminale” levels)pay directly for their meals every day.For students who arrive to the LFS after the beginning of a term or leave definitely the LFSbefore the end of a term, a partial payment or refund will be made for each entire monthduring which the student was not present. 5 – BILINGUAL CLASSES FEESThe annual bilingual classes contribution is to be paid for each child registrered in bilingualclasses.The amount is indicated on the “tarif des écolages - school fees” table given to parents which isalso posted and updated every year on the website of the LFS.Bilingual classes contribution must be paid together with the first instalment of school fees for theforthcoming year.Please note that the bilingual classes fees must be paid in full. No partial payment will berefunded should the child arrive or leave during the school year.6 – TERMS OF PAYMENT- Cheques are to be made in favour of "Lycée Français de Singapour Ltd ".- Fees due to LFS can also be paido by credit card (Visa, Master Card, American Express) at the accounting department (3 rdfloor – block E). Administrative fees of 2% of the fee amount will be charged to parents, oro by transfer. Transfer fees are to be be borne by parents.- Registration can only be confirmed after payment of registration fees and school fees advance.- The school fees are to be settled as follows : 40 % of the annual amount must be paid beforeSeptember 20th, 30 % to be paid before January 20th and the remaining 30 % before April20th . Before each deadline, a reminder will be sent to each family.- You are kindly requested to meet the deadlines mentioned above in order to allow our schoolto cover all its expenses on-time and to guarantee fairness towards other families. Interests willbe charged for late payments.- If the payment of the school fees advance, or annual registration fees or school fees is notmade on the due date, students will not be admitted to the school. The Executive Committee ofthe French School may take legal action against defaulters, should the need arise.- Claims to concession of school fees will not be considered in the event of a student beingabsent for an indeterminate period.7 –SCHOLARSHIPS GRANTED BY THE FRENCH GOVERNMENTFrench students are entitled to receive a scholarship depending on their parents’ income.Application forms can be obtained at the French Embassy (Chancellerie Consulaire).Families who benefit from a partial bursary have to settle the balance of their paymentof school fees before the deadlines mentioned above.Update : June 2013Financial Regulations : page 4 20


8 – PROCEDURE WHEN LEAVING OUR SCHOOLThe following procedures are to be followed when a student leaves the school :- Prior notice must be given to the Administration Department and the departure form must becompleted by the parents, as well as companies for the financial information when thecompanies have paid the deposit or school fees advance.- Books must be returned at least two days before the student's departure either to teachers (forprimary school students) or to the librarian (for secondary school students). An officialdocument will be given, to prove that books have been returned.- An appointment must be made with our administration officer so that the following documentswill be given to the family :• Cheque equivalent to the amount of the initial deposit (students registered before theacademic year 2010-2011), if the deposit was settled by the parents (not by thecompany).• Student's certificate of attendance at the LFS. Compulsory for those moving to anotherFrench School.• Eventually the student’s school records.These documents will be given to the parents upon presentation of the official documentmentioning that books have been returned (see second bullet above) and after receivingconfirmation from the Accounts Department that school fees have been paid.If books have been lost or damaged, a contribution of SGD 40 will be payable by the parents asstated in the books loan agreement signed between the LFS and the Families at the beginning ofthe academic year.Update : June 2013Financial Regulations : page 5 21


FINANCIAL SUPPORT OF COMPANIES TO THE FINANCING OF THE LYCEE FRANCAIS DESINGAPOURLycée Français de Singapour (“LFS”) is facing a huge challenge regarding growth.The financing of extension projects can unfortunately only be possible with the financial aidesfrom companies incorporated in Singapore in the following manner :--acquisition of Option de Fondateur (“ODF”)-donation to Lycée Français Development FundOption de fondateur (« ODF »)Being an ODF holder via acquisition of ODF, a company incorporated in Singapore becomes a‘corporate member’ of LFS. The corporate members are involved and committed tothe management of the LFS by providing expertise and financial aides.It is a financial participation to the LFS that entitles a corporate member to the following benefitsfor each student for whom an ODF has been subscribed:1. Priority for registration. The children of employees of corporate member will be given thepriority to admission to LFS2. Exemption of initial school deposit / school fees advance3. Exemption of annual registration fees amounting to SGD 2,675 (inclusive of GST) for 1st timeregistration and SGD 1,605 (inclusive of GST) for subsequent annual registrationThe above mentioned benefits are valid for a 5-year or 10-year duration depending on the type ofODF acquired. The cost from September 2012 is as follows:- a 5-year duration ODF costs SGD 32,000 (excl GST) which includes a SGD 20,000 donation toLycée Français Development Fund- a 10-year duration ODF costs SGD 53,000 (excl GST) which includes a SGD 30,000 donation toLycée Français Development Fund.Donation to Lycée Français Development FundThe donation provides partial financial aide to building extension projects.Lycée Français Development Fund is a charity which benefits from the Institution of PublicCharacter (IPC) status from the Singaporean government.In contributing to this fund, a company benefits from a corporate tax deduction.Starting from the academic year 2012-2013 onwards, for students leaving definitely the LFS, adonation towards the extension project of the Lycée Français de Singapour, equal to part or all ofthe amount of the deposit / school fees advance, can be made instead of a reimbursement.
