A few days earlier the8th Circuit Court of Appeals had denied theCounty’s petition for rehearing, making theSupreme Court the final option in pursuingthe Counties request that the district courtmake a declaratory judgment on the existenceor non-existence of the former 1855 MilleLacs Indian Reservation.In judging the wisdom of this latest action,one needs to recall that it was the U.S.Supreme Court that in 1913 awardedcompensation to the Mille Lacs Band inreturn for disestablishment of the MilleLacs Indian Reservation (1863-64) and therelinquishment of their claim that the cededformer reservation was theirs to use andoccupy forever (1889).Mille Lacs County has asked the court fora declaratory judgment on the basis that onprevious occasions, the court has made suchjudgments on legitimate Indian reservationboundary disputes without additionalspecific controversy being present. The legalprecedent of City of New Town, NorthDakota v. United States (1972) and RosebudSioux Tribe v. Kneip (1977), the Countycontends, should rule in the current case.
