Cahaya SPK Resort Club BerhadCompany No.: 728134-KARTICLE 6: Fees6.1 The prescribed fees for the Club Membership shall include all or otherwise, part ofthe following fees to be charged in to their respective categories of ClubMembership as set out in Article 4.2:(i)(ii)(iii)(iv)Membership Fee;Refundable Security Deposit;Subscription Fees;Processing Fees; andany other prescribed charges that may be imposed by the Company, unlessotherwise any waiver has been granted by the Company to such Club Member.6.2 Subject to approval from Companies Commission of Malaysia, the Company shallbe entitled to determine and vary the amount of the Membership Fee, RefundableSecurity Deposit, Subscription Fees, Processing Fees and other prescribed feesincidental to the Club Membership from time to time and as well as to waive theimposition of such fees or any part thereof from such Club Members or categoriesof Club Membership.6.3 If any Club Member shall default in paying the Subscription Fees for three (3)consecutive months, a notice from the Company (“the Notice”) shall be sent tothe Defaulting Member requiring payment of the Subscription Fees to be madewithin fourteen (14) days from the date of the Notice.6.4 All payments for the Subscription Fees and charges incurred by the Club Membermust be paid within Fourteen (14) days from the date of the statement of account,failing which the Club Member shall pay interest at the rate of one-point-five percentum (1.5%) per month on a monthly rest basis, from the due date until the date ofactual payment and until so paid shall be a debt due from the Club Member to theCompany and be forthwith recoverable by action.”ARTICLE 7: Family of Members7.1 Lawful spouses and lawful children of Club Members shall be permitted to use theFacilities and Amenities of the Club provided that any restrictions applicable tothe Club Member shall also apply to the spouses and children.7.2 Club Members shall be fully responsible for the behaviour, conduct, acts, default,negligence or omission (whether willful or not) of their spouses and children andtheir observance of Articles herein.ARTICLE 8: Nominee8.1 Club Members who hold the Resident Memberships or who is a corporate bodymay nominate one (1) Nominee inclusive of his lawful spouses and lawful childrento enter the Club as a mere licensee of the Company to use and enjoy theFacilities and Amenities of the Club and the services provided by the Club incommon with Other Members and persons permitted by the Company.8

Cahaya SPK Resort Club BerhadCompany No.: 728134-K1.4.5. Running, dunking, pushing, jumping and horse play is notpermitted within and around the Pools area as it may result ininjuries.1.4.6. No diving and/or snorkeling are allowed in the Pools unlessauthorized by the Company.1.4.7. The use of any glass or metal objects is not permitted in the Poolsfor safety reasons. The Company reserves all rights to allow ordisallow the use of any object in the Pools.1.5. Heavy Rain1.5.1. Club Members are advised in their own interests to leave the Poolsduring drizzle or heavy rain. In the event that there arethunderstorms, lightning, electrical failure or upon request by thelifeguards or any authorized personnel of the Club, Club Membersshall leave the Pools. The Company shall not be held responsiblefor any death, injury, accidents or other mishap caused to anyoneusing the Pools.1.6. Whistles1.7. Towels1.6.1. ONE (1) whistle means that users of the Pools should stop andlisten to the lifeguards or any authorized personnel of the Club’sinstructions. THREE (3) whistles means the users of the Poolsmust get out of the Pools immediately.1.7.1. The Club Member, the Family Members, the Nominee and/or guestmust utilize the towels provided at the Dedicated SportsReception. The Club Member, the Family Members and/or theNominee must produce the membership card and register thenumber of towels taken at the Dedicated Sports Counter. Any ClubMember who fails to return a Club towel shall be charged a losttowel fee.2. THE INDOOR AND OUTDOOR COURTS (“Squash, Badminton, Basketball andTable Tennis”)2.1. Operating Hours2.2. Area2.1.1. The operating hours of the tennis, squash, badminton, tabletennis and basketball courts (“the Courts”) are from 8:00am to11:00pm daily, subject to the extension and variation by theCompany from time to time at its sole and absolute discretion andas may be notified to Club Members on the Club’s notice board.2.2.1. The respective sports shall only be played in area designated bythe Company for such games.27Constitution & Bye-Laws

The Company reserves the right to cancel reservations as a resultof any breach of any provisions of this Bye-Laws, or of the Courtsare needed for the use of any special events other than thoseprovided in this Bye-Law.2.5.1. The clock situated at the Club Reception Counter or the DedicatedSports Reception shall determine the starting time and finishingtime of play.2.6. Equipment2.7. Others2.6.1. The Company shall only provide nets for badminton, tennis andtable tennis. Only generally approved types of equipment shall beused on the Courts. Club Member shall arrange for necessarysuitable equipment for the specified game including but not limitedto proper shuttlecocks, tennis balls, basketballs and non-markingsquash balls.2.7.1. All badminton games shall be played in accordance with the rulesand regulations set forth by the Badminton Association ofMalaysia.2.7.2. All tennis games shall be played in accordance with the rules andregulations of the Lawn Tennis Association of Malaysia.2.7.3. All squash games shall be played in accordance with theconstitution and rules of the Squash Racquet Association ofMalaysia.3. GYMNASIUM AND DANCE STUDIO3.1. Operating Hours3.2. Area3.1.1. The operating hours of the Gymnasium and Dance Studio are from8.00 a.m. to 10.00 p.m. daily subject to the extension andvariation by the Company from time to time at its sole andabsolute discretion and as may be notified to Club Members on theClub’s notice board.3.2.1. Gymnasium and Dance Studio facilities shall only be used in areadesignated by the Company for such facilities.3.3. Children3.3.1. Children below the age of SIXTEEN (16) years old are notpermitted to utilize the Gymnasium.3.3.2. Children between the age of SIXTEEN (16) years old toEIGHTEEN (18) years old who utilize the Gymnasium must be29Constitution & Bye-Laws

Lockers are available for rent to all Club Members and anappropriate fee for the lockers shall be as determined by theCompany at the Company’s sole and absolute discretion.4. STEAM ROOM4.1. Operating Hours4.1.1. The operating hours of the Steam Room is from 8.00 a.m. to10.00 p.m. daily subject to the extension and variation by theCompany from time to time at its sole and absolute discretion andas may be notified to Club Members on the Club’s notice board.4.2. Dress Code4.3. Towels4.2.1. No person is allowed to enter the Steam Room unless he wears abath towel or swimming attire of an acceptable and proper design.T-shirts, sports shorts or other forms of clothing are not allowed inthe Steam Room.4.2.2. Club Members and guests who are using the Steam Room mustuse the towels that are provided by the Club. Nude bathing or theuse of personal underwear is strictly prohibited in the SteamRoom.4.3.1. The Club Member, the Family Members, the Nominee and/or guestMUST utilize the towels provided at the Dedicated SportsReception. The Club Member, the Family Members and/or theNominee must produce the membership card and register thenumber of towels taken at the Dedicated Sports Reception. AnyClub Member who fails to return a Club towel shall be charged alost towel fee.4.4. Prohibitions4.4.1. Persons suffering or suspected to be suffering from communicablediseases, colds, open sores, nasal, eye or ear discharge and anyother infection or contagious diseases of any kind are not bepermitted to enter the Steam Room.4.4.2. No footwear is permitted in the Steam Room.5. MALE/ FEMALE CHANGING ROOM5.1. Operating Hours5.1.1. The operating hours of the Changing Rooms are from 8.00 a.m.to 11.00 p.m. daily subject to the extension and variation by the31Constitution & Bye-Laws

Boys above the age of FIVE (5) years are not allowed to enterinto the Female Changing Room and girls above the age of FIVE(5) years are not allowed to enter into the Male Changing Room.5.3. Lockers5.3.1. Lockers are available for free of charge to all Club Members, theFamily Members and the Nominee. The Club Members and theFamily Members must produce the membership card and registerthe number of lockers taken at the Dedicated Sports Reception. Alocker’s key will be provided during the registration at theDedicated Sports Reception.5.3.2. The Club Members and the Family Members must produce themembership card and register the return of the numbers ofLockers taken. The locker’s key must return to the dedicatedsports counter after using. Any Club Members who fails to returnthe locker’s key shall be charged a lost locker’s key fee.5.4. Towels5.3.3. Articles deposited in the locker or left in the Changing Rooms shallbe entirely at the risk of the Club Member and the Company shallnot be responsible for loss or damage to any articles depositedtherein.5.3.4. Storage of food-stuff, weapons, banned publications, drugs andother illegal things in lockers is prohibited.5.4.1. The Club Member and the Family Members must produce themembership card and register the number of towels taken at theDedicated Sports Reception.5.4.2. The Club Members and the Family Members must produce themembership card and register the return of the numbers of towelstaken at the Dedicated Sports Reception after usage. The ClubMember shall be responsible for the return and proper usage oftowel by the guest.5.4.3. In the event that the number of towels taken are not returned bythe Club Member or in the event the Company is of the opinion(which opinion shall be final and binding on the Club Member) thatthe Club Member is inappropriately using or has inappropriatelyused the towels, the Club Member shall immediately pay to theCompany a fee of such amount as may be determined by theCompany at its sole and absolute discretion.5.5. Prohibitions5.5.1. Toiletries and fittings that belong to the Company MUST NOT betaken out of the Changing Rooms.32Constitution & Bye-Laws
