<strong>Terms</strong> <strong>and</strong> <strong>Conditions</strong> <strong>for</strong> <strong>your</strong> <strong>British</strong> <strong>Gas</strong><strong>System</strong> <strong>Improvement</strong> Quotation <strong>and</strong> AgreementPlease read this document carefully as it will tell you everything you need to know about the terms on which wewill deal with each other when you have accepted our quotation to install or upgrade central heating in <strong>your</strong> home.1. This is <strong>your</strong> quotation <strong>and</strong> we undertake to carry outthe work specified <strong>for</strong> the amount quoted, subject tothe following terms <strong>and</strong> conditions. All prices includeV.A.T at the current rate.2. The quoted price is valid at the time of quotation<strong>and</strong> will expire if not accepted by you within 28 days.The quotation is subject to installation taking placewithin 90 days from the date on which the quotationis accepted.3. We have quoted the cost of upgrading <strong>your</strong> centralheating as set out on the quotation <strong>for</strong>m. Once youhave accepted this quotation, we agree to carry outthe central heating upgrade on the terms set out inthis document. All materials <strong>and</strong> parts are guaranteed<strong>for</strong> one year from the date of fitting. This does notaffect <strong>your</strong> statutory rights.4. There will be an additional charge <strong>for</strong> any variationsor additions to the work which you ask <strong>for</strong> or whichwe find to be necessary whilst we are doing the work<strong>and</strong> which could not have been identified when wegave you the original quotation. In such a case, wewill explain to you the reasons <strong>for</strong> the extra work <strong>and</strong>let you know in advance what the extra cost will be.5. We will do all the work set out in the quotation at thequoted price during normal working hours which are8.00am to 6.00pm Monday to Friday. If you want usto work outside normal working hours it may benecessary <strong>for</strong> us to make an additional charge whichwe would agree with you in advance. We will needaccess to <strong>your</strong> home at all times whilst we are doingthe work.6. The time estimate provided <strong>for</strong> doing the work is ourbest estimate, <strong>and</strong> we will make every reasonableef<strong>for</strong>t to complete the work on time. However, wecannot be held responsible <strong>for</strong> delays due to weather,or any other circumstances beyond our control.In such situations, we will revise time estimateswith you.7. The quoted price does not include the cost ofremoving any dangerous waste material, such asasbestos, which could not have been reasonably<strong>for</strong>eseen when we gave you the original quotation<strong>and</strong> which we become aware of only when doing thework. You may decide to call a specialist contractorto do this work <strong>for</strong> you. Alternatively, it may bepossible <strong>for</strong> us to do this work <strong>for</strong> you at an extra costwhich we will agree in advance. When you have hadany asbestos removed a clean air certificate mustbe provided be<strong>for</strong>e we will do any further work at<strong>your</strong> property.8. If you are a tenant, you may need <strong>your</strong> l<strong>and</strong>lord’spermission to carry out the work detailed in thequotation. In the absence of <strong>your</strong> advice to thecontrary, we will assume that you have made enquiry<strong>and</strong> obtained permission where required. We shallnot have any liability <strong>for</strong> unauthorised works <strong>and</strong> youindemnify us <strong>for</strong> any losses howsoever arising that weincur from <strong>your</strong> failure to obtain such permission.9. You will be responsible <strong>for</strong> ensuring that be<strong>for</strong>e westart the work, there is an adequate gas supply to<strong>your</strong> property. If necessary, we can put you in touchwith <strong>your</strong> gas transporter, to arrange this.10. We may require you to take up all or some carpets<strong>and</strong> floor coverings, including tongue <strong>and</strong> grooved,parquet hardwood, rubber or tiled floors, be<strong>for</strong>e westart the work, <strong>and</strong> we will give you as much notice aspossible if we need you to do so. You may decide tocall a specialist contractor to do this work <strong>for</strong> you.Alternatively, it may be possible <strong>for</strong> us to do this work<strong>for</strong> you at a cost which we will agree in advance. It willbe <strong>your</strong> responsibility to replace the flooring whenthe work is completed.11. We will take reasonable care to carry out the workwithout causing unnecessary damage to <strong>your</strong>property. While we will make good unnecessarydamage directly caused by our negligence, youaccept that the work (including removing ordismantling existing fixtures <strong>and</strong> fittings) may causedamage <strong>and</strong> certain areas may need redecorationfollowing completion of the installation. This is <strong>your</strong>responsibility <strong>and</strong> is not included in the price.12. Where we need to connect new equipment to <strong>your</strong>existing central heating system, we will not acceptliability <strong>for</strong> the cost of repairing or replacing parts of<strong>your</strong> existing system which subsequently developsfaults in that system unless we have been negligentin not realising that such damage may occur or theway we did the work caused the fault. Nor will weaccept liability where <strong>your</strong> central heating systemdoes not function properly because <strong>your</strong> watersupply becomes inadequate or the water pressure isvariable.13. We do not accept liability if we cannot fulfill our side ofthe contract <strong>for</strong> reasons which are beyond our control,such as fire, accidents, war, adverse weather conditions,industrial disputes, strikes <strong>and</strong> lock outs which we arenot directly involved in. We will only be liable <strong>for</strong> lossesthat are <strong>for</strong>eseeable.14. Materials used <strong>for</strong> the work are guaranteed <strong>for</strong> oneyear from the date of fitting them. Within this period, ifthe materials are defective then we will repair orreplace the defective materials free of charge. If ourwork is defective, then we will re-per<strong>for</strong>m our work freeof charge. Our work is guaranteed <strong>for</strong> one year fromthe date that the work is completed. The guaranteeonly applies to the specific materials provided by us<strong>and</strong> repairs made by us <strong>and</strong> does not apply to anyfurther unrelated faults with the system or appliance.These guarantees do not affect <strong>your</strong> statutory rights inrelation to the quality <strong>and</strong> description of goods <strong>and</strong>services. You can contact <strong>your</strong> local authority tradingst<strong>and</strong>ards or Citizen’s Advice Bureau if you need morein<strong>for</strong>mation about <strong>your</strong> statutory rights.15. To carry out the work as quickly as possible, we mayneed to use sub-contractors. All sub-contractors areapproved by the company <strong>and</strong> are fully qualified <strong>and</strong><strong>Gas</strong> Safe registered (<strong>for</strong>merly CORGI registered). Allengineers carry identity cards.16. The deposit shown on <strong>your</strong> quotation must be paidwhen you place <strong>your</strong> order. You must pay the balanceof the quoted price when we have finished theinstallation unless you have signed a Credit Agreement.If <strong>your</strong> Credit Agreement is terminated <strong>for</strong> whateverreason, subject to the terms of the Consumer CreditAct 1974, the balance of the quoted price becomesimmediately payable <strong>and</strong> you agree that you will berequired to immediately pay the balance of the quotedprice instead of <strong>your</strong> financier.17. Notice of <strong>your</strong> Right to CancelYou can cancel this agreement up to 14 daysafter the day any goods are delivered, or if theagreement is <strong>for</strong> services only (<strong>for</strong> examplelabour only, <strong>and</strong> not parts), <strong>for</strong> 14 days afterthe day you accept the quotation. This is <strong>your</strong>“cooling off’’ period.You can ask us to start work be<strong>for</strong>e the cooling offperiod ends. If you do this <strong>and</strong> then cancel, we’llcharge you our reasonable costs <strong>for</strong>:• Any work already carried out, or• Any goods installed into <strong>your</strong> propertyWe can deduct our costs from any deposit you’vepaid or bill you <strong>for</strong> them. You won’t be able tocancel once work is fully completed or the goodshave been installed in <strong>your</strong> property. If you wish tocancel you can call us on 0800 294 9650 or emaillondonhu@britishgas.co.uk. This does not affect<strong>your</strong> statutory rights.18. Third Party rights: nobody other than you will be ableto benefit from this agreement.19. These terms <strong>and</strong> conditions together with thein<strong>for</strong>mation overleaf are intended by us to set out thewhole agreement between us <strong>and</strong> you, <strong>and</strong> shall beread as one document. If you have any queries, pleasecontact 0800 294 9650.Governing law <strong>and</strong> jurisdiction. The terms <strong>and</strong>conditions <strong>for</strong> all products <strong>and</strong> services are written inEnglish <strong>and</strong> all correspondence entered into shall be inEnglish. Your agreement is governed by the Laws ofEngl<strong>and</strong> <strong>and</strong> Wales.20. Using personal in<strong>for</strong>mation20.1 We or our agents may use in<strong>for</strong>mation about you to:a identify you when you contact us so that we knowexactly who we are speaking to;b offer you accounts, services <strong>and</strong> products fromtime to time (we may do this using an automaticscoring system, which also uses in<strong>for</strong>mation aboutyou from other agencies, including creditreference agencies);c help run, <strong>and</strong> contact you about improving theway we run, any accounts, services <strong>and</strong> productswe have provided be<strong>for</strong>e, provide now or mayprovide in the future (we may also contact you bye-mail or text message if you have given us thesecontact details);d create statistics, test computer systems, analysecustomer in<strong>for</strong>mation <strong>and</strong> create marketingopportunities (including using in<strong>for</strong>mation aboutwhat you buy from us <strong>and</strong> how you pay <strong>for</strong> it, <strong>for</strong>example the amount of gas or electricity you use<strong>and</strong> any discounts we have offered you);e help to prevent <strong>and</strong> detect fraud or loss; <strong>and</strong>fcontact you in any way (including by post, e-mail,phone, text or multimedia messages or visitingyou) about products <strong>and</strong> services we <strong>and</strong> ourpartners offer.20.2 We may allow other people <strong>and</strong> organisations to usein<strong>for</strong>mation we hold about you:a to provide services you have asked <strong>for</strong>;b as part of selling one or more of our businesses;c to help to prevent <strong>and</strong> detect debt, fraud, or loss(<strong>for</strong> example by giving this in<strong>for</strong>mation to a creditreferenceagency). If you do not pay <strong>your</strong> debt, wemay transfer <strong>your</strong> debt to another organisation<strong>and</strong> give them details about you <strong>and</strong> that debt;d if we have been asked (<strong>for</strong> example by Ofgem or alawyer) to provide in<strong>for</strong>mation <strong>for</strong> legal orregulatory purposes;


MI401 JUL14 29020435 ONLINEe as part of current or future legal action;fas part of government data-sharing initiatives; org if you hold an insurance policy with us, to passin<strong>for</strong>mation to an insurer to manage <strong>your</strong> insurancepolicy (including underwriting <strong>and</strong> claims, to helpdevelop new services <strong>and</strong> to assess financial <strong>and</strong>insurance risk).From time to time, these other people <strong>and</strong>organisations may be outside the European EconomicArea (EEA) in countries that do not have the samest<strong>and</strong>ards of protection <strong>for</strong> personal in<strong>for</strong>mation asthe UK.20.3 We may also let companies in our group (including<strong>British</strong> <strong>Gas</strong>, Scottish <strong>Gas</strong> <strong>and</strong> Dyno Group) use <strong>your</strong>in<strong>for</strong>mation to do any of the things mentioned inclauses 20.1 <strong>and</strong> 20.2.20.4 We may use <strong>your</strong> in<strong>for</strong>mation to help train our staff.We may also monitor <strong>and</strong> record any communicationswe have with you (including phone conversations <strong>and</strong>e-mails) to make sure that we are providing a goodservice <strong>and</strong> to make sure we are meeting our legal<strong>and</strong> regulatory duties.20.5 We may pass <strong>your</strong> address, property <strong>and</strong> postcode,<strong>and</strong> details of <strong>your</strong> gas appliances, flue, hot-watercylinder, system controls <strong>and</strong> electrical installations(including details of any repairs or removals) toorganisations that supervise these activities includingCapita <strong>Gas</strong> Registration <strong>and</strong> Ancillary Services Limited(previously CORGI) <strong>and</strong> the ECA (ElectricalContractors Association). These organisations maypass this in<strong>for</strong>mation to local authorities to meetbuilding regulations. They may also use thisin<strong>for</strong>mation to contact you to inspect appliances orsystems, recall faulty products <strong>and</strong> carry out audits,<strong>and</strong> <strong>for</strong> health <strong>and</strong> safety purposes. Whereappropriate, we will give you or the property owner(or both) a certificate to show that <strong>your</strong> appliances<strong>and</strong> so on meet building regulations.20.6 We will check <strong>your</strong> details with one or more creditreference<strong>and</strong> fraud-prevention agencies to help usmake decisions about <strong>your</strong> ability to make payments<strong>and</strong> the goods <strong>and</strong> services we can offer you. Below,we have given a brief guide to how we, the creditreference<strong>and</strong> fraud-prevention agencies will use <strong>your</strong>in<strong>for</strong>mation. If you would like more in<strong>for</strong>mation aboutthis, you can find the full version at britishgas.co.ukOr, phone us on 0800 048 0202 <strong>and</strong> we will send youa leaflet.a We will search at credit-reference <strong>and</strong> fraudpreventionagencies <strong>for</strong> in<strong>for</strong>mation about you<strong>and</strong> all the people you are applying with. If you areproviding in<strong>for</strong>mation about other people on ajoint application, you must make sure they agreethat we can use their in<strong>for</strong>mation to do this. If yougive us false or inaccurate in<strong>for</strong>mation <strong>and</strong> fraud isidentified, we will pass <strong>your</strong> details to creditreference<strong>and</strong> fraud-prevention agencies. Lawen<strong>for</strong>cementagencies (such as the police <strong>and</strong> HMRevenue & Customs) may receive <strong>and</strong> use thisin<strong>for</strong>mation.b We <strong>and</strong> other organisations may also access <strong>and</strong>use in<strong>for</strong>mation about you that credit-reference <strong>and</strong>fraud-prevention agencies give us to, <strong>for</strong> example:• check details on applications you make <strong>for</strong> credit<strong>and</strong> credit-related services;• check <strong>your</strong> identity;• prevent <strong>and</strong> detect fraud <strong>and</strong> money laundering;• manage credit <strong>and</strong> credit-related accountsor services;• recover debt;• check details on proposals <strong>and</strong> claims <strong>for</strong> alltypes of insurance; <strong>and</strong>• check details of employees <strong>and</strong> people applying<strong>for</strong> jobs with us.c When credit-reference agencies receive a searchfrom us, they will record this on <strong>your</strong> credit filewhether <strong>your</strong> application is successful or not.d We <strong>and</strong> other organisations may access <strong>and</strong> use,from other countries, in<strong>for</strong>mation recorded byfraud-prevention agencies.e If you want to see what in<strong>for</strong>mation creditreference<strong>and</strong> fraud-prevention agencies holdabout you, you can contact the following agenciescurrently working in the UK. They have a duty of care to givegood advice which could involve the recommendationto purchase additional products or services from<strong>British</strong> <strong>Gas</strong> in the interest of safety, efficiency oreconomy. The engineers are paid an annual salarybut can also earn an extra payment linked tonumber of factors including additional products/services purchased by customers.
