General Terms and Conditions of Business Events<br />

1a. Optional dates are binding for both parties in <strong>the</strong> contract. Municon conference centre reserves <strong>the</strong> right <strong>to</strong> let <strong>the</strong> rooms <strong>to</strong> third parties<br />

after <strong>the</strong> optional date has passed.<br />

1b. The written consent of <strong>the</strong> conference centre is necessary for <strong>the</strong> subletting or letting <strong>to</strong> third parties of rooms, display cases or surfaces.<br />

2. The organiser of <strong>the</strong> event/<strong>the</strong> client can withdraw from <strong>the</strong> contract by written announcement 22 business days before <strong>the</strong> beginning of<br />

<strong>the</strong> event. If <strong>the</strong> cancellation takes place after this delay, <strong>the</strong> Municon conference centre will charge <strong>the</strong> usual rental price, if <strong>the</strong> letting<br />

<strong>the</strong> third parties proves impossible.<br />

3.<br />

The claims at present are as follows:<br />

More than 30 days prior <strong>to</strong> <strong>the</strong> event 20% of <strong>the</strong> allocation rate<br />

30 – 14 days prior <strong>to</strong> <strong>the</strong> event 50% of <strong>the</strong> allocation rate<br />

03 – 13 days prior <strong>to</strong> <strong>the</strong> event 80% of <strong>the</strong> allocation rate<br />

less than 3 days prior <strong>to</strong> <strong>the</strong> event 100% of <strong>the</strong> allocation rate<br />

It is up <strong>to</strong> <strong>the</strong> discretion of <strong>the</strong> Municon conference centre <strong>to</strong> post additional charges from up <strong>to</strong> 35% Percent of ordered F&B turnover.<br />

If <strong>the</strong> rate for <strong>the</strong> food turnover has not been definitely fixed, <strong>the</strong> minimum price applicable at <strong>the</strong> time for a lunch buffet times <strong>the</strong><br />

number of persons is <strong>the</strong> basis of calculation. In case of pre-ordered conference packages <strong>the</strong> above mentioned percentage are<br />

multiplied by <strong>the</strong> price of <strong>the</strong> conference package and <strong>the</strong> number of persons<br />

3. A reduction in <strong>the</strong> number of participants of a lunch buffet must be notified <strong>to</strong> <strong>the</strong> service 72 hours in advance, as o<strong>the</strong>rwise <strong>the</strong> original<br />

number of seats is billed.<br />

4. Different or collateral agreements need <strong>to</strong> be in writing.<br />

5. The provision on use of decoration materials and o<strong>the</strong>r items must receive <strong>the</strong> consent of <strong>the</strong> conference centre. All decoration materials<br />

must conform fire regulations. All items provided must be collected within 2 days after <strong>the</strong> end of <strong>the</strong> event, as o<strong>the</strong>rwise <strong>the</strong> Municon<br />

conference centre reserves <strong>the</strong> right <strong>to</strong> have <strong>the</strong>m disposed at <strong>the</strong> client’s cost.<br />

6. The Municon conference centre can not be held for <strong>the</strong> loss of or damage <strong>to</strong> self supplied items, unless <strong>the</strong> damage was caused wilfully or<br />

through gross negligence by <strong>the</strong> staff of <strong>the</strong> conference centre.<br />

7. The organiser/<strong>the</strong> client is liable for <strong>the</strong> payment for additional services as well as for loss damage caused by his employees, helpers or<br />

<strong>the</strong> participants.<br />

8. If <strong>the</strong> conference centre has good reasons of business, doubts about <strong>the</strong> safety precautions take by <strong>the</strong> organiser/client or is concerned<br />

about <strong>the</strong> good reputation of <strong>the</strong> Municon conference centre and in case of major force, <strong>the</strong> conference centre may withdraw from <strong>the</strong><br />

contract without being liable for any damages <strong>to</strong> <strong>the</strong> organiser/client.<br />

9. All Services provided by <strong>the</strong> conference centre may only be made use of according <strong>to</strong> <strong>the</strong> terms of agreement.<br />

10. The provision of food and beverages by <strong>the</strong> organiser/client requires <strong>the</strong> written agreement by <strong>the</strong> Municon conference centre. A corkage or<br />

service charge will be fixed.<br />

11. The Municon conference centre guarantees that a change in rates is excluded during 4 months following <strong>the</strong> agreement. The conference<br />

centre reserves <strong>the</strong> right <strong>to</strong> increase rates after this period of time.<br />

Prices are inclusive VAT. A possible rise of <strong>the</strong> VAT after <strong>the</strong> agreement is concluded is borne by <strong>the</strong> client.<br />

12. Bills are payable within 14 days from <strong>the</strong>ir date<br />

without deductions.<br />

13. As far as <strong>the</strong> conference centre provides technical or o<strong>the</strong>r services by third parties, or has <strong>the</strong>m provided by third parties, it only acts in<br />

<strong>the</strong> name and for <strong>the</strong> account of <strong>the</strong> organiser. The organiser is responsible for <strong>the</strong> correct use and return of <strong>the</strong>se appliances and<br />

exonerates <strong>the</strong> conference centre of all claims by third parties arising out of this use.<br />

14. If <strong>the</strong> client is not identical with <strong>the</strong> organiser, <strong>the</strong>y are liable jointly and severally.<br />

15. Newspaper advertisement, invitations for presentations or sales events need <strong>the</strong> prior written<br />

consent and if substantial interests of <strong>the</strong> Municon conference centre.<br />

16. In <strong>the</strong> case of events being prolonged after 20.00 p.m. <strong>the</strong> Municon conference centre will calculate a service charge per hour (please refer<br />

<strong>to</strong> current price list for rates).<br />

17. Rooms can be changed.<br />

18. If individual items of terms and conditions of business events should become inapplicable or changed, this<br />

does not impair <strong>the</strong> applicability of <strong>the</strong> remaining items.<br />

19. The terms and conditions of business are subject <strong>to</strong> <strong>the</strong> laws of <strong>the</strong> Federal Republic of Germany.<br />

Place of performance and jurisdiction is Munich.
