9.0229 ECONOMIC DEVELOPMENT GRANT FOR RECIPIENTS OF INTITIAL<br />

ISSUANCE OF RESERVE “CLASS B” INTOXICATING LIQUOR<br />

LICENSES<br />

A. Findings <strong>and</strong> Purpose<br />

The Common Council finds that businesses such as restaurants, hotels <strong>and</strong><br />

taverns make important contributions to the City’s economy. These<br />

establishments serve important public purposes including increasing the<br />

City’s property tax base, providing employment <strong>and</strong> promoting tourism.<br />

Excessive license fees deter new businesses <strong>and</strong> are contrary to these<br />

public purposes. 1997 Wisconsin Act 27 requires municipalities to<br />

establish a minimum fee of $10,000.00 for each initial reserve “Class B”<br />

liquor license issued. Since the new fee far exceeds the actual cost of<br />

licensing the activity, additional revenue will be available to the City. It is<br />

the purpose of this ordinance to utilize revenue generated by Wisconsin<br />

Act 27 to assist new reserve “Class B” licensees achieve the important<br />

public purposes identified.<br />

B. Economic Grant<br />

Following the initial issuance of a reserve “Class B” liquor license <strong>and</strong><br />

upon application by the licensee, the Common Council may provide a<br />

grant to the licensee in an amount not to exceed $9,550.00. Prior to<br />

awarding any grant, the Common Council shall make such findings <strong>and</strong><br />

establish such conditions to ensure that any funds awarded further the<br />

important public purposes identified above.<br />

Penalties<br />

9.0230 PENALTIES<br />

A. Forfeitures for violations of Sections 125.07(1)-(5) <strong>and</strong> 125.09(2) of the<br />

Wisconsin Statutes, adopted by reference in Section 9.0201 of the Code of<br />

Ordinances of the City of Marinette, Wisconsin, shall conform to the<br />

forfeiture penalty permitted to be imposed for violations of the comparable<br />

State Statute, including any variations or increases for subsequent offenses.<br />

B. Any person who shall violate any provision of this Chapter of the Code of<br />

Ordinances of the City of Marinette, Wisconsin, except as otherwise provided<br />

in subsection (a) herein, or who shall conduct any activity of make any sale<br />

for which a license is required without such license, shall be subject to a<br />

forfeiture as provided in the general penalty section of this Code of the City<br />

of Marinette, Wisconsin.<br />

C. Nothing herein shall preclude or affect the power of the sentencing court to<br />

exercise additional authorities granted by the Wisconsin Statutes.<br />
