PATTAYA CONTINUES TO BOOM

For many expats who have made Pattaya their

home away from home for more than 15 years,

the changes to the resort have probably crept

up on them slowly. At one point the city was

the bricks and mortar equivalent of the national

‘black sheep of the family’, but over recent

years it now enjoys are far more ‘respectable’

reputation.

Of course, what is euphemistically termed

Pattaya’s ‘vibrant’ night life remains arguably

its most potent tourist attraction, but the city

administration has, over the past decade or so,

managed to build up its other strengths, especially

its proximity to the capital.

The paradigm shift was certainly given emphasis

in local Thai minds with the 2011 floods

which inundated parts of Bangkok. The floods

saw a trek of middleclass Thais decamping to

Pattaya and surrounds to escape the rising

waters, and sparked the realisation that here

was a city with all the services of Bangkok just a

couple of hours down the road from the capital.

The opening of Central Festival Mall in the wide

expanse between Beach Road and Second

Road Soi 9, replacing a brace of tired old beer

bars at both ends, was a definite statement

Pattaya was undergoing a strong change.

Holiday Inn, one of the world’s premier hotel

chains, set up in business. Amari expanded its

already well-respected product, with business

people taking up as much room ‘space’ as

tourists.

Upmarket property developments have been a

part of the real estate landscape in the city for

most of the last decade. While there were many

who questioned some of the developments,

wondering where all the buyers were going

to come from, the reality is that most of these

places have been well patronised. Clearly, the

market does exist, and it is one which is strong.

As the developments have grown in sheer

numbers from some of the biggest property

developers in the country, so too has the need

to cater to this upwardly mobile marketplace.

The Thai-run upmarket furniture showrooms

Decco and Chic Republic on Sukhumvit Road

in south Pattaya opened a few years ago and

the management of both of these companies

believed the Pattaya market was becoming

more sophisticated, both among Thais and

foreign expats, and they were looking to position

themselves within that marketplace.

Medical tourism is another area not just confined

to the better quality hospitals of Bangkok.

Just down the road in Sri Racha, as well as in

Pattaya, there is plenty of evidence of foreign

visitors taking advantage of the high level of

medical services available in the resort.

This success in its turn helps drive the restaurant,

hotel, and property market in a kind of

knock-on fashion. People who have used the

medical services are likely to stay for a little time

afterwards to recuperate. This augurs well for

both hotels and good restaurants in the shorter

term. In the longer term, if people like what they

see, it may well lead to an interest in taking on a

property as either a second home, or even as a

major place of residence.

Travel is slowly getting easier between Bangkok

and Pattaya, with by-passes enabling traffic not

coming into Pattaya proper to be fed away from

the main roads, and, of course, the new tunnel

feeding traffic heading into south Pattaya should

be open by the time you read this. This means

there is a greater chance of some key businesses

being prepared to relocate their main operations

to Pattaya. The corridor between the two

cities is already notable as a dormitory region,

and the deepwater port at Laem Chabang also

adds to the Pattaya attraction.

Pattaya will certainly be at the forefront of business

on the Eastern Seaboard and beyond for

the foreseeable future.

LOAN CRITERIA

The president of the Housing

Business Association (HBA), Atip

Bijanonda, recently was quoted

as saying that those involved in

property development would like

to see financial institutions relax

their currently quite stringent home

loan approval criteria in order to

provide some relief to this sector

of the marketplace.

The HBA has also urged the government

to roll back its blacklist

period for credit card and auto

loan non-payment from three

years to just 12 months in order to

enable homebuyers to get better

access to mortgages.

The Association claims this would

help boost the home market of

the property sector amid what it

sees as the current unfavourable

outlook.

Mr Bijanonda was quoted as saying,

“The overall housing market

[in 2016 was] quite sluggish as

economic conditions [were] wanting

and many potential homebuyers

are unable to get mortgages

despite their good qualifications.

Many home loan applications

were rejected for nonsensical reasons.

Some homebuyers who had

earlier qualified for home loans

are now being rejected despite

having the same qualifications.”

He said financial institutions

should use the same loan approval

criteria as it used in the past.

He claimed home loan applicants

who used to get a credit line of 50

times their monthly income now

only get the equivalent of between

30-40 times from some banks.

As he noted, “With the sluggish

economy, the government wants

the private sector to invest. But

if developers can’t sell and transfer

housing units, how can they

continue investing? Developers

can’t unload their housing stock

because banks aren’t giving out

loans.”

Another key issue is the relatively

long blacklist period imposed by

the National Credit Bureau. According

to some figures there are

over 100,000 people who were

blacklisted by the National Credit

Bureau, but who have since

cleared their credit card and auto

loan debts.

Unfortunately, even though the

debts have been cleared, these

people remain on the credit bureau’s

blacklist and this, of course,

prevents them from getting mortgages.

As Mr Bijanonda states, “These

people have strong purchasing

power, and they are prospective

homebuyers.”

He said the home loan rejection

rate is expected to rise from an

average of 50 percent at present.

Some developers said they have

found the home loan rejection

going as high as 70 percent, especially

in the low-priced segment.

The Housing Business Association

scheduled meetings with related

government agencies to discuss

the blacklist period and try to

find some common ground.

The HBA said that while the government

has been trying to stimulate

the economy through mega

projects, it further needs to boost

the property sector in order to create

a multiplier effect for the economy.

When It Comes To Lifestyle Choice, It Doesn’t Get Better Than This

As the Asean Economic Community

(AEC) begins its second

year we will take a slightly different

tack to covering it by looking

at what many pundits consider is

the potential ecommerce value of

the Southeast Asian region and its

member states.

In an article published online in

November last year by Sheji Ho,

he noted ‘Little data exists on the

current and projected size of the

ecommerce market in Southeast

Asia. Part of this is because it’s

still a nascent industry and, as a

THE AEC AND ITS ECOMMERCE POTENTIAL

result, legacy institutions like government

and research firms are

still playing catch up.’

Another factor is that an enormous

amount of customer-to-customer

(C2C) ecommerce, estimated

to be anywhere from one-third

to half of total ecommerce Gross

Merchandise Volume (GMV), is

largely unregulated and almost

certainly untaxed.

Equally, much of the C2C action

across the region happens via on

social media such as Facebook

and Instagram and channeled

by conversations on messaging

apps such as LINE and Facebook

Messenger.

As Sheji Ho noted, ‘several reputable

organizations have taken

a stab at assessing the size of

ecommerce in this region. One

of the earliest attempts at market

sizing comes from AT Kearney

in collaboration with CIMB. Published

in early 2015 and titled Lifting

the Barriers to E-Commerce in

ASEAN the report estimates the

current market size at US$7 billion

(as of 2013), and projecting a

future potential of US$89 billion.’

So, there’s the start point in one

report: the equivalent of $89 billion.

Yet, as Ho writes, ‘More recently,

Google partnering with Temasek,

released a report titled e-conomy

SEA: Unlocking the $200 billion

digital opportunity in Southeast

Asia that sizes the current ecommerce

market at $5.5 billion (as of

2015) and foresees it to grow into

an $88 billion market as early as

2025.’

Yet that report leaves out C2C

and peer-2-peer (P2P) marketplaces

such as OLX, Carousell

and Instagram because of the

difficulty in obtaining reliable data.

Ho is quite adamant that the marketplace

may well be far bigger

than currently estimated.

At present the, ‘US ecommerce

market today is a $394 billion

market. But then again, and quite

obviously, the US is a much more

mature ecommerce market…’

China ‘surpassed the US in 2013

to become the world’s largest

ecommerce market in terms of

GMV.’

Right now, the Chinese ecommerce

is a $700 billion market and

that equates to about 13 percent

of total retail in the country.

In the next issue we’ll look at

where the AEC ecommerce market

place could be in 2025.

In the autumn of 2016 I paid a

trip back to the UK in order to

celebrate a special birthday, but

whilst I was there I was somewhat

taken aback by the poor 4G

coverage I found right across the

north of England when compare

to Thailand.

I was not particularly surprised

therefore when I read that the UK

was ranked 54th in the world for

coverage, behind Bulgaria and

Lithuania. But with the talk now

being of 5G, it made me reflect

upon the different generations of

mobile communications, so here

is a summary of the story so far.

You could only really make

calls on 1G

It was analogue and the phones

looked a bit like this. My first

mobile was fixed in my car with a

big box in the boot!

Video calling became a thing in

2001

3G and its 2mbit/s (or 0.25 megabytes

per second) data came in at

around the time the first wave of

smartphones arrived in shops.

It’s not that fast but it gave wireless

access to internet which was

the first step - and it made video

calling possible.

To give you an idea of quite how

slow it is as standard, if you wanted

from iTunes it will supposedly take

more than five hours to download

the 4.26GB file.

2010 saw 4G become available

And the faster speeds meant that

mobile gaming was brought to a

whole new level.

The same film that would have

taken you more than five hours

to download on 3G supposedly

takes less than 8 minutes on 4G.

But 4G isn’t available everywhere

yet, some parts of the UK don’t

even have 2G let alone 3G or 4G,

and I think that national coverage

for 4G in Thailand is infinitely

better than the UK.

Then 2G introduced text

messages

Known as an SMS, 2G made it

possible to send text messages

between friends.

There were

also picture

messages

called MMS

(multimedia

messaging

service)

brought

in with 2G.

And also

GSM, GPRS,

EDGE on

mobile

phones like

this one.

And what about 5G?

Well it is predicted that this will be

around sometime between 2020

and 2030 and will let you download

a one hour HD movie in six

seconds.

Who knows what phones will look

like then? Phones made of flexible

materials that you can literally

roll up and put in your pocket are

under development with the first

flexible screen (but just how flexible?)

being slated for this year!

SOUTHEAST ASIA BUSINESS ROUNDUP

Indonesia/Singapore

PT Nusantara Sejahtera Raya (NSR), which

operates the Cinema 21, Cinema XXI and The

Premiere brands in Indonesia, has entered into

a strategic partnership with GIC, Singapore’s

sovereign wealth fund, to set up the company

for the next stage of growth.

GIC has invested the equivalent of US$259.59

million, with the partnership expected to expand

NSR’s cinema footprint nationally.

The investment reflects GIC’s confidence in

Indonesia’s long-term growth potential.

In July 2016, GIC stated that a key measure of

returns fell to four percent in the 20-year period

to March 31, from 4.9 percent in the period

ended March 2015, as global stock markets

posted lacklustre performance and bond returns

tumbled.

Singapore’s GIC and its state investment firm

Temasek Holdings are likely to increase their

exposure in Indonesia over the coming years.

It is the largest economy in Southeast Asia and

one of the world’s largest emerging markets,

supported by strong growth in consumer demand

and infrastructure investment.

Myanmar

US-based Convalt Energy has received state

approval to invest in solar power development.

New York-based Convalt Energy is a portfolio

company of ACO Investment Group and received

approval from the Myanmar Investment Commission

for a $480 million investment to set up

two solar power plants.

Convalt Energy Myanmar Co Ltd will start

construction of the two 150 MW solar power

plants in the Mandalay region.

Myanmar conglomerate, Eden Group, has

partnered with US-based hotel operator, Hilton

Worldwide Holdings to set up two hospitality

properties in the country at an investment of

US$130 million.

One of the two hotels will be located in Bagan

in the Mandalay region, the other property will

be located in Inle in Shan State.

The 150 to 200-room hotels are expected to

open as early as 2018.

Philippines

Philippine Airlines (PAL) and Air Philippines

are set to merge into a single entity through a

US$165 million (P8.24 billion) share swap deal.

The goal is to make PAL a more viable investment

for interested investors and enable the

same access funds to expand the business.

Vietnam

Vietnamese budget airline VietJet and its controlling

shareholder plan to raise up to US$194

million in an initial public offering (IPO).

The offering for the country’s only private airline

will consist of 44.7 million shares, which could

be increased by an additional 14.9 million

shares if there is sufficient demand.

Indicative pricing was set at 75,900-98,400

dong, suggesting a market capitalisation of

between $1.08 billion and $1.4 billion.

Singapore/Malaysia

Fast food chain McDonald’s Corporation has

sold the franchise rights in Singapore and

Malaysia to Lionhorn Pte Ltd, a Saudi Arabian

group. Lionhorn Pte Ltd assumed ownership

of its 390 restaurants.

The Saudi firm has 20 years of experience

as the direct licensee (DL) for the nearly 100

McDonald’s restaurants in the Western and

Southern regions of Saudi Arabia.

The deal is part of McDonald’s plan to move

away from direct ownership in Asia and move

to a less capital-intensive franchise model.

THAI GARDEN RESORT KEEPS ITS

WHAT IS HEART ANGIOPLASTY?

Angioplasty, also called percutaneous

coronary intervention

(PCI), is a procedure used to

surgery. Angioplasty can be done

in an emergency setting such as

an acute heart attack or in an

elective setting when heart disease

is strongly suspected from

non-invasive testing.

For angioplasty, a special catheter

(a long, thin, hollow tube) is

inserted into a blood vessel and

guided to the blocked coronary

artery. The catheter has a tiny

balloon at its tip. Once the catheter

is in place, the balloon is inflated

at the narrowed area of the

coronary artery. This presses the

plaque or blood clot blocking the

artery against the sides of the artery

making more room for blood

The use of fluoroscopy (a special

type of X-ray that’s like an X-ray

“movie”) helps the doctor find the

blockages in the coronary arteries

as a contrast dye moves through

the arteries. This is called coronary

angiography.

A stent is a tiny, expandable,

metal mesh coil that is put into the

newly-opened area of the artery

to help keep the artery from narrowing

Some stents do not have this

medicine coating and are called

bare metal stents or BMS. They

This may be the preferred stent

in people who are at high risk of

MEDIATION IN THAILAND

Mediation is a form of dispute resolution

facilitated by a neutral third

person who assists the disputing

parties in finding mutually acceptable

solutions. It gives the parties

the opportunity to discuss and

clear their issues and find areas

of agreement. If the parties reach

an amicable solution, they may

enter into a binding and enforceable

compromise agreement.

The mediator is the neutral third

person whom the parties agree

to help facilitate their negotiation

to achieve an amicable solution.

The mediator facilitates the negotiation

process without making

the decision on the issue as the

outcome rests solely on the decision

of the disputing parties. In

the court-annexed mediation, the

mediator may be a lay qualified

person.

Types of Mediation

1. Out-of-Court Mediation is

the mediation of a pre - litigation

dispute. Even though a plaint

has been filed and the dispute is

during the litigation process, the

disputing parties can also agree

to carry out the mediation without

any court involvement.

2. Court-Annexed Mediation is

the mediation conducted while the

cases are still pending in court. It

is a dispute resolution mechanism

that can enable a convenient,

speedy and efficient settlement.

The disputing parties may achieve

a mutually satisfactory settlement

in which there is no loser or winner

from the outcome. Both parties

can emerge as the winner with a

win-win solution that can preserve

their long-term relationship. The

outcome of the Court-Annexed

Mediation can be stated in the

compromise agreement and issued

by the court. This agreement

acts as the court’s order. In

case there is any party who fails

to comply with this agreement,

the other party can start the legal

execution process immediately.

Advantages of Mediation

In some circumstances, mediation

may be preferable to filing a

lawsuit. Mediation provides many

significant advantages, including

the following:

1. Greater Control and

Flexibility. In mediation, the parties

are in control of the negotiation

process and have a greater

flexibility in attaining a solution

suitable for the parties’ needs.

2. Preserves relationship

between the disputing parties.

Mediation can help preserve

business and personal relationships,

that would likely be destroyed

through years of litigation.

Because mediation isn’t naturally

a win/lose process and because

it is a mutual, rather than oppositional

process, important relationships

can often be saved.

3. Confidential. Mediation is

normally confidential. The parties

participating in a mediation process

usually agree to confidentiality of

the process, and not to use the

information that is known to them

during the mediation for other

purposes such as in the litigation.

Any evidence used during mediation

cannot be disclosed.

4. Minimizing appeal cases.

Mediation reduces the number of

appeal cases as the disputes are

settled.

5. Compliance. Compliance with

an enforceable settlement agreement

is generally higher than with

lawsuits.

BUYING NEW CARS IN THAILAND

Smoothlane Co., Ltd., founded by two Stanford

Graduate School of Business classmates,

launched its CarParagon portal in Thailand in

December enabling new car buyers to save

time, money and hassle by functioning as an

online multi-brand motor show, 24 hours a day,

7 days a week, 365 days a year. Potential car

buyers cannot only find information on car

pricing, car specifications, promotional offers

from major dealers and up-to-the-minute dealer

inventory, but they can also request a test

drive online with just a few clicks or speak to the

dealer directly from their mobile phones via the

CarParagon website.

Based on the venture-backed pre-revenue business

model which is being successfully used in

the US and Europe, the CarParagon website

will initially be available to service those living

in the Greater Bangkok area before expanding

nationwide and throughout Southeast Asia.

“Motivated by the government’s Thailand 4.0

policy in encouraging creativity and innovation

through the application of technology, we developed

this one-stop new car shopping portal free

of charge to eradicate the usual hassle and time

consuming process of buying a car. In turn, we

Toscana: offering a wide variety of

wines to complement a great menu

This publication has been covering the Italian-style Toscana and

associated Moom Talay Thai restaurant in some depth over a number

of recent issues, primarily because this duo are nothing like the

average eatery.

We mentioned in the last issue that we would be dedicating some

in-depth material in this issue to Toscana’s incredibly wide range of

wines available to customers and all designed to complement the

equally wide array of Italian dishes served inside Toscana.

As the name suggests, Toscana features cuisine which is almost

uniquely derived from the Tuscany region of northern Italy. In keeping

with this theme, it’s probably no surprise that although Toscana

stocks wines from all over the Italian peninsula, the majority are

sourced from Tuscany.

All told, there are 60 red wines and 31 white wines from which to

choose. There are also nine choices of prosecco (otherwise known

as sparkling wine). As mine host Luca says, prosecco is a kind of

Italian champagne, but made from different grapes than

what most people know as champagne.

Three choices of lambrusco (also referred to as sparkling red), either

dry or sweet, and four Rose wines add further depth to the Toscana

wine list.

If customers are not in the mood to make specific choices, then

there are three house whites and three house reds available, all

of them are IGT (that is, certified from the region they come from).

Toscana’s house wines are served by the glass (180 baht) or in

quarter-litre, half-litre or one-litre (1,350 baht) carafes.

Luca imported a machine made in Italy which keeps wine fresh for

up to three weeks after a bottle has been opened. This machine

operates under a controlled temperature to ensure the wine tastes

as good as when it was first opened.

Luca long ago realized that some customers may order only a

single glass of wine with their dinner, but would enjoy ordering

from a specific bottle rather than indulge in the house wine. Of

course, opening an entire bottle and simply serving one glass was

uneconomical, but Luca decided to offer eight bottled reds and

five bottled whites from which customers may choose. Yes, they

may only have one or two glasses, but by utilising the special machine,

Luca noted he could keep the opened choices fresh and

would be able to still serve other discerning customers from these

already-opened bottles, but without the loss of the original flavour

and body.

The cost is anywhere from 360 to 720 baht per glass, depending

on which wine is selected.

The comprehensive variety of wines in Toscana can be gauged by

the incredible difference in value: from as little as 1,300 baht for a

bottle up to 20,000 baht a bottle for the finest wine in the house.

All the wines are stocked in the Wine Cellar located inside the

Toscana fine dining section of the restaurant in a specially-built

temperature-controlled cellar. As Luca notes, this ensures the wine

is consistently good. In many places wine is stored on shelves in

the restaurant, which means when the restaurant is closed the

air-con is off the bottles of wine experience regular changes in

temperature.

In Toscana the customer can order from the wine menu when

they’re selecting their food or go into the cellar and pick their choice

of wine from the impressive selection there.

Toscana also has 27 different types of grappa drinks, all offering a

different kind of grape from each region of Italy, thereby giving each

a distinctive smell and taste.

For the beer drinker, Toscana has wide selection of these including

real Italian Peroni, available on draught and in bottles.

On occasions, Toscana puts on a Wine Promotion, usually with

selected reds. In January, there are two red wines being promoted

and Luca has selected six main dishes aimed at complementing

these wines. If a customer opts for one of the wines then they can

select one main dish for the same price. If there are a few people

at the table they might want to order the both wines and select two

of the main dishes from the special selection.

Fraser & Neave

Fraser & Neave (F&N) recently submitted tenders

to purchase another 5.4 percent stake in

Vietnam’s largest business, Vinamilk. It already

held 10.95 percent of the business.

Vinamilk announced in early December that

F&NBev Manufacturing and F&N Dairy Investments,

two wholly-owned subsidiaries of F&N,

had submitted documents to the Vietnamese

Securities Commission and the Ho Chi Minh

City Stock Exchange (where Vinamilk is listed

as the biggest stock in terms of market capitalization)

for each to acquire 2.7 percent of the

dairy company.

Shares began selling at a starting price of

144,000 VND apiece on 12 December.

The method of transaction for F&N’s bids was

by public auction, put-through transactions and

order matching on the stock exchange between

December and 6 January 2017.

The intention of stepping up in buying Vinamilk

has marked another move in the deal-making

spree of Charoen Sirivadhanabhakdi, the

magnate behind ThaiBev, who completed acquiring

Metro Cash & Carry Vietnam for 655

million euros earlier this year, and reportedly

the Melia Hanoi Hotel and retail distributor Phu

Thai Group in 2013.

WorkVenture

Online job matching platform WorkVenture

raised US$420,000 in a seed funding round

participated by several investors including Thai

businessmen Songphon Chaovanayothin and

Sommaphat Traisorat.

Through its own algorithm called ‘WorkScore’,

WorkVenture is able to help both job seekers

and hiring companies connect and match with

each other in terms of availability, requirements,

qualifications, salary, location, among others.

Founded in 2014, WorkVenture is a Thai social

enterprise led by a team of Chulalongkorn

University & Sasin graduates. It provides

opportunities handpicked from the largest and

most prospective local and multinational companies

in Thailand.

Formerly known as JobNisit, the startup’s portal

now reportedly has 500 signed up hiring companies,

with an average of 400,000 monthly

visitors.

Asahi Glass

Japan’s biggest glass maker Asahi Glass has

announced it was going to buy a controlling 59

percent stake in the Thai plastics company

Vinythai from Belgium chemical firm Solvay SA.

The Japanese maker of autoglass and display

panel components will pay the equivalent of

US$291 million for the stake, with the purchase

to be completed by the end of June next year.

Asahi Glass said the purchase of Vinythai was

aimed at bolstering its chemicals business in

Southeast Asia.

Vinythai makes construction materials and

coatings used by car manufacturers and consumer

electronics makers.

For Solvay, the deal represents a further

withdrawal from PVC production after the sale

of its European operations and the impending

divestment of its Brazilian activities as it

seeks to concentrate on specialty chemicals

and polymers.

Solvay said the sale, based on an enterprise

value of 16.5 billion Thai baht, represented a

multiple of eight times core mid-cycle earnings

(EBITDA). Solvay said the proceeds would be

used to reduce its net debt.
