A: With or without a Last Will, in order for your assets to reach your heirs or other beneficiaries, a probate court proceeding is generally required to transfer your assets. An attorney must be hired to petition the court to supervise disbursement of your assets as directed by your Will or state law. To avoid probate you should consider preparing a Revocable Living Trust to transfer assets at your death.
