LEGAL MATTERS with Curt Schatz CHANGES TO EXTENDED HOURS PERMITS On 2 February 2017, Queensland Parliament passed legislation to give effect to the changes to late night one-off extended hours permits (XHPs) that were announced in late January 2017 when the Queensland Government decided not to proceed with the lockout laws. Licensees were previously entitled to apply for up to 12 one-off XHPs each year and there did not need to be any special occasion or event for the XHP. The changes now mean that for XHPs to trade after 12 midnight: • licensees are limited to six XHPs per calendar year (down from 12) • only one XHP will be granted for a premises each month (subject to a few exceptions), and • an XHP will only be granted for a “special occasion”. A special occasion means an event that is independent of the licensee (ie the licensee cannot just put on its own event) and could be: • the celebration of a wedding, birthday or another private occasion not open to the general public, or • a “special public event” which is a unique or infrequent event of local, state or national significance (examples include a local music festival or a televised international sporting match involving an Australian team). Further regulations may be developed to define certain events that are or are not “special public events” to provide more certainty. Importantly, licensees should be aware that this legislation has the effect of automatically cancelling any XHPs already issued by the OLGR, such that licensees that had already an XHP for an event in the future will now need to re-apply. Licensees will be refunded the application fees paid in association with these cancelled XHP applications. Additionally, the restriction of six XHPs per calendar year takes into account XHPs already used by licensees this calendar year. Therefore, licensees who have already used their six XHPs for 2017, will have to wait until next year to be eligible for another XHP. IMPORTANTLY, LICENSEES SHOULD BE AWARE THAT THIS LEGISLATION HAS THE EFFECT OF AUTOMATICALLY CANCELLING ANY XHPS ALREADY ISSUED BY THE OLGR, SUCH THAT LICENSEES THAT HAD ALREADY AN XHP FOR AN EVENT IN THE FUTURE WILL NOW NEED TO RE-APPLY. Further, where a premises becomes licensed part way through a particular calendar year, the number of available XHP will be decreased on a pro rata basis in accordance with how many months remain in the calendar year. Licensees will now need to use their available XHPs more selectively to maximise the opportunities available to increase trade for late night private events or special public events. Additionally, licensees will need to make new applications for those XHPs automatically cancelled by the new laws.
