For professional, helpful service, Phone 379-7100 Public Notices NOTIFICATION OF LIFTING OF PROHIBITED FIRE SEASON (Imposed Pursuant to section 22(2) of the Forest and Rural Fires Act 1977) CHRISTCHURCH CITY RURAL FIRE AREA INCLUDING BANKS PENINSULA Notice is hereby given that the prohibited fire season currently imposed by the Christchurch City Council over the rural fire area for which the Council is the Fire Authority is lifted from 7am on Saturday, 8 April 2017, to be replaced by an OPEN FIRE SEASON. Fires may now be lit in the open air in rural areas without permit. Restrictions may be reimposed at a later date if weather conditions create a potentially dangerous fire situation. All residents are requested to take care when lighting open fires. Before lighting fires in the open air, careful consideration must be given to weather conditions, adequacy of fire breaks, availability of water, and the patrolling of fires until completely out. Fires are not to be left burning after dark. NOTE: Resource Consent conditions imposed by Environment Canterbury may still apply. Darrin Woods PRINCIPAL RURAL FIRE OFFICER www.ccc.govt.nz CHANGES TO PERMITTED DEPOTS AND TEMPORARY ACCOMMODATION FOR PEOPLE DISPLACED BY EARTHQUAKES Under Clause 7(3)(a) and Clause 8(3)(a) of the Canterbury Earthquake (Resource Management Act Permitted Activities) Order 2011 Following the February 2011 earthquake many residents and businesses were displaced from their usual homes or premises. Depots and storage facilities were urgently required for earthquake recovery. The Canterbury Earthquake (Resource Management Act Permitted Activities) Order 2011 enabled the Council to, by public notice, permit depots and storage facilities and temporary accommodation for displaced people and businesses, that would otherwise not comply with the City and District Plans. On 9 April 2011 the Council issued a public notice that permitted temporary accommodation and depots throughout the City if they complied with general standards in that notice. At its meeting on 22 September 2016 the Council resolved to issue a new public notice to change the scope of the permitted temporary activities and the associated policy. This was due to the time elapsed since the earthquakes, issues arising over time as a result of temporary accommodation approvals, the progress of the rebuild, legislation extending the timeframe for temporary activities under the 2011 Order, and the Replacement District Plan including rules providing for temporary activities. The standards for depots and storage facilities and temporary accommodation are hereby amended in the following ways: • Temporary residential accommodation is no longer permitted by general standards. • Temporary depots and storage facilities are no longer permitted by general standards. • Site specific temporary activity approval or a resource consent will now be required for these activities if they do not comply with the rules in the Christchurch District Plan. The effect of these amendments is to remove all remaining standards for permitted activities under the Order in Council. The associated policy, as amended, can be viewed on the Council website. The amendments will take effect from the date of this notice and amend those advertised in previous public notices. The amendments do not affect activities that have been lawfully established under the existing standards prior to this public notice. This notice relates to temporary accommodation, as defined in the Canterbury Earthquake (Resource Management Act Permitted Activities) Order 2011. All other statutory requirements and regulations applying to the activity or site (e.g. building consent, animal control, resource consent from Environment Canterbury, Ministry of Education standards, liquor licensing or health licensing) must also be complied with. Any temporary activity established under these provisions shall not create or give rise to any existing use right in respect of any land, activity, or structure (refer clause 5(3) of the Canterbury Earthquake (Resource Management Act Permitted Activities) Order 2011). The ban, which has been in place since Saturday, 14 January 2017, will be lifted from 7am on Saturday, 8 April 2017 until further notice. The existing prohibition on fires in the open air is imposed pursuant to Section 13 of the Christchurch City Council Urban Fire Safety Bylaw 2014 and is in force for properties not zoned residential in Christchurch City and within the Urban Fire Districts of Christchurch, Brooklands, New Brighton, Sumner, Lyttelton, Governors Bay, Diamond Harbour, Little River and Akaroa. Fires may now be lit in the open air in the urban areas without permit. Restrictions may be re-imposed at a later date if weather conditions create a potentially dangerous fire situation.
