The Planning Department recommended the applicant consider removing two signs, but Commissioners wanted the petitioner to come into as close of compliance with its revamped signage code. The property has three manually changeable message signs which are prohibited. McEnery and Attorney Lyman Tieman initially said they would prefer to only remove one sign, but later on said they would be negotiable if given time to remove and change out signage. “Why wouldn’t you listen to the Mayor?” Commissioner Peter Kroner asked in regards to signage compliance issues relayed since 2012. In regards to public safety concerns, staff reached out to the Will County Sheriff’s Office and Tinley Park Police Department to obtain crime statistics since 2015 regarding the property. There were four total incidents, according to the report, including an accident, theft, lockout and ambulance request. The Village also tasked Brad Bettenhausen to prepare an economic report on property values with nearby housing, but Commissioners and citizens said they would have liked to see a comparison with the entire village and not just those nearby the business. “We have to take it with a grain of salt,” Chairman Ken Shaw said. Concerns were also raised to a traffic count conducted by an engineering firm that sampled a single day of traffic from March 22. The report, produced by KLOA, Inc., indicated out of 724 vehicles that went in and out during peak morning and evening hours, only nine trucks went in and seven came out. Residents said traffic issues were much worse in the summer compounded by concerts at the nearby Hollywood Amphitheater. Parking space was another point of contention with Commissioners and citizens disagreeing with Village staff determination of 51 parking spots, which include 16 vacuum bay spaces and lack of striping for truck parking spots. Resident Glenn Arnold, one of a dozen on-the-record commenters in opposition, questioned the projected revenue number and noted that municipalities only receive five percent of gaming income. “I just want everyone to realize who the big winner for these machines are,” he said. Before voting to postpone the hearing, McEnery offered a rebuttal. “It was always going to be a gas station. We’re not going anywhere,” he said. “I’m not asking for anything wild and crazy. We’re not bad guys.” When directly questioned by a resident if McEnery would consider the annexation request without liquor sales and video gaming, he responded with a blunt, “no comment.” Written opposition A number of past comments and documents in opposition to the annexation request were included in the staff report from current and former officials as well as residents. Will County Board Member Tom Weigel emailed a statement to Board of Trustees, urging the officials not to accept liquor sales and gambling. “The income generated from this facility only takes away from other facilities of this type in the area. The Will County Board did not want to grant a liquor license or gaming license for this facility due to the large number of existing liquor licenses in the area already,” he wrote. Back in 2012 when the Will County Land Use Department was considering special use permits and a map amendment, then Mayor Ed Zabrocki sent a letter stating opposition to a semitruck fueling facility and encouraged McEnery to closely mimic Village ordinances on signage. That was followed by another Zabrocki letter in 2015 to the Will County Board setting out 14 recommendations developed from conversations with nearby residents and reviewing Village ordinances and codes. Former Mayor David Seaman also wrote the Will County Land Use Department regarding similar concerns. Small contractor request Prior to the annexation request public hearing, a separate public hearing for a Special Use permit request filed by petitioner Mark Zamiar, on behalf of Lankford Construction Company - Painting Division to operate a small contractor’s office with approximately seven employees. The office property, located at 18521 Spring Creek Drive Unit G & H, is zoned ORI (Office and Restricted Industrial). Zamiar was the only member of the public who addressed the Commission and no opposition was stated. He said the space was ideal as it allowed room for expansion and that the company was excited to be relocating to the Village and contribute to the local business community. The 5,000-square foot, two-floor office space was last occupied in 2012 by Integrated Systems, according to staff documents. The Plan Commission unanimously recommended approval for a Board vote on April 17.
