4 Mid-Valley Claims Association News NetworkApril 2018 Christine Reed Provides DOI Fair Claims Regs Recertification at March MVCA By Bryan Harrison The Mid-Valley Claims Association welcomed returning guest speaker, Christine Reed, of Low Ball & Lynch, with the annual Fair Claims Settlement Practices Act Recertification luncheon seminar March 16, 2018. Ms. Reed, partner from the Carmel Law offices of Low Ball & Lynch, conducted the annual recertification of the California DOI’s “Fair Claims Settlement Practices Act” regulations. Ms. Reed emphasized the importance of being be sure, as claims professionals, you always document every detail, and maintain communications with an insured. California Insurance Code 790.03 (h) sets forth sixteen claims settlement practices that are deemed to be unfair, and thus prohibited, when an insured either “knowingly committed” them on a single occasion, or committed them with such a frequency so as to make them a part of a general business practice. She detailed numerous mandates, and stressed the importance of meeting time lines. “You must acknowledge notice of claim, and maintain communications throughout the claims investigation process,” she explained. Numerous questions and discussion with the claims people in the crowd followed, and all those in need received their certificate of completion. Ulises regularly teaches courses on issues ranging from Arson and Fraud Investigation to Fair Claims Practices. He has presented at various statewide & national organizations on numerous occasions and will be presenting “Bad Faith Nightmares - Trends & Themes” at the 2018 CPCU Society’s Annual Conference in San Diego. Ulises is also a co-author of Scientific Evidence and Expert Testimony, Chapter 6 - Origin and Cause of Fire. He is bilingual and has acted as a media spokesperson for local news and information programs, including Spanish-speaking television. Ulises earned his Chartered Property Casualty Underwriter (CPCU) designation in 1989 and is a past president of the Sacramento Valley Chapter.
