The simple answer is no - both owners have
an equal right to access and to occupy the
property.
PROPERTIES HELD IN ONE NAME
The simple answer is yes - the owner of the
property is entitled to change the locks and
restrict access to the property.
In the case of a marriage breaking down, the
non-owner can seek to register a “Notice of
Homes Rights” against the property provided
it has been occupied as the matrimonial home.
This is advisable for protection as it prevents
disposal of the property without notice.
For unmarried couples, it may be possible
to secure a unilateral notice or other
restriction against the property depending
on the circumstances of your case to
prevent disposal of the property before an
agreement has been reached.
DOMESTIC ABUSE
In cases where domestic abuse has taken
place, consideration can be given to applying
to the Court for an Occupation order stating
that you are entitled to occupy the property
and for an order excluding the other party
from the property.
