UTAPAO AIRPORT GAINS

PUBLIC BUS SERVICES

As Utapao International airport

continues to be developed as a

major alternative to the main Suvarnabhumi

International airport

for the Eastern Seaboard area of

Thailand, the military-controlled

facility rolled out its first public bus

transit services in May.

Three routes were established

under the auspices of the Department

of Land Transport, connecting

arriving passengers with the

cities of Chonburi, Chantaburi

and Trat.

The Land Transport Ministry has

set a target of the end of this year

to establish road-based transit

systems at all of the country’s 34

operational airports.

Utapao will be a main transport

hub within the Eastern Economic

Corridor (EEC) and as such was in

urgent need of transport networks

according to the Land Transport

Department.

Each of the medium-sized buses

can carry 19 passengers with

the first route going to Trat, via

Chantaburi, a distance of around

220 kilometres. The bus will stop

at the main bus stations in Chantaburi

and Trat. The estimated

travelling time for the trip will be

three hours and 15 minutes with

a maximum cost of 130 baht.The

second bus route travels to Rayong

Bus Terminal 2, just 35 kilometres

away. It will cost between

11 and 24 baht and take around

30 minutes. The third route goes

for 100 kilometres and terminates

at the bus station in Chonburi,

stopping in Sattahip, central Pattaya

and Sri Racha along the way.

The cost will be from 14 to 64 baht

and take around an hour and a

half overall. Two companies have

been given the contracts to run the

bus services and all vehicles are

equipped with automatic braking

systems (ABS) and GPS tracking

devices.

At this stage only four buses

will be used on each route on a

daily basis, but as demand is expected

to grow in coming years,

the numbers will also grow. At this

point there is an average of 40

flights a day coming into Utapao

and the bus schedules are worked

around these arrivals.During

2017, Utapao handled approximately

one million passengers

and the military director of the Navy-controlled

airport was quoted

as saying he expects that number

to double by the end of this year.

Utapao airport had been expected

to open its second terminal in August

last year, but the full opening

has been delayed until January

2019. It is partially open at present.

Terminal 2 will eventually replace

the current main terminal

and the director said this will allow

Utapao to handle upwards of three

million passengers a year.

What is fake news?

Lots of things you read online especially

in your social media feeds may appear to

be true, often is not. Fake news is news,

stories or hoaxes created to deliberately

misinform or deceive readers.

Usually, these stories are created to either

influence people’s views, push a political

agenda or cause confusion and can often

be a profitable business for online publishers.

Fake news stories can deceive

people by looking like trusted websites or

using similar names and web addresses

to reputable news organisations.

The Rise of Fake News

Fake news is not new however it has become

a hot topic since 2017. Traditionally

we got our news from trusted sources,

journalists and media outlets that are required

to follow strict codes of practice.

However, the internet has enabled a

whole new way to publish, share and consume

information and news with very little

regulation or editorial standards.

Types of Fake News

There are differing opinions when it comes

to identifying types of fake news. However,

when it comes to evaluating content

online there are various types of fake or

misleading news we need to be aware of.

These include:

1. Clickbait

These are stories that are deliberately

fabricated to gain more website visitors

and increase advertising revenue for websites.

Clickbait stories use sensationalist

headlines to grab attention and drive clickthroughs

to the publisher website, normally

at the expense of truth or accuracy.

2. Propaganda

Stories that are created to deliberately

mislead audiences, promote a biased

point of view or particular political cause

or agenda.

3. Satire/Parody

Lots of websites and social media accounts

publish fake news stories for entertainment

and parody. For example;

The Onion, Waterford Whispers, The Daily

Mash, etc.

4. Sloppy Journalism

Sometimes reporters or journalists may

publish a story with unreliable information

or without checking all of the facts which

can mislead audiences. For example,

during the U.S. elections, fashion retailer

Urban Outfitters published anElection

Day Guide, the guide contained incorrect

information telling voters that they needed

a ‘voter registration card’. This is not required

by any state in the U.S. for voting.

5. Misleading Headings

Stories that are not completely false can

be distorted using misleading or sensationalist

headlines. These types of

news can spread quickly on social media

sites where only headlines and small

snippets of the full article are displayed on

audience newsfeeds.

6. Biased/Slanted News

Many people are drawn to news or stories

that confirm their own beliefs or biases

and fake news can prey on these biases.

Social media news feeds tend to display

news and articles that they think we will

like based on our personalised searches.

The Fake News Business Model

The internet and social media have made

it very easy for anyone to publish content

on a website, blog or social media profile

and potentially reach large audiences.

With so many people now getting news

from social media sites, many content

creators/publishers have used this to their

advantage.

Fake news can be a profitable business,

generating large sums of advertising revenue

for publishers who create

and publish stories that go viral. The more

clicks a story gets, the more money online

publishers make through

advertising revenue and for many publishers

social media is an ideal platform to

share content and drive web

traffic.

How to spot fake news?

There are a number of things to watch out

for when evaluating content online.

1. Take a closer look

Check the source of the story, do you

recognise the website? Is it a credible/

reliable source? If you are unfamiliar with

the site, look in the about section or find

out more information about the author.

2. Look beyond the headline

Check the entire article, many fake news

stories use sensationalist or shocking

headlines to grab attention. Often the

headlines of fake new stories are in all

caps and use exclamation points.

3. Check other sources

Are other reputable news/media outlets

reporting on the story? Are there any

sources in the story? If so, check they are

reliable or if they even exist!

4. Check the facts

Fake news stories often contain incorrect

dates or altered timelines. It is also a good

idea to check when the article was

published, is it current or an old news story?

5. Check your biases

Are your own views or beliefs affecting

your judgement of a news feature or

report?

6. Is it a joke?

Satirical sites are popular online and

sometimes it is not always clear whether

a story is just a joke or parody… Check

the website, is it known for satire or

creating funny stories?

Will the EU’s GDPR affect Thai companies?

You have probably already been aware

of the EU’s General Data Protection Regulation

(GDPR), most likely by way of a slew of emails

from various companies that hold data about you,

updating their data protection and privacy policies.

The GDPR is intended to add extra data

protection for EU citizens and to regulate data processing

of any company, whether in or out of the

EU, which holds data on EU Citizens. It came into

force on May 25th 2018.

Such companies could include airlines

and hotel chains, some of which operate from

Thailand.

The GDPR is being taken seriously because

companies that fail to adhere to the new

regulations can face fines of up to 4% of their total

revenue, which could be a huge amount. So much

so, that European companies have rushed to comply,

but where does it leave companies outside of

the EU, such as those operating from Thailand.

Hotel chains in Thailand welcomed the

new rules saying that they would bolster confidence

in their ability to hold data responsibly.

In Thailand, in addition to the GDPR,

there is already the local Personal Data Protection

Act also in force.

Although the EU’s GDPR was being assessed,

Deputy Prime Minister Wissanu Krea-ngam,

was quoted as saying, “If there is any impact on

Thais, it would come from Thai law, not from EU law.”

Thailand Mobile expo welcomed new

Chinese Smartphones

The Thailand Mobile Expo held recently at the

Queen Sirikit National Convention Centre, saw

increased activity on the part of Chinese smartphone

makers as they continue to move in to the

Thai market rivalling the likes of Apple.

New Chinese brands have been launched

even in spite of the fact that the Thai market is already

saturated and is likely to post a decline this

year, though maybe not as large as in the previous

year. In the current environment the only way to

grow is to steal market share from competitors.

Opas Chadpun, chief executive of M Vision

Plc., organiser of the Thailand Mobile Expo

was quoted as saying, “Nearly 50% of the smartphone

market comes from the retail channel and

the rest is through mobile operators so there is opportunity

for new players, especially the Chinese

brands.”

New AI phones were on display which

can detect objects in images and make clearer

pictures, but apart from that, the lack of significant

technological updates is one reason that people

are holding back on upgrading their phones.

Smartphones that were priced in the

10,000 baht to 15,000 baht range proved popular.

This is in contrast with Apple’s new offering that

topped US$1000 or in excess of 30,000 Thai baht.

U.S. Tariffs on Thai Steel and

Aluminium being challenged

After the announcement by U.S President

Donald Trump that Steel and Aluminium tariffs

would be introduced to protect American producers,

the Thai Commerce Ministry is stepping

up efforts to try to get Thailand exempted from the

new ruling.

A letter was drafted to the United States

Trade Representative that requested exemption

based on the fact that Thailand has a very low

share (less than 1 per cent) of the U.S. Market.

In the meantime the Association of Thai

Cold Rolled Flat Steel (ATCF) said that Thai industry

could lose up to 2.6 billion baht if the tariffs were

to go ahead.

There are hopes for possible exemption

after some other countries, including Mexico, Canada

and South Korea were already exempted.

Thailand exported 23,572 tonnes of Steel

and Aluminium to the U.S. worth 623 million baht

in April alone.

UPDATE TO

THE THAILAND

ARRIVAL CARD

- TM6

Frequent visitors to Thailand

will be familiar with the TM6

card which foreigners and Thai nationals

alike are required to complete

when entering Thailand via

any air or land port.

The new style TM6 card

was first introduced in September

2017, but only became in full use

in late 2017/early 2018.

In case you are not aware

you are required to keep the portion

of the card returned to you by

the immigration officer and complete

it with new details when you

leave Thailand.

Be really careful not

to lose this card as if you lose it

then you have to go through the

process of filing a report at a local

police station or at the airport

police station if you do not realise

it is missing until you are about to

leave. This is very time consuming

so go and check your passport

right after reading this article to

make sure it is still there!

Unlike in previous times,

immigration no longer staple it into

your passport, it is merely inserted

between the pages and being

much smaller than it used to be, it

is very easy to lose.

The departure card on the

left hand side is the part which will

be returned to you and must be

kept in your passport.

Additional information is

now being requested which includes

phone number, email address,

occupation, purpose of visit

and length of stay. Although this

hasn’t been confirmed it is probably

not advisable to add a length

of stay which exceeds your current

permission to stay or the allowance

of a visa on arrival.

There is also a new section

on the back for non Thai residents

which requests further information

about your travel schedule

and lifestyle and appears to be for

the purposes of tourism research.

The new information asks

if you are travelling on a scheduled

or chartered flight, whether

you are part of a tour group, if it is

your first trip to Thailand and the

type of accommodation you are

staying in. The final column has

check boxes which again request

the purpose of your visit and ask

about your yearly income.

Whether leaving any of

this information blank would cause

issues at the point of entry is unclear.

The new forms also have

a barcode for faster departure and

hopefully easier reporting if you

happen to lose it.

the direct sales company, to the distributor

or rep, and to the consumer.

What is Direct Marketing?

Direct Marketing is a form of advertising

where organizations communicate directly

toprospective customers through

telemarketing, email marketing, websites,

online adverts, direct mail, fliers

and catalog distribution, promotional letters

and targeted

television, as well as newspaper and

magazine advertisements.

What are the disadvantages

of impulse buying of goods

through direct sales and

marketing?

The consumer protection by the provisions

of the Consumer Protection Act

is not sufficient in the particular case of

direct sales and direct marketing business,

where an independent distributor

or a direct sale agent offers the direct

distribution of goods and services to the

consumers with a strategy for introducing

goods to stimulate the consumers’

demand.

2. If the consumer is not satisfied with the

goods bought from the independent distributor,

the consumer can send written

notice of his or her intention to terminate

the contract to the business entity within

7 days from the date of receipt of goods

or services. However, this may not apply

to all types of goods or services. This

may depend on the categories, prices or

types of goods and services;

3. A consumer exercising the right to terminate

the contract shall return the

goods to a business entity or appropriately

keep the goods for the return;

4. If goods or services are damaged, lost

or impossible to return due to the fault

of a consumer, a consumer shall pay

damages to a business entity except for

damage normally arising, for the purpose

of using the goods or services;

5. Where a consumer exercises his or

her right to terminate the contract, a

business entity shall refund the total

sum that is paid by the consumer to buy

goods or services within the period of 15

days from the date of receipt of the notice

of intention to terminate the contract;

6. A warranty on goods or service shall

be made in Thai language and shall

clearly indicate the rights of a consumer

to claim his rights pursuant to the

warranty.

Which Government Agency

has the duties to protect

consumer rights?

goods and services, a contract of sale

will establish obligations, and these

might have negative consequences for

the consumer. When the selling of goods

and service is done through the media,

the consumers cannot touch nor have

a clear look at the goods. As a consequence,

in the advertisement. And after

the return of goods, the consumer might

receive nothing back, or a refund might

be very slow.

The Direct Selling and Direct Marketing

Act have been issued in order to take

legal measures for controlling the direct

selling and direct marketing business

and protect the consumers.

consumer must receive the document

or receipt with understandable Thai language

statement, containing the

following particulars:

Board is an agency which has duties to

protect consumer rights, promoting fairness

and against being exploited as

a result of buying goods and services

from business entities, together with promoting

consumer awareness in buying

goods and services and supporting and

strengthening coordination among consumer

groups and networks.

What happens if the Direct

Sales Business Entity fails to

comply with the Contract?

If an independent distributor of any direct

sale company has sold a certain amount

of goods and he or she demands for

monetary consideration, discount, commission,

or the return of goods according

to the rights indicated in the contract,

the company must accept the goods

and pay back money with the value of

the returned goods and monetary considerations

as indicated in the contract

between the independent distributor and

the direct sales business entity.

of payment of debt;

• Method for termination of the contract;

FOREIGN CURRENCY UPDATE

There has been a significant rise in

the US Dollar’s value over the last month, with

a rising interest rate outlook and political news

mainly driving the move. The DXY Dollar index,

(an index that measures the US Dollar’s valueagainst

a number of other currencies), rose

from a low of 90.26 to hit 94.01. Whether or not

there will be continuation of the move remains

to be seen. Against the Thai Baht, the Dollar

advanced from 31.52 to 32.12, indicating that

the pair may have bottomed in the short term.

Any holder of British Pounds has suffered

quite some pain over the last 4 weeks

with the currency falling from its high of 1.4378

back to 1.4050 then to 1.3720 then down quickly

to 1.3310. This very large drop so far has no

signs of stopping and it is interesting that whilst

the dollar has strengthenedby some four per

cent, the pound has dropped by over seven per

cent, showing that the pound has suffered its

own weakness. A hold on interest rates by the

Bank of England has only helped to make the

pound look less attractive. A technical rebound

may occur but it is likely to be only a temporary

move. Against the Thai baht the British Pound

dropped from 44.01 to 42.80

The US Dollar vs. Japanese Yen cross

rate continues to rise moving from 107.61 to

111.35 in short order, before dropping back to

109.90. Much of this has to do with the U.S.

Dollar’s rise rather than Yen weakness. This

is evidenced by the fact that against the Thai

baht, the rate for the Japanese Yen remaining

relatively steady, moving from 0.291 to 0.292,

a very tiny move indeed.

The Russian Ruble has leveled of

somewhat after last month’s volatility but still

saw a measured leap from 61.80 to the US

Dollar to 63.90 before dropping back to 61.70.

Expect volatility to remain a possibility going

forward. Against the Thai baht the Ruble

dropped from 0.5088 to 0.4955 before regaining

its poise to move to 0.5210.

The Euro has taken quite a drubbing

against the dollar and since the European currency

makes up half the weighting of the dollar

index this is to be expected, given the recent

Dollar rise.The Euro has moved quite dramatically

from 1.2240 to the U.S. Dollar all the way

down to 117.06. The move happened in a continuous

and relentless drip-drip fashion that

would have frustrated Euro bulls. There may be

a pause at 117.00 based on technical analysis,

but a reversal is likely to be short lived, if it occurs

at all. Against the Thai baht the Euro lost

almost a full Baht’s worth of value falling from

38.48 down to 37.56.

Who’s got the power?

An Australian-based

think tank, the Lowy Institute,

created what it calls the Asia

Power Index which has eight

key measures and 114 indicators

to determine which nations

it considers hold the power

in the Asian region. The Asia

Power Index includes the United

States as well as Australia

and New Zealand even though

these three countries are not

within Asia. It also excludes

East Timor, which only gained

independence from Indonesian

occupation in 2002 and remains

arguably the poorest nation in

Southeast Asia. The eight key

measures are, economic resources

(GDP at purchasing

power parity), military capability

(defence spending and the size

of the armed forces), resilience

(that is the capacity to deter

threats), future trends (a projection

out to the year 2030 which

covers distribution of economic,

military and economic resources),

diplomatic influence, economic

relationships (covering

trade and investment ties), defence

networks (alliances and

the like) and cultural influence

(the ability to shape international

public opinion).

It would come as no surprise

that the United States ranks in

first place overall ahead of China,

Japan, India and Russia.

Notably, while the US holds first

place in the economic resources

and military measures, it is second

behind China in diplomatic

influence. The highest-ranked

Southeast Asian nation is, again

not surprisingly, Singapore,

which comes in at eighth place,

ahead of Malaysia (ninth), Indonesia

(tenth) and Thailand in

eleventh position.

In diplomatic influence, Thailand

ranks twelfth, behind New Zealand

and Vietnam, but ahead of

Malaysia and Pakistan.

Global Entrepreneurship

vis-à-vis Asia-Pacific

The Global Entrepreneurship

Index measures the

strength of entrepreneurship

across 137 countries and for

2018 the top four nations are

the United States, Switzerland,

Canada and the United Kingdom.

Australia was the leader

in the Asia-Pacific region, moving

into fifth place worldwide,

up from seventh in 2017. Hong

Kong went from 32nd in 2017 to

13th this year while the best of

the Southeast Asian countries,

Singapore, dropped from 24th

to 27th. Nonetheless, this was

well ahead of the next best, Brunei,

which is ranked 53rd in the

world. Thailand fell from 65th in

2017 to 71st this year, behind

Malaysia (58th), but still well

clear of the Philippines (84th),

Vietnam (87th) and Indonesia

(94th). By way of further comparison,

Japan ranks 28th in the

world while China is only 43rd.

MAZDA MAINTAINS LEADERSHIP IN SMALL CAR SEGMENT

WITH MORE THAN 21,000 UNITS

SOLD DURING FIRST 4 MONTHS

Mazda is celebrating outstanding sales

performance with April sales growing by 5 per

cent to almost 4,500 units, while during the first 4

months of the year, the company has already sold

more than 21,000 vehicles in Thailand to register

a 33-per cent growth compared to the same period

last year. Last month, Mazda had just celebrated

a highly successful sale for fiscal year 2017-

2018, with Thailand becoming the fastest-growing

market for the brand worldwide.

Mr. Chanchai Trakarnudomsuk, President

of Mazda Sales (Thailand) Co., Ltd. (MST), said after

going through a major restructuring in every department,

particularly in the organization’s management

targeted at creating a stronger working team within

the company and its dealerships or “One Mazda”,

MST has seen its efforts bearing fruit.

“With increasing popularity in the Thai

automobile market thanks to its emotional design,

attention to details and large number of innovative

technologies offering outstanding performance

and efficiency, Mazda products have caught the

limelight, with customers helping to ‘spread the

word’ about their exceptional experience with

Mazda,” he said.

In April, Mazda sales rose by 5 per cent

compared to the corresponding month last year,

with the Mazda2 sales of 2,768 units, an increase

of 6 per cent. Sales of the Mazda CX-5 SUV

surged by as much as 153 per cent to 700 units

in April, while sales of the Mazda3 reached 376

units, a decline of 24 per cent. Sales of the CX-3

were 157 units, down 59 per cent, and sales of the

Mazda BT-50 PRO were 415 units, declining by 9

per cent. As for the MX-5 roadster, 3 units were

sold, an increase of 200 per cent. In total, Mazda

sold 4,419 units in April.

“The important factors that enabled Mazda

to increase sales by 5 per cent in April were

the large number of orders placed at the Bangkok

Motor Show, with deliveries starting to take

place. There are also customers who wanted vehicles

delivered in time for the Songkran festival,”

he said, adding that customer confidence in the

Mazda brand has grown stronger.

Meanwhile during the first 4 months of

2018 (Jan-April), Mazda sold a total of 21,005

vehicles in Thailand, registering a growth of 33

per cent. The Mazda2 is the top-selling model

with an aggregate of 13,081 units, growing by 42

per cent, followed by the Mazda CX-5 with 3,071

units, surging by 186 per cent). Sales of the Mazda

BT-50 during this period reached 2,065 units,

down slightly by 8 per cent, while 1,666 units of

the Mazda3 were sold, also down by 8 per cent.

Sales of the Mazda CX-3 were 1,115 units, down

20 per cent, and sales of the MX-5 were 7 units.

Mr. Thee Permpongpanth, Vice President

of Marketing and Government Affair, added

that Mazda has been highly committed in terms

of product marketing throughout the years. “We

have been studying the wants and needs of automobile

consumers and we have collected a lot

of suggestions from our dealers in order to put

together sales campaigns that are most effective

and are capable of answering to the consumers

as much as possible,” he said. “We also give high

importance to establish new communication channels

with our customers, whether through online

and offline media, websites, printed media, radio

and television, as well as through Mazda’s own

social media such as Facebook, LINE, YouTube

and Instagram.”
