Nearly three dozen neighbors of the 277-seat Polynesian restaurant convinced the Planning Board to reject a proposal from twins Matthew and David Palumbo for the three-story, wood frame complex. The building, which faces Route 128 from Moulton Drive, would include 24 two-bedroom and eight one-bedroom apartment priced from $2,200 to $3,300. While Ted Regnante, attorney for the twins who live in town, argued town zoning allows for the development because it is simply another NEWS 16 PAGES • ONE DOLLAR nonconforming use that will not be detrimental to the neighborhood, abutters disagreed. But Patrick Curley, an attorney who lives on nearby Locksley Road, said the proposal should be brought before Town Meeting for a change in zoning bylaw because the proposed use of the Bali Hai land for an apartment building does not satisfy the Lynnfield zoning bylaws. He said the area is zoned for single-family homes. “Developers cannot subvert local zoning requirements simply by characterizing wholesale changes of use, and constructing a new building as a mere incidental change in use,” he said.
