KPDA Achievements

KPDA Corporate Member, Optiven Group have this as

their company motto, ‘We value you.’ It is short, catchy and

meaningful, I envy them for having coined it first before us!

I chose to use it in this message to you in this issue of The

Developer’s Digest however, because it is important that you

our members know just how important you are to us. Without

you, there would be no KPDA.

The focus of the July to September 2018 Issue of this

newsletter is to connect with you dear member, and share with

you the various ways that we offer you value for your annual

financial investment in KPDA, and more so, how you can get

more active as a member.

Inside, you will be able to peruse through our achievements

over the recent few months as well as familiarise yourself with

the parts of the engine that make KPDA run; our committees.

KPDA VISITS THE WATER

RESOURCE AUTHORITY

(WRA), 3 rd AUGUST 2018

On Friday, 3 rd August 2018 the KPDA Regulatory

Bodies Working Group were garciously hosted by

the Chief Executive Officer of the Water Resources

Authority, Mr. Mohamed Moulid Shurie. The group

was well received and praised for ‘their courage to

contact the regulatory body despite the somewhat

tumultous relationship that exists between WRA

and private developers.’

During the meeting, KPDA officials emphasized

that ‘KPDA members are keen to ensure close

and focused engagement with regulatory

bodies such as WRA who KPDA members

interact with whilst doing business in the

Kenyan real estate sector.’

The Water Resources Authority (WRA) – formerly

the Water Resources Management Authority, is a

state corporation established under Section 11 of

the Water Act, 2016. Pursuant to Section 6 of the

Act which came in to effect on 21st April, 2017 vide

Legal Notice No. 59, the Authority is an Agent of

the National Government responsible for regulating

the management and use of water resources.

The Water Act, 2016 makes extensive provisions

on the Authority’s role in regulating the use and

management of water resources.

THE PROGRAM

IMPLEMENTATION UNIT ON

THE DELIVERY OF 500, 000

HOUSING UNITS HOLDS A

MEETING ON 2ND AUGUST

2018

The Program Implementation Unit (PIU) on the

delivery of 500, 000 housing units, which is

under the State Department for Housing, Urban

Development and Public Works held a meeting on

Thursday, 2nd August 2018. KPDA who also has

nominees on the various technical committees of

the PIU was in attendance.

The various subcommittees are organized

into the various thematic areas that

shall assist the private sector to invest in

affordable hsouing through its engagemenyt with

the government. These sub committees are;

2. Technology/Techniques

3. Land

4. Infrastructure & Services

5. Information Communication & Technologies

6. Communications and PR

7. Stakeholder Coordination

8. Procurement/PPP/Contracting

KPDA PAYS THE NATIONAL

BUILDINGS INSPECTORATE

(NBI) A COURTESY CALL,

2 nd AUGUST 2018

Representatives from the KPDA Regulatory

Bodies Working Group paid a courtesy visit

to the Secretary of the National Buildings

Inspectorate, Qs. Moses Nyakiongora at their

offices in Works House.

During the meeting, NBI was able to share a brief

on its objective to ‘ensure that a safe, healthy,

quality sustainable built environment was achieved

through observation of the laid down building

regulations and standards thorough continous

Quality testing, Audit and Inspections of unsafe

buildings and structures.’

NBI was conceived as a result of Presidential

Directive in 2015, following a spate of buildings

collapsing in Nairobi.

NBI is currently not anchored in any law the

proposed Built Environment Bill 2012 seeks to

bring order in the booming construction industry by

establishing minimum standards and practices will

also establish the Building Authority of Kenya.

KPDA will be seeking to engage with NBI in order

to establish a specific liaision to address member

needs, carry out sensitization on buiolding safety

and partner to train on building regulations and

standards as well as the aspects of NBI’s Quality

testing, Audit and Inspections of unsafe buildings

and structures.

We will keep members posted as we continue to

engage with the National Buildings Inspectorate.

‘Creating a value driven, sustainable and socially responsible real estate industry’

Summary on KPDA Committees

Members are encouraged to request to join any of

the Association committees to connect and engage

with professional/peer networks and government

leadership; as well as identify a leadership

position that aligns with one’s professional goals

and objectives. KPDA members are encouraged

to play a more active role in the Association by

getting involved in leadership opportunities.

I. THE KPDA AFFORDABLE

HOUSING TASK FORCE

Established at the beginning of 2017, the aim of

the KPDA Affordable Housing Task Force is to

clearly demonstrate what the private sector can do

and propose ways in which the government (and

its relevant agencies) can be engaged to bridge

the housing gap in Kenya.

The Task Force is chaired by the KPDA Vice

Chairman, Palkesh Shah.

II. THE PUBLIC POLICY AND

ADVOCACY COMMITTEE

The Public Policy and Advocacy Committee is

committed to ensuring that KPDA impacts the

industry through engagement on policy issues

and becomes the most reputable body for the

advocacy of real estate issues.

Mandates:

1. Ensures that KPDA enhances the business

environment that KPDA members are

operating in;

2. Engaged in increased advocacy for issues

facing members;

3. Ensures focused engagement with policy

makers;

4. Ensures increased knowledge on priority

areas of advocacy and best approaches;

5. Facilitates increased dissemination

of research findings and KPDA’s main

areas of focus;

6. Facilitates increased capacity of KPDA to

conduct impactful advocacy by increased

engagement with likeminded organizations,

associations and institutions.

The Convenor of this Committee is KPDA Board

Director Gikonyo Gitonga.

The committee has also subdivided

itself into working groups who work on

focused advocacy areas:

1. The National Government Working Group:

Facilitate KPDA’s engagement with central

government (primarily the Ministry of Lands

and Physical Planning as well as the

Ministry of Transport, Infrastructure, Housing

and Urban Development).

The Group is led by Esther Omulele of MMC

Africa Law.

2. The County Government Working Group:

Ensure effective engagement with various

county governments to enhance the

business environment that KPDA members

work in.

3. The Research and Development Working

Group: Spearhead the project to develop

the KPDA Construction Process Handbook.

The Group is led by Azmeena Bhanji of PDM

(Kenya) Ltd

4. The Regulatory Bodies Working Group:

Ensure close and focused engagement

with regulatory bodies that KPDA members

interact with doing business in the Kenyan

real estate sector.

Group is led by Alex Waiharo of Jabez Properties.

III. MEMBERSHIP AND OUTREACH

COMMITTEE

The main aim of the Membership and Outreach

Committee is to develop KPDA to be the most

relevant association for property developers

and other players in the real estate sector. This

committee supports the secretariat by maintaining

active members by organizing vibrant and active

activities and events as well as increasing

membership numbers.

The Convenor of the Committee is KPDA Board

Director Ken Luusa.

III. THE INSTITUTIONAL

STRENGTHENING COMMITTEE

It is the mandate of this committee to develop

structures that will ensure financial sustainability,

operational capacity and facilitate realization of

KPDA’s mission and vision.

The Convenor of the Committee is KPDA Board

Director Emma Achoki.

Developers can peruse some

development strategies to reduce the

cost of development, while increasing

the likelihood of success

. Unit Sizing: Building smaller

units can help reduce the price of

units, while allowing developers to

retain their margins. Reducing unit

sizes can increase the per unit cost of

a development, given the finishes and

internal walls required.

2

. Incremental Housing: The

affordability of housing may also

be increased by making use of basic

materials with the provision that home

owners can make improvements on the

house over time through an incremental

housing model.

. Land JVs: Land is a big upfront

expense. Land JVs can help reduce

the cost of land, but also reduce the

speculation of land prices. Clear

objectives and assumptions should be

agreed at the outset and codified into

robust legal agreements.

. Parking Ratios: Buildings with

smaller unit sizes and more units

may need to provide a smaller parking

ratio per unit than buildings with larger

units. Developers need to either selling

parking or limiting the number of parking

available by building along public

transport routes.

. Sales & Cash Flow: Managing

a developers cashflow is paramount.

It’s important to have a robust financial

model at the outset of a development

and to monitor expenditures against

the budget. Timely collection of cash is

imperative for a developer to manage his

interest expense.

media articles from the week that we think are worth your time as a player

in the property development sector. We look for compelling articles not

only about trends in the market, but also policy issues, upcoming

technologies and global trends in real estate. We would love to hear from

The Media Weekly Review Report is circulated every Monday at 6.00am.

Advertisers are therefore requested to submit their artwork by latest Thursday of the week preceding the

report being circulated.

WHAT IS THE COST OF ADVERTISING USING THE KPDA MEDIA WEEKLY REVIEW REPORT?

We will run your advertisement for a period of four (4) consecutive weeks at a cost of Kshs. 15, 000.

Advertisers who commit to advertise for four (4) consecutive months will get an additional four (4) weeks

for free

Payment is required within two (2) working days of the production of the report (First Wednesday of every month

from commencement of agreement).

Online Advertising Terms and Conditions: Payment is due within two (2) working days of an invoice being

issued. Banner ads may be pulled if account balances are not paid by the due date. As space is limited, banner

upon determination that the products or services advertised are in keeping with KPDA’s philosophies.
